Chairman Widener welcomed everyone to the meeting.

3. INVOCATION AND PLEDGE OF ALLEGIANCE

The invocation was given by Commissioner Dando and Chairman Widener led the pledge of allegiance.

On a motion by Commissioner Hutton, seconded by Commissioner Dando the agenda was approved. The vote was unanimous (7-0).

1. Minutes of June 22,2020 Regular Meeting

On a motion by Commissioner Dando, seconded by Commissioner Edins the minutes of the June 22, 2020 regular meeting were approved. The vote was (5-0-1), Commissioner Gibson abstained because he was not at the June 22, 2020 meeting.

6. PUBLIC HEARINGS

1. Jennifer Blankenship, on behalf Tanoex, LLC, Property Tax Map #146-A-46: Request for a Special Exception Permit for a small business in general, more specifically: classroom / facilities for wilderness medical classes, event venue for social gatherings, including receptions, reunions, weddings, and / or company meetings, community meetings, including fall festival, men / women retreats on approximately 2.87 acres of property located at 21405 Parks Mill Road, Abingdon, Virginia, 24211 in the A-2 (Agricultural, General) zoning district, Madison Magisterial District, Madison (C-11) Election District.

Stephen Richardson summarized the request. He stated that this property has been used as a mill for over 100 years. Recently the property was also used as a restaurant which also held events. Jennifer Blankenship wants to use the former store/restaurant for class rooms and social, community and business events. She and her husband are also restoring the mill. All adjoining properties are in the A-2 zoning district. Surrounding properties have residential and agricultural uses.

Stephen "Brock" Blankenship noted that he and his wife had observed the property for some time and decided to buy the property to preserve it. He discussed that he taught wilderness medical classes and would like to use the former restaurant for those classes. He said that friends had suggested the property also be used for events. Commissioner Rehfuss suggested Dr. & Mrs. Blankenship consider seeking historic grants. Chairman Widener opened the public hearing. No one spoke in support or opposition to the application. Chairman Widener closed the public hearing. On a motion by Commissioner Edins, seconded by Commissioner Gibson it was resolved to recommend this application be approved. The vote was unanimous (7-0).

2. Damascus Equipment LLC, on behalf of Dharma Pharmaceuticals, llc, Property Tax Map #107-11-23: Request for a Special Exception Permit for retail sales produced and associated with a pharmaceutical processor on approximately 8.3 acres of property located at 26864 Watauga Road, Abingdon, Virginia, 24210, near the intersection of U. S. Route 11 (Lee Highway) and State Route 677 (Watauga Road) in the M-2 (Industrial, General) zoning district, Madison Magisterial District, Monroe (D-11) Election District.

Stephen Richardson summarized the application. He discussed that this property has been used for heavy manufacturing for many years. Damascus Pneumatics and Wolf Hills Fabricators have manufactured underground mining carts at this location. Dharma Pharmaceuticals is proposing to move their operation from Bristol, VA, at the former Bristol Mall to this location. Dharma Pharmaceuticals growing, processing, manufacturing and shipping is permitted by right at this location. The application for the Special Exception Permit is required for their products to be sold retail at this location. Dharma Pharmaceuticals is regulated by the Virginia Board of Pharmacy. Part of the requirements of their licensure is that they dispense their products to individuals that have medical need for them. Mr. Richardson explained that this facility will not be open or accessible be the public. Only individuals that have been screened and pre-approved will be able to have access to these services. He noted that the adjoining properties and the properties directly across the road are zoned A-1 and A-2. The surrounding area has residential and agricultural uses.

Jack Page Chief Operating Officer & Michael Johnson, Pharmacist addressed the Planning Commission on behalf of Dharma Pharmaceuticals. Chairman Widener asked if the inspections by the Virginia Board of Pharmacy are different that the inspections for a retail pharmacy. Mr. Johnson replied that the security requirements are much higher. He stated that any location the product could be has to be monitored by camera 24 hours a day, seven days a week. They have 2 layers of motion sensors. Mr. Page said that a typical pharmacy inspection last 2-3 hours in one day, an inspection at this facility is scheduled over a 3 day period. The typical inspection report for a retail pharmacy is 20 - 30 pages, the inspection report for this facility is over 80 pages. Commissioner Hutton asked about the expected traffic volume for this location. Mr. Page replied that he expected 75 to 150 people a day. He pointed out that off-site locations will be opened in the district so that all of the patients will not be coming to this location. Commissioner Edins asked if the building facade would be improved and if the driveway and parking lot be paved. Mr. Page replied that the driveway and parking lot would be paved, and that the side facing Watauga Road would be dressed up. Commissioner Rehfuss asked if any outside fencing is proposed. Mr. Page answered no. Commissioner Dando asked about registered patients and registered agents. Mr. Page and Mr. Johnson replied that to be a patient you have to be recommended by a medical provider. The recommendation goes to the Board of Pharmacy and they issue the patient a card. To gain access a patient must provide the certificate from the medical provider, the card from the Pharmacy Board and a photo ID. In cases where the patient is not capable of coming to the facility, the patient can appoint someone to be an agent to get the product. An agent can only register for two people. Commissioner Rehfuss asked if security was present in the building. Mr. Page responded that they were, and that the security team is made of former DEA and ATF agents.

Chairman Widener asked if they anticipated a demand in customers after the facility is opened. Mr. Page said that they believed it would increase. Chairman Widener opened the public hearing. No one spoke in support of the application. Freda Blevins spoke in opposition. Mrs. Blevins talked about her concerns for safety of the neighborhood, especially small children, including her grandchildren. She discussed the level of the criminal element in our region. Mark and Amber Wilkinson spoke in opposition. Mr. and Mrs. Wilkinson said that security was their number one concern. They stated that they have small children that play outside and it sometimes takes a while for the Sheriff's Office to respond. Chairman Widener closed the public hearing. Commissioner Gibson asked Mr. Page if security was on site 24 hours a day seven days a week. Mr. Page responded that they did not have security there 24 hours a day seven days a week currently. Mr. Page stated that there had been no attempts by anyone to get into their current facility. Shanna Berry, Chief Executive officer stated that they had coordinated and worked with the police force in Bristol and would do the same thing in Washington County. Commissioner Dando made a motion to recommend the application be denied, Commissioner Hutton seconded the motion. The motion failed by a vote of 2-5. Commissioner Rehfuss made a motion to recommend the application be approved with the following conditions: sheilded lighting be installed, 24 hour manned security be mandated and a traffic study be performed by VDOT and an acceptable parameter be established before the use would be approved. Commissioner Gibson seconded the motion. The motion passed by a vote of 6-1.

3. Virginia Hollifield, Property Tax Map #084-8-1: Request for a Special Exception Permit for a small business in general, more specifically an office with snack bar, bathroom, and storage on approximately 2.4 acres of property located between 14629 & 15003 Branch Street, Abingdon, Virginia, 24210 in the A-2 (Agricultural, General) zoning district, Harrison Magisterial District, Harrison (A-11) Election District.

Stephen Richardson summarized the request. He stated that Mr. & Mrs. Hollifield both want an office for personal business purposes. He said that Mr. Hollifield occasionally has technicians in the office to train on equipment. He said that Mr. & Mrs. Hollifield plan to build a home on this

property at a later date. Adjoining properties are all in the A-2 zoning district and surrounding uses are residential and agricultural. David Hollifield addressed the Planning Commission. Mr. Hollifield explained that he does teach people how to use equipment and treat concrete floors. He stated Lowes, Coca Cola and UPS are some of his customers. He said that Mrs. Hollifield has 3 farms with timber that she manages. He said that there would be no traffic at this location and that this is not a retail locations.

Commissioner Smith asked if the proposed snack bar was for retail purposes. Mr. Hollifield replied that it was for personal food storage. Commissioner Refuss asked about the appearance of the building. She noted that the description was of a pole barn. Mr. Hollifield replied that he planned on the building resembling a cabin. Commissioner Rehfuss asked if it would have a rustic appearance. Mr. Hollifield answered yes, it would be very rustic. He said the building would be white pine board and batten siding. Commissioner Rehfuss asked if the trees would remain on the property. Mr. Hollifield replied that there would be a 75 feet buffer between Branch Street and the structure and the structure would not be visible from Branch Street. Chairman Widener complimented Mr. Hollifield for the thoroughness of detail and penmanship in the application. Chairman Widener opened the Public Hearing. No one spoke in support of the application. Robert Jones spoke in opposition. Mr. Jones stated that the only uses on Branch street are agricultural and residential. He said that a Special Exception Permit was issued to one business on Branch Street and this is a second request. He said that there should be zoning districts with permitted uses, but not Special Exception uses because it defeats the purpose of zoning. He said that if Special Exceptions were going to be allowed then there is no reason to have zoning. Chairman Widener closed the Public Hearing. On a motion by Commissioner Hutton, seconded by Commissioner Dando it was resolved to recommend that the application be approved with two conditions: 1) the building be constructed in a rustic fashion, and 2) that there be a maximum limit of 5 customers at the building at one time. The vote was unanimous (7-0).

Robert Jones spoke during public comment. He stated that he did not have a problem with the Hollifield's application. He stated that he felt zoning should allow and prohibit activities without allowing special exceptions.

8. GENERAL BUSINESS

A. Recommendation of Planning Commission Member to serve on the Mount Rogers

Planning District Commission.

Commissioner Gibson nominated Commissioner Dando to be recommend to the Board of Supervisors to serve on the Mount Rogers Planning District Commission. Commissioner Rehfuss seconded the nomination. The vote was unanimous (7-0) to recommend Commissioner Dando

Commissioner Smith commended the Planning Commission for conducting the meeting cordially, respectfully and professionally.

Commissioner Rehfuss also expressed her appreciation to Planning Commissioners for working together.

10. COMMISSION INFORMATION AND REMINDERS

1. Board of Supervisors Actions July 14, 2020 Meeting

Mr. Richardson reported that the Board of Supervisors approved the 2 rezoning applications at the July 14, 2020 meeting that were recommended by approval by the Planning Commissioner. The comprehensive rezoning in the Tyler district and the rezoning of the Boring Contractor property.
