Commerce 2017 Lifetime Achievement Award. Mr. Park began his farming career after serving
in the Korean War, and he continues to contribute to the potato and tree farming industries and

(1-7) Larry Clark, of Presque Isle, who has received the Central Aroostook Chamber of
Commerce 2017 Lifetime Achievement Award. Mr. Clark is the longest standing member of the
Rotary Club of Presque Isle, with over 48 years of service, and is often seen working
competently and quietly behind the scenes at community events. We extend to Mr. Clark our

The Spirit of America Foundation was established to encourage and promote volunteerism, and
the foundation presents awards to honor local individuals, organizations or projects in

this award;

(1-12) David Lyman, of Norridgewock, to whom the Town of Norridgewock has dedicated its
Town Report. Mr. Lyman has been involved in the community for many years in many roles,

(1-13) Daniel Rosso, of Palmyra, a member of Boy Scout Troop No. 59, who has attained the
high rank and distinction of Eagle Scout. This is the highest award in Boy Scouting and is given

Joint Resolutions
Joint Resolutions in Memoriam:
WHEREAS, the Legislature has learned with deep regret of the death of:
(1-14) Henry M. Glover, D.O., of Smithfield. Dr. Glover practiced medicine in Oakland for 35
years. He received many awards and recognitions for excellence in medicine, including his
being named the Young Physician of the Year and Central Maine's Physician of the Year, and he
served on numerous state and hospital boards. Dr. Glover will be long remembered and sadly
missed by his wife of 30 years, Michelle, and by his family and friends;

WHEREAS, the Legislature has learned with deep regret of the death of:
(1-15) Miles Edward Francis, of Indian Island, an elder of the Penobscot Nation. Mr. Francis,
who was part of a family legacy of service over several generations, spent his life working in his
community, including serving on the Tribal Council for 26 years. He owned his own
construction business, operated Penobscot Super Bingo and participated in the development of
Foxwoods Casino. He was also President of Penobscot Indian Nation Enterprises, which created
a number of government contracting organizations that trained and employed tribal members.
Mr. Francis's efforts brought hope to those struggling to find employment, and he was a role
model who encouraged members of the community to strive for success. Mr. Francis will be
long remembered and sadly missed by his wife of 32 years, Zoraida, and by his family, his
friends, his community and all those whose lives he touched;

JOINT RESOLUTION MAKING APPLICATION TO THE CONGRESS OF THE
UNITED STATES CALLING A CONSTITUTIONAL CONVENTION UNDER
ARTICLE V OF THE UNITED STATES CONSTITUTION LIMITED TO
PROPOSING AN AMENDMENT TO THE UNITED STATES CONSTITUTION
TO REQUIRE A BALANCED FEDERAL BUDGET
WHEREAS, under the United States Constitution, Article V, the Congress of the
United States, whenever two-thirds of both Houses shall deem it necessary, shall propose
amendments to the United States Constitution, or, on the application of the legislatures of
two-thirds of the several states, shall call a convention for proposing amendments that, in
either case, shall be valid to all intents and purposes, as part of the United States
Constitution, when ratified by the legislatures of three-fourths of the several states, or by
conventions in three-fourths thereof, as the one or the other mode of ratification may be
proposed by the Congress; and
WHEREAS, with each passing year, this nation becomes more deeply in debt as
its expenditures grossly and repeatedly exceed available revenues, so that the public debt
now exceeds hundreds of billions of dollars; and
WHEREAS, the annual federal budget is a continual demonstration of an
unwillingness or inability of both the legislative and executive branches of the Federal
Government to curtail spending to conform to available revenues; and
WHEREAS, unified budgets do not reflect actual spending because of the
exclusion of special outlays that are neither included in the budget nor subject to the legal
public debt limit; and
WHEREAS, knowledgeable planning, fiscal prudence and plain good sense
require that the budget reflect all federal spending and be in balance; and
WHEREAS, believing that fiscal irresponsibility at the federal level, with the
inflation that results from this policy, is the greatest threat that faces our nation, we firmly
believe that constitutional restraint is necessary to bring about the fiscal discipline needed
to restore financial responsibility; and
WHEREAS, we believe action on amendments to the United States Constitution
concerning federal expenditures to be vital; now, therefore, be it

RESOLVED: That the Legislature of Maine respectfully applies to the Congress
of the United States, under the provisions of Article V of the United States Constitution,
for the calling of a convention of the states limited to proposing an amendment to the
United States Constitution requiring that, in the absence of a national emergency, the
total of all federal outlays made by the Congress of the United States for any fiscal year
may not exceed the total of all estimated federal revenues for that fiscal year, together
with any related and appropriate fiscal restraints; and be it further
RESOLVED: That this application is to be considered as covering the same
subject matter as the presently outstanding balanced budget applications from other
states, including but not limited to previously adopted applications from Alabama,
Alaska, Arkansas, Colorado, Delaware, Florida, Georgia, Indiana, Iowa, Kansas,
Louisiana, Maryland, Michigan, Mississippi, Missouri, Nebraska, Ohio, Nevada, New
Hampshire, New Mexico, North Carolina, North Dakota, Oklahoma, Pennsylvania, South
Dakota, Tennessee, Texas, Utah and West Virginia; and this application must be
aggregated with same for the purpose of attaining the two-thirds of states necessary to
require the calling of a convention for proposing amendments, but may not be aggregated
with any applications on any other subject; and be it further
RESOLVED: That this application constitutes a continuing application in
accordance with Article V of the United States Constitution until the legislatures of at
least two-thirds of the several states have made applications on the same subject. It
supersedes all previous applications by this Legislature on the same subject; and be it
further
RESOLVED: That suitable copies of this resolution, duly authenticated by the
Secretary of State, be transmitted to the Secretary of the Senate and presiding officers of
both houses of the legislatures of each of the several states in the nation, the Speaker and
Clerk of the United States House of Representatives, the President and Secretary of the
United States Senate and each member of the Maine Congressional Delegation.

Pursuant to State Government Evaluation Act (GEA), Title 3 of the Maine Revised Statutes,
chapter 35, we are pleased to submit the findings of the Joint Standing Committee on
Environment and Natural Resources resulting from the review and evaluation of the Board of
Environmental Protection under the GEA.
As a result of our review, although the Committee found that the Board of Environmental
Protection is operating within its statutory authority, the Committee has voted to report out
legislation pursuant to 3 MRSA §955(4) in order to consider implementation of the following
statutory changes relating to the authority and administration of the Board:
1. Amend 38 MRSA §341-D(4)(D) to clarify that participation of the Public Utilities
Commission (PUC) in appeals to the Board of license decisions relating to expedited wind
energy development, offshore wind energy demonstration projects or tidal demonstration
projects is optional and at the PUC Chair’s discretion; and
2. Amend 38 MRSA §341-C to clarify that a member of the Board shall continue to serve
until that member has been reappointed or a successor has been appointed.
It is our Committee’s intent that this legislation be referred back to Committee for a public
hearing, work session(s) and a Committee vote before it is considered by the full Legislature.

Pursuant to State Government Evaluation Act (GEA), Title 3 of the Maine Revised Statutes, chapter 35,
we are pleased to submit the findings of the Joint Standing Committee on Environment and Natural
Resources resulting from the review and evaluation of the Department of Environmental Protection under
the GEA.
As a result of our review, although the Committee found that the Department of Environmental Protection
is operating within its statutory authority, the Committee has voted to report out legislation pursuant to 3
MRSA §955(4) in order to consider implementation of the following statutory changes relating to the
administration and efficiency of the Department:
1. Amend 38 MRSA §349(2-A) to remove a limitation that prohibits a repeat violator of the same
environmental law to take advantage of a supplemental environmental project (SEP) and remove
language limiting a violator to offsetting no more than 80% of a monetary penalty by conducting a
SEP (i.e., allow offset of up to 100% of a penalty);
2. Amend 38 MRSA §589(3) to clarify two exemptions from the requirement that air
contamination sources maintain continuous emission monitoring systems to mitigate a conflict
between the current statutory provisions on continuous emission monitoring and existing applicable
federal regulations; and
3. Amend 38 MRSA §2124-A to provide that the solid waste generation and disposal capacity
report the Department must submit annually to the ENR Committee must be submitted only
biennially.
It is our Committee’s intent that this legislation be referred back to Committee for a public hearing, work
session(s) and a Committee vote before it is considered by the full Legislature.

Rule 108. Annual Harassment Training.
Each member must attend in-person training on harassment at the beginning of each regular
session. The Presiding Officers must arrange sufficient opportunities for each member to attend
this in-person training on harassment. Each member must sign an affidavit stating that the
member has attended the in-person training on harassment and must file that form with the office
of the Executive Director of the Legislative Council. The Executive Director of the Legislative
Council shall provide a report to the Presiding Officers listing the members who have not
attended the required training and submitted the affidavit.
