Whereas Sh.Mangat Ram Clerk ( under suspension) Block Education Officer Assandh (Karnal)

was arrested for demanding and accepting a bribe of Rs. 2000/- from Sh. Ram Roop, Science

teacher for processing his application for departmental permission of acquiring higher education.

Where as an FIR No. 21 of 14-5-2008 u/s 7/13 PC Act, 1988 was registred against Sh. Mangat

Ram Clerk 0/o BEO Assandh at Police Station SVB/ Haryana Rohtak . He was tried and convicted

by the Court of Sh. Ravi Kumar Sondhi , Special Judge, Karnal vide order dated 29-9-2011, as

No. 4819-G-II-57/11919 dated 08-07-1957, if a Government Servant is convicted of charges

involving moral turpitude, he should be dismissed or removed from Government service and the

filing of the appeal did not debare the authority from inflicting a suitable punishment as provided in

Provis (b) to Sub Rules (2) of Rule 7 of the Haryana Civil Services (Punishment & Appeal) Rules,

1987. It is clear from the above instruction, that merely suspension of sentence by the appellate

Court does not debar the competent authority to take deceision against an employee on the basis of

conduct, which lead to his conviction.Taking an overall view of the matter and judgment dated 22-09-2011 passed by Special Judge,

Karnal, the undersigned fully satisfied that the conduct of Sh. Mangat Ram, which led to his

conviction for offence under section 7 & 13 (1) (d) of the Prevention of Corruption Act (which also

involves moral turpitude) is such as to render his further retention in public service

undesirable. So in pursuance of proviso(a) to article 311(2) of Constitution of India read with

Proviso (b) to Sub Rules (2) of Rule(7) of the Haryana Civil Services (Punishment & Appeal )

Rules 1987, it would be appropriate that Sh, Mangat Ram, Clerk, Block Education Officer Assandh

(Karnal) is dismissed from service with immediate effect in the light of facts as enunciated above.
