Some gaps of the 1994 Directive have now been closed by defining new standards
● e.g., the new definitions of „information“, consultation“ and the „transnational competence” of the EWC

Articulation between the different levels ● Unless negotiating parties define these processes more precisely,
Information of the EWC before or at the same time as the national level – but not after!
Art. 12 +Rec 37

Articulation between the different levels ● EWC members need appropriate facilities and rights to inform about the
content and results of the EWC. This is important to anchor EWC into the national and local levels of employee representation.

The recast EWC Directive contains important improvements for the work of many EWCs
● “Article 13” EWCs may be exempt from the new rules, but they can and should still work politically with the new standards.

Deutschland - immerhin: einige klare Regeln● Ausschuss entscheidet über Qualifizierungsbedarf und bestimmt Teilnehmende;
● Gesetz definiert “wesentliche Änderungen”, die zu Verhandlungen nach Art 13 neu führen;
l’Allemagne - tout de même: quelques règles claires● Le Comité Restreint décide des besoins de formation et désigne les participants;
● La Loi définit les «principaux changements» qui mènent aux négociations selon l’Art 13 nouveau;

● law defines “major changes” leading to negotiation according to new art 13;

● in case of consultation: right to meet Management and to receive an answer

ah-mv © igm-etui (2011) EWC Directive 2009/38/EC GPA-djp, Vienna24

● As always: practice and politics – not the strict wording of agreements or the law – determine how effective EWCs can be!

Questions?Suggestions for the discussion
● Will the new definitions of information, consultation and transnational issues be helpful?
● In which cases have you reached the limits of your agreement / of the Directive / of the law in the past?
● How do you make sure to link the local with the European employee representation. Can the new rules help?
● Should EWCs be informed and consulted before, after or at the same time as local / national employee representation?
● Will the right to training mean that you will ask for training with management?
ah-mv © igm-etui (2011) EWC Directive 2009/38/EC GPA-djp, Vienna29
Fragen?
