In correspondence received in this office on May 25,2010, you submitted a request for documentspursuant to the Freedom of Information Act (FOIA), MCL 15.231 et seq. This notice is issued inresponse to your request, a copy of which is attached and incorporated herein.

The Department grants and denies your request in part. Concerning the granting of your request. TheDepartment grants your request as to existing, nonexempt public records that are determined to beresponsive to your request for records. Our records indicate that we can provide you with a copy of thecurrent Oaths of Office for Judge James R. Chylinski and Deborah Ross Adams; a certification statingthat "no Oath" was filed with this office for 2000-2001for Judges James R. Chylinski and John R. Perryand for 2006-2007 for Judge John R. Kirwin. Please find enclosed a certified copy of the requestedrecords.

Concerning the denial of your request. I certiff to the best of my knowledge, information and belief thatthe Department does not possess a public record matching the description for items #2 - #7 and #9 listedabove. Please be advised that Magistrates and Prosecuting Attorneys are not required to file an Oath ofOffice with the Office of the Great Seal.

For the reason cited above, part of your request is denied. Pursuant to MCL $ 155.240(1), you may doeither of the following:

1. Appeal this decision in writing to Anne Corgan, Director, Legal and.Regulatory ServicesAdministration, Department of State, Richard H. Austin Building, 4'Floor, 430 West AlleganStreet, Lansing, Michigan 48918. The writing must specifically state the word "appeal" and must

identiff the reason or reasons you believe the denial should be reversed. The head ofthedepartment, or her designee, must respond to your appeal within 10 days of the receipt. Underunusual circumstances, the time for response to your appeal may be extended by 10 businessdays.

2. File an action in circuit court to compel disclosure of the records. The Action must be filedwithin 180 days after the date of the final determination to deny the request. lf you prevail insuch an action, the court is to award reasonable attorney fees, costs, and disbursements. Further,if the court finds the denial to be arbitrary and capricious, you may receive punitive damages inthe amount of $500.00.

The Department does not refund amounts under $10.00. The total cost for the provided totaled $5.00.You submitted $10.00. You have a credit of $5.00 that you may use when requesting additionalinformation. This credit is valid through September 30, 2010. Please enclose this letter when requestingadditional information to utilize this credit.
