O'Melveny & Myers Succeeds in Landmark Chapter 15 Case

Ms. Uhland recently served as lead counsel in what legal commentators have described as a landmark case in the U.S. bankruptcy system. Noting that the decision provides a roadmap for foreign companies navigating the U.S. bankruptcy courts, legal experts have stated that the case resituates the United States to serve a crucial role in international restructurings.
OMelveny & Myers represented Suntech Power Holdings, a distressed firm and former leading international producer of solar cells. The firm sought recognition for its bankruptcy case in the Cayman Islands as the foreign main proceeding in its New York bankruptcy process. Former solar panel producer Solyndra objected to this motion, seeking a change of venue on the grounds that the Cayman Islands did not serve as Suntechs primary center of interests. Solyndra had previously sued Suntech in the Northern District of California for antitrust violations and sought to transfer to a venue within that jurisdiction. The judges opinion set a significant precedent in deciding the first disputed chapter 15 bankruptcy case in the Southern District of New York, granting recognition to Suntechs Cayman Islands case as the foreign main proceeding and denying Solyndras request for a change of venue.
