A contractor is a person, or an organisation, that provides a service for a fee but is not a direct employee of Nazareth College. Nazareth College is likely to engage specialist contractors from time to time to perform certain kinds of work such as maintenance, repair, cleaning and gardening.

Nazareth College understands that it has the same duty of care towards contractors as it does for its employees. To ensure the contractors the College engages work safely when on site and do not introduce any unmanaged risks when undertaking the work, plans must be put in place to manage contractor activities. This includes conducting pre-commencement Contractor Induction, advising contractors of specific site hazards, sighting Safe Work Procedures and acting on identified non-compliance of contractors to Nazareth College procedures.

This section provides procedures and forms to assist with managing the risk of activities undertaken by contractors at Nazareth College.

1. Introduction

Contractors perform various types of work for Nazareth College, some of this work is potentially

hazardous and so clear interaction with Contractors are their staff about the way the College

manages work, to control health and safety risks are very important.

2. Purpose

The purpose of this procedure is to ensure that there are appropriate Occupational Health and

Safety Management Systems in place to control work carried out by Contractors to Nazareth College.

This document provides the tools to assist Nazareth College staff in the selection and ongoing

management and supervision of contractors engaged by the College. This will assist in ensuring that

all work undertaken by contractors complies with OHS legislative obligations and that all staff,

students and visitors are properly controlled and protected from harm.

In general terms, a good contractor control programme consists of four main elements, these being:

ensuring contractors have a good record, an adequate health and safety system and insurance;

ensuring the contractor is aware of the requirements of Nazareth College’s OHS Management System, that the contractor must comply with whilst on the school premises;

ensuring all of the contractor’s supervisory staff and employees undergo a safety induction, which includes a briefing in Nazareth College’s OHS Management System;

ensuring the contractor’s tools and equipment are safe, and reviewing the contractor’s safe work methods prior to commencement of work on our premises;

regular safety and housekeeping inspections of the contractor’s operations to ensure compliance with Nazareth College’s OHS Management System.

3. Scope

This procedure outlines the process in managing all types of contracts, large and small, ensuring that

appropriate duties of care are in place to protect the contractors as well as staff, students and

visitors to Nazareth College from potential risks.

4. Definitions

A Contractor is a provider of a contracted service, where a person/company is engaged to perform

work for Nazareth College, but is not a direct employee of the College, nor is operating under a

contract of direct employment or training. The organisation or person contracted to provide works,

goods or services following a tendering process.

4.1 Types of Contractors

4.1.1 Major Contractor

A Major Contractor is a company contracted to provide a service, usually but not limited to

demolition, design and construction of new facilities or significant refurbishment and fit out of

existing facilities. Such works will usually involve many phases, possibly requiring traffic

management plans, connections to utilities and management of essential services, and the fencing

off of parts of the campus.

4.1.2 Regular Service Contractors

A Regular Service Contractor is a person or company contracted on a long-term basis to provide a

service (e.g. electrician, plumber). These contractors may be required to work with limited

supervision and therefore must have, and be required to take responsibility for, their own safe

system of work. Service standards and protocols in relation to entry into the premises, use of a

common pool of people, equipment storage etc needs to be agreed as appropriate to the contract.

Regular Service Contractors are only permitted in areas of the premises in which they are contracted

to work, unless authorised by Nazareth College.

4.1.3 Accompanied Minor Contractor

An Accompanied Minor Contractor is a person or company who has been requested to attend the

premises to carry out a task that is not part of a regular or routine service, and is not one for which

there is a predictable future need. These contractors are typically engaged for their specialist

knowledge or skills and possibly because they provide special (diagnostic or analytical) tools or

equipment. This includes trades people other than regular service contractors (i.e.

delivery/couriers) to do jobs that typically take no more than a couple of hours. Relevant experience

and recognised competencies (e.g. licenses) must be checked prior to work commencing. These

contractors are to:

receive a brief verbal induction that reflects the hazards of the immediate work area that they will be working in, and whether or not they will be accompanied throughout the contract.

be given first aid contact details and emergency evacuation procedures.

be given enough information and direction as to what they can do and the boundaries of the site they are able to access, if not fully accompanied throughout the contract.

be given means to contact/access the Property Manager at any time.

be checked on at intervals of not more than 30 minutes at a time.

4.1.4 Additional Office Labour

Persons employed as temporary staff to assist during times of heavy workload, or absence of

administration staff, are termed Additional Office Labour. Typically, these people are on site for no

more than a day and will not work alone (i.e. out of sight/hearing range). Therefore, they are only

required to have a brief verbal induction, which covers hazards for their particular tasks, ergonomic

set up, first aid and emergency procedures.

Supervision and task training will be as for a new employee on their first day.

4.1.5 Emergency Teachers

Emergency teaching staff will be briefed on First Aid and Emergency Evacuation Procedures.

4.1.6. Emergency Contractor

An emergency contractor is a person or company that is hired in the event of an emergency when no

approved/previously accepted contractor is available, and the urgency precludes detailed planning

and checking.

Nazareth College’s Property Manager is required to work closely with emergency contractors in

planning and managing the work activity, providing supervision and remaining available for rapid

decision making.

The urgency of the task is not to override OHS Management Systems requirements. The emergency

contractor is to act responsibly and keep the Property Manager informed of work planning and the

potential OHS requirements of the work. The contractor is to be advised initially, and reminded,

that they will be bound to take notice of directions and work with Nazareth College’s Property

Manager.

6. Responsibilities

6.1 The Principal is responsible for:

Ensuring that this procedure is adopted and followed throughout the college;

6.2 The College Property Manager is responsible for:

Ensuring that contractors are made aware of their health and safety responsibilities in meeting their contractual obligations while on site;

In order to achieve this, the Property Manager will ensure the following occurs:

Include the main OHS requirements/standards to be met in all tender and contract documents;

Depending on the size and nature of the contract evaluate the health and safety management systems policy, procedures and job safety analysis;

Induct contractors and issue all relevant work permits and site safety rules;

6.3 Consultants must also ensure that the details of this procedure are followed.

6.4 Nazareth College Staff working with Consultants and their employees who are onsite regularly

are responsible for ongoing observation of contractor activities with a view to identifying hazards

and reporting variances from the Contractors OHS Plan.

6.5 The Contractor is responsible for ensuring that all Nazareth College’s and legislative

requirements are met and that permits to work are obtained (where required) and signed.

6.6 The Contractor’s representative will:

establish contact with Nazareth College’s Property Manager upon initial arrival at the site;

prepare and discuss a Job Safety Plan (Job Safety Plan CM Forms 4 and 5 );

maintain regular (daily) contact with the Property Manager;

ensure all contractor employees are aware of Nazareth College’s safety rules and regulations by way of an induction program; details of which shall be recorded on the Contractor Induction

Form, ();

ensure all incidents/accidents are reported to the Property Manager and that all serious accidents are investigated using Nazareth College’s Incident Report Form (CM Form 6).

conduct daily safety and housekeeping inspections of the contractor’s area of operations;

induct all personnel working on the site;

provide specific Safe Work Practices, Personal Protective Clothing and Equipment and an understanding of the risk assessment and control measures on the Site, including Emergency and First Aid arrangements.

7. Procedure

7.1 Prequalification Selection of Contractors

In selecting a contractor to work on site, Nazareth College must ensure the contractor is suitable,

based on previous history and the following criteria:

Their insurance is suitable and current;

They follow safe systems of work and use safe work practices;

Their plant and equipment is maintained to ensure it can be operated safely;

Their employees are competent, trained and properly qualified to work safely;

All licenses are issued and updated;

Emergency contact numbers are updated and accessible;

Proven good safety performance history; and

They complete the required check sheets and supply confirmation of their insurance status.

To achieve the above, Nazareth College needs to ask potential contractors to fill out a Contractor

Pre-qualification Checklist (CM Form 02).

7.2 Contract Specification

The development of contract documentation is an important stage for specifying health and safety

requirement to contractors tendering for works. Contractor OHS requirements and responsibilities

must be clearly and unambiguously specified in tender documents.

When including OHS Clauses in contracts and addressing the scope of monitoring and supervision,

the Level of Risk, Work Complexity, and Duration need to be considered.

Significant hazards to the public

In all cases a standard tender document shall contain OHS Standard clauses as shown in OHS Clauses

for Contracts CM Form 1. Each contract needs to be examined individually to determine the level

and types of risks and reference made to the further specific OHS clauses dealing with particular

risks.

7.3 Project OHS Plan

Contractors engaged by Nazareth College shall be required to complete a specific Project OHS Plan

with hazards identified, risks assessed and control measures prepared prior to commencing any

works.

Contractors are required to identify specific OHS hazards associated with the contract works and the

methods they will adopt to adequately control OHS risks

7.4 Nazareth College Assessment of Contractors OHS Plan

Nazareth College Property Manager shall ensure that the contractor:

completes the Nazareth College OHS Contractor’s Management System questionnaire;

has a good understanding of the hazards and risks associated with their activities;

have established systems and procedures for managing those risks;

holds current trades license(s) and/or qualifications (if required);

has a history of performing work on site safely;

holds Registers of Plant and maintains plant and equipment to an appropriate standard;

requires sub-contractors to prepare Job Safety Analysis within their overall OHS Project Plan;

has written Safe Work Practice documentation.

The contractor shall not be permitted to commence work until the OHS Project Plan and / or Job

Safety Analysis has been reviewed and accepted by Nazareth College.

When accepted by Nazareth College both parties will sign off on the plan

7.5 Induction onto Nazareth College Property

The Nazareth College Property Manager shall induct key contractor personnel. The extent of

induction shall be determined for each contract and may include:

an outline of the Nazareth College OHS program, including relevant policies and procedures and features of the specific site that may have OHS implications.

7.6 Inspections

Nazareth College shall undertake periodic inspections of the workplace as a part of its monitoring of

the Contractor’s OHS Plan. The first such inspection should occur within 2 months of the start of the

contract and thereafter at a frequency no greater than 6 months. Inspections should be more

frequent when site activities or contractor performance indicates a greater need.

7.7 Reporting of Accidents / Incidents

All hazards and incidents resulting in injury to any person or property damage must be immediately reported to the Property Manager using the Incident Report Form (CM Form 6), within 24 hours of the hazard being observed and/or incident occurring

7.8 Contract Management and Supervision

Regular Site Meetings between Contractors and Nazareth College Property Manager

shall be undertaken to verify and ensure:

compliance with Nazareth College OHS policies, procedures and contract requirements;

conformance with the Project OHS plans;

compliance with OHS legislation, regulations, standards and Codes of Practice;

The extent of Nazareth College action and involvement will depend on a number of factors

associated with the works including:

level of hazards/risks;

complexity of the tasks performed;

level of Contractors interaction with other parties;

duration of contract;

introduction of new plant, equipment and or systems of work;

Nazareth College shall determine the requirements for each contract and ensure appropriate

monitoring of contractors’ safety performance at Site Meetings by:

ensuring OHS is a standing Agenda Item

undertaking workplace inspections; (See Inspections CM Form 10)

reviewing Contractors OHS Performance Reports and records;

reviewing incident and corrective action reports;

7.9 Non-conformances

Any contractor found not to be working in accordance with their Project Safety Plan or in

contravention of Victorian legislation shall be notified immediately of the non-conformance. Any

significant breach of the contract requirements of where significant injury may result from activities

undertaken by the contractor shall require an immediate suspension of work until the issue is

resolved.

7.10. Approved Contractors List

For major and minor projects, contractors who have been previously approved can be placed on a

list that allows selection of contractors on an as-needs basis (Register of Approved Contractors CM

Form 03). This eliminates the need for interviews for each minor project.

8. Insurance

All non-emergency contractors engaged by are to provide evidence of insurance coverage through a

Certificate of Currency, which includes coverage in the following areas:

Workers’ Compensation;

Public Liability;

Motor Vehicle Third Party Property Damage, and

Professional Indemnity Insurance, where applicable.

REQUIRED INFORMATION, PROCEDURES AND CONDUCT FOR

CONTRACTORS WORKING ON SITE AT NAZARETH COLLEGE All contractors working at Nazareth College must observe the following conduct

requirements and procedures. As a school with adolescents, it is important that all workers

model appropriate behaviours to the students.

As such the following requirements are in place:

All Contractors must sign in on arrival at the General Office, receive a Visitors Badge,

and must sign out on departure from the General Office.

No smoking on the premises – as a government site, smoking is banned from this

workplace.

No swearing, wolf whistles or use of inappropriate language

No consumption of alcohol on the workplace site.

Music if played, must be at a level that does not interfere with the learning of the

students in the classrooms.

First Aid facilities are available in the school in the Main Building. Please report to the

General Office if you require First Aid assistance.

All hazards should be reported to the Property Manager and recorded in the Hazards

Register located in the main office. All incidents should be reported to the Property Manager

and recorded in the Incidents Register located in the main office.

There is a register in the General Office of the Hazardous Substances and Dangerous goods

stored on the site. Prior to commencing work, please check with the General Office as to

whether you will encounter these during your work.

A copy of the Emergency procedures and Traffic Management Plan is provided with this

form. Please ensure you are familiar with these.

Should your work require you to work at a height of above two metres, in an enclosed space,

or require welding or other hot work activities, you will need to get a Permit to Work from the

Property Manager, prior to commencing work.

Standard OHS Contract Clauses

1.1 General Occupational Health and Safety Requirements

Nazareth College is obliged to provide and maintain so far as is practicable a working environment for its employees and members of the public that is safe and without risk to health. As a condition of this contract Nazareth College requires that any Contractors or subcontractors that may be engaged to perform a service on its behalf will at all times identify and exercise all necessary precautions for the health and safety of all persons including Contractor employees, Nazareth College employees and members of the public who may be effected by this service. The Contractor will inform itself of all occupational health and safety policies procedures or measures implemented or adopted by Nazareth College and or the occupiers of any premises at or within which the Contractor will perform works under this contract.

The Contractor will comply with all such policies, procedures or measures and in the event of any inconsistency will comply with such procedures or measures as they produce the highest level of health and safety.

The Contractor will forthwith comply with any and all directions by Nazareth College relating to occupational health and safety.

1.2. Legislative Compliance

The Contractor must comply with and ensure its employees subcontractors and agents comply with any Acts regulations local laws and by-laws, Codes of Practice, Australian Standards and Nazareth College OHS Policy and procedures which are in any way applicable to this contract or the performance of the services under this contract.

1.3 Tenderer OHS Management Questionnaire

Tenderers shall complete the OHS Management System Questionnaire and incorporate the completed document with their tender submission. Tenderers who do not complete the questionnaire shall be ineligible for selection. Tenderers will be required to verify their questionnaire responses by providing evidence of their OHS ability and capacity. By submission of the tender and questionnaire the Tenderer acknowledges and confirms as accurate all details contained in the questionnaire and any verifying documents.

1.4. Contractor OHS Management Systems

The OHS Management System of the Contractor must as a minimum requirement demonstrate compliance with all the duties of an employer specified in the Occupational Health and Safety Act 2004. The Contractor must when requested by Nazareth College submit a copy of their company OHS management system documentation which must as a minimum include;

a) OHS policy and objectives b) Organisation structure and Site Manager with OHS responsibilities c) Safe work practices and procedures d) OHS training and induction e) OHS auditing and inspection procedures f) OHS consultation procedures g) OHS performance monitoring 1.5 Accredited OHS Management Systems The Contractor must provide evidence of certification of their OHS management system the minimum level of certification is SafetyMAP Initial Level Achievement or equivalent established by independent audit by the Victorian Workcover Authority or other recognised certifying body. Certification must be achieved within 12 months of the commencement of this contract. If the Contractor does not maintain certification of the OHS management system as required, Nazareth College may terminate the contract.

1.6 Health and Safety Plan

Prior to commencing the works under the contract the Contractor shall submit to Nazareth College a Health and Safety Plan specific to the contract and works. The Contractor shall complete the Health and Safety Plan in conformance with requirements set out in Nazareth College Guidelines for preparing Health and Safety Plans The Health and Safety Plan shall consider and respond to the specific OHS Hazards and issues relevant to the contract works and shall document the systems and methods to be implemented for the term of the contract. The Health and Safety Plan shall be reviewed by Nazareth College and formal approval to commence the contract shall be provided subject to acceptance.

11. 1.7 Control of Workforce

The workforce shall be at all times under the control of a supervisor trained and experienced in and familiar with the requirements of this specification. The responsibilities of the Supervisor shall include but not be limited to: Coordinating of services and equipment isolations and protection Coordinate site safety and conduct inspections Supervision of site clean-up and defects rectification.

1.8 OHS Performance Reporting

The Contractor must when requested at Site Meetings by Nazareth College staff provide evidence of ongoing performance of the Contractors OHS Management System. Without limiting the requirements of this obligation the Contractor shall provide the following information on a monthly basis in the form of a Contractor OHS Performance Report Staff Inducted Number of Lost Time Injuries (LTI) Working days lost due to injury Current status of any injured personnel damaged property or environmental damage or pollution Status of implementation and outcomes of corrective actions undertaken as a result of OHS inspections and risk assessments

The OHS Performance Report shall be submitted by the Contractor using the Nazareth College Contractor Monthly OHS Performance Report Form

The Contractor shall when requested by Nazareth College provide copies of reports on OHS Incident Reports, Inspections, and particular Job Safety Analysis during the course of the contract.

12. 1.9 First Aid

The Contractor shall comply with and shall ensure that their sub-contractors comply with the provision of first aid facilities for their workforce in accordance with: 1. The relevant Industrial Award 2. The Occupational Health and Safety Code of Practice pertaining to First Aid in the Workplace.

3. First aid facilities and trained first aiders are to be maintained

1.10 Incident Notification Requirements

If the Contractor is required by regulations to notify the Victorian Workcover Authority of an accident occurring during the performance by the Contractor of works under the contract, the Contractor shall at the same time or as soon as possible in the circumstances thereafter give a copy of the notice to Nazareth College.

The Contractor must promptly notify Nazareth College of any accident, injury, property or environmental damage which occurs during the carrying out of the contract works.

All lost time incidents shall be immediately notified to Nazareth College. The Contractor must and within 3 days of any such incident provide a report giving complete details of the incident, including investigations into its causes and any recommendations or strategies for prevention in the future.

1.11 Non Compliance

If during the performance of works under the contract Nazareth College informs the contractor that it is the opinion of Nazareth College that the contractor is:

Not conducting the work in compliance with the Contractors Health and Safety Plan, health and safety management procedures, relevant legislation or OHS procedures provided by Nazareth College

Conducting the work in such a way as to endanger the health and safety of Contractors employees, and subcontractors employees, plant equipment or materials,

The Contractor shall remedy that breach of health and safety.

Nazareth College may direct the Contractor to suspend the work until such time as the Contractor satisfies Nazareth College that the work will be resumed in conformity with applicable OHS provisions.

During periods of suspension referred to above Nazareth College shall not be required to make any payment whatsoever to the Contractor.

If the Contractor fails to rectify any breach of public health and safety for which the work has been suspended, or if the Contractors performance has involved recurring breaches of health and safety, Nazareth College may terminate the work forthwith, without further obligation to the Contractor. In this event Nazareth College liability shall be limited to payment for the work performed and costs incurred by the Contractor up to the time of termination or an earlier suspension of works.

13. 1.11 Insurance

As soon as possible after the Date of Acceptance of Tender, The Contractor shall provide to Nazareth College all insurance’s for the works, including but not limited to: Evidence of currency of Public Liability Insurance in the form of an Insurance Certificate of Currency detailing the following:- 1. Public liability $10.0 Million any one occurrence. 2. The names of the Contractor and Sub-Contractors for their respective rights and interests. 3. A waiver of subrogation. 4. Cover of unregistered mobile plant and equipment. 5. Motor Vehicle third-party liability.

6. Evidence of currency of Workers Compensation Insurance in the form of a copy of certificate of registration with the Accident Compensation Commission.

7. Evidence of currency of Insurance of Works. 8. Evidence of compliance with the requirements of the Payroll Tax Act and where applicable the Construction Industry Long Service Act. The Principal, Nazareth College shall be named as insured by these insurance policies. This Public Liability policy must cover the interests of sub-contractors. The policy limit of indemnity shall be expressed to mean “per occurrence” in respect of incidents occurring during the policy period, except as regards “Products Liability” which shall be “per occurrence and in the aggregate”

Nazareth College Staff to Insert into Contracts As Required

Prevention of Falls / Work at Heights

The Contractor must conduct a risk assessment for elevated work for all persons who are either performing the work or gaining access to and from a work area where they may fall to a lower level. Unless the outcome of the risk assessment establishes an alternative safe work practice, fall protection devices should be provided for all persons exposed to a fall of 1.8 metres or greater. Ladders should only be used for works of a minor nature. Safe use of ladders should follow the appropriate standards and codes of practice and should never be used near perimeter of the building where there is a danger of persons falling to the ground. Where elevating work platforms such as cherry picker or boomlifts are used, workers should wear a safety harness.

14. Isolation of Services

It is the Contractor’s responsibility to ensure that all services have been isolated and that the work area is rendered safe. Due care is to be taken before breaching any energy conduit, either pipe or cable. The Contractor shall make full allowance for the disconnection and subsequent reinstatement of services where necessary, including mechanical, electricity and fire services.

The Contractor must provide a risk assessment and training for their staff with regard to any live electrical or data services remaining in the work area prior to commencement of works. This training should ensure that the workers have means for determining if the electrical and data cabling is energised and the importance of tagging and protecting services during the project. An A-Grade electrician is required to sign off all electrical isolations.

False alarms resulting in the call out of emergency services or security services shall be the responsibility of the contractor, and the contractor shall meet any associated costs. The Contractor shall install appropriate tagging in accordance with Australian Standards for any electrical isolation at the switchboard and other areas. The Contractor shall organise for the re-commissioning of the smoke detectors, sprinklers and fire services at the conclusion of operations in consultation with Nazareth College as required.

15. Fire Safety Plan

To evacuate all personnel in the case of fire, the Contractor shall provide an audible alarm, air horn or similar, positioned in a convenient location within earshot of the occupants of the work area. The alarm shall be used for fire alarms only. The Contractor must ensure that they provide and maintain appropriate fire control and suppressions systems for hot work undertaken at all times. A Permit system shall be established for Hot Work and fire watch shall be employed at all times during and for a period of one hour after any hot work. A fire safety and evacuation plan must be prepared and all workers inducted in the emergency procedures to be adopted by the Contractor, Portable fire extinguishers should be kept in the work areas at all times and maintained in an operable condition. The fire service panel and detection system may only be isolated on a work area basis in agreement with Nazareth College and the Fire Brigade. Access/egress routes and stairwells to be kept clear and lit and accessible at all times.

16. Warning Notices

Suitable warning signs shall be placed around the area of the works. These signs shall conform to AS1319-1983 and the Dangerous Goods (Placarding of Workplaces) Regulations 1985. The Contractor shall ensure that such signs remain secure and in good condition for the duration of the works. The signs are to be replaced at the Contractor's cost if removed or damaged before the Certificate of Practical Completion has been issued.

17. Codes and Regulations

The following Codes, Regulations and Standards shall be the minimum applicable to the work. Where a Code of Practice applies to the work, its recommendations shall be mandatory unless stated otherwise in this specification.

Disposal of Wastes

All prescribed waste materials that are to be disposed of off-site must be removed off-site by an EPA licensed transporter to an EPA approved disposal site. All pressure vessels shall be cut up prior to their removal from the site.
