Jeffrey Allen Carr Catherine Ann Furlow Casandra Marie Gibbs Limited License Agreements In the matter of occupational therapist endorsement applicant #APP-000191972, the Section requested additional information from the applicant, by which the applicant must provide proof of completion of occupational therapy doctorate program ACOTE accredited program, provide verification of licensure from another state, and proof of completion of TOEFL English proficiency examination if the applicant graduated from a Non-ACOTE accredited occupational therapy program. The Section instructed the occupational therapy assistant applicant APP-000075187, to complete AOTA CE course titled “Exploring the Occupational Therapy Practice Framework: Doman and Process, 3rd Edition Short Course”, as outlined in the applicant’s limited license agreement dated, January 29, 2018. Continuing Education Report Action: Melissa Van Allen moved that the Section approve 71 applications for contact hour approval. Mary Beth Lavey seconded the motion. The motion carried. Assistant Attorney General’s Report LaTawnda Moore, AAG had no formal report for the Section. Enforcement Report Mary Beth Lavey reported that the Enforcement Division opened seven cases and closed nine cases since the July 12, 2018, meeting. There are currently fifteen cases open. There is one consent agreements and one adjudication order being monitored. Enforcement Actions: Mary Beth Lavey recommended that the Section accept consent agreement OT FY18-009 in lieu of going to hearing. Langenek, Case Number OT-LD-18-001. The hearing was held before Hearing Officer Paul Stehura on May 15, 2018.

In accordance with Board procedures, the member who reviewed the application for this individual and made a recommendation to the Board regarding this application, shall not participate in further adjudication of the case and must abstain from further participation in the adjudication of these matters. Mary Beth Lavey recommended the application denial and identified herself. The Hearing Officer Paul Stehura served a Report and Recommendation to the Board Office on August 13, 2018. Amber L. Langenek received a copy of the Hearing Officer’s Report and Recommendation via certified mail on August 16, 2018. Ms. Langenek did not file objections to the Report and Recommendation or request to address the Board. The members did not have any questions concerning the range of possible actions available to the Board. Action: Beth Ann Ball moved that, pursuant to section 4755.031 of the Ohio Revised Code, fees be assessed against Ms. Amber L. Langenek. Melissa Van Allen seconded the motion. Mary Beth Lavey abstained from voting. The motion carried. Melissa Craddock reported that the costs required under section 4755.031 of the Ohio Revised Code covered a total of two invoices: (1) hearing officer, and (2) court reporter, which included transcripts. The total cost for the two vendors is $2,177.75. The Executive Director is hereby instructed to prepare an adjudication order to carry out the mandate of this Section of the Board and serve the order to Ms. Amber L. Langenek in the manner prescribed by law. This concludes the matter of Amber L. Langenek, Case Number OT-LD-18-001 Correspondence The Section reviewed the correspondence and provided feedback to the Correspondence Liaison. Old Business Jurisprudence Examinations The Section discussed removing questions pertaining to escrow and wall certificate display. The Section will add additional questions related to licensure reinstatement, ethics, and cultural competence. Melissa Van Allen will draft three new questions for the jurisprudence examination. New Business Frequently Asked Questions The Section discussed whether a license is required to teach in Ohio. The Section reviewed the Physical Therapy Section’s statue and rules regarding teaching physical therapy in Ohio. CE Broker CE Broker gave a presentation on their web-based continuing education management system. CE Broker’s system can be used to audit licensees and manage board courses and providers. Call to Order Beth Ann Ball, Section Chair, called the meeting to order at 9:39 a.m. The Section began the meeting by reading the vision statement. The Occupational Therapy Section is committed to proactively:


Assistant Attorney General’s Practice Pointers LaTawnda Moore, AAG, gave an overview of the process for a mock hearing. Disciplinary Guidelines The Enforcement Staff walked the Section through the disciplinary guidelines. The Section made changes where necessary. Standard Responses The Section reviewed the standard responses. The Section made revision to update current practice. The Section discussed forming a committee to review the laws and rules to regarding co-signatures. Melissa Van Allen and Mary Beth Lavey were assigned to this committee. Standard responses 10 and 11 pertain to documentation and co-signatures. The Enforcement Division recommended that the Section create a standard response for dry needling, cupping, pelvic floor, and therapeutic modality. The Section discussed the supervision frequency and reviewed rule 4755-7-04 which states that the supervising occupational therapist must provide supervision at least one time per month for all occupational therapy assistants beyond their first year of practice. Beth Ann Ball and Joanne Estes will work on the response for abandonment.

The Section discussed updating the standard response regarding productivity. The Section will review the Physical Therapy Section’s response on this topic. Open Forum Mary Beth Lavey asked the Section for clarification on what to do if someone asks a Board Member a practice question. The Section informed Mary Beth Lavey to have the individual send the question to the Board office for a formal response. Missy Craddock will forward the link to Lawriter to review the Ohio Occupational Therapy Practice Act and instructions to access SharePoint and OAKS. The Section discussed the reassignment of Liaison roles for the upcoming meeting. The Section discussed an email correspondence pertaining to scope of practice and ethics. The Section will table this item until the September 2018 meeting. Elected to join the newly reconstituted Board Leadership Advisory Panel for eLicense. Large reprogramming of OPP licensure requirements was completed 9/20/18 to take

effect on November 1. One change request is outstanding related to the ability to request the consolidation of and LO or LP to an LPO via eLicense.

Successfully ran the OT audit, but ran into some functionality difficulties when those audits were closed. Fix was put in place in October 25 release.

Renewal questions were adjusted for OPP and a 90 day renewal notice for OPP was created

In accordance with rule 4755-7-04 of the Administrative Code, it is the position of the Occupational Therapy Section that if client documentation includes any type of paper and/or electronic treatment grid, a single co-signature and date of review on the form is sufficient. Co-signature verifies that the supervisor reviewed the document and agrees with its content.

It is the position of the Section that for any hand written documentation, the supervising occupational therapist must co-sign each entry into the client medical record with their name, credential, and date.

It is the position of the Section that for any electronic documentation, the supervising occupational therapist must co-sign and reference the dates of the entries into the client medical record. If needed within an electronic document, the occupational therapist may make a separate entry, referencing the date of the note(s) that are being reviewed with documentation referencing the review, noting agreement, and/or changes needed in the intervention plan.

In reviewing the State Practice Act for OT, I found 4755‐7‐08.C15 states that "A licensee shall obtain informed consent from the client." In the area of school‐based OT, can a verbal consent be used? An example ‐ if the evaluating school psychologist spoke with the parent by phone, and parent agreed to the team evaluation by phone. But the signed form giving consent to evaluate hasn't yet been returned. Is this sufficient for our licensure to proceed with the evaluation?

OT's are taking advantage of OTA's. In a school setting, we not only carry the largest caseload than any other therapy specialty usually, we are expected to assess students and provide the info to the OT to be typed in or in some cases only co-signed. Which in my opinion is a full misrepresentation of "Collaborate with OTA". We are expected to write all IEP's write all Progress Reports and keep up with our daily treatment of 100% of the caseload and our own daily progress notes and billing. Ohio needs to crack down on OT's taking advantage of OTA's. The collaboration needs to be dropped out of the vague rules and clear defined amount of time spent on an OT's own caseload and documentation needs to be clearly defined. I have only had two OT's in my long career of 24 years being an OTA pull their fair share of the load. So tired of OT's getting paid twice as much as OTA's and making us do all the work while they sit behind a desk! STATE OF NEVADA BOARD OF OCCUPATIONAL THERAPY

The Public School systems are facing budget shortfalls and challenging economic conditions which can lead to lower staffing levels and larger case loads. When faced with providing adequate OT services; administrators may be considering alternatives measures to providing OT activities. The following questions and answers provide guidelines to the OT practitioner in school based practice.

Can a COTA attend an IEP without an OTR present and can she sign the IEP? Does she sign that she is representing OT or COTA/L?

The COTA can attend an IEP with the OTR, and sign using COTA/L. Technically a COTA can attend an IEP without the OTR, but at that point the COTA risks being out of compliance with their license in the area of treatment planning. Some school districts are beginning to document use of the IEP as the treatment plan or plan of care. The IEP meeting is a team planning meeting, where goals are developed and services are determined at the meeting. (Treatment planning). Prior to the IEP, most OT's meet with the teacher of record to discuss the teacher's proposed educational goals. Often during this discussion, the OT for-mulates a recommendation or proposal of OT intervention methods, which includes ser-vice type, duration, and location. As the IEP meeting is based on team agreement on individualized educational programming, plans are often adjusted, added or deleted. There is no reason to place the COTA in a potentially liable situation by attending the meeting without the OTR. Best practice is that the team would attend IEP's together, but it is difficult to support with large caseloads while maintaining intervention schedules.

Can a COTA do the present level of performance as long as it is not an initial evaluation or a 3 year re-evaluation?

(NAC 640A.265) NO—The COTA is always able to provide/contribute to present levels with the OTR. The OTR then takes this information, combines it with their informal as-sessment/present levels/interventions and interprets this information for placement in present levels. It is up to the OTR and teacher of record to determine what information goes into the IEP document. Best practice suggests that all team members information/present levels are blended together, rather than each discipline/team member information listed separately. The OT is responsible for linking proposed OT support to educational goals/modifications and intervention methods.

Challenges in School Based Practice

Can a COTA carry her own caseload as long as she is supervised by an OTR for 1 hour for every 40 hours worked?

(NAC 640A.265 and NAC 640A.250) NO—A COTA is one member of the team, and does not have a caseload. The OTR has the caseload and is responsible for all the students that are shared by the OTR/COTA team. The COTA can be assigned to work with any student on that OTR's caseload, but is it under the direction and treatment plan written by the OTR. Best practice caseloads provide equal access to all students on the OTR's caseload, which allows the OTR to know each student and assign the COTA as needed to cover any student on the caseload. Teams may choose to rotate weekly, biweekly, or monthly so that treatment interventions are evidenced based (data) and adjusted. COTA assignments to specific students are often based on IEP dates, referrals, re-evaluation schedules, illness or student needs as determined by the OTR. Supervision of 1.0 hour per 40.0 hours worked —This is the minimum amount of time required for supervision, and more is expected with high caseloads and involved students. Teams may choose to use two documentation methods for supervision, the required log which is more general and one that is student specific. Documentation that supports OT/COTA supervision on a specific student is up to the team, and is essential in cases which are moving toward a due process hearing. These notes might be in specific student files, not listed on the general log, so that student information is confidential. Many OTR's choose to remove the COTA from situations headed toward/in due process.

Can a COTA determine the frequency of service? (NAC 640A.265) NO—Determining intervention frequency is linked to OT related services support of educational goals and treatment planning. The COTA is expected to provide the OTR with information from their interventions. The OTR is responsible for assessment, interpretation of intervention session data, treatment plans , modification of interventions in response to evidenced based practices, and present levels. The OTR proposes intervention methods (style, frequency and location) at the IEP and the team discusses the proposal until a team agreement is reached.

Can a COTA complete the goal page of the IEP? (NAC 640A.265) NO—Working with goal information involves interpretation of informa-tion and treatment planning. The OTR meets with the teacher of record and discusses educational goals throughout the year. OT information is blended by the teacher into her data to determine progress on educational goals. IDEA requires OT as a related service to the educational program, which supports access to educational programs. Most districts have moved away from earlier models (1980-1990's) and no longer use isolated goals. OT related services support educational goals which are chosen and linked by the teacher to state curriculum standards.

Good morning; I need your assistance again. ODE has changed how we report the student’s progress on the report cards. They have developed a new form where there is a section that states “on task; yes or no” and “goal met; yes or no”. Our PTA’s have always typed the data from their sessions onto the report cards since they were the ones providing the direct services. Now that the added questions are on there, can a PTA say that the student is on task and whether the goal has been met or not? Or does the PT have to go into the report card, look at the PTA’s data to determine the answer to those two questions?

My OT would like to know the answer for their discipline also. Who can she contact at the OT/PT/AT board?

Maybe to help clarify: "Hands-on" a student is not permitted unless the parent has signed a consent for evaluation. This is significant. IDEA Section 1415 (c) contains the rules of prior written notice. It is essential that a parent is informed that their student may be touched and why and then given opportunity to grant permission or refuse.

Screens cannot involve physical contact with the patient as there is no order from the physician giving permission to see a patient. Hands‐on is not permitted as this would create a liability for the therapist and possibly the facility. Observations are okay.

Patient Screenings According to rule 4755‐27‐03 (E)(5) of the Ohio Administrative Code, when practicing within the scope of physical therapy, a physical therapist assistant may gather data about a patient to perform a screening that is non‐evaluative in nature. Screens include a review of the patient’s medical information and/or verbal contact with other health care practitioners, family, or the patient to review the patient's medical history and past functional ability but do not include physical contact with the patient. Interpretation of this information, including the need for a physical therapy evaluation, is the responsibility of the physical therapist.

Under the Ohio Physical Therapy Practice Act, physical therapists and/or physical therapist assistants may perform screens without a physician's referral and without notification of a health care professional under direct access rules. Any screen conducted by a physical therapist assistant must be cosigned by the physical therapist.

School Response In the educational setting, screening students to determine the need for a full physical therapy evaluation may include a review of the patient’s medical information and/or verbal contact with other health care practitioners, family, or the patient to review the patient's medical history, and performance of relevant skills. Interpretation of this information, including the need for a physical therapy evaluation, is the responsibility of the physical therapist and cannot be delegated to a physical therapist assistant.
