A while back, I spoke to you about the effort to rebrand our association. I am long overdue for a follow up on how that is going. The board feels we have made strides to creating an association that has value to its members. Our education initiative “Trades in the Schools” has taken off and grown. Last year, we did two schools. This year, we already have commitments from three additional schools that have invited us to talk to their students. I feel very strongly that this is one of the most important things we are doing right now. The market for hirable trades workers is as tight as ever and we need to deepen that pool. Another initiative that the board has gotten behind is more educational opportunities for members. We have done this in the form on our Lunch and Learns. Last year, we had an informative session on Pre-liens and Mechanics Liens. We also had our local representatives attend a Lunch and Learn and give us an update on the bills affecting the building industry. Next month, we have a Lunch and Learn with a representative from DOLI on upcoming changes to workers’ comp in regards to subcontractors. Good information for all. Also, thanks to Brainerd Glass for sponsoring and thanks to all who attended the General Membership Meeting at Gull Dam Brewery. The

annual elections were held and I want to welcome Jeff Hanson from Hy-Tec Construction to the Board of Directors. We look forward to seeing as many members as possible in the upcoming months at our events.

After attending monthly meetings and social events, Dale was elected to the local board of directors as an associate member representative. He served several years as the membership chair and many years on the scholarship golf committee. In 1988, Dale was awarded the MMBA “Associate of the Year” award. In 1989,

he was awarded the “Associate of the Year” award at the state level because of his involvement in the state board of directors.

Please join us on Tuesday, October 17th for the Lunch and Learn where Ken Kimber from the MN Department of Labor and Industry will be presenting and talking about workers’ compensation insurance and how it relates to the building industry. Among the construction industry there is often confusion as to who should have this important coverage and why. Ken will be covering this topic during his presentation among other things and staff from the AgencyOne Insurance Agency in Baxter, who is sponsoring the meeting, will be on hand as well to help facilitate the meeting and answer questions about this important topic.

The FUTURE SKILLED TRADES ORIENTATION allows students to acquire not only basic construction information, but also the information needed to understand the residential and commercial construction industry. Students have the opportunity to learn about careers in the industry by interacting with local businesses.

According to the Department of Economic Development, the Construction Industry is supposed to increase by 14% by 2024. America was built by hand. The demand for hardworking, well-trained skilled tradesman will continue to grow. A career in the Residential Construction Industry can provide a great living while building America.

It is common for Minnesota’s state agencies to seek “primacy” over federal programs to customize regulatory efforts to the state’s specific needs and bring them closer to “home”. The most recent quest for state agency authority is happening at the Minnesota Department of Health (MDH) as the agency embarks on rulemaking and other administrative changes impacting its lead abatement standards and the criteria necessary to become a certified renovation firm and qualified professional.

Becoming an EPA authorized state for the lead regulations is a high priority for MDH and “primacy” is featured in both its MN Childhood Lead Poisoning Elimination Plan and its Healthy Homes Strategic Plans. If successful in adopting the Lead Renovation, Repair, and Paint (RRP) rule, MDH will relieve the federal Environmental Protection Agency – Region 5 (Chicago) of its responsibility to administer and enforce the Lead Paint and Remodeling program in the state.

As members know, the renovation of pre-1978 residential structures comes with heightened regulatory demands triggered by the Lead Poisoning Prevention Act. The Act authorized the adoption of rules to: • Set standards for the lead content of

paint, dust, drinking water and bare soil and establish methods for sampling and analyzing these components;

• Establish methods for lead hazard reduction;

• Establish licensing of persons who perform

regulated lead work; and • Establish permit requirements for training

courses.

MDH’s proposed rule has increased importance to BAM’s members as more and more of members are expanding their business models to encompass both new construction and remodeling.

On August 28, 2017 BAM joined with the Contractors Association of Minnesota (CAM – the exterior siding specialty contractors), Association of Minnesota Building Officials (AMBO), and others who also participate on the MDH lead advisory committee to provided valuable feedback to MDH on its proposal to take over the program.

While the jury is still out on whether it is a good idea for Minnesota to take over the program, there are specific items in the proposed rule that need attention and change, including:• Clarification that the rule only applies to

lead-based paint;• Clarification that the cleaning verification

only applies to the work area;• Technical adjustment to the concept

“free of lead” to reflect the science-based reality of base-line naturally occurring lead content;

• Clarification on what “on-site” training means and whether it is per-job or per-component / task and to allow for refreshers vs. comprehensive on-site training at each job site; and

• Improved compliance materials such as the MDH checklist supporting each job’s work plan and required documentation.

BAM expects that by late fall MDH will re-issue a draft rule incorporating many of the changes suggested by the industry. MDH has not completed its SONAR – the Statement of Need and Reasonableness – the document necessary to support the rule and justify the costs related to the rule and this has slowed the rule adoption process, too. Once the SONAR and the rule revision are published by the agency, there will be additional meetings, comment periods, and a potential administrative hearing on the rule.

Following the formal comment period and a review by the Office of Administrative Hearings, MDH anticipates it will self-certify the PRE/RRP program with EPA during FY2018. EPA has a six-month period following self-certification to authorize the Minnesota PRE/RRP program.
