AN ORDINANCE REQUIRING ALL BUSINESS, PUBUC TRANSPORTAnON TERMINALS, COMMERCIAL AND INS11TUnONAL ESTABUSHMENTS IN THE ENnRE CITY OF SANTA ROSA,

LAGUNA TO DISPLAY IN THEIR ESTABUSHMENTS, SIGNAGE THAT THEY WELCOME AND OFFER BENEFITS/PRMUGES TO PERSONS WITH DISABIUTIES,

WHEREAS, Section 16 of RA7160, that every local government unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

WHEREAS, Section 17 (a), local government units shall endeavour to be self-reliant and shall continue exercising the powers and discharging the duties and functions currently vested upon them;

. WHEREAS, Section 17 of the same code, Local government units shall also discharge the functions and responsibilities of national agencies and offices devolved to them pursuant to this Code;

WHEREAS, Section 17 of the same code, Local government units shall likewise exercise such other powers and discharge such other functions and responsibilities as are necessary, appropriate, or incidental to efficient and effective provisions of the basic . services;

WHEREAS , among the basic services which include programs and projects on child and youth welfare, family and community welfare, women's welfare, welfare of the elderly and disabled persons;

WHEREAS, Republic Act No. 9442, a law amending Republic Act No. 7277, and as further amended by Republic Act No. 10070, otherwise known as Magna Carta for Persons with Disability, induded Chapter 8, a provision instituting "Other Priviliges and Incentives" as provided for in Section 32 and

33.

WHEREAS, The City Government of Santa Rosa, Laguna recognizes the need to implement the Magna Carta for the Disabled Persons and to further provide for provisions that will ensure the effective delivery of benefits and incentives for more meaningful, productive and satisfying life of all Persons with Disability in the City of Santa Rosa, Laguna;

NOW, therefore, on motion of SP Member Hon. Edward Femandito S. Tiangco, duly seconded by SP Member Cendana and SP Member Algabre, it is:

Hereby RESOLVED, as it hereby RESOLVED to adopt and implement the provisions of Republic Act No. 7277, as amended by Republic Act No. 9442 and as further amended by Republic Act No. 10070, otherwlsw known as Magna Carta for Disabled Persons, to wit:

SEcnON 1. Title - AN ORDINANCE REQUIRING ALL BUSINESS, PUBUC TRANSPORTATION TERMINALS, COMMERCIAL AND INSTITUTIONAL ESTABUSHMENTS IN THE ENllRE CITY OF SANTA ROSA, LAGUNA TO DISPLAY IN THEIR ESTABLISHMENTS, SIGNAGE THAT THEY WELCOME AND OFFER BENEFITS/PRIVIUGES TO PERSONS WITH DISABIUTIES.

SEcnON 2. Statement of Policies and Objectives - It is the objective of this Ordinance to effectively implement the policies and provisions stated under Republic Act No. 7277 in which the persons with disability will have the opportunity to participate fully in the mainstream of the society.

1.1 REQUIREMENT FOR POSTING SIGNAGE

Signage in the form of metal plate and alike be posted in all business, public transportation terminals, commercial and institutional establishments to be posted in conspicuous places that could be seen by the public and persons with disability.

1,2 DESIGN OF SIGNAGE

Signage in the form of metal plate and alike shall be in the following design:

a. Require business, public transportation terminals, commercial and institutional establishments to display on their entrance and inside premises signage which state the following, or something to this effect: "We Welcome and Provide Benefits and Privileges to PWDs,"

b. "This Establishment Complies to the Laws on Persons with Disability," and/or Basta sa mga PWD, Kami ay Friendly," and/or

c. Display the following Logo affirming their establishments welcome customers with disabilities:

Note: The design of the metal plate signage must include the logo of CSWDO , City of Santa Rosa Logo and the Logo Slogan of the city.

2.3 AVAILABILITY OF SIGNAGE

The Business Pennit and License Office (BPLO) of the City of Santa Rosa, Laguna shall provide all businesses with metal plate signage that will be incorporated in their application requirements, the amount of which is equivalent to the cost of materials and supplies.

Appropriations - The amount of which shall be less than 1 % of each agencies total budget for the year equivalent to the amount provided for in the general appropriation act of 2001.

Monitoring and Document Compliance and Non Compliance of Establishments and Public Transportation

3.1 The City Government shall monitor and document cases of compliance/non-compliance of the provisions of this ordinance within its territorial jurisdiction thru the members of the Persons with Disability Affairs Office (PDAO);

3.2 The Office of the Sangguniang Barangay will also help in monitoring document compliance/non-compliance of this ordinance and report it to PDAO on a monthly basis for immediate action;

3.3 The City Philippine National Police by its Chief will also help in monitoring document compliance/non-compliance of Public Transportation of the provisions of this ordinance and report it to PDAO on a monthly basis for immediate action, thru the implementation of the City Traffic Management Enforcement Office (CTMEO) ;

3.4 The City Social Welfare and Development Office (CSWDO) shall document compliance and non-compliance of the provisions of this ordinance and report it to the members of the PDAO during their regular monthly meeting.

Penalties and Sanctions of Violations of this Ordinance.

4.1 The following acts or omissions shall be deemed violations of this

Ordinance and shall be subject to the imposition of the corresponding

penal sanctions:

(1) For th~ first violation, a fine of not less than One Thousand Five Hundred Pesos (Pl,500.00) ; and

(2) For any subsequent violation, a fine of not less than Two Thousand Five Hundred Pesos (P2,500.00) m: imprisonment for not less than two years but not more than six years, or both at the discretion of the

court.

(3) Any person who abuses the privileges granted herein shall be punished with imprisonment of not less than six months or a fine of not less than Five thousand pesos (PS,000.00), or both, at the discretion of the

court.

(4) If the violator is a corporation, business establishment, organization or any similar entity, the officials thereof directly involved shall be liable

therefore.

(5) If the violator is an alien or a foreigner, he shall be deported immediately after service of sentence without further deportation proceedings.

Upon filing of an appropriate complaint, and after due notice and hearing, the proper authorities, the City Mayor may also cause the cancellation or revocation of the business permit, permit to operate, franchise and other similar privileges granted to any business entity that fails to abide by the provisions of this

Ordinance.

SECTION 6.

SEC110N7.

SECTlONS.

Repeallng aause, - All ordinances, resolutions, executive issuances, or rules

and regulations, or parts thereof, whose provisions are inconsistent with or

contrary to the provisions of this Ordinance, are hereby deemed repealed,

amended, or modified accordingly.

APJZ[icability Clause. - The provisions of existing ordinances, resolutions, or

executive orders dealing with related subject matter such as protection of the

Rights , Rehabilitation, Self-development , and Self-reliance of Disabled Persons

and their Integration into the Mainstream of Society , and the like, which are not

contradictory with this Ordinance, are hereby adopted as an integral part of this

Ordinance.

Separability Clause. - If, for any reason, any section or provision of this

Ordinance is held unconstitutional or invalid, the other sections or provisions

hereof shall not be affected thereby.

SECTION 9. Effectivity, - This Ordinance shall take effect after thirty (30) days from the date of completion of its review by the Sangguniang Panlalawigan and its publication in a newspaper of local circulation, posted to information area of the City Government Buildings and Commercial
