MERTON COLLEGEAs a student in the Oxford Berkeley Program, you attend classes and live at Merton College, one of the two oldest colleges at Oxford. Merton is picturesque, known for its medie-val and 17th-century buildings and a garden protected by the city wall. Merton is situated on a quiet, cobbled street close to university libraries and lecture halls. Over the centuries, prominent scholars and cultural leaders have called Merton home, including four Nobel Prize winners and the physician who discov-ered the circulation of blood.

At Merton you will have access to our Oxford staff. Our program administrators work with you and hold regular office hours throughout the duration of your stay to assist with admin-istrative, cultural, and logistical matters.

FIELD TRIPSScholars typically take three field trips while at Oxford, generally each Thursday of the seminar. Field trips are led by tutors and linked to seminar material and are an essential part of your experience. Field trips incor-porate an important participatory learning component to the seminar and may include visits to museums, castles, historic buildings and abbeys, walking tours, and more.

Examples of typical field trips could be a visit to London’s restored Globe Theatre to understand how Shakespeare’s plays were perceived by audiences of his time, or a tour of the great houses of the English country-side to experience the power and wealth of England’s ruling families through their art and architecture.

A TYPICAL DAYBerkeley Scholars spend three weeks at Oxford and balance their academic seminars with activities and free time.

Terms, Conditions, & Waiver

Price Per Person: $6,750 per person, no single supplement.

Final Payment: Reservations are to be paid in full by April 16, 2018 (90 days prior to de-parture). Final payment may be made by personal check, MasterCard, Visa, or Amex. Make checks payable to Cal Alumni Association. Late payments will be subject to a $100 late fee and/or subject to cancellation.

Cancellations and Refunds: All cancellations must be submitted in writing to be valid. Every cancellation, regardless of the reason, will be subject to a $300 per person cancellation fee, if requested in writing 121 days or more prior to departure. Cancellations made 120-91 days prior to departure will be subject to a $600 per person cancellation fee. Cancellations made 90-31 days prior to departure will result in forfeiture of 50% of the trip cost per person. No refunds are granted within 29 days of tour departure or for no-show or early departure from a trip already in progress. The payment of the deposit OR any other partial payment for a reservation on a program constitutes consent by all guests covered by that payment to all provisions of the cancellation policy contained in this information, whether the guest has signed the form or not.

CAA Membership Policy: One traveler per room, whether an alumni or friend, must be a current Cal Alumni Association member at the time of departure to participate in Cal Discoveries Travel offerings. Payment of $60 for seniors 65 years and over and $75 for others establishes a regular or affiliate membership with all other Association benefits. Memberships are for individuals only, and are nonrefundable and non-transferable. A traveling pair and their children under 21 years of age may travel on one membership. Please make dues payable to CAA by separate check, or, if you prefer, provide a Visa, MasterCard, Discover, or American Express number with expiration date for payment. You can also enroll online at alumni.berkeley.edu/join.

Cost Includes: 19 nights at Merton College in a single dormitory room with semi- private bathroom (upgrades available); tuition; full daily breakfast; mid-morning tea and biscuits during seminar sessions; lunch on weekdays; dinner on weekdays and Sundays; general lectures and receptions; and services of on-site Program Director.

Cost Does Not Include: International airfare; ground transportation; costs of passports and visas (if needed); meals other than those specified; beverages; optional tipping or gratuities; travel insurance; and other expenses of a personal nature (liquor, laundry, etc.).

Mobility and Fitness To Travel: This is a moderately active trip including a faster pace and extensive walking with substantial distances covered. You should be in good physical condi-tion to enjoy the tour to the fullest. You must be able to navigate at least one to two flights of medieval-era stairs, which can be uneven and steep. There are no elevators at Merton College.Passengers requiring special assistance, including without limitation those who per-manently or periodically use a wheelchair, must be accompanied by someone who is fit and able to assist them, and who will be totally responsible for providing all required assistance.

Reservations: Reservations are subject to availability and processed on a first-come, first-served basis. If your reservation changes from double occupancy to single occupancy for any reason, you will be charged the single supplement (as available). No changes to your reservation can be made within 30 days of departure.

Release and Limitation of Liability: The Cal Alumni Association (CAA) and its contracted partners serve only to assist in making necessary travel arrangements for its participants, and in no way represents, or acts as an agent for, transportation carriers, hotels, and other sup-pliers of travel-related services connected with this tour. CAA does not assume responsibility, directly or indirectly, for any loss, damage, or injury to property or person in connection with such services.

Accordingly, in the absence of gross negligence by CAA, its owners, employees, agents and representatives, each participant agrees not to hold CAA, its owners, employees, agents, and representatives liable for any loss or injury, expense, or damage that results directly or indirectly from any act or omission by any person or firm that is to, or does provide, goods or services in connection with the trip, or any available optional excursion

While CAA has exercised due diligence in recommending financially sound and reliable suppliers of travel for the Cal Discoveries educational travel program, CAA does not assume responsibility for the actions of its contracted partners and/or suppliers. With limited excep-tions, CAA and its officers, directors, employees, shareholders, and affiliates (collectively,

“CAA”) do not own, operate, or control any entity that provides, or is to provide, any goods or services for a participant’s trip or expedition, including, without limitation, own or control any lodging facilities, airline, bus, vessel, or other transportation companies, food service providers, local ground operators, outfitters or guides, equipment suppliers, organizers of optional excursions, entertainment providers, etc., including, without limitation, various entities that may use CAA’s name or logos. CAA is not responsible for any negligent or willful act, or failure to act, of any such person or entity, or of any other third party not under CAA’s control. Without limitation, CAA is not liable for any direct, indirect, consequential, or incidental damage; injury, loss, or damage to person or property, illness, death, delay, inconvenience, or irregularity of any kind in connection with the trip or expedition that may be occasioned by or resulting from any act or omission beyond its control, including, but not limited to, any willful or negligent act, failure to act or breach of contract of any third party, acts of God, force majeure, acts of war or civil unrest, acts of government, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind or the threat thereof, climate conditions, high altitude, overbooking or downgrading of accommodations, or structural or other defective conditions in hotels or other lodging facilities, the operation of and/or mechanical or other failure of any means of transportation or for any failure of any transportation mechanism to arrive or depart in a timely or safe manner, dangers associated with or bites from animals, pests, or insects, marine life or vegetation of any sort, dangers incident to any recreational activities, epidemics or the threat thereof, sanitation problems, including, without limitation, risks associated with food or impure water, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, stolen, lost, or misplaced luggage or property, theft or break-ins into vehicles, lodging rooms, or elsewhere, or for any other action or omissions of third parties, or conditions beyond the control of CAA.

Additionally, each participant agrees to release CAA from its own negligence, excepting its gross negligence, and assumes all risk thereof. Each participant agrees to follow all rules, guidelines, policies, regulations, and recommendations (the “Rules”) made by CAA, and to indemnify CAA for any costs or losses that are caused by or arise in connection with that par-ticipant’s failure to follow any such Rule of which participant has been made aware, whether verbally or in writing.

Assumption of Risk: Participants acknowledge that the tour they are undertaking may involve risks and hazards of travel to and in areas where injury, illness, death, delay, or un-anticipated events may occur as a result of forces of nature, the negligence of CAA or other persons and companies known or unknown, or of willful or criminal conduct of third parties, including terrorists. Participants acknowledge that travel and tours also involve activities that carry inherent risks that cannot be eliminated regardless of the care taken to avoid injury. Participants acknowledge that weather conditions may be severe, adverse, and/or unpleasant. Participants further acknowledge that medical services or facilities may not be readily avail-able or accessible during some or all of the time during which they are participating in the tour, and/or that what medical facilities do exist could be of inferior quality compared to what is available at home. By signing this Agreement, participants unconditionally understand and agree fully to assume all of the risks inherent in travel and tours.

Dispute Resolution (Binding Arbitration): The parties agree to resolve any disputes con-cerning this Passenger Information Form for this trip, or the trip itself, by binding arbitration pursuant to the then-existent commercial rules of the American Arbitration Association in Alameda County, California. In any such arbitration, the substantive but not procedural law of the State of California shall apply. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.

Itineraries: Participants accept that disruptions and unforeseen situations may and often times do occur, including but not limited to delay; partial or complete changes in timing or routing of itinerary; changes in pricing; changes in announced tour guides; changes in grades of or location of accommodations; and modes or quality of air, land, and/or sea transport. Participants agree that CAA and/or its contracting partners may make last-minute or on-site decisions to address changed circumstances. CAA reserves the right to make changes to the itineraries whenever conditions so warrant if CAA deems it necessary for the comfort, convenience or safety of the tour participants. Information presented in the tour brochure, including but not limited to dates, schedules, program details, tour leadership, and costs are subject to change and modification by CAA. The tour brochure provided by CAA to partic-ipants for their specific tour is incorporated in and made a part of this Agreement by this reference. If the brochure mentions the participation of a lecturer, the lecturer’s participa-tion cannot be guaranteed and is based on a minimum number of paying participants.

Physical Condition: CAA’s expectations are that participants have the appropriate health status to participate in published tour activities and while on tour, behave in a responsi-ble way with consideration for others. CAA’s tour activities are intended for persons of reasonably good health. Participants who are not fit for tour activities for any reason are advised not to participate, as this entails an unacceptable risk to them, may interfere with the enjoyment of all participants, and may compromise the completion of the journey itself. These conditions may include, but are not limited to, physical disability, frailty or obesity that severely limits mobility and balance, unstable or severe heart or lung conditions, or mental illness. Conditions that are considered by a participant’s family physician to be stable or

controlled by treatment may not necessarily prohibit the participant.

CAA is not responsible for injuries resulting from a participant’s personal health issues, actions or inactions, including but not limited to medical conditions that limit participation in tour activities, ingestion of alcoholic beverages, and/or inability to negotiate terrain on the tour. CAA reserves the right to decline to accept any person as a participant in tours, or to require any participant to withdraw from the tour at any time when such action is deter-mined by the appropriate CAA staff or contracted partners representative to be in the best interests of the health, safety and general welfare of the tour group or individual participant, subject only to the requirement that the portion of the total amount paid which corresponds to the unused services and accommodations be refunded.

By participating in CAA’s tour and signing this Agreement, participants attest that they are in good general health and mobility and are capable of performing normal activities on this tour. Participants attest they are capable of caring for themselves during the tour, and that they will not impede the progress of the tour or the enjoyment of others. Participants certify that they have not been recently treated for, nor are aware of, any medical condition, infirmity or disability (physical or mental) that would create an unreasonable risk to themselves or to other members of the tour. Participants requiring special assistance, including without limitation, those who permanently or periodically use a wheelchair, must be accompanied by someone who is fit and able to assist them, and who will be fully responsible for providing all required assistance to that participant.

Airline Tickets: Participants should not purchase airline tickets before receiving written notice via letter or email from CAA stating that they are confirmed on the tour. Neither CAA nor its contracted partners accept liability for any airline cancellation penalty incurred by the purchase of a nonrefundable domestic ticket to the tour departure cities and/or the purchase of a return ticket. Baggage and personal effects are the sole responsibility of the owners at all times.

Insurance: CAA recommends that participants purchase comprehensive insurance coverage for trip cancellation/interruption, lost/damaged baggage, medical expenses, medical evacua-tion, accidental death and emergency assistance. Participants are solely responsible for care-fully reading any exclusions, exemptions and/or limitations for acts of terrorism or contracted partners insolvency as CAA is not a guarantor or insurer against bankruptcy or insolvency.

Cancellation: Participants acknowledge that they have read, understood, and accept the terms of the cancellation and/or refund policy set forth in the tour brochure provided by CAA for their specific tour. The cancellation and/or refund policy set forth in the tour brochure provided by CAA to participants for their specific tour is incorporated in and made a part of this Agreement by this reference.

Travel Documents: CAA is not responsible for provision of visas for travelers and gives no advice regarding visas. It is the responsibility of the participant to ensure that the participant has all appropriate documentation, including passport, visas, and permits, if required, allow-ing the participant to travel to the destination included on the trip or tour.

Photo Release: Participants understand and acknowledge that during CAA tour, partici-pants’ image or likeness may be captured on photograph, video, sound recording, live-action Internet transmission and other media (“Personal Images”), and that CAA may wish to use these Personal Images for promotional and other business purposes. Participants agree that CAA or the Tour Operator organizing or arranging the trip may use the participants’ photo/video image, likeness, voice, name, and/or interview or biographical material in all forms and media (including, but not limited to video, audio and photography) for all purposes including advertising, trade or any commercial purposes without any compensation or fees to the participants. If a participant does not want his or her likeness to be used, that participant understands that he or she must notify CAA in writing prior to departure of the tour.

Immunization and Government Posted Warnings or Advisories: Participants un-derstand that immunization requirements vary from country to country and even region to region (up-to-date information should be obtained from local health departments and consulates). Participants assume complete and full responsibility for any duty to check and verify vaccination or other entry requirements of each destination, as well as all safety and se-curity conditions of such destinations during the length of the proposed travel or extensions expected or unexpected. For information concerning possible dangers at international desti-nations, contact the Travel Advisory Section provided by the government of that country. In the United States of America, contact the State Department, by phone at 202-647-5335 or access online at http://travel.state.gov/travel/ warnings.html. For medical information, call the U.S. Centers for Disease Control and Prevention (CDC) at 404-332-4559, use its fax informa-tion service at 404-332-4565, or access online at www.cdc.gov/travel. Participants may wish also to consult a physician knowledgeable about travel medicine and medical issues.

Severability: Participants understand and acknowledge this Agreement is intended to be as broad and inclusive as permitted by law. If any portion of this Agreement is deemed invalid, it is agreed that the remaining portions of the Agreement shall continue in full force and effect.
