Newsletter 2014-38 September 19, 2014 OCTOBER 1 DEADLINE FOR REGISTERING ABOVE GROUND STORAGE TANKS All Above Ground Storage Tanks (AST), whether operational or non-operational, must be registered by October 1, 2014. After that date, it is unlawful to own or operate an unregistered AST. An owner is liable for a civil penalty not to exceed $10,000 per tank per day for each AST that is knowingly not registered. The initial registration process is through the WVDEP Electronic Submission System (ESS). Owners must register for a username and password, if one has not already been obtained under other WVDEP water or air electronic permitting. The WVDEP website includes a useful “Sign Up Guidance” document: https://apps.dep.wv.gov/ast/FinalASTUserGuide.pdf The AST registrations are specific to a physical site location, operator and owner. If companies have multiple tanks at one site, one registration form may be used detailing the information for all tanks. If there are multiple tank locations, a separate registration for each location is required. As noted in the September 12 CAWV Newsletter, state environmental regulators will allow people who are not registered professional engineers to inspect the majority of aboveground storage tanks in an attempt to allow owners to meet upcoming deadlines in S.B. 373. The DEP released its “interpretive rule” concerning tank inspections and documents tank owners must submit through the new law. The rule creates a three-tiered system for tank classification that is intended to give guidance to tank owners while easing some inspection requirements ahead of December and January deadlines in the law. The rule requires professional engineers inspect tanks that pose “high risk of harm to public health”: the tanks might be located near public water sources, known in law as a zone of critical concern; contain “hazardous” materials; contain 5,000 gallons or more of anything or in some other way warrant more scrutiny in the eyes of the DEP. The interpretive is out 30 days for public comment and the DEP plans to host a public hearing to discuss the Rule at its headquarters in Charleston. The hearing will be at 6:30 p.m. Oct. 9. Chairman Josh Booth will hold the event on Wednesday, October 8, from 5:30 to 7:00 p.m. at Buffalo Wild Wings located at 2501 Mountaineer Boulevard at the Southridge Shopping Center in Charleston. The meeting will be held in the private room behind the bar area of the restaurant. This is a great time to bring new faces from your companies whom you see becoming more involved in the CAWV and the industry. Appetizers and drinks will be provided in exchange for your good ideas for this year’s social events, education training, and volunteer work. REGISTER NOW TO ATTEND CAWV’S FALL MEETING, OCTOBER 2-3 WATER FRONT PLACE HOTEL; SPECIAL PRESENTATION ON WVU CONSTRUCTION PROGRAM President Dan Flesher invites all CAWV members to attend the CAWV Fall Board Meeting which will be held October 2 and 3 at the Water Front Place Hotel in Morgantown. There will be a special guest speaker at the October 2 dinner who will talk about the hundreds of millions worth of construction going on at West Virginia University’s two campuses and hospital. Members in North Central West Virginia will receive a letter and sign-up sheet regarding the meeting and activities. All members in the Morgantown area these dates are invited and welcome to attend. 9:00 a.m. Oct. 3 CAWV Board of Directors Meeting Salon E CAWV MIDYEAR MEETING INFO OUT TO MEMBERS; HURRICANE ODILE UPDATE Many CAWV members have already registered to attend the 2015 Midyear Meeting at the Fiesta Americana Resort Grand Los Cabos, January 30 - February 4, 2015. Currently, the Program Committee is finalizing the agenda which features an excellent mix of educational programs, division meetings and social outings. The Board chose to return to Los Cabos after 95 percent of those who attended the 2011 meeting at Fiesta Americana voted in favor to return. There are two new things for the 2015 meeting. First, and most exciting, is that Fiesta Americana is now an all-inclusive resort. Included in the room rate are all meals and all beverages. The hotel now has eight restaurants and five bars and all meals and drinks at these facilities are part of the room fee. Second, and more serious, Los Cabos was hit by damaging winds and rains last week by Hurricane Odile. The CAWV has been in constant contact with Fiesta Americana Resort. The hotel, like Cabo, sustained damage. Fiesta Americana is part of a large hotel company and repairs are starting immediately. They fully expect to be back up and running at full capacity. The Baja Pennisula also received heavy damage. However, Los Cabos is one of Mexico’s major tourist areas and work is expected to begin quickly to repair the damage. The CAWV will be monitoring progress during the next four months. The early bird deadline is Friday, October 17. January is Cabo’s busiest tourist season, so those who are interested in attending should contact Wendy Long immediately at [email protected] or (304) 342-1166. MEMBERSHIP AND PUBLIC RELATIONS COMMITTEE HOLD JOINT MEETING The CAWV Membership and the CAWV Public Relations Committees held a joint meeting on Wednesday, September 17, at the CAWV headquarters. Chairperson Kimberly Ridenour led the Public Relations Committee in its efforts to promote the “Hard at Work” license plate campaign, focusing on ways to reach the goal of 1,000 plates. Other items that were discussed included: developing a social media plan and the Third Annual Cynthia Snyder Blood Drive that will be held in conjunction with the EXPO on March 25 and 26, 2015.

Scott Pierson, Chairman of the Membership Committee, discussed developing a plan to boost membership by urging current members to help recruit new contractor and associate members. In the coming weeks, a letter will be mailed to current members asking them to provide at least one contractor and one associate perspective member that would benefit from joining the CAWV in an effort to grow the association’s membership base. Other topics discussed included how to retain members, the need for current members to better educate new members on the benefits of being a CAWV member, and encouraging member involvement in the association’s activities. The next meeting of the Membership and Public Relations Committee will be Wednesday, December 3, at 10:00 a.m. at the CAWV. CAWV TO EXHIBIT AT OIL AND GAS EXPO The CAWV will be exhibiting at the Oil and Gas Expo at Mylan Park in Morgantown on October 1, 9:00 a.m. to 5:00 p.m. The Expo is a business to business event that gives vendors and visitors a chance to speak face-to-face with business owners and industry leaders in the oil and natural gas industry. Any CAWV member that would like to volunteer to work with CAWV staff at the booth should contact Pat McDonald at (304) 342-1166 or [email protected] . CAWV WELCOMES NEW STAFF MEMBER The CAWV is pleased to announce that Cassidy Webb has joined the staff as Communications Manager. She will also take on the role of show manager for the WV Construction and Design EXPO. Webb has a B.S. in Communications from WVSU with minors in graphic design and advertising. She joins us from The Chapman Printing Company, Charleston Division. Her creativity and experience with print media and design will be beneficial to the association, in particular the Construction News magazine. “We are pleased that Cassidy has joined the CAWV family,” said CAWV Executive Director Mike Clowser. “She brings attributes to our staff that will be of great benefit to our members and our organization.”

AGC BUILDING CONTRACTORS CONFERENCE BRINGS COLLABORATION SOLUTIONS TO THE CONSTRUCTION INDUSTRY A Texas sized crowd showed up at the AGC Building Contractors Conference on September 10-12, 2014 at the Omni Austin Hotel Downtown in Austin, TX. “A/E/C Collaboration 2014: Partnering, Opportunity, Risk, Success & the Future”, brought together almost 200 high-level leaders in the building construction industry to share, learn and discuss how teamwork can reduce costs and deliver projects more efficiently. Sessions included: “Improving Onsite Productivity with Collaborative Lean Implementation”, “Winning Work Through Collaboration: A Live Case Study”, “Getting it Right: How Owners Hire the Best Talent” and “Millenniums – Shaping OUR Collective Future”. Sessions on September 12 were led by the AGC Public/Private Industry Advisory Council (PIAC), a committee that provides a direct line of communication between private and public owners and AGC of America. These sessions featured an economic overview and outlook presented by AGC Chief Economist Ken Simonson, a presentation on better planning to minimize change orders by Kevin Keller of Johnson and Johnson, Inc. and highlights of several strategies and trends driving the industry. Attendees also enjoyed numerous networking opportunities including breakfasts, evening receptions, a keynote luncheon featuring Chuck Gremillion and Jim Stevenson of Construction Career Collaborative (C3). Before the Conference began, AGC held one preconference event, “The Lean Executive Course”. The course was designed for construction executives who want to know the first steps to leading the Lean implementation in their companies. OSHA EXPANDS REQUIREMENT FOR REPORTING FATALITIES AND SEVERE INJURIES

A final rule announced Sept. 11 requires employers to notify OSHA when an employee is killed on the job or suffers a work-related hospitalization, amputation or loss of an eye. The rule, which also updates the list of employers partially exempt from OSHA record-keeping requirements, will go into effect on Jan. 1, 2015 for workplaces under federal OSHA jurisdiction.

Under the revised rule, employers will be required to notify OSHA of work-related fatalities within eight hours, and work-related in-patient hospitalizations, amputations or losses of an eye within 24 hours. Previously, OSHA's regulations required an employer to report only work-related fatalities and in-patient hospitalizations of three or more employees. Reporting single hospitalizations, amputations or loss of an eye was not required under the previous rule.

Employers can report these events by telephone to the nearest OSHA Area Office during normal business hours or the 24-hour OSHA hotline 1-800-321-OSHA [6742], or electronically through a new tool which will be released soon and accessible at www.osha.gov/report_online.

The new rule maintains the exemption for any employer with 10 or fewer employees, regardless of their industry classification, from the requirement to routinely keep records of worker injuries and illnesses.

All employers covered by the Occupational Safety and Health Act, even those who are exempt from maintaining injury and illness records, are required to comply with OSHA's new severe injury and illness reporting requirements.

OSHA has posted a new website with plain language materials about the new requirements. OSHA has also posted training material and other guidance on how to keep OSHA records to make it easy for newly covered employers to comply.

WDA BONDS GET A1 RATING FOR CHESAPEAKE BAY PROJECTS BONDS Moody’s Investor Service has assigned an A1 rating to the West Virginia Development Authority’s $76.3 million Infrastructure Excess Lottery Revenue Bonds, 2014 Series A. Bond proceeds will be used to finance certain watershed compliance projects in the Chesapeake Bay watershed and the Greenbrier River watershed. The bonds are backed by the State Excess Lottery Fund after the WV Legislature two years ago passed a bill to increase the amount of lottery proceeds going to water and sewer funding from $40 million annually to $46 million. The additional $6 million is for debt service on the bonds. West Virginia is a partner in the Chesapeake Bay Watershed Agreement which is a six-state agreement to clean rivers and streams that flow into the bay. The bonds that will be issued, probably next week, will pay for improvements, upgrades and new construction of wastewater treatment plants in West Virginia’s eight-county Eastern Panhandle region plus Greenbrier County. The improvements are needed to meet new, stringent pollution limits imposed by the U.S. EPA for the Chesapeake Bay Restoration program. The original estimated cost to make the improvements to 13 sewer plants was $225 million. The WV Infrastructure and Jobs Development Council, Water Development Authority, WV Department of Environmental Protection, Public Service Districts and engineers have been working the past two years to get the projects funded and designed. ($ Amounts in Millions) STATE COURT AFFIRMS ENVIRONMENTAL QUALITY BOARD ON QUARRY PERMIT On August 25 the Circuit Court of Kanawha County rejected challenges by Potomac Riverkeeper, Inc. to a National Pollutant Discharge Elimination System (NPDES) permit, which was issued by WVDEP in January 2011 to North Mountain Shale. The permit allows the quarry, located in the eastern panhandle, to mine shale in a 100-acre site near WV 51 in Gerrardstown. A coalition of organizations representing environmental, historical and community interests have continued to appeal the permit with concerns for the viewshed and water quality. The Surface Mine Board has implemented stipulations to the permit, restricting the number of truckloads removed from the site per day and requiring the reclamation of each section before moving on to the next. The DEP and North Mountain Shale have maintained the project has complied with the state’s review and permitting process.

WV DOH PROBLEM STATEMENTS FOR FY 2016 RESEARCH; EEO CONFERENCE SET FOR OCT. 1-3 The Research and Special Studies Section under the Planning Division of the WV DOH is soliciting problem statements for FY 2016 research. AGC, ARTBA OPPOSE HIGHWAY DEVOLUTION PROPOSAL

Transportation interests have written Congress to express opposition to the so-called “devolution” of the federal highway program and the proposed Transportation Empowerment Act. The bill, introduced in the House and Senate last fall, transfers almost all authority over federal highway and transit programs to the states over a five-year period. It would lower the federal gas tax to 3.7 cents from 18.4 cents over the transition period, and during the five-year phase out states would receive block grants that come with fewer federal controls over how the money is spent. The federal share comprises about 61 percent of West Virginia’s highway construction and maintenance program.

“TEA is ill-conceived and by stripping away most federal funding for surface transportation projects, would virtually eliminate the federal government’s constitutionally mandated role in promoting interstate commerce,” the letter, dated Sept. 16, says. “Devolution … would prove disastrous to state and local governments’ ability to maintain and improve their transportation systems when it is widely acknowledged that current resources are seriously insufficient.”

Along with ATA, the coalition includes AAA, the U.S. Chamber of Commerce, the American Association of State Highway and Transportation Officials, the American Highway Users Alliance, the American Road and Transportation Builders Association, the American Society of Civil Engineers, the Associated General Contractors of America and others. The bill sponsors, however, frame the legislation with conservative principles such as increased local control and a streamlined, more efficient use of taxpayer dollars. “Under the Transportation Empowerment Act, Americans would no longer have to send significant gas-tax revenue to Washington, where sticky-fingered politicians, bureaucrats, and lobbyists take their cut before sending it back with strings attached,” said Sen. Mike Lee, R.-Utah, who sponsored the bill in the Senate. “Local communities should finally have the flexibility to develop the kind of transportation system they want, for less money, without politicians and special interests from other parts of the country telling them how, when, what, and where they should build.”
