6. Income Tax : Deducted as per I.T. act.

7. If late payable interest on : Nilamount of contract.

8. Insurance of work : Whenever necessity of contractor & inThe favour of work insurance isIncluded fire, earthquake, cycloneetc, At least Up to completion of work.Insurance has to be taken byContractor with own risk.

9. Retention Money : The retention amount to be refundedto the contractor upon completion ofthe work, after 12 months subject to :

1. Issue of completion certificate by theArchitect.

Contractor’s removal of his materialsequipment, labour force, temporarystore etc. from the site (excepting for asmall presence required, if any for repairsduring the defect liability period, uponobtaining approval of the same.).

The amount may be refunded14(fourteen) days after the end of thedefects liability period, provided thecontractor has satisfactorily carried out

all the works and attended to all defectsin accordance with the conditions of thecontract.

T E R M S & C O N D I T I O N S

This tender is according to latest & last “Terms of Contract” by IndianInstitute of Architect.

1. This tender is calling for Furniture & Electric works for Bank of India,Kidwai Nagar Branch, Kanpur.

2. At the time of submission every tender of furniture and electrical workmust be accompanied by a Demand draft of Rs.17500/- in favour ofBank of India, as Earnest money. Any tender, which is notaccompanied by the earnest money, shall be rejected. Thecontractors may also submit separate tenders for furniture andelectrical works. In this case, the earnest money will be Rs.5000/- eachfor furnishing and electrical tender. Besides this, the tender fee will beRs.1000/- for each tender.

3. The Earnest money deposit of unsuccessful tenders will be returnedafter the tender is decided or within two week.

4. The security Deposit should release after the completion of “Defectliability Period.”

5. Contractor who will get work order, his amount of earnest money willterminate in “Security Deposit Amount.”

6. Successful contractor has to make “Contractor Agreement” with theowner, and in this schedule of quantities, Abstract, Filled rate, Terms ofcontract, Specification, Receipt of owner will be included, all theexpenditures above agreement will be paid by Contractor.

7. If successful contractor will fail to make “Contract Agreement.”Withoutany particular reasons, his amount of earnest money will be forfeited asa penalty of loss & damages.

8. The tender should quote the rates in figures as well as in words.

9. The rates quoted in the tender shall include all. Charges of scaffoldinglift any tools & plants, excise duty, sales tax, octroi and any other taxesof expenditure for carrying out the work.

10. The contractor must co-operate with Architect / Engineer, appointedby the bank. So, that entire work shall proceed smoothly with leastpossible delay and to the satisfaction of the Bank.

11. The contractor shall remove all debris etc. wash & clean the floors at hisown cost and hand over the site in proper manner on the completionof work.

12. The contractor will attend to all defects noticed during defect liabilityperiod. If the contractor fails to attend the defects, the Bank will rectifythese defects and the expenditure incurred on this account will berecovered from S.D.

13. The contractor shall be responsible for application of labour laws,compensation for injury & accident to person, whether, employed byhim or by his sub-contractor.

14. The contractor will take necessary precautions for carrying out the workavoiding any damage to structures/decorative parts of the property.The contractor will rectify any damages done at his cost.

15. The Bank has the right to terminate the contract, if the contractorabandons the work or fails to commence & complete the work in timeor fails to abide by the contract conditions.

16. The contractor has to certify the bill and measurement from theArchitect and he has to obtain the “Completion Certificate” of thework from Architect.

17. All extra item rate without tender will be considered as market rate.Contractor should submit the rate analysis of all extra item rate.

18. Contractor has to follow the plans, specifications, Architect’sinstructions and all the specifications shown in the schedule of thequantities.

19. The Contractor may be allotted the whole or part of the workmentioned in this tender & the same should be acceptable & binding tothe contractor as is the tender for that portion has only been floated.

20. Tender shall go through all documents before quoting rates, andprovide for necessary costs as may be included in either bill or materialor specifications.

21. Tenderer shall give prices in blank column. Entries in English made in ink.Arrive also at the grand total must also fill in all “Rate only columns”and sign all corrections.

22. Tenders shall be invalid unless all rates are filled in. No extra conditionsshall be submitted and conditional tenders are liable to be rejected. Allthe legal partners of the firm shall sign tenders.

23. Work shall be done in night and day without extra charge, if necessary.

24. Tenderer shall provide for stacking materials in such a way as tofacilitate raped checking of quantities.

25. Contractors shall arrange for all temporary connections.

26. No extra shall be paid, quantity sheets and drawings both to beconsidered jointly and Architect is final authority for the interpretation.

27. Site instruction shall deem for proper execution and shall be carried outwithout extra charge.

28. Contractors shall submit samples of work for the approval of theArchitect before commencing the bulk of work. The rest of the workshall be completed only on the express approval for the Architect.

29. The serviceable materials out of the dismantled materials will beproperty of Bank / Employer and shall be property streaked by theContractors as directed by the Engineer – in charge on theserviceability on the Contractors.

30. All labour employed by the Contractors shall be covered by workmen’scompensation Act. Any death injury or mishap to the workman of theContractors will be entirely at the Contractors responsibility and Bank /employer shall not be liable to pay any damages for the same.

31. The Contractors shall give his permanent account number (from theincome tax department.)

32. Ar. Inder Pal Singh (Contact No. 9 8 3 9 0 6 8 6 2 8 ) will be Architectfor the subject of work.

33. The contractors may be required to make his own arrangement forwater and electricity for the work.

34. The bank will not be bound to accept the lowest tender and reservesthe right to accept or reject any or all the tenders without assigningany reason whatsoever.

35. Contractor in their own interest are advised to visit the site & getthemselves familiarise in the prevailing situations before submitting theirrates. No claim whatsoever for ignorance, misunderstanding shall beentertained later.

36. The unsealed tenders, tenders not superscribed as the prescribedtender document, conditional and unsigned tenders, tenderscontaining absurd rates and amounts, tenders which are incomplete orotherwise considered defective are liable to be rejected.

37. Any damage done to the property of the bank during execution of thework shall be responsibility of the contractor & it shall be made goodby firm at his cost to the entire satisfaction of Architect / Bank.

38. The architects shall have full power to get the material or workmanshipetc. inspected & tested by an independent agency for its soundness &adequacy at the cost of contractor.

39. The contractor shall examine all drawings before quoting &commencing of actual work & report to the Architect/ Bank anydiscrepancies for omission & shortcomings in the drawings.

40. Bank Reserves its right to abandoned (Cancel) / Discontinue any of thework / Total work mention in here in above before its commencementduring / or its currency at any time without assigning any reason.

41. Bank has right levy penalty per day of Rs.500/- if the work is notcompleted stipulated time as mention in the tender documents.

42. All Drawings are Guidative tender drawings. The detail measurementdrawing shall be as per the site condition & as per the good forconstriction drawings, which shall be submitted during executionand/or after work-order issued to the successful contractor. The tenderdrawings may be changed as per bank’s requirement & designrequirements by the consultant.

43. The contractor has to remove or shifting or replacing the existingfurniture, tables, storage racks cupboards, safes, etc. at convenientplace as per the instruction of Architect / Bank without claiming anyextra cost.

Electric Contractor License. Electric Supervisor License. Valid Bank Contractor. Sales tax Registration Certificate / Vat. Income-Tax Certificate / PAN No.

02. Contractor should execute 40 % above or below the tender mentionquantity without deviation of quoted rate.

03. Propose plans and layout should be approved before starting the work.04. No extra payment for Jarry, Chiselling, POP cutting will be made.05. Payment

40 % of the quoted rates will be paid on receipt of materials at site. No mobilization advance will be paid. No direct payment to traders or materials suppliers will be paid by

bank on behalf of contractors. Minimum 4 working days required to process the bill by Architect.

06. All queries, objection regarding tenders should be solved during pre-bid or accepting the award letters.

07. Contractors are requested to visit the site before quoting the rate.08. Contractor should sign every and each page of tender document as

token acceptance of terms and conditions of tender.09. Piping and wiring should be made before POP work & flooring work

started with keeping approximate length dumped in junction box.10. Telephone and computer/UPS/ Electrical wiring should be drawn
