I. BACKGROUND AND METHODOlOGY

Minnesota Statutes 1975, Chapter 126.21 reads in part:

(126.21) DISCRIMnrA!ION: ATH:L:!.,.ICS: ~Q.UAL OPFORTUl11f~'Y. SuCdiV"ision ~.Notwithstanding any other state law to the contrarj, in athleticp~grams operated by educational institutior~ or public sernces anddesigned for pa.:rtlcipants 12 years old or older or ion the seventh g=adeor above, it is not unfair disc~-mir~torl practice~

(1) to restrict membership on an athletic team to participants ofone sex, if this restriction is necessarJ to provide members of eachsex ?~th an equal oppo~unity to participate in the athletic ~rogram:

provided, if a- membership restriction on the basis of sex results L,."
