    PLEASE TAKE NOTICE that theTown Board of the Town of Riverheadadopted a local law amending Chapter 48entitled “Beaches and Recreation Cen-ters”, of the Riverhead Town Code at itsmeeting held on April 5, 2016. Be it en-acted by the Town Board of the Town ofRiverhead as follows:

    Chapter 48. Beaches and RecreationCenters

    § 48-1. Definitions.RECREATION CENTER OR FA-

    CILITYAn indoor or outdoor facility, which

    may involve large amusement areas,rides, playing fields, courts, arenas, stadi-ums or halls, designed to accommodatesports and recreational activities andincluding, by way of example but not byway of limitation, bowling, dancing, ice-skating and roller-skating and outdoorsports, recreational pursuit and athleticcompetitions generally. This definitionshall include gymnasiums, health spas,shooting ranges, docks, boat launch andtennis facilities.

    § 48-7. Application for permit; fee tooperate vehicle on Sound Beach.

    B. Permits shall be issued at a cost of$35 set by the Riverhead Town Boardand shall run from January 1 through De-cember 31 annually. The Town Board, byresolution, shall establish the annual feefor a permit to operate a motor vehicleon Sound Beach and determine the pe-riod of time a permit shall be valid. Theapplicant shall furnish the following in-formation:

    D. The Recreation Department ishereby authorized to issue permits forthe use or operation of a motor vehicleon the Long Island Sound beach to a dulyorganized fishing club. The club must berecognized and approved by the TownBoard and certified by the Town Clerk.Said permit shall be issued for a fee of$100 set by the Riverhead Town Boardper permit. The duly organized fishingclub is authorized to receive permitsequal to 10% of its active membership.The permit shall be conspicuously dis-played on the dashboard of the motorvehicle being used by a club member. Afishing club permit shall allow parking inspaces provided during the hours of be-tween 6:00 p.m. and 9:00 a.m. at any pub-lic bathing beach. A permit issued pursu-ant to this section shall not authorize thepermit holder to park at any other timeand, instead, a resident or non-residentparking permit is required for parking atall other times.

    E. The Recreation Department ishereby authorized to issue parking per-mits which allow parking in spaces pro-vided during the hours of between 6:00p.m. and 9:00 a.m. at any public bathingbeach to a duly organized fishing club fora fee of $25. A permit issued pursuant to§ 48-7D shall authorize the permit holderto park his vehicle at any public bathingbeach between the hours of 6:00 p.m. and9:00 a.m.

    § 48-9. Expiration of permit. All permits issued pursuant to this

    article shall expire on Labor Day of theyear stated on the permit. The TownBoard, by resolution, shall determine theperiod of time a permit shall be valid.

    § 48-12. Licensing of vehicles requiredRequirement for permit.

    § 48-13. Parking and permits relatedto use of recreation centers and facilities,parks, playgrounds, public bathing beach-es, and dog parks.

    (1) Parking area at South JamesportBeach., excluding area designated foruse by residents with East Creek Dock-ing Permit (East Creek Docking Facilityand commonly referred to as East CreekMarina.

    (7) (Reserved) Parking area at Mi-amogue Beach.

    (10) Parking area at boat launchingfacility East Creek Boat Launch Facility,located at Peconic Bay Boulevard, SouthJamesport (commonly known as SouthJamesport Boat Launch).

    B. Permits. The Recreation Depart-ment is hereby authorized to issue a sea-sonal and daily parking permits for use atany public bathing beach, recreation cen-ter, park or playground; night fishing per-mits; docking permits; boat launch per-mits; and permits for dog park and other

    areas designated for, or approved for,dog/animals. Seasonal parking permitsfor parking vehicles in the designatedparking areas shall be issued as follows:

    (1) Seasonal resident parking permit.(a) A seasonal parking permit shall be

    issued to all persons who are qualifiedresidents of the Town of Riverhead,. andit shall run from Memorial Day throughLabor Day. The Town Board, by resolu-tion, shall determine the period of timea seasonal parking permit shall be valid.Persons applying for a seasonal residentparking permit will be requested to sub-mit for inspection one of the following asproof of residence:

    (d) There will be a cost of $10 for aseasonal resident parking permit. Theseasonal resident parking permit fee forseniors 60 years of age and older shall be$5. The Town Board, by resolution, shallestablish the fees for a resident seasonalparking permit and senior resident sea-sonal parking permit.

    (2) Senior citizen/handicapped sea-sonal resident identification permit (IDpermit). The Recreation Departmentshall issue identification (ID) permits tosenior citizens or handicapped residentswho do not drive and need someone elseto take them to the beach. These cardswill grant access to any vehicle as long asthe person is a passenger in the car. Thecard should be left in plain sight whenthe people leave the vehicle. In order toobtain access to recreation facilities, thesenior citizen or handicapped residentmust produce picture ID to the atten-dant. There will be a cost of $5 for the IDpermit. The Town Board, by resolution,shall establish the fee for a senior citizen/handicapped resident seasonal identifica-tion permit

    (3) Nonresident seasonal parking per-mit.

    (b) The fee for the issuance of a non-resident seasonal parking permit shall be$150 annually or $75 weekly or $25 daily.The Town Board, by resolution, shall es-tablish the fee for non-resident seasonalparking permit.

    (c) Daily nonresident seasonal park-ing permits may be issued for the parkingof vehicles, passenger vehicles and buses,at all Town beaches to any person by theattendant on duty at such parking areas.The Town Board, by resolution, shall es-tablish the fee for a daily non-residentseasonal parking permit.

    (4) South Jamesport Boat Ramp park-ing permit. The fee for the issuance of aseasonal parking permit shall be $10 an-nually.

    C. Night fishing permits.(1) Resident fishing permits for fishing

    purposes shall be issued by the RiverheadRecreation Department to any vehiclewith a valid seasonal parking permit andwill entitle the vehicle to remain at theparking areas after 10:00 p.m. The Rec-reation Department is hereby authorizedto issue a resident night fishing permit.Note, this permit is separate and distinctfrom the fishing club permit issued pursu-ant to §48-7. The Town Board, by resolu-tion, shall establish the fee and determinethe hours and period of time a permitshall be valid.

    (2) There will be no cost for a residentfishing permit. A resident must have avalid seasonal parking permit to qualifyfor a resident night fishing permit andpossess a valid permit issued by the NewYork State Department of Environmen-tal Conservation or such agency autho-rized to issue a New York State fishingpermit.

    D. Dog park permits.(1) Permits for the dog park shall be

    issued by the Office of the Town Clerkupon proof of a current dog license, ra-bies vaccine certificate and health certifi-cate. The Recreation Department is here-by authorized to issue a dog park permitand permit relating to dogs/animals inother designated public areas. Note, thispermit is separate and distinct from doglicensing requirements set forth in otherprovisions of the Town Code. All ownersshall be required to produce proof of acurrent dog license, rabies vaccine certifi-cate and health certificate.

    (2) Fees for the year-round dog parkpermit are as follows:

    (a) Resident: $15.(b) Nonresident: $30.(c) Replacement of lost/damaged per-

    mit: $10.(d) Amended dog owner permit for

    each additional dog: $5.The Town Board, by resolution, shall

    establish the fee and determine the hoursand period of time a permit shall be valid.

    E. Boat Launch Permit.(1) The Recreation Department is

    hereby authorized to issue a resident,non-resident and commercial boat launchpermit for use at the East Creek BoatLaunch. Note: Launching and recovery

    of boats/vessels with a motor vehicle shallbe prohibited at Reeves Beach, except asmay be deemed necessary, from time totime, by authorized Town of Riverheadpersonnel, including but not limited tolifeguards, police officers or the Bay Con-stable. In addition, parking of vehiclesand/or trailers on the beach at ReevesBeach is prohibited.

    (2) A resident or non-resident seekinga boat launch permit must be 18 years orolder and possess a valid seasonal park-ing permit to be eligible for a boat launchpermit.

    (3) A resident or non-resident seekinga boat launch permit must provide a de-scription of the boat/vessel make, model,year and registration number. The appli-cant must produce a valid registration forthe boat/vessel evidencing that the appli-cant is the owner of the boat/vessel.

    (4) An individual seeking a commer-cial boat launch permit must providename, address of company and a descrip-tion of the trailer and registration num-ber.

    (5) All resident and non-resident boatlaunch permits must be affixed to theboat/vessel and commercial boat launchpermits must be affixed to the trailer.

    (6) The Town Board, by resolution,shall establish the fee and determine thehours and period of time a boat launchpermit shall be valid.

    § 48-14. Vehicle restrictions in beachareas. Reserved.

    No vehicles shall be driven or operat-ed over or upon the beach area nor standat any public bathing beach between May15 and September 15, both inclusive, ineach year, from 9:00 a.m. to 6:00 p.m., in-clusive, as follows:

    A. Reeves Beach:(1) Launching and recovery of vessels

    with a motor vehicle shall be prohibited,except as may be deemed necessary, fromtime to time, by authorized Town of Riv-erhead personnel, including but not lim-ited to lifeguards, police officers or theBay Constable.

    (2) (Reserved)(3) Parking of vehicles and/or trailers

    on the beach at Reeves Park is herebyprohibited.

    § 48-18. Dogs and other animals; de-struction of property.

    A. No dogs or domestic animals shallbe allowed on any public bathing beachor recreation center except service dogs,therapy dogs, working dogs or detec-tion dogs as set forth in § 58-2B(2) orby permit of the Town Clerk RecreationDepartment as set forth in § 48-23 or des-ignated dog park as set forth in § 48-24.

    § 48-20. Hours. A. All public bathing beaches of the

    Town of Riverhead shall be open onlybetween the hours of sunrise and 10:00p.m. The Town Board, by resolution, shallestablish the hours and period of time apublic bathing beach, recreation center,park, playground or dog park shall beopen. Note, the Town reserves the rightto limit or extend the hours for townsponsored and/or approved programsand in cases of emergency.

    B. All parks and recreation centersshall be open only between the hours ofsunrise and sunset unless a town-sanc-tioned program is in progress.

    § 48-23. Animals. No person owning or being custodian

    of any animal shall cause or permit suchanimal to enter any area designated aspublic bathing beach, recreation centeror facility, park, or playground unlessauthorized by permit issued by the TownClerk Recreation Department. Except asset forth in § 48-24, an owner or custodianof any animal who is issued a permit bythe Town Clerk Recreation Departmentas set forth in Chapter 58 granting per-mission to enter the public bathing beach,recreation center, park or playgroundwith an animal shall be required to keepthe animal on a leash and restrained notmore than six feet in length from theowner or custodian at all times and shallnot permit the animal to defecate or uri-nate in the vicinity of other persons. If ananimal defecates in any public bathingbeach, recreation center or facility, park,or playground, the owner shall immedi-ately collect the feces and remove it fromthe public bathing beach, recreation cen-ter or facility, park, or playground.

    § 48-24. Dog park.C. No dog shall be permitted to en-

    ter a Town-designated dog park withoutthe owner obtaining the required permitfrom the Town Clerk’s Office Recreation

    Transient or daily use.No person shall use any portion of said

    town dock for the purpose set forth in §56-1 for a longer period than 24 hours,said period of 24 hours beginning at 6:00a.m., Eastern standard daylight and sav-ings time, each day unless they conformto the fees collected for overnight tran-sient dockage. A permit is not requiredfor use of a Town dock to receive ordischarge passengers or short term tran-sient docking defined as docking for aperiod of time less than three hours be-tween 6:00 a.m. and 9:00 p.m. or at suchtimes established by resolution of theTown Board subject to the regulationsset forth in Chapter A113. All residentsand non-residents must obtain a permitfrom the Town of Riverhead RecreationDepartment for daily or overnight dock-ing available at the Riverfront Dock andEast Creek Boat Launch Facility. Note,the Town of Riverhead reserves the rightto limit the period of time any boat/vesselremains docked at any town dock.

    § 56-3. Penalties for offenses. A violation of this chapter shall consti-

    tute a misdemeanor and shall be punish-able by a fine of not exceeding $10 for thefirst offense and by a fine of not exceed-ing $25 for each subsequent offense.

    A. All boats docked at a Town dockwithout a permit issued by the Town ofRiverhead and/or in violation of the pro-visions of this Chapter or Chapter 113 Awill be fined $10.00 per foot per day. Thelength of boat will be determined by theregistration documents issued by the NewYork State Department of Motor Vehi-cles, such other governmental agency au-thorized to issue registration documentsfor the boat/vessel or by measurementof the boat/vessel. Boats docked with-out a permit for more than a week maybe removed/impounded and the ownershall be responsible for all costs relatedto removal/impoundment and any and allother costs, including storage.

    B. Any person launching or utilizingthe boat launch/ramp at East Creek BoatLaunch Facility without a boat launchpermit will be fined $100.00 per occur-rence.

    C. Any person(s) failing to affix apermit to the boat/vessel or vehicle asrequired by this Chapter or such otherapplicable Chapters of the Town Code,including but not limited to Chapter 48and Chapter A113, shall be fined $100.00per occurrence, per day, that said boat/vessel or vehicle continues to remain atdock and/or parking facility.

    § A113-2. License required;regulations;fees. Docking permits.

    A. All residents and nonresidentsmust have a license and/or docking per-mit to dock at any Town docking facility.

    B. Transient docking is permitted on lyat the Riverfront Docking Facility andthe East Creek Boat Launching Facility.

    C. Seasonal docking is permitted onlyat the East Creek Docking Facility toboaters who have obtained a Riverheaddocking license from the Recreation De-partment.

    D. The Town Clerk shall be autho-rized to collect all transient dockingfees and distribute the docking permitsticker.

    E. The Recreation Department shallbe authorized to collect all fees and dis-tribute permits in accordance with anapproved docking license.

    F. No license shall be issued to anyoneunder the age of 18.

    G. Licenses and per mits are nontrans-ferable.

    H. The East Creek Docking Facilityseason shall be from April 1 to Novem-ber 15.

    I. No transient vessel shall be permit-ted to dock overnight without prior ap-proval from the Recreation Department.(See Chapter 56, Docks and Wharves).

    J. The Town Board shall establish feeseach year for seasonal docking.

    K. All vessels docked at Town facili-ties shall comply with Riverhead TownCode Chapters 48 and 106, and all appli-

    cable U.S. Coast Guard rules and r egula-tions, including inspections, if any.

    A. A permit is not required for shortterm transient docking (short term tran-sient docking shall be no longer thanthree hours) between the hours of 6:00a.m. and 9:00 p.m., or as otherwise estab-lished by resolution of the Town Board,at the Riverfront Docking Facility.     (2) A permit is not required for shortterm transient docking (short term tran-sient docking shall be no longer thanthree hours) between the hours of 6:00a.m. and 9:00 p.m., or as otherwise estab-lished by resolution of the Town Board,at the East Creek Boat Launch Facility(i.e. a tie-up along the bulkhead afterlaunching vessel with boat launch per-mit affixed to vessel). All residents andnon-residents must obtain a permit fromthe Town of Riverhead Recreation De-partment for transient daily (more thanthree hours) and overnight docking.Note, the Town of Riverhead reservesthe right to limit the period of time anyvessel remains docked at the East CreekBoat Launch Facility.

    C. All residents must obtain an EastCreek Docking Facility seasonal dock-ing permit to dock any vessel at the EastCreek Docking Facility and the seasonaldocking permit must be affixed to thevessel.

    D. All residents and non-residentsseeking a permit as described above(A113-2 (A) (B)(1)(2) and (C) must be18 years or older to be eligible to obtaina permit to use the docking or ramp fa-cilities described above.

    E. A permit, be it a boat launch per-mit, transient docking, seasonal dockingor seasonal parking permit, is not trans-ferable and must be affixed to the vesselor vehicle. A permit may not be duplicat-ed or copied and any such duplication orcopy of a permit shall be deemed invalidand all penalty provisions of this Chap-ter shall apply to any vehicle or vessel inviolation of the permit requirements.

    F. All vessels docked at Town facilitiesshall comply with Riverhead Town CodeChapters 48, 64 and 106, all applicableU.S. Coast Guard rules and regulations,including inspections (if any) and, to theextent applicable, Town of RiverheadDocking Agreement.

    § A113-3. Waste and debris.No owner or other person in charge

    of any boat, vessel or other watercraftshall empty, clean out, pump out or oth-erwise discharge water or waste materialfrom the bilge holding tank(s) or toiletsthereof into the waters.

    § A113-3. Vehicle Parking. A. Parking at Riverfront Docking

    FacilityAll motor vehicles parking in the vi-

    cinity of the Riverfront Docking Facility,including Riverfront Drive, McDermottAvenue, and parking lot areas shall notrequire a seasonal parking permit how-ever all motor vehicles shall adhere toall parking restrictions and regulationsset forth in Chapter 101.

    B. Parking at East Creek BoatLaunch Facility

    All motor vehicles parked in the park-ing lot of the East Creek Boat LaunchFacility (also known and referred to asthe South Jamesport Boat Ramp) musthave a seasonal parking permit issuedby the Town of Riverhead RecreationDepartment as set forth in Chapter 48.

    C. Parking at East Creek DockingFacility

    All motor vehicles parked in theparking lot of the East Creek Dock-ing Facility must have a seasonal “EastCreek Docking Facility” parking permitissued by the Town of Riverhead Recre-

    ation Department. Note, each holder ofan East Creek Docking Facility seasonaldocking permit shall be issued one EastCreek Docking Facility parking permitand may obtain one guest seasonal park-ing permit for an additional fee. The EastCreek Docking seasonal parking permitand guest permit is only valid for park-ing within that portion of East CreekTown Beach located in South Jamesportsegregated as and for parking associatedwith the East Creek Docking Facilityand a seasonal parking permit shall berequired for parking of motor vehicles inall other areas designated as a parking-by permit only, including the parkingarea for the East Creek Town Beach asset forth in Chapter 48.

    § A113-4. Rights of Town Board .A. The Town Board or its representa-

    tive can ask any vessel to leave the dockif that vessel is causing damage to per-sons or property.

    B. Any representative of the TownBoard shall have the right to board anyboat in order to secure it or prevent itfrom bumping into or scraping otherboats moored at any Town docking fa-cility.

    § A113-4 Fees for transient docking,seasonal docking and seasonal parkingpermits.

    A. The Town Board shall establishfees each year for transient docking, sea-sonal docking and seasonal parking forresidents and non-residents.

    B. The Recreation Department shallbe authorized to collect all fees and dis-tribute permits in accordance with anapproved transient and seasonal dock-ing permit and seasonal parking permit.The Town Board, by resolution, shallestablish the period of time the seasonalpermit, be it docking or parking, shall bevalid for during the year such permit isissued.

    § A113-5. Mooring; tying; owner re-sponsibility.

    A. Dinghies, rowboats, floats or anysmall craft, capable of being stored on avessel and less than 12’ in length, whichare usually tied to the stern of a largerboat, are not permitted, except whenfirmly secured to the upper deck of theaccompanying boat or placed in the da-vits, typically used to support, raise andlower which are usually provided for onsuch boats. Dinghies, rowboats, floatsor any small craft shall never be permit-ted to be located on the dock or at anyboat slip overnight. Notwithstanding theabove, the Town of Riverhead reservesthe right to issue permits for overnightdocking for such boats and all provisionsof § A113-2 shall be made applicable tosuch permit.

    B. License holders are responsible forthe appearance of the boat and docks infront of or adjacent to their berth. Anydamage to the docks, pilings, bulkheador neighboring boats is the boat owner’sresponsibility.

    § A113-6. Prohibited acts. A. Swimming is prohibited in the wa-

    ters surrounding all Town docking facili-ties.

    B. No boat shall be operated at aspeed greater than five miles per hournor create a dangerous wake at anyTown docking facility pursuant to § 106-8C.

    C. No unleashed animals are permit-ted at any Town Docking Facility. Noowner or other person in charge of anyboat, vessel or other watercraft shallempty, clean out, pump out or otherwisedischarge water or waste material fromthe bilge holding tank(s) or toilets there-of into the waters.

    D. No unleashed animals are per-mitted at any Town Docking facility.All owners and/or custodians shall berequired to keep the animal on a leashand restrained not more than six feet inlength from the owner or custodian atall times and shall not permit the animalto defecate or urinate in the vicinity ofother persons. If an animal defecates theowner shall immediately collect the fe-ces and remove it.

    § A113-8. Penalties for offenses. A. All boats docked at a Town dock

    without a permit issued by the Town

    of Riverhead and/or in violation of theprovisions of this Chapter or Chapter56. A will be fined $10 per foot per day.The length of boat will be determined bythe registration documents issued by theNew York State Department of MotorVehicles, such other governmental agen-cy authorized to issue registration docu-ments for the vessel or by measurement.Boats at the docking facilities without aRiverhead Town license and/or permitswill be fined $10 per foot per day. Boatsdocked without a license and/or permitsfor more than a week may be removed/impounded at the owner’s expense. andthe owner shall be responsible for allcosts related to removal/impoundmentand any and all other costs, includingstorage.

    B. Vehicles that launch boats at theTown boat launch ramp without a park-ing permit will be fined $100 per occur-rence. Any individual who launches aboat at the East Creek Boat Launch Fa-cility without a boat launch permit willbe fined $100 per occurrence.

    C. The Town Board can revoke thelicense or permit of any person for anyviolation of these rules. Any person(s)failing to affix a permit to the vessel orvehicle as set forth in A113-2, with theexception of a guest parking permit,shall be fined $100.00 per occurrence/day and $100.00 per day for each daythat said vessel or vehicle continues toremain at dock and/or parking facilitywithout the proper permit affixed to thevessel or vehicle.

    D. Except as set forth in A113.8(a)(b)(c) or as otherwise set forth in Chapter48, 64, 106 or in the Town of RiverheadDocking Agreement, any person violat-ing any provisions of this Chapter shallbe fined $100.00 per day.
