ORDINANCE RELATING TO HUMAN RIGHTS, AMENDING CHAPTER 25
OF THE OKLAHOMA CITY MUNICIPAL CODE, 2010, SECTIONS 25-39,DISCRIMINATION IN HOUSING, AND 25-43, COMPLAINTS GENERALLY,
AND REPEALING SECTIONS 25-40, DISCRIMINATION IN CITY
EMPLOYMENT, 25-44, INVESTIGATION AND CONCILIATION OF
COMPLAINTS, AND 25-46, VIOLATIONS AND PENALTY
ORDINANCE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OKLAHOMA CITY:
SECTION 1. That Sections 25-39 and 25-43 of Article III of Chapter 25 of the
Oklahoma City Municipal Code, 2010, are hereby amended as follows:

ARTICLE III. DISCRIMINATION

§ 25-39. Discrimination in housing.
(a) No financial institution shall discriminate in the granting of any financial assistance
sought by an applicant for the acquisition or construction of any housing unit because ofage, familial status, disability, race, color, sex, sexual orientation, gender identity,
religion, creed, ancestry or national origin.
(b) No person, real estate broker, salesman or agent shall do any of the following:
(1) refuse to sell, lease, rent, assign or otherwise transfer the title or other interest inany housing, or real property upon which residential housing is to be constructed
or located, to any person or discriminate in the terms or conditions of the sale,
rental or leasing of any residential housing unit or in the provision of services orfacilities because of age, familial status, disability, race, color, religion, sex,
sexual orientation, gender identity, creed, ancestry or national origin.

(2) refuse to negotiate with any person for the sale, rental or leasing of any residential
property or represent that the property is not available for inspection, sale, rental
or lease when in fact it is so available because of the person's age, familial status,disability, race, religion, sex, sexual orientation, gender identity, color, creed,
ancestry or national origin.
(3) solicit or induce, or attempt to solicit or induce, any person owning any interest in
any residential housing to sell, rent or lease or not to sell, rent or lease such
housing to any person on the ground of loss of value due to the present or prospective entry into the neighborhood of a person of another age, familial
status, disability, race, color, religion, sex, sexual orientation, gender identity,
creed, ancestry or national origin, either by direct solicitation or inducement or by
the purchase of other property in the neighborhood for the purpose of suchinducement or distribute or cause to be distributed material or statements designed
to induce a residential property owner to sell or lease his property due to such
change in the neighborhood.
(4) file a complaint alleging a violation of this Article with knowledge that the
complaint is false in any material respect or file the complaint for the sole purposeof harassment.
(c) The exemptions to discrimination in housing set forth in 25 O.S. § 1453, as now
codified or as may hereafter be amended by the State Legislature, are adopted byreference into this section as if set forth fully herein and, to the extent applicable, such
exemptions shall constitute exemptions to the prohibitions set forth in subsections (a)
and (b) of this section.

§ 25-43. Complaints generally.
Complaining parties may submit a complaint on a Discrimination Complaint Form,
containing alleged violations of this article to the Municipal Counselor or to the CityManager, who will refer the complaint to the Municipal Counselor must give written notice
to the Municipal Counselor of alleged violations of this article within 30 days after a
violation is alleged to have occurred and failure to give such notice shall be considered awaiver of the application of this article. Information charging the violation of this article
may be filed in the Municipal Court within but not more than 90 days after the violation is
alleged to have occurred. Such complaints should be submitted within 90 days after theviolation is alleged to have occurred. The Municipal Counselor will notify complaining
parties whether or not any information has been filed in Municipal Court relative to the
alleged discrimination refer such complaints to the U.S. Department of Housing and UrbanDevelopment or the Office of Civil Rights for the Attorney General of the State of
Oklahoma, or to such other federal or state administrative agency that may have jurisdiction
over the subject matter of the complaint.

SECTION 2. That Sections 25-40, 25-44 and 25-46 of Article III of Chapter 25 of the
Oklahoma City Municipal Code, 2010, are hereby repealed.
