Therefore, the priority for Bryan Cave’s pro bono program is

to offer legal services benefiting persons of limited means

and nonprofit organizations servicing those individuals’

needs, and to advocate for civil rights, human rights, civil

liberties and public rights.

Rather than a complete compilation, this report is a snapshot

of the types of pro bono projects the firm handled in 2016

– important work that included civil rights and public rights

law, prisoner cases, asylum cases, child abduction matters,

family law and counseling nonprofit organizations.

Overview of 2014 Pro Bono Projects

Public Policy/Civil RightsBirth Certificate Rights for Same-Sex ParentsBryan Cave in Atlanta successfully partnered with Lambda Legal to challenge South Carolina’s policy of refusing to provide accurate birth certificates for the children of same-sex spouses. The clients, Casy and Jacqueline Carson, were issued birth certificates for their twins listing only Jacqueline as the parent and refusing to list Casy as a parent. Without accurate birth certificates, the couple faced difficulty accessing Casy’s benefits for their children through the Veterans Administration and Social Security following her service in the National Guard. Casy and Jacqueline also were concerned that they might experience problems obtaining medical care for their twins in the future. A motion for summary judgment was filed in May 2016, arguing that the policies of South Carolina violated the Equal Protection and Due Process clauses of the 14th Amendment. On Feb. 15, 2017, a U.S. District Court in South Carolina ruled that the state must issue accurate birth certificates for children of married same-sex couples.

National Center for Transgender EqualityFor the second consecutive year, Bryan Cave continued to serve the legal needs of the transgender community through the National Center for Transgender Equality (NCTE) Trans Legal Services Advisory Council. In furtherance of NCTE’s – and the firm’s – efforts to promote equality and dignity for transgender individuals, a team of Bryan Cave attorneys in San Francisco worked closely with NCTE attorneys to prepare and submit Freedom of Information Act requests to both the State Department and the Social Security Administration. These requests sought information on the record-keeping process and statistical data on requests, denials and grants of gender change records to better inform NCTE’s policy and education efforts at

the federal level. Bryan Cave looks forward to continu-ing its relationship with NCTE by providing legal resources to the underserved transgender community.

Extension of Voter Registration DeadlineBryan Cave in Atlanta successfully partnered with The Lawyers’ Committee for Civil Rights Under Law to obtain a court order extending the voter registration deadline for the Nov. 8, 2016, election in Chatham County, Ga. The plaintiffs contended that the mandatory evacuations imposed by the governor and the closing of governmental offices due to Hurricane Matthew prevented many potential voters in Chatham County from registering to vote for the general election. While the voter registration deadline was Oct. 11, the Chatham County Board of Elections office was closed Oct. 6-12. When asked to extend the deadline prior to suit being filed, both the governor and the secretary of state refused to do so. The plaintiffs argued that the defendants’ failure to extend the voter registration deadline violated the 1st and 14th Amendments of the United States Constitution as well as the provisions of the National Voter Registration Act. Noting the unprecedented nature of the circumstances, the court found that “[e]xtending a small degree of common courtesy by allowing impacted individuals a few extra days to register to vote seems like a rather small consolation on behalf of their government.” More than 1,400 voter registration applications were submitted in Chatham County during the extended voter registration period.

Amicus Brief to Restore Voting Rights to Former FelonsWith The Lawyers’ Committee for Civil Rights Under Law, attorneys in Bryan Cave’s New York and Washington offices filed an amicus curiae brief in the Virginia Supreme Court supporting Gov. Terry McAuliffe’s executive order restoring voting rights to 206,000 Virginia residents

who have completed their sentence and post-release supervision. The lawsuit, Howell v. McAuliffe, challenged the constitutionality of Gov. McAuliffe’s executive order. Those challenging the executive order contended that Virginia’s Constitution required individual orders from the governor for each of the formerly incarcerated Virginia residents, many of whom are African Americans and other minorities. The amicus brief focused on the disparate impact of the prior practice. The Virginia Supreme Court issued a 4-3 decision on July 22 vacating the governor’s executive order, thereby making the 206,000 residents covered by his order ineligible to register to vote, although the governor then proceeded to restore voting rights on an individual basis.

Firm Aids Indybay in Copyright LawsuitA Bryan Cave team in San Francisco represented the San Francisco Bay Area Independent Media Center (Indybay), a user-generated Bay Area news website, in a frivolous copyright lawsuit. The Ninth Circuit affirmed the District Court’s order that the plaintiff against Indybay and a co-defendant should pay nearly $90,000 in attorneys’ fees. In November 2014, attorney Dionne Choyce of The Choyce Law Firm was ordered to pay Indybay and hosting service Layer42 their attorneys’ fees following the court’s dismissal of Choyce’s “objectively baseless” copyright lawsuit, finding he did not own the copyright to a photograph of himself used to illustrate user-generated articles on the website. Choyce said the stories were false and sued for defamation, libel and copyright infringement for the use of the picture from his firm’s website. Choyce is one of a number of plaintiffs who have tried to use copyright law to stop critical reporting because federal copyright claims are not subject to state anti-SLAPP statutes. Websites like Indybay often do not have the resources to defend themselves.

Chang v. United States, et al.Bryan Cave represented individuals swept up in a mass arrest during the 2002 World Bank/IMF protests in the District of Columbia in subsequent litigation. What followed was more than 13 years of intense discovery and motions practice, rulings on qualified immunity

(which twice were decided in the plaintiffs’ favor in the DC Circuit), and Special Master hearings relating to evidence spoliation by the District of Columbia. In 2016, two months before a scheduled trial, the District of Columbia and the federal government offered terms of settlement which included offers to the plaintiffs of the largest individual payments in DC history for false arrests without substantial physical injuries, and compensation for fees and expenses. After negotiation, the plaintiffs accepted the settlement proposal and the case was closed.

Prisoner RightsCapital Post-Conviction AppealIn 2016, a team of Atlanta lawyers began representation of Jimmie Christian (Chris) Duncan in his capital post-conviction appeal pending in Louisiana state court. Mr. Duncan has been imprisoned on death row at the Louisiana State Penitentiary in Angola since being convicted of first-degree murder in 1998. At trial, the state alleged Mr. Duncan brutally attacked and killed his then-girlfriend’s 23-month-old daughter. There is, however, compelling evidence to suggest that the child’s death was the result of an accidental drowning. The Bryan Cave team is working with the Capital Post-Conviction Project of Louisiana in seeking post-conviction relief for Mr. Duncan.

Robinson Habeas Case Bryan Cave’s St. Louis office has since 2015 represented David Robinson in Missouri state trial court to overturn his conviction for first-degree murder. Mr. Robinson was convicted of shooting a woman in a parked car in Sikeston, Mo., based on no physical evidence and the testimony of a drug-addicted “eyewitness” who received payments from the police and a jailhouse informant. After Mr. Robinson had served 15 years, both of the state’s trial witnesses recanted their testimony and admitted to committing perjury during Mr. Robinson’s trial. The firm filed a petition for a writ of habeas corpus in the case in August 2016, asserting a freestanding claim of actual innocence. In December,

the Missouri Supreme Court entered a preliminary writ of habeas corpus. Since then, the court has appointed a circuit judge as a special master to receive evidence. A trial commenced in 2017.

Bryan Cave and Concordance Academy Establish Legal Fellow Program

In the fall of 2016, Bryan Cave and the Concordance Academy of Leadership established the Bryan Cave-Concordance Academy Legal Fellowship to help address recidivism and its many associated problems. The partnership dedicates two legal fellows – one who commenced work in the fall of 2016 and another in the fall of 2017, each serving for two years – who will spend approximately 50 percent of his or her time on pro bono matters for Concordance Academy participants in St. Louis and the balance of his or her time on Bryan Cave billable matters.

Concordance Academy is a St. Louis-based nonprofit that offers the country’s first set of integrated, holistic and evidence-driven services to individuals returning to society from prison. Led by President and CEO Danny Ludeman, the organization assists participants in three primary areas: behavioral health and wellness; education and employment; and community and life skills. The academy starts working with individuals six months prior to release and continues assisting for up to a year after their return to the community. The organization is committed to restoring individuals, rebuilding families, transforming communities and advancing the field of re-entry services.

9th Circuit Court of Appeals Representation The firm’s Kansas City office prevailed for pro bono client Jamisi Calloway in the 9th Circuit Court of Appeals. At a trial confirmation hearing, Mr. Calloway informed the District Court for the Eastern District of California

that he did not think he could effectively present his 8th Amendment claims against prison guards to a jury and that he needed an attorney to help him. The next day, the District Court dismissed his case sua sponte, providing no reason for the dismissal other than Mr. Calloway’s “multiple representations” at the hearing that he was “incapable and unable to proceed to trial in this matter.” On appeal, the 9th Circuit agreed with our argument that Mr. Calloway’s statements at the hearing were best understood as a motion for the appointment of counsel and provided no basis for dismissing the case. The case was remanded for a trial on the merits.

Habeas Corpus Appeal in Sixth CircuitWith the assistance of several Bryan Cave lawyers in St. Louis, a student participating in the Washington University School of Law Appellate Clinic prevailed in a habeas corpus case in the United States Court of Appeals for the Sixth Circuit. Thomas Crangle pleaded guilty after being told by his lawyer and the judge that he would not be subject to “post-release control,” a system in Ohio that is more burdensome than ordinary parole. However, several years later, post-release control was added to his sentence in a nunc pro tunc judgment as a result of an Ohio Supreme Court holding in an unrelated case. Mr. Crangle argued pro se in his habeas corpus petition that his guilty plea was not knowing and voluntary because his sentence was inconsistent with the statements of the judge and his lawyer at the plea hearing. The federal district court dismissed the petition as untimely because it was not filed within one year of the original conviction. The Sixth Circuit appointed the clinic to represent Mr. Crangle on appeal and reversed, holding that his amended sentence triggered a new limitations period.

Other Individuals in NeedBryan Cave / CenturyLink On-Call AssistanceIn a partnership that generated the most pro bono attorney hours from Bryan Cave in 2016 – 1,413 total – firm attorneys continued their work with CenturyLink’s in-house counsel to give on-call assistance to the 17th

involving the purchase of her first home. The matter ultimately required help from multiple attorneys, including one fluent in Spanish. The client, a native Spanish speaker, attended a seminar on purchasing a home. The seminar was conducted entirely in Spanish by a mortgage broker who subsequently agreed to help our client locate, negotiate and purchase her first home, to house her family of seven. She had made it clear that she only wanted a home connected to the city sewer system. The home she purchased with the assistance of the broker was advertised as connected to the city sewer. However, the broker failed to translate the sales contract containing certain waivers from English into Spanish for her, and he also failed to advise her of the need for property inspections. Two years after the sale, the house’s plumbing failed and the client learned for the first time that the house was connected to an undersized, failed septic system. Once complaints were filed with the Arizona Department of Real Estate and the local court, the defendants agreed to mediation, where the parties successfully resolved the dispute on a proposal submitted by firm attorneys: The seller agreed to re-purchase the home and the broker’s insurer agreed to pay a cash settlement.

Pro Bono Adoption AssistanceBryan Cave’s Los Angeles office contributes significant pro bono hours each year to area families seeking help with adoptions. According to the Alliance for Children’s Rights, 62,000 children live in foster homes in California, and approximately 13,000 are in the process of being adopted. Bryan Cave handled more than 70 adoption and guardianship cases over the past nine years for the organization.

Guardianship ProceedingsBryan Cave in St. Louis has attorneys from nearly every practice group handling guardian ad litem (GAL) cases. In 2016 alone, they handled 40 GAL cases totaling nearly 390 pro bono hours. The firm serves as the only law firm and sole source of GAL representation for children involved with guardianship proceedings in the St. Louis City Circuit Court, Probate Division. Judicial District’s self-help center, located in Brighton, Colo. Together, the two organizations staff an innovative pro bono effort that overcomes the issue of connecting pro se litigants that are located far from volunteers. The result has helped thousands of individual pro se litigants as well as the entire local court system. Now, in addition to clients walking into the Self-Help Resource Center, court personnel direct appropriate clients to utilize a hotline that is forwarded to either CenturyLink or Bryan Cave volunteers who provide assistance from their desks, where they have access to the resources they use every day plus online training materials created especially for the initiative. As a result, 20 Bryan Cave lawyers along with CenturyLink lawyers and other professional staff support the program six hours daily.

Hague Convention Custody Battle – DenverBryan Cave in Denver successfully resolved a protracted pro bono child custody battle under the Hague Convention. The firm represented a father whose ex-wife had kidnapped their two daughters and fled to Argentina. After five years of highly publicized litigation, the father prevailed in returning the children to Aspen, Colo. Thanks to the work of our team, the father succeeded in denying a flurry of post-judgment motions filed by the mother’s counsel seeking to relocate the children to Argentina and obtain sole decision-making authority. Instead, the father remains the primary parent with sole decision-making, and the judge ordered many protections to keep the mother from re-abducting the children.

Hague Convention Custody Battle – St. Louis A St. Louis team prevailed in an international child abduction case brought under the Hague Convention. Our client brought a petition seeking the return of his child to Mexico after his wife, without his knowledge or consent, absconded with their child and illegally crossed the border into the United States. The judge in the U.S. District Court for the Eastern District of Missouri ruled that the child be returned to Mexico.

background checks, meet the children and inspect the home to ensure conditions are acceptable for granting guardianship. The attorneys typically also visit or interview educators, doctors, social workers, therapists and other professionals involved with the children and families. The attorneys then attend the hearing on behalf of the children, call and cross-examine witnesses and make recommendations to the court.

Clooney Foundation for Justice TrialWatch Project

A Bryan Cave team spanning New York, London, Paris and Phoenix is working pro bono with the Clooney Foundation for Justice (CFJ) to launch its global trial monitoring program, the TrialWatch Project. CFJ is led by George and Amal Clooney. The TrialWatch Project was established to train trial monitors using a distance-learning, interactive online course developed in partnership with multilateral organizations working in this area. CFJ is developing an international network of trusted journalists, lawyers, diplomats, parliamentarians and human rights activists to identify upcoming trials that pose a high risk of human rights violations. They will help to place trial monitors in courtrooms worldwide to follow these trials, help to create or disseminate fairness reports of these trials based on expert assessments, share the fairness reports with international lawyers who can represent the defendants, and gather data that will contribute to a first-ever Justice Index documenting national courts’ adherence to human rights and the rule of law.

Win for Political BloggersThe firm’s London office obtained summary judgment in two libel claims brought by East End political candidate Kamran Malik. Prominent political

bloggers John Gray and Martin Warne wrote articles in June 2014 referring to Mr. Malik’s conviction on two counts of illegally providing immigration advice, for which he was sentenced to six months imprisonment and criticized for exploiting vulnerable people. Despite the blog posts being true and also being an accurate report of court proceedings, Mr. Malik made an application for an injunction against Mr. Gray, which was refused. He then commenced libel proceedings against Mr. Gray and Mr. Warne. The court granted our clients summary judgment in both cases and awarded both their costs, expressing disapproval that the claims were brought and that Mr. Malik refused reasonable offers to settle.

Nonprofit Organizations Congregation Beit Simchat TorahBryan Cave’s New York office has aided in the acquisition and development of the new home in Midtown Manhattan for longtime pro bono client Congregation Beit Simchat Torah, a synagogue for lesbian, gay, bisexual and transgender Jews.

Cleveland County Potato ProjectBryan Cave in Charlotte represents the Cleveland County Potato Project, a charity in North Carolina that plants and harvests white potatoes in the spring and sweet potatoes in the summer, with all of the potatoes donated to local organizations for distribution to impoverished families in and around the county. Since 2009, more than 700,000 pounds of potatoes have been produced and donated. CCPP is a volunteer organization, with just a few people paid by the hour to help harvest potatoes if needed.

Hong Kong Red CrossBryan Cave was retained to provide legal assistance to the Hong Kong Red Cross in connection with its 3rd Youth IHL Moot program for the young generation. The Youth IHL Moot program is designed to raise awareness for the participants about the basic principles of the International Humanitarian Law and the unique role of the International Committee of the Red Cross.

Through the years, Bryan Cave attorneys in many offices and practice groups have taken on the important pro bono work of aiding individuals seeking asylum status in the United States. In 2016, Bryan Cave attorneys devoted approximately 700 pro bono hours to asylum cases.

Many of the firm’s asylum cases are referred by Human Rights First, a nonprofit, nonpartisan human rights organization founded in 1978, based in New York City and Washington, D.C. The organization focuses on protecting the rights of refugees, supporting human rights around the world and pressing for the U.S. government’s full participation in the international human rights system. Bryan Cave attorneys work closely with attorneys at Human Right First and have partnered with the organization for at least two decades.

The New York office has an active docket representing refugees seeking asylum in the United States. In one case, the firm is representing a Tibetan monk who escaped Tibet because he was sought by Chinese authorities after demonstrating his support for the Dalai Lama and the independence of Tibet. He applied for asylum two years ago and is waiting for his asylum interview to be scheduled. Attorneys are representing a Syrian man seeking political asylum for holding views against the Assad regime. After his interview with an asylum officer, it was recommended that his request for asylum be approved, subject to a background check by agencies reporting to UCIS. That background check is still in progress. Bryan Cave also for more than three years represented a Syrian woman and her teenage daughter who fled a suburb near Damascus after government forces decided their neighborhood was a rebel stronghold and turned it into a war zone. After our clients were denied asylum at the administrative level in January 2015 we took their case to the Executive Office for Immigration Review. Recently, they went to trial and our attorneys persuaded the court to grant them asylum. Bryan Cave is representing a Pakistani human rights activist and advocate who received death threats from terrorists in Pakistan as a result of his public advocacy of women’s education and his volunteer work with Western-based human rights organizations. He has been in the United States for about a year and his asylum interview has not yet been scheduled. The firm is representing a 27-year-old woman from Honduras who fled the brutal domestic abuse of her ex-partner in 2015 with her 8-year-old son.

In the DC metro area, Bryan Cave also assists the Capital Area Immigrants’ Rights (CAIR) Coalition and other local charities with immigration and asylum cases. In one

such representation referred by CAIR, a 13-year-old boy living in Texas ventured into Mexico in 2015 for a one-day visit with a friend. When he returned to the U.S., he was detained at the border because he was not a U.S. citizen and, despite living in Texas for almost his entire life, was undocumented. The Immigration and Customs Enforcement agency placed him in a detention facility in Virginia, where attorneys from Bryan Cave’s DC office met him and began the process of obtaining an order permitting him to have special juvenile immigration status, which will allow him to later apply for a green card. In another case, in partnership with Christian Legal Aid of the District of Columbia and the Human Rights Foundation, Bryan Cave attorneys are representing a client from Ivory Coast in an asylum claim based on political opinion. The client’s initial application has been filed, and support for his claim is being built through evidence such as a legal brief and an affidavit telling his story. The client is expected to have his asylum interview by 2018. In the meantime, he has been granted a work permit and is employed.

Attorneys out of Bryan Cave’s Dallas office are representing several women and their children who fled to the United States from Central America to escape pervasive gang and domestic violence. These families initially were jailed in a federal detention facility and faced deportation proceedings. Bryan Cave is representing them in their asylum trials and, for those for whom asylum already has been won, assisting them with work permits and augmentation to permanent residency status.

In San Francisco, Bryan Cave attorneys aided a youth who fled El Salvador when his family was targeted and forced into hiding by members of the MS-13 gang after his twin sister was attacked by gang members for assisting in the prosecution of one of her attackers. The client applied for asylum in September 2014 and in February 2016, his application was granted. His family remains in hiding in El Salvador.

The firm’s St. Louis office represented two Syrian sisters for whom the firm filed asylum applications based on their well-founded fears of religious persecution. Despite very complicated factual and legal issues, both sisters were granted asylum. Work has now been focused on obtaining a visa for the husband to one of the sisters, who is still in Syria, to reunite the family in the U.S.

State Bar Honors Bryan Cave Attorney for Asylum WorkThe Bankruptcy Law Section of the State Bar of Texas presented Michael P. Cooley,

Dallas, with its Pro Bono Service Award at the State Bar annual meeting. Cooley was recognized for his work representing Central American women and children seeking asylum in the United States, as well as his work in creating the Pro Bono Bankruptcy Project for the Northern District of Texas.

Weiss Appointed to ABA Legal Aid CommitteeCharlie Weiss, St. Louis, has been appointed a member of the American Bar Association’s Standing

Committee on Legal Aid and Indigent Defendants (SCLAID) for a three-year term. SCLAID was established in 1920 to examine issues relating to the delivery of legal services to the poor. SCLAID examines the administration of justice as it affects low-income populations, protects remedial measures intended to help guard the legal rights of low-income populations, works for the establishment and maintenance of legal aid and defender organizations, and cooperates with other interested public or private agencies. Among his numerous other professional involvements, Weiss has served as chair of the American College of Trial Lawyers Access to Justice and Legal Services Committee. He is a former president of The Missouri Bar and the Bar Association of Metropolitan St. Louis and is a member of the Board of Governors of the American Bar Association.

for his pro bono efforts. Hirsch often uses his Spanish language fluency to provide pro bono legal services in Phoenix; in 2016, he donated more than 100 pro bono hours to various cases referred to him by VLP.

Lantta Receives ‘Extraordinary Pro Bono Service Award’ from Atlanta Legal Aid SocietyLuke Lantta, Atlanta, received the Extraordinary

Pro Bono Service Award from the Atlanta Legal Aid Society (ALAS) for his community service. Along with serving on the board of directors for the Atlanta Legal Aid Society, he is also a volunteer and lifetime member of the Cobb Justice Foundation, the Atlanta Legal Aid Society’s pro bono arm in Cobb County. In 2011, Lantta established a partnership between Bryan Cave and the Cobb Justice Foundation to represent survivors of domestic violence and stalking. More than a dozen Bryan Cave attorneys have handled domestic violence temporary protective order (TPO) cases through this partnership, which Lantta currently manages and for which he is a volunteer. Lantta also assisted in establishing the Bryan Cave TPO screening project in which attorneys and paralegals interview clients who have applied for assistance with Legal Aid.

Firm Receives Robert F. Mullen Pro Bono AwardBryan Cave in Atlanta received the Robert F. Mullen Pro Bono Award for work in defending the voting rights of Georgia citizens along with the Lawyers’ Committee for Civil Rights Under Law. In NAACP v. Board of Elections of Hancock County, the firm filed a claim in the Middle District of Georgia seeking to reverse steps taken by a local board of elections to purge African-American voters from the voter rolls. The court ordered that unlawfully purged voters be restored to the rolls. In NAACP v. Governor Nathan Deal, the firm brought suit in the Southern District of Georgia under the National Voter Registration Act seeking to extend the time period for voter registration in the wake of Hurricane Matthew. In that case, the court granted a motion for preliminary injunction and required registration be extended. Approximately 1,400 individuals were thereafter permitted to register and vote in the November general election. The Mullen Award honors a law firm that has provided extraordinary pro bono legal services on behalf of Lawyers’ Committee clients or matters.
