Section I – Financial Review

Per state statute, the Oregon Board of Optometry (OBO) is required to have an audit or financial review after each biennium. OBO has elected to have financial reviews for the past several biennia. This year OBO contracted with Powers CPA, LLC to conduct the financial review on behalf of the Board. Attached is a copy of the final report, as well as the Board’s response to the report.

A copy of the report and the financial statements were filed with the Secretary of State’s office on January 26, 2020.

OBO is due for an IT risk assessment and is scheduled for spring 2020. IT services are provided to OBO by DAS. Thentia, the new licensing system vendor went through OSCIO and ESO review prior to the 7/1/19 system implementation.

Section II: Budget Comparison

The Board’s primary income source is related to its licensing activity. Total 2017-19 biennial income was $683,383, which was 1% higher than the Board’s final amended biennial budget. Active license fee income was 3% less than budgeted. New license application income was 17% higher than budgeted. New license application increases could be attributable to the improved economy and Oregon becoming a very attractive place to live. Many Pacific University optometry new graduates, as well as out of state optometry graduates, enter into residency programs in Oregon after they complete their degree. That means that they are required to get licensed in order to complete their residency. They don’t always stay in the state after the residency, which means that they don’t renew their licenses after initial licensure.

Personnel and related costs are 97% of the biennial budget. Total expenses for the 2017-19 biennium were $734,898, which left a net loss of $51,515. The budget was projected to have a net loss of $92,474, so the Board outperformed its budget expectations significantly. The Board passed an amended biennial budget, which included fee increases as of 1/1/2019.

Over time the Board’s expenses have increased. The primary cost drivers are personnel and related costs, as well as IT and related services. The Board implemented an online licensing system in the 2015-17 biennium. That system had a monthly licensee fee as well as monthly DAS storage fees—the system was housed on dedicated servers in DAS.

On July 1, 2019, the Board implemented a new online licensing system. That system has the same monthly fee, but is a cloud based system, so doesn’t have any additional data storage fees. The online licensing systems rely on credit card payments, so the Board’s credit card processing fees have increased due to increased use of credit cards for licensing payments. Five years ago the Board didn’t accept credit cards, so has made great strides in IT implementation and licensing efficiency.

In order to meet the requirements of ORS 182.462(2), the Board passed the 2017-19 budget on February 10, 2017 after having a public hearing. All licensees and the Board’s notification list were notified of the hearing date and the opportunity for public comment. No comments were received and the Board unanimously approved the budget.

The revised 2017-19 budget was adopted at the Board’s August 23, 2018 meeting after doing the required public notice and hearing.

Section IV: Consumer Protection

The Oregon Board of Optometry was created in 1905 to regulate the optometric profession in Oregon and ensure patient safety. The Board oversees the statutes in Chapter 683 and promulgates rules (chapter 852) to clarify and support those statutes. The Board is also tasked with enforcing those laws and rules to ensure safe patient treatment.

The primary consumer protection efforts are focused at addressing consumer complaints and providing information on the Board’s website. Consumers can fill out an online complaint from the Board’s website with the new system implemented in July 2019. The old system required the consumer to phone the Executive Director, discuss the issue and then fill out a form and mail, fax or email it to the Board.

Once a complaint is filed, the staff and Board members investigate the complaint and then make a determination about whether to close the case without action, send an educational letter to the licensee/infractor or send a legal notice and begin the contested case process.

As you’ll see in the licensing and discipline section, there are low numbers of complaints filed for violations of our laws and rules. The majority of cases are closed with no action or an educational letter. Few cases merit penalties or sanctions—the majority of them are related to CE/CPR audit compliance. Any discipline is also reported to the National Practitioner Data Bank (NPDB). The NPDB is the federal repository for health care practitioner discipline.

There is little unlicensed practice in the optometry profession. The primary risk continues to be the sale and use of cosmetic contact lenses, which are sold without a prescription, proper fitting, or education about maintenance and use. The Board continues to investigate sales of cosmetic contact lenses throughout Oregon.

The Board prepared two new marketing pieces to assist Oregonians understand the profession, regulation and potential consumer harm this biennium.

The first was a consumer notice that explains the prescription release requirements and how to contact the Board if there are concerns or complaints. The notice was prepared and offered via email to any licensee that was interested. The Board also maintains a copy on the website.

The second piece was a full-color marketing flyer talking about the dangers of unprescribed contact lenses. There are a variety of cosmetic contact lenses sold for Halloween, parties and dress up. Many consumers and vendors don’t realize that they are regulated medical devices and that they can cause severe damage to eyes due to improper fit or poor quality. These flyers were offered to all licensees, medical facilities, former infractors (flea markets, etc) and are posted on the Board’s website.

The Board has also conducted sweeps of known markets where these lenses are sold. The Board also did extensive investigation on Craigslist and Facebook Marketplace making purchases and then sending the cease sales letters. There has been minimal postings since that work was done last biennium.

Section V: Licensing and Discipline

As of September 10, 2019 (the Board doesn’t have a way to get a historical license count) the Oregon Board of Optometry had approximately 1,152 licensees. Of those, 831 were active licensees (72%) and 321 were inactive (28%). Throughout the biennium, OBO issued a total of approximately 2,438 licenses. That number is slightly higher than the last biennium. Over the last five biennia the number of licensees has decreased overall. The primary driver of that downward trend is the switch to online license renewal. The losses have been in inactive licensees, so tend to be older and less likely to feel comfortable with online technology. They have also reached the point in their career where they are retiring rather than looking at future practice opportunities.

During the 2017-19 biennium, 100 license applications were received and 126 new licenses were issued. License applications require a variety of materials, including college transcripts, fingerprinting, national exam scores (there are four required professional exams) and previous state license verifications. It often takes several weeks for the Board to obtain all of the information for a complete license application. Once a complete application is received, a license is generally issued within one day. The average on the report is 3 days. That’s due to the fact that some licensees wait to have the Board issue their license due to where their due date falls and/or when they plan to begin to practice. Another factor is the time it takes for OSP to process fingerprinting data. The Board encourages licensees to have fingerprinting done early, which helps prevent processing delays.

Each licensed optometrist is required to complete 18 hours of continuing education each year. Licenses expire on the last day of a licensee’s birth month. The due date for the license renewal is the first day of the licensee’s birth month; that gives licensees some additional time to complete or document the 18 hours of CE before having an expired license. Nearly all licensees, active and inactive, are renewing their license online, which gives the Board better data.

The Board approves continuing education courses, as well as accepts nationally approved CE through the Council on Optometric Practitioner Education (COPE). Licensees have a wide array of courses to select from and the Board removed the requirement to complete a minimum number of CE hours in person. An Oregon licensee has the option to complete all of their CE credit online if they choose to do so.

Consumer safety is the primary mission of the Board. As such, consumers often contact the Board with complaints about their optometrist, optician or other practitioner. The Board has limited jurisdiction. When a consumer complaint appears to be within the Board’s jurisdiction, staff directs them to complete the consumer complaint form (or as of July 1, 2019 the online complaint process).

The online licensing system allows real time license verification of optometrists’ licensure. Credentialing organizations, patients or other constituents can do a licensee search and see

information on past and present licensees. The Board posts the legal documents for licensees with discipline for a 15 year period.

ORS 676 also requires health practitioners to report when another provider hasn’t provided an appropriate standard of care. Practitioners can also complete a reporting form online or may call or email the Board with reports.

Once a report is received by the Board, staff investigates and provides the collected information for formal Board review. If it is a cosmetic contact sales case, a staff, Board member or contracted private investigator will make a purchase and then a cease sales letter is sent to inform the business owner of the legal violation.

In this biennium the Board gave the Executive Director delegated authority to sign consent and final orders on simple CE/CPR audit cases. If there is no dispute, the E.D. can process these cases and then have them ratified by the Board. If the licensee has any concerns with the case, the case is instead taken to the full Board for review and determination.

Every case within the Board’s jurisdiction is reviewed by the Board at a formal Board meeting, in Executive Session. Board members review patient files and other information gathered and determine the appropriate resolution of the matter. The Board’s long-term AAG attends every Board meeting and consults with Board staff through the investigation process.

There is some fluctuation in the number of enforcement cases each biennium. CE audits began in 2016 to prepare the online license renewals. The Board has seen new cases due to lack of compliance with the CE audit. As mentioned earlier, the Board has also spent time investigating cosmetic contact lens sales, which led to high numbers of letters of concern to non-licensees selling plano or cosmetic lenses without a prescription.

Section VI: Other Board Activities

Here is an org chart for the Oregon Board of Optometry as of the end of the 201-19 biennium:

The 2017-19 biennium was one of stability. There were no staff changes in this biennium. Molly Cardenal, OD left the Board this biennium and was replaced by Steven Tronnes, OD from Roseburg. That meant that four of the five Board members served the entire biennium. When there is turnover in Board membership, OBO works with the Oregon Optometric Physicians Association (OOPA) to identify and recruit potential optometrists. Once applications are received, the Executive Director prepares a Board applicant matrix that is then reviewed with the Governor’s Health Policy Advisor. Board members are Senate confirmed. During 2017-2019 biennium the Board used the eLite licensing system, along with four other Oregon Boards. OBO looked at three new licensing system options and decided to go select the Open Regulate system offered through Thentia Global Systems. OBO partnered with the Oregon Physical Therapy Board in developing the contract with Thentia, and shared the DOJ costs for the contract development. OBO’s Executive Director worked through the OSCIO non-stage gate IT approval process and was given the green light to move forward with the project on January 31, 2019. The contract between OBO and Thentia was signed on February 1, 2019. Here is a status report of the 2017-19 goals:

1) Finish scanning all licensee files into the eLite system. Maintain hard copies of some source documents but all renewals, address charges, etc. will be shredded and disposed of. This project hasn’t moved forward as expected. It takes at least an hour to scan and upload a licensee file online. Board staff hasn’t had the opportunity to do much of this work and the Board has budgeted $4,000 each year for temporary payroll for this work. That money hasn’t been spent due to the time intensity of the work. This will remain a long-term project.

2) Maintain the Board’s website to provide timely information.

Board staff maintain and update the website as needed.

3) Maintain Board records per the retention schedule. This is being done on a regular basis by culling old licensee files and other paper records.

4) Consistently offer telephone and/or web access to Board meetings. All Board meetings offered at the Salem office are available via conference call. Board staff will work on offering web meetings in the 2019-21 biennium.

5) Update Board policies, rules and desk manuals to ensure everything reflects the new systems in place with the new licensing system and the change to two staff members. The Board approved updated policies and has done several rule changes during the biennium. Board staff will updated desk manuals in 2019-21 due to the new licensing system.

2019-21 Goals 1. Complete a strategic plan and regularly review it with the entire Board and staff. Track

Board actions and update the plan as the Board makes changes to plans and goals.

2. Transfer to DAS Payroll for staff and Board payroll processing.

3. Continue making progress on the licensee paper file scanning project.

4. Update the Board’s website to Sharepoint 2016.

5. Work with OOPA on doing outreach to high schools and other groups on the profession, its benefits and the educational pathway.

6. Work with the Board on documenting expectations for new Board members.

Eye doctors are required to provide patients with a copy of their ophthalmic lens prescriptions as follows:

• Spectacle prescriptions: Release upon completion ofexam.

• Contact lens prescriptions: Release upon completion ofexam or upon completion of the fitting process.

• Patients may take their prescription to any eye doctor ordispensing business to be filled.

• Written prescription requests must be responded towithin 14 days.

Optometrists are regulated by the Oregon Board of Optometry.

The Oregon Board of Optometry receives and investigates all consumer complaints involving the practice of optometry.
