Chairman’s MessageThe results from the Annual Commercial Vehicle Safety Alliance Road Check, from June 5-7 have been released. Nearly 12,000 trucks and buses were placed out-of-ser-vice. The annual blitz placed 11,897 vehicles and 2,664 drivers out-of-service. A total of 67,502 road checks were conducted over the 3 day event - 45,400 of which were Level One inspections. The top out-of-service violations for vehicles were brake systems, tires and wheels and brake adjustments. The top out-of-service violations for drivers were hours-of-service, wrong class license and false record of duty status.

FMCSA is removing the requirement for drivers with insulin treated diabetes to obtain a waiver to drive interstate. Effective November 19th Medical Examiners will be able to grant medical certificates for one year to drivers with stable insulin regiments and properly controlled insulin-treated diabetes mellitus (ITDM). Drivers with ITDM will be required to provide at least three months of blood glucose self-monitoring records to there clinician in order to obtain a one year medical certificate. If three months of records are not available a driver can receive a three months certificate to obtain a three month period of records. If a driver experiences a severe case of hypoglycemia, he or she must not drive and will be required to report the incident to their clinician ASAP. The driving prohibition lasts until the clinician determines that the episode has been ad-dressed and the driver again has a stable insulin regiment and properly controlled ITDM. Drivers diagnosed with severe non-proliferative diabetic retinopathy or proliferative dia-betic retinopathy (both conditions when diabetes affects the eye sight) are permanently disqualified from driving a commercial vehicle.

The Federal Aviation Administration Authorization Act (F4A) has been an issue for a long time. To be more specific and to clarify it, the issue is states like California enacting additional laws and regulations already governed and regulated by the federal govern-ment in regards to interstate commerce. There is an issue with additional meal and rest breaks required by States. The Pipeline and Hazardous Safety Administration (a sister agency of FMCSA) has published in the Federal Registry a notice of preemption, which states that carriers whose drivers haul hazardous materials or explosives and those who must file security plans do not have to comply with California meal and rest break laws.

The ATA now has also filed a petition with FMCSA in an effort to ensure nationwide uni-formity in regards to meal and rest breaks for commercial drivers.

As I am sure most are aware of by now Unified Carrier Registration has been delayed again this year. The UCR Board of Directors has submitted a proposal to FMCSA of a 4.5 percent reduction in fees for 2019. South Dakota IFTA license renewals will be processed without 2019 UCR fees being paid. When UCR registration becomes available there is also a new web site: www.ucr.gov. For detailed information refer to page 9 of this publication.

Driver turnover rate is almost reaching 100 percent for large fleets. At an annualized rate of 98 percent, this is the highest rate since 2015. However driver turnover rates have fallen to 72 percent for small fleets. Reports say the retention for small fleets is largely due to aggressive pay increases for the year. I believe pay is a big factor, but even more important to so many is the totally different appreciation for an individual in a small fleet. You truly do become part of a family.

FYI: Effective October 1st the IRS has increased the meal per diem by $3 for owner-operators while they are away from home and on the road.

It seems video recorders on heavy trucks are a very hot topic in recent months. The National Transpor-tation Safety Board (NTSB) has seen the way that video recorders provide a more decisive look into fatal commercial vehicle accidents and the group would like to see adoption rates increase because of the significant impact they could have. Video recorders are on the NTSB’s Most Wanted List — a series of high-priority safety changes the agency would like to see made mandatory. The group states that the information they can capture from video is critical to helping investigators take proactive steps toward prevention. But so far, video recorder adoption in the commercial vehicle industry is low, estimated to be at around 6% or about 400,000 commercial vehicles total.

A 2013 University of Michigan Transportation Research Institute study of 8,309 fatal car-truck crashes showed that 81% of the time, car drivers were at fault. Another study by the National High-way Traffic Safety Administration studied more than 10,000 fatal accidents and found that cars were responsible 91% of the time during head-on crashes, 91% of the time in opposite-direction sideswipes, 71% of rear-end crashes and 77% of same-direction sideswipes. The Federal Motor Car-rier Safety Administration looked at 6,131 fatal car-truck crashes over a three-year period in 2007, 2008 and 2009. In 2007 and 2008, cars were assigned fault in 85% of crashes and 81% in 2009.

Even when armed with these statistics, determining fault for an accident can ultimately come down to your driver’s word against that of the other driver. Video camera footage can certainly provide a great deal of clarity when it comes to an insurance claim or when a case is in the hands of a jury.

I am quite aware that this industry does not like government mandates and I am doubtful that such a mandate will come from the government. However, insurance carriers may have some influence in convincing the trucking industry that these cameras are necessary. If you were to check into such a system, you would find they are not cost prohibitive. In fact, there is a vendor in Sioux Falls that would love to have that discussion with you.

Camera based safety systems are becoming an invaluable tool for fleets to train drivers more effec-tively and can legally protect an operation or driver in the event of an accident. The NTSB claims that the use of video recording technology by heavy truck fleets could reduce fatal and injury crashes by 20%.

Jerry “Skimpy” Seaman, professional truck driver for NTA, Ltd., Huron, SD, has been selected as the October 2018 Driver of the Month by the South Dakota Safety Management Council.

Skimpy has been a professional truck driver for 47 years. He has driven over 4 million miles with only one accident in the Spring of 1969.

Skimpy has either participated in or volunteered at the South Dakota Truck Driving Championships for years. He was the South Dakota Grand Champion in 2011. He has also competed in the National Truck Driving Championships in 2011 and again in 2018.

He has earned several safety awards over the years. He was the NASTC Driver of the Year in 2010 and recently a semi finalist in the TA Petro Citizen Driver Awards. He has worked all aspects of the trucking industry. He has dedicated his life to the business.

• The reason for the delay is to allow Federal Motor Carrier Safety Administration (FMCSA) time to complete its rulemaking process on fee levels for 2019.

• Once the rulemaking is published, the UCR Board will issue a recommended enforcement date three (3) months from the start of the registration period. The proposed fees for 2019 currently under review are based on a recommendation that was submitted by UCR to the FMCSA to reduce fees for carriers at all levels by 4.5% in 2019. This follows a 9.1% reduction this year.

• Carriers will be notified when the 2019 UCR registration form and online registration is available at www.ucr.gov. Please note that this is a new site!!! See below….

UCR LAUNCHES NEW NATIONAL REGISTRATION SYSTEM - WWW.UCR.GOV

• The Unified Carrier Registration Plan (UCR) is announcing the launch of its new national registra-tion system atwww.ucr.gov. Please save to your favorite’s for future use. The old site of www.ucr.in.gov will redirect all users to the new site. The portal is now available to carriers and permit agents for the remaining 2018 UCR registrations. The online portal is an upgrade for commercial motor carriers and other businesses required to register and submit annual fees by the 2005 UCR Act. You will need the DOT # and the last 4 digits of the carriers FEIN to access the system and process the application. The system is very easy to navigate.

WHO IS SUBJECT TO UCR?

• As a general rule, all transportation operations involved in interstate commerce that are required to register with FMCSA and obtain a U.S. DOT number – whether or not they have actually registered and received a DOT number – are subject to UCR. Entities that have a DOT number are therefore presumed to be subject to UCR requirements.

• Categories of Operation Subject to UCR - The following categories of operation are subject to the fees and other rules imposed under the UCR program, provided they operate in interstate com-merce in the United States:

Motor carriers of property, both for-hire and private, whether or not they are considered exempt carriers for purposes of federal regulation;

For-hire passenger motor carriers;

Freight forwarders;

Brokers; and

Leasing companies that lease vehicles without drivers to interstate motor carriers or freight for-warders.

This encompasses carriers, freight forwarders, brokers, and leasing companies operating inter-state in the U.S., no matter where they are based, whether in a participating or nonparticipating state, in a territory of the United States, or in a foreign country.

Reasons W is Wrong – Requires Statewide Vote to Fix AND to Change Rules.

A statewide vote is required to change the South Dakota Constitution. There is no other way to change it – period. It is set up that way to make sure changes to the Constitution get a full debate and that a majority of voters agree.

“Pass it and you’re stuck with it, unless you can pass another statewide vote to change Amendment W again,” said David Owen, Chairman for No on W Committee. “Voters should be aware of the following facts.”• The Legislature cannot change the Constitution.• The Governor cannot change or veto constitutional amendments.• Even the Supreme Court cannot change the Constitution.

There are two ways to change South Dakota’s Constitution:• The Legislature can vote to put an amendment on the ballot, OR• Citizen groups can circulate petitions and, if they gather enough valid signatures (equal to 10

percent of the number of votes cast for Governor in the most recent election), the amendment is placed on the ballot.

Either way, it takes a statewide vote to make the change.

For this reason, it will take a statewide vote to fix Amendment W when any of its eight pages prove to have unintended consequences.

It will take a statewide vote to change campaign contribution limits that prove to be either too limiting or not limiting enough.

It will take a statewide vote to change details like how long legislators have to wait until they can work as lobbyists. This was doubled from 1 year to 2 years by the 2017 legislature – this change shouldn’t take a statewide vote.

It will take a statewide vote to make sure that groups of constituents can meet with elected officials and have coffee or even lunch without such meetings being classified as “illegal gifts”.

Public Vote on Rules and All Changes in Initiative Law.Even worse than having to conduct a statewide vote to fix any of Amendment W’s mistakes, the amendment itself clearly says NO LAW that “substantively changes the rules, requirements. or criteria governing the initiative or referendum process may take effect until after that law has been submitted to a vote of the electors of the state and approved by a simple majority of those voting on the question.” [Section 2, Subsection 18; #3; 3rd paragraph]

Amendment W will force every regulation or law changing the initiative process to be voted on in a statewide vote. For example, during the 2018 legislative session, Senator Nesiba (D-Sioux Falls) wanted to extend the time frame for gather-ing signatures so groups had more time to get petitions signed. Amendment W says that can’t happen without a statewide vote.

The legislature has made several changes to how petitions must publish the actual law being proposed by an initiative, changes including details such as the font size of the text. Small changes like this shouldn’t require a statewide vote.

Conflict with Amendment X. Amendment X is also on the ballot this November and, if passed, will put into the Constitution a requirement that future constitutional amendments can only be approved with 55 percent or more of the votes in a statewide election.

Amendment W on the other hand says amendments (or laws or rules) changing the initiative process can pass with a majority vote in a statewide election. Because Amendment W declares that it has control over all other provisions of the constitution, regardless of when they were approved, future amendments pertaining to the initiative process will not need 55 percent of the vote no matter how many people vote for Amendment X.

The big picture: A photographer’s joint replacement journeyChuck Taylor logged many miles in search of the perfect photograph until knee pain accompanied the click of the camera shutter.Date: September 21, 2018 by Jenny Rackl

Chuck Taylor was used to logging many miles weaving up and down the streets of Hartford, South Dakota, in search of the perfect photograph. He would travel all around town taking pho-tos of the beautiful nature he saw -– like flowers, bumblebees, butterflies and crickets.

But a couple of years ago, joint pain in his right knee started to accompany the familiar click of Chuck’s camera shutter. The pain built gradually, slowly worsening over time.

CHOOSING A NEW KNEE: Chuck adapted as well as he could, using a cane to help support his right knee, but this made it harder for him to carry photography equipment. The cane prevented him from nimbly adjusting angles or switching out lenses. Eventu-ally, Chuck could only walk about 100 feet or less before needing to stop and rest.“It wasn’t until I went to the doctor that I realized it wasn’t normal,” Chuck says.

As Chuck’s joint pain worsened, Timothy Walker, M.D., an orthopedic surgeon at Sanford Health, started him on a cycle of fluid injections meant to supplement the fluid in his knee, helping to lubricate and cushion the joint.

While the shots initially alleviated Chuck’s pain, the relief was temporary. Pain would surge back even before the six-month mark, which was how long the injections were intended to last.

“It got to the point where I could only walk about 50 feet and then had to buck up my courage to get back to the house, because there was so much pain,” Chuck says. “And I realized at that point that I really had to have something done.”

Chuck discussed options with Dr. Walker, including total joint replacement, which Chuck had done previously on his left knee in 2005.

“At first I wasn’t going to do it because I had adapted –- I was using a cane and getting along, but I decided that wasn’t good enough for me,” Chuck explains. “I’m a photographer and I wanted to be able to carry my equipment.”

RECOVERY AND THE NEW NORMAL: After his knee joint replacement procedure, Chuck began the recovery process and was walking with assistance in just around six weeks.Chuck worked with a Sanford Health outpatient physical therapist and his wife, Marjorie, to stay active. Because he showed strong progress, Chuck was recommended for the Bridging the Gap program at the Sanford Wellness Center. Bridging the Gap is a free, two-month program for joint replacement patients where they join an exercise specialist for group exercise sessions.

Chuck is an advocate for staying active during recovery, because it has helped him throughout the joint replacement process.

“You have to keep up with the exercises, because if you don’t you get stiff,” says Chuck. “I think it’s so important not to hiber-nate in the house.”

Continued exercise helps patients like Chuck find a health and fitness routine that works best for them and maintaining a new joint.

While he is still recovering, Chuck is already enjoying better mobility. Everyday tasks like accompanying his wife to the grocery store are no longer frustrating, painful ordeals.

“I can do a lot of things right here in Hartford,” Chuck says. “Because I can walk now, wherever I need to go.”
