TERMS OF REFERENCE
Consultant-Facilitator for the IACVAWC 2013-2016 Strategic Planning Workshop
I. GENERAL INFORMATION
Title of Engagement: Contract of Service for the Consultant-Facilitator for the Inter-Agency Council on Violence Against Women and Their Children (IACVAWC) 2013-2016 Strategic Planning Workshop
Contract Duration: July 29 – September 30, 2013 Workshop dates: August 22-23, 2013 Target participants: thirty (30) participants Fund Source: GAA II. BACKGROUND / RATIONALE Republic Act 9262 or the Anti-Violence Against women and their Children Act was passed into law in 2004. It seeks to address the prevalence of violence against women and their children in the context of intimate relationship. Section 39 of the said law led to the creation of the Inter-Agency Council on Violence Against Women and their Children (IACVAWC). The IACVAWC or Council is composed of twelve (12) government agencies, namely the Department of Social Works and Development (DSWD), Department of Interior and Local Government (DILG), Department of Justice (DOJ), Department of Health (DOH), Philippine National Police (PNP), Department of Education (DepEd), Department of Labor and Employment (DOLE), Commission on Human Rights (CHR), Civil Service Commission (CSC), Council for the welfare of Children (CWC), National Bureau of Investigation (NBI) and Philippine Commission on Women (PCW). The DSWD and DILG serve as the Chair and Co-Chair respectively, while PCW serves as the National Secretariat. The Council is primarily responsible in ensuring effective implementation of RA 9262 and spearheads the coordination and monitoring of all VAWC initiatives of the government. Council member agencies are tasked to formulate programs and projects that will address VAWC concerns based on their respective mandates, while developing their human resources to become more gender sensitive to the needs of their clients.
In 2005, the Council formulated the IACVAWC strategic plan for 2007-2010. The strategic plan identified interventions in five (5) key strategic areas, namely: a) Public Information and Advocacy, b) Capacity-building and Service Delivery, c) Research and Policy Development, d) Sustained Linkages and Partnerships, e) Resource Generation and Mobilization.
After the plan implementation period, a study was conducted to assess the implementation of the RA 9262. The assessment showed that while various VAWC interventions such as setting up of policies; systems and infrastructure have been put in place much is still needed in terms of public information, advocacy and service delivery. Further, the study surfaced the challenges that need to be addressed in the formal legal process. Some courts were found to disregard some provisions of the Anti-VAWC Law such as in giving priority to hearing cases of VAWC, prescribed period for deciding temporary/permanent protection order (TPO/PPO), privacy and confidentiality and prohibition on mediation and amicable settlement.
Considering the results of the study and in order for the Council to strategically address the challenges and constraints on the effective implementation of the law, the IACVAWC needs to craft its Strategic Plan for the year 2013-2016 and set the overall direction of the Council for the next 3 years. To facilitate this and ensure that the strategic plan is a result of the deliberation and active and meaningful participation of each member-agency, the hiring of an expert to facilitate the strategic planning process is highly recommended
III. OBJECTIVES The Strategic Planning workshop aims to develop the Council’s Strategic Plan for 2013 to 2016 that will ensure more complementation, synchronization and coordination of programs, projects and activities (PPAs) for the effective implementation of RA 9262. Specific Objectives:
1. To provide a venue for sharing of the accomplishments and challenges among the PPA’s of each member-agency for the intended beneficiaries.
2. To analyze the current strengths, weaknesses, opportunities and threats/gaps (SWOT) of the Council;
3. To examine the past and existing Anti-VAWC programs and services and analyze these vis-à-vis the result of the assessment study conducted;
4. To re-examine the Council’s vision, mission and goals (VMO) and discuss workable strategies;
5. To identify the target milestones of the IACVAWC in the next 3 years; 6. To draw up concrete plan of actions and indicators of success to reach the
targets; 7. To identify agency joint programs and projects;
IV. EXPECTED OUTPUTS
The planning workshop is aimed at delivering the following outputs:
1. Strategic Plan for 2013-2016, containing objectives, strategies, success indicators, and a concrete plan of action, taking into consideration the result of the assessment conducted;
2. Target milestones of the IACVAWC in the next 3 years 3. SWOT analysis; 4. Documentation of the proceedings.
V. SCOPE OF WORK The Consultant is expected to perform the following:
1. Conduct consultations with member-agencies and come up with proposed Key Strategic Areas
2. Review the draft programme design for the workshop and recommend enhancement
3. Provide workshop materials/handouts 4. Facilitate the conduct of the Strategic Planning Workshop 5. Engage the services of project staff (assistant facilitator, documenter, etc.)
who will assist in the conduct of the pre-, actual and post-workshop outputs and pay their corresponding professional fees
6. Submit the packaged Strategic Plan and the process documentation. VI. MAJOR OUTPUTS The Consultant is expected to deliver as major output the packaged document of the final 2013-2016 IACVAWC Strategic Plan of Action. VII. PERIOD OF ENGAGEMENT The period of engagement shall be two (2) months and will start on July 29, 2013 upon signing of the contract between the PCW and the Consultant and end upon submission and issuance of certificate of acceptability of the final output, which should not be later than September 30, 2013.

VIII. PROFESSIONAL FEE The PCW will pay the consultant a professional fees in the amount of One Hundred Sixty One Thousand, Three Hundred Pesos (P161,300.00), subject to mandatory government tax. Payment of professional fees shall be made upon submission and acceptance of final outputs and the issuance of certificate of acceptability by the PCW and in accordance with the schedule agreed upon and stipulated in the contract of service signed by the contractor and the PCW. IX. QUALIFICATIONS
The Consultant should meet the following minimum qualifications:
§ With university degree preferably masters or doctorate level or equivalent, in
political science, public administration, development studies, etc.; § Have extensive experience in conducting/ facilitating strategic planning
workshops and expertise in focusing the process; § Is knowledgeable on group dynamics of decision making and problem
solving; § Have considerable knowledge of the provisions of the Anti-Violence Against
Women and Their Children Act of 2004 and understanding of gender-based violence, particularly violence against women and its social, cultural and political implications
§ Have considerable knowledge on rights-based and gender-responsive governance;
§ Have significant experience as an external adviser or consultant to government agencies
