Motions 86. Motion from Councillor Mary Freehill

Due to the increased level and frequency of wind, the City Council needs to focus its attention on multiple dwellings whose owners frequently flaunt the law by leaving seriously over full bins at the front of these houses. The impact of this is on windy days and nights the contents of these bins are strewn all over the area which is a serious health hazard for these areas. This committee therefore resolves to set up a pilot scheme getting Litter Wardens to adopt a zero tolerance approach to landlords who do not take proper care of refuse disposal from their rented properties. It is agreed that Upper and Lower Rathmines with all roads off it be the first focus of the area of the pilot. All landlords should be immediately made aware of the pilot scheme.

87. Motion from Councillor Mary Freehill That the Conservation Department presents a report on how 201 and 201a, Harold's Cross Road which is a listed building, unoccupied and seriously falling into disrepair, can be saved.

88. Motion from Councillor Mary Freehill Following newspaper reports that the Harold's Cross greyhound stadium will be put on the market, that the Planning Department sets out the options available to this committee which would be in the best interest of the local community and good planning practice. Account also has to be taken of the area’s utilities capacity, especially its drainage system

89. Motion from Councillor Dermot Lacey This Committee requests the City Manager to begin the process of preparing for the

installation of a playground at the vacant site of the Ross Road flats. This to include arranging for site evaluation and playground design and submission to the budgetary process for funding.

90. Motion from Councillor Mary Freehill

That the drainage dept present a report to Dse Lac on the suitability of the hospice Harold's Cross Road Focus Ireland site for development on whether our current drainage scheme is capable of serving this site and whether development on this site could have an adverse impact or cause flooding locally.

That the traffic department explain the apparent reluctance to provide DYL's on the lane at the rear of Palmerston Gardens. See details attached which explains the need for these yellow lines.

92. Motion from Councillor Paddy McCartan

To have double yellow lines at the junction of Haddington Road and Haddington Place extended. Vehicles have their view obscured while exiting Haddington Place and turning right onto Haddington Road.

93. Motion from Councillor Paddy McCartan To ask the Chief Executive to extend double yellow lines at the vehicular entrance to the apartments of the Sisters of the Holy Faith at the Haddington Place junction, Off Haddington Road. At present, cars are parking on a single yellow line at the entrance, thus blocking entry and exit from these new apartments.

94. Motion from Councillor Paddy McCartan To ask the Chief Executive to deal with the following safety issues affecting Wilfield Road and Wilfield Park, Sandymount by (1) erecting "Children at Play" signs at the entrance to each road, (2) placing a speed ramp at the entrance to each road, and (3) reducing the speed limit to 30km/h with sign posts.

95. Motion from Councillor Jim O’Callaghan

Dublin City Council supports the Carers Association’s calls on the Minister for Social Protection to amend the Social Welfare Bill to make provision for the restoration of the Respite Care Grant.

96. Motion from Councillor Claire Byrne

That this Committee supports the residents of Ringsend, Irishtown, Sandymount and the wider Dublin area in their opposition to the development of the Poolbeg Incinerator and their petition calling on Minister Alan Kelly T.D. to act immediately and change the Waste Management Act 2001, to return decision making authority over waste management issues to the locally elected councillors in Dublin City Council.

97. Motion from Councillor Claire Byrne

That this Committee supports the residents of Ringsend, Irishtown, Sandymount and the wider Dublin area in their opposition to the development of the Poolbeg Incinerator based on their concerns about the social and environmental impacts of the increase in traffic in the area due to the transport of waste to the facility, the type of materials that will be transported and the potential for hazardous and flammable waste materials being transported to the facility and the type of systems in place to monitor and manage this, and asks that the Chief Executive addresses these concerns as a matter of urgency.

98. Motion from Councillor Paddy Smyth

That this committee urges the manager to prioritise the commencement of the long planned upgrade to the Dodder cycle track which would significantly decrease traffic congestion along this route by giving commuters a safe and healthy alterative to using the car, as well as adding a substantial amenity to the community.

99. Motion from Councillor Mannix Flynn

That this committee of South East Area calls on Dublin City Council to initiate an order of protected structure on the Central Bank and its plaza. This iconic building and plaza has won the hearts of many Dubliners and deserves its position and place in the record of protected structures. It forms part of the legacy of the late architect Sam Stephenson who also designed the iconic Civic Offices. We have a duty and a responsibility to modern architecture and here is a prime example and a well deserving one at that.

That the Chief Executive ensures that Macken Street / Cardiff Lane receive road and pathway cleaning by arranging for the old type road cleaning to be done at least every 2 weeks as sometimes an automatic road sweeper will come down the road but it is unable to clean as the cars are constantly parked 24hrs.

Motion from Councillor Chris Andrews That planning application Ref 3420/14 for “The Greenery on Lennox” is reviewed by planning enforcement and ensure that storage of rubbish is on site and not outdoors and also ensures that the opening hours are not extended beyond 5.30 as it is clearly a residential area and protected under Z1 stating that it should operate no later than 5:30 in the evening to protect the residential amenity.

That the Chief Executive gives a view on the proposal by residents in the Golden Lane area with a view to making Golden Lane; a one way from Chancery Lane to Bride Street, a one way with the traffic going from East to West and going down ship street onto Bride Road and on to Christchurch. This would mean traffic would be allowed into Golden Lane from Bride Street.

This Committee would conduct an audit of the results of the Tidy Towns and Villages competition for each of the entries from our area to see what actions Dublin City Council could help them in future. Order: Agreed.

Motion from Councillor Dermot Lacey That in the event of work on the unwanted Poolbeg Incinerator commencing that a Project Monitoring Committee be established similar to the one established and continuing to operate regarding the construction and operation of the Aviva Stadium. The membership and operational arrangements of the Committee to be developed and agreed by the South East Area Committee. Order: Agreed.

59. Motion from Councillor Dermot Lacey

That in view of the efforts by local business to enhance the area and the previous works undertaken there, that a meeting of interested traders and occupants of the area behind the Ringsend Library, councillors and Dublin City Council officials be arranged to see how the area can be further improved. 60. Motion from Councillor Ruairi McGinley That the City Council erects a “Blue Plaque” on 90 Beechwood Avenue Lower, Ranelagh in memory of author Paddy Finnegan who died on 16th July 2014. Order: Refer to Commemorative Naming Committee.

61. Motion from Councillors Dermot Lacey and Kieran Binchy This Committee notes with approval the proposed Havelock Square Renovation Plan prepared by residents of the square and requests the Chief Executive to liaise with the residents’ representatives to see how Dublin City Council can assist in its implementation. Order: Agreed.

62. Motion from Councillor Dermot Lacey

To ask the Area Manager if she will give me an update on why the disc parking previously agreed for the other side of the road on Leahy Terrace has not been implemented and what other measures other could be introduced to improve the traffic and pedestrian situation on Leahy Terrace area of Sandymount.

Order: Agreed. 63. Motion from Councillor Mannix Flynn

That this committee of Dublin City Council supports the residents of Ross Road, Nicholas Street and Bride Street in their efforts to have a play area for children established on the vacant site on Ross Road. Order: Agreed.

64. Motion from Councillor Mannix Flynn

That this meeting calls on Dublin City Council (the Parks Dept.) to create a children’s park and garden area at the Peace Park at Christchurch. This park would be dedicated entirely to children and would be a park calling to mind the many children throughout Dublin City who were sent away to institutions under the non-attendance of school act that was administered by Dublin Corporation, now known as Dublin City Council.

Thousands of children were incarcerated under this act. Dublin City Council in 2010 made a public statement apologizing for its involvement in the legacy of cruel and inhumane treatment of these children. This initiative should not be construed as a memorial park but merely as an acknowledgement and a visualization of the hidden and secret social history and also an effort to place to the forefront of Irish society the advances in children’s rights and protection. Order: Agreed.

65. Motion from Councillor Paddy McCartan

To ask the Manager to consider extending the clearway on Merrion Road outgoing at the Merrion Inn, as it constitutes a bottleneck and impediment to public transport. The removal of Pay & Display for approximately 14 cars during clearway hours would aid traffic flow.

To ask the Manager to outline what measures have been taken to deal with the illegal occupation of Dublin City Council property on South Bank Road adjacent to the Sean Moore roundabout, Ringsend by Travellers? Due to the lack of any hygiene facilities, this now constitutes a health hazard. At this moment there are a number of caravans there, and approximately twenty members of the Travelling community in occupation.

That Dublin City Council provide advice and help to residents of the Rathmines Palmerston area as to they could effectively deal with the problem of foxes in area. Food is not made available to them so they are digging up bulbs in gardens with their paws, eating shrubs out of pots and in one area have eaten tennis nets and eating grubs. Order: Report to Councillor. Councillor requested further information and assistance on the issue?

68. Motion from Councillor Mary Freehill

That the Manager gives us an account of the current situation regarding the elimination of a right of way at Shamrock Villas, Harold’s Cross. Shamrock Villas is a public road on which residents reside. Recently bollards have been erected across the road which means that an area of the public road has been cordoned off. Would the manager state has part of the public road been given to the applicant of the elimination of the right of way, Mr Derek Whelan. Will he be able to apply for planning permission to build on this part of the public road and did he pay any money to the Council for this public road. Furthermore it would be useful to know what was the difference of opinion at the South Central area meetings which caused it to be referred back by the City Council in 2009 on so many occasions. Does the Manager have a record of the votes in favour both at South Central and City Council meetings? Order: Report to Councillor. Councillor requested further examination of the matter?

In the interest of trade in Terenure Village, this meeting agrees that the double yellow lines between No. 120 Terenure Rd North and Eaton Rd as per details below be removed.

• 18/06/2004 Rescind Clearway (Stat 12513) from the northern boundary of

property No. 120 to the southern kerb line of Eaton Road. (Hours of operation Mon-Sat, 07.00-10.00 and 12.00-19.00).

• 18/06/2004 Clearway (Stat 12514) from the northern boundary of property No. 120 to the southern kerb line of Eaton Road. (Hours of operation Mon-Sat, 07.00-10.00 and 12.30-19.00).

In 2005 there were enhancements made to the Rathfarnham QBC which included improved facilities for cyclists as follows:

• 17/08/2005 Advisory Cycle Lane (1.5m wide) (Stat 14914) From the end of the

parking at No. 114, extending northwards to the start of the existing cycle lane to the north of the car park, with a buffer strip provided outside the taxi rank.

In conclusion; from the information above it is clear that parking along this stretch of Terenure Road North has been prohibited since March 2001 for all vehicles except those permitted to use the double yellow lines within the loading window which currently runs from 10.00-12.30 Mon-Sat. The only vehicles allowed to use double yellow lines to park within the loading window are vehicles parked while goods are being loaded in or on to it or unloaded from it, for a period not exceeding thirty minutes from the commencement of such parking.

The sign for the restricted parking are still displayed. If we revert to the restricted parking system prior to total prohibition of parking it would be in the interest of the trading and social life of Terenure village.

Bearing in mind the huge number of complaints about overgrown trees in the South East Area can we have an indication of how much is spent on tree removal in the area and can the trees at 2 / 3 Beechill Crescent, Donnybrook, 38 Beechill Crescent, Donnybrook, Dublin 4 and 1 Leukos Road and 6 Pine Road in Ringsend are all removed as they have caused serious damage to the footpaths particularly the one in Leukos Road which is particularly serious and if they are not removed they should be heavily cut back. Order: Report to Councillor.

This Committee calls on the Area Manager to install cycle lanes on the Merrion Road between Merrion Gates and the Rock Road. Order: Agreed.

74. Motion from Councillor Frank Kennedy

Having regard to the fact that a frequent response to traffic related queries is that there is no need to take a particular action or preventative measure because the underlying problem is already illegal (for example, there is no need for painting yellow lines within five metres of a junction because it is already illegal to park there; see Reply to Q.35, South East Area Committee September 2014), and having regard to the serious health, safety and welfare risks which can arise in certain situations where additional measures are not put in place, this Committee calls on the Area Manager to amend local traffic policy to the effect that the mere fact that an action is already illegal is not, in isolation, a reason to prevent additional signage etc. being put in place. Order: Agreed.

75. Motion from Councillor Frank Kennedy This Committee calls on the Area Manager to allow the residents of Wilfield Road, Sandymount, Dublin 4, to ballot on the question as to whether parking may be permissible on the footpath up to a point designated by continuous white lines. This is so where the current parking situation poses a daily risk to the residents of this road as illustrated by the recent experience of one resident who, having broken his leg, could not be collected at his door by an ambulance because it could not navigate a route through the road. This Committee further recognises the need for there to be enough space on the footpath for wheelchairs to get by but maintains that there is adequate space to do both. This Committee notes further that it is already extremely difficult for wheelchairs to get by with unregulated, unlawful parking on the footpath.

That this Committee writes to the Minister for Transport pointing out the pilot scheme that had been approved by the previous Minister, asking him what progress has been made with it, asking him if he is prepared to take it up and furthermore if he is prepared to meet us so that we can make the case.

76. Motion from Councillor Mary Freehill That Dublin City Council find a way to restrict the sale of spray paint that is used for graffiti and that these recommendations are made to government. Order: Report to Councillor.

77. Motion from Councillor Jim O’Callaghan

This Committee calls upon the Chief Executive to work with the residents and businesses of Rathmines in seeking to clean up Rathmines and, in particular, to achieve greater City Council cleaning of the streets in Rathmines. Order: Agreed.

78. Motion from Councillor Jim O’Callaghan

This Committee calls on the Chief Executive to alter the manner in which contracts for waste collection are allocated by the City Council. Instead of granting licences to independent waste collectors to collect throughout the City, certain areas should be allocated to one waste collector at prices to be set by an independent regulator. The benefit of this system is that the people of Dublin would not be exposed to numerous waste collectors traversing the streets each week, and very quickly people could independently see which waste collectors are more efficient and tidy than others. This Committee calls upon the Chief Executive to introduce immediately new traffic measures to facilitate Christmas shopping in the village of Rathmines. In particular, in order to enable shoppers to park on the Lower Rathmines Road this Committee calls upon the Chief Executive to permit vehicular parking on the east side of the Lower Rathmines Road (where there is no bus lane) up to 4pm Monday to Friday. Failure to introduce this measure will result in a continuing marked reduction in business for the small traders on the Lower Rathmines Road.

The South East Area Community Team is liaising with some of the traders in Kimmage, and we have agreed to assist with the development of a draft plan to enhance the precinct around the shops. Initially, we will be adding additional planters to the area once a location map and agreement on their maintenance and upkeep has been given.

To ask the traffic managers to assess the safety, for pedestrians, at the junction at Cowper Road and Palmerston Road. This is a busy one serving both traffic and pedestrians. There is no pedestrian crossing here for some reason. Given the considerable volume of school children and adults that transit this junction I believe the junction would be a lot safer if serviced by a pedestrian crossing. There are numerous schools in the area attended by many local children who would benefit from this safety measure. Currently the nearest pedestrian crossing is at the Belgrave end of Cowper Road and of no consequence to either Luas users coming/going from Upper Rathmines, children transiting to/from school in Ranelagh, Scoil Bhride / Lios Na nÓg or people getting off the bus on Cowper Road. Reply: This matter has been referred to Traffic for investigation and report. A report will issue to the Councillor in due course.

Q8. Councillor Dermot Lacey To ask the Manager if she will arrange for a constructive and active response to the issues raised in this email about the slow nature of repairs to the pavements before this question is reached for reply given the extraordinary prolonged timescale of the work to date.

Just wanted to contact you re the condition of the footpaths on St. Alban’s Park; most notably down the cul-de-sac. Road re-surfacing work began at the end of July and due to a cracked drainage pipe at the beginning of the cul-de-sac the resurfacing contractors were unable to complete the work till pipe repairs were carried out. This has become quite a protracted process as it is still on-going and despite estimates of completion date being end of September we will believe that when we see it! The rate and speed of the work is painfully slow, a fact not helped by the short working day of the City Council Drainage Department (usually done and dusted by 2.30 pm - they were finishing up at 1.30-2pm on a regular basis till a call was put in to an engineer responsible informing him of the hours being kept by the workers). The condition of the footpaths have been poor for quite a while but they have now deteriorated in places to an unacceptable degree as a direct result of the trucks delivering materials and collecting rubble (an unavoidable occurrence) but also as a result of the earlier road resurfacing work where the lower lip which borders the tarmac at the edges of the road surface have been damaged. Obviously no repairs could be carried out till the drainage work is complete but we feel that the footpaths need to be assessed BEFORE the final surface layer is laid so that the road edges can be repaired FIRST. I will endeavour to send you some photos in another email but suggest if at all possible for you to come see for yourself first-hand the state of the footpaths etc.

Reply: The Drainage Division has completed the repair work to the sewer on the 18/09/2014, well inside the estimated date of the 30/09/2014. The crew working on the job were not working shorter hours at any stage. Road Maintenance has visited the area on numerous occasions and had taken note of the conditions of the footpath. It is our intention to firstly repair the footpaths and then resurface the road. Repairs to the footpath are on our works list, however Irish Water are to complete work in this area prior to this. Once Irish Water has completed their works, the repairs to the footpath will commence. Resurfacing the cul de sac will follow once the repair of the footpaths is complete.

To ask the Chief Executive to carry out following works: Eaton Square, Terenure; repaint railing & bins, repair/replace wooden pads on benches – many are in bad repair. Reply: The repair to the benches at (details supplied) is scheduled and will be carried out within the next 2 weeks. There are no plans in place at the moment to carry out repainting in the park but it will be considered in future work programmes.

Councillor Ruairí McGinley To ask the Chief Executive if the bottle bank currently located in middle of Terenure village could be relocated to one of the 3 supermarket car parks in the village and if some screening could be put in place in the meantime. Reply: The bottle banks located in the car park of Terenure village have been in place for the past ten years; they have an established use and play an important recycling role with the local community. They are operated and managed on behalf of Dublin City Council by private contractors, Rehab Glassco. The suggestion of relocating the bottle banks to an alternative car park is not one for the Council to decide as supermarkets are private grounds and permission would need to be sought initially by management. The grounds are maintained on a daily basis and banks power washed on a weekly basis by Dublin City Council personnel. In addition these banks are serviced by the contractor twice a week. With regards screening, the Local Area office can advise if the banks could be adopted under the anti-litter and anti-graffiti ‘adopt a bottle bank’ scheme. The three supermarkets will be approached to see if they are willing to allow relocation of the bottle bank. The bottle bank will also be looked at under the “Adopting a bottle bank” scheme as regards its general appearance.

Reply: The provision of cycle parking bike stands in Terenure Village has been forwarded for inclusion in the Cycle Parking 2014 project. The provision of cycle stands is handled in batches whereby a number of suitable locations are provided with cycle stands under one contract. It is not possible to provide a more accurate timeframe at this stage, but the Councillor will be kept informed as information becomes available.

Q12. Councillor Ruairí McGinley To ask the Chief Executive to address matters below: The erosion of the grass along Sandymount seafront as a result of the toxic killers used by Dublin City Council in an effort to control growth. There should be a year- round grass-growth at this location. The bags of sand returned after the flooding alert have been left out in the open resulting in many of them deteriorating so as they cannot be reused. This is a pitiful waste and an added eyesore. They should be placed inside the containers. The containers could be better placed in the trees and growth, removing a blight on the landscape.

Reply: All Parks and Landscapes Services staff who work in the area have been instructed that grass and vegetation growing along Sandymount seafront is to be controlled by mechanical means only and it is intended to reinstate the area as quickly as possible.

Q13. Councillor Dermot Lacey To ask the Area Manager if she will arrange for a new street light to be erected at the Waterloo end of Wellington Lane. This end of Wellington Lane is very dark, spooky and threatening at night. It would make a great difference to the residents both mentally and physically for a street light to be put in place at that end of the lane. Reply: The installation of an additional public lighting standard here will be considered as part of a future programme of improvement works, subject to finances made available.

Councillor Dermot Lacey To ask the Manager to arrange the large tree outside number 12 The Pumphouse to be pruned and ivy on the wall to be removed as much as possible as both are causing real problems for residents. Q16. Councillor Sonya Stapleton To ask the Area Manager to put a safety railing or bollards on Camden Street in front of Marie’s fruit and vegetable stands. With congested traffic on Camden Street and in winter high winds she has no protection. This is a safety precaution for her and the public as her stall is in danger of falling out onto traffic. Reply: Following an on-site inspection; a pedestrian guardrail is not recommended. Guardrails should only be installed where there is a proven or demonstrable safety benefit, for example where people may inadvertently step onto the carriageway (e.g. at a school entrance). Items of street furniture including pedestrian guardrails are not intended to provide fixing points for casual traders.

Q17. Councillor Sonya Stapleton To ask the Area Manager to implement a plan to paint outside of flat complexes. All Pembroke South Dock blocks need to be painted as they have not been painted in many years. Details below of complexes urgently needing attention: Whitefriar Street Gardens, McDonagh House and Golden Lane flats. Dublin 2. These are in very bad condition and residents have stressed urgency of need to have them painted. With the Radisson Hotel facing them it does not paint a pretty picture for tourists and is bringing down general morale in the community. Reply: Flats / apartments in South Docks are not City Council units and therefore the responsibility for painting these units lies with the owners. Whitefriar Street flats and McDonagh House were listed for Precinct Improvements; therefore painting of these complexes was postponed. Both of these complexes have now been included on our 2015 Painting Programme. The units in Golden Lane are houses. The painting of houses is the responsibility of the tenants.

Q18. Councillor Sonya Stapleton To ask the Area Manager to have grass and tree cut down at the back of Cuffe Street flats beside O’ Callaghan’s Hotel as a matter of urgency. Reply: Parks and Landscapes Services will contact the Councillor to determine the exact location of the tree and shrubbery referred to.

Q19. Councillor Sonya Stapleton To ask the Area Manager to investigate 5 Chapel Avenue, Ringsend. There is a derelict house that is causing quite a disturbance to residents in the area. Reply: 5 Chapel Avenue, Ringsend was entered on the Derelict Sites Register in July 2014. If the site remains derelict at the end of the year, in accordance with legislation, a levy will be demanded in January 2015.

Q20. Councillor Sonya Stapleton To ask the Area Manager to find a solution that will stop heavy vehicles using Bath Avenue Place as a short cut onto Bath Avenue. Possible solutions include bollards

or railings, as there are no gardens at the front of houses and a very narrow road. This is a danger to residents as vehicles drive onto pathway which is literally a foot away from residents’ front doors. Reply: Requests for speed ramps, to convert Bath Avenue Place into a cul-de-sac and bollards have been examined by an area engineer recently. Speed ramps are not recommended as Bath Avenue Place does not meet the criteria for the installation of speed ramps. Introducing a cul de sac arrangement is not recommended as it would be incongruent with the guidelines set out by the Design Manual for Urban Roads & Streets as well as the current Dublin City Council Development Plan. Bollards on the footpath are not recommended as there is sufficient street width available for vehicles to travel along Bath Avenue Place without the requirement to mount the footpath. It is an offense to drive wholly or partly along or across a footpath except for access. Incidents of illegal driver behaviour, as reported, are a matter for the Gardaí to enforce. Information regarding the issue of illegal driving manoeuvres along the footpath on Bath Avenue Place is being forwarded to the Gardaí.

Q21. Councillor Sonya Stapleton To ask the Area Manager to look into possibility of allocating plots of land that are being neglected and unused. Community organisations will transform them and maintain them with gardening projects. Two community organisations have come forward with interest in individual projects. The first plot of land in question is located at the pump house in Ringsend and the second is located at the front of Cuffe Street flats. Interested community groups are: BADRA/ the scouts in Derrynane Gardens and C.A.P. (Care after Prison). Reply: Dublin City Council has a 1530mm diameter trunk sewer traversing the land in question. The Drainage Division is open to accommodating a small horticultural project at this location provided suitable access to maintain and repair the sewer is made available when required.

Q22. Councillor Sonya Stapleton To ask the Area Manager to implement a plan to remove trees from front of the houses on Bride Street facing St Patrick’s Cathedral and to trim trees on Cuffe Street. However an overhaul of all constituency trees needing attention is required. Reply: The trees on Bride Street have been listed for removal. All trees on Cuffe Street are to be pruned in the coming winter season.

Q23. Councillor Sonya Stapleton To ask the Area Manager to work with O’Callaghan’s Hotel in finding alternatives for storing their rubbish bins. They are causing distress to residents due to late waste collections and being left close to flats. This is a fire and safety hazard and should not be allowed to continue. Reply: This hotel will be approached to discuss this issue and to find a solution that is acceptable.

Q24. Councillor Sonya Stapleton To ask the Area Manager to investigate broken windows seals, broken window locks, bars missing from windows etc. in Mercer Street flats and take steps to fix them. Both residents have been trying to get these fixed for over four years. Reply: The Area Maintenance Officer reports that he has been sourcing replacement parts

for the windows in these dwellings, however he has not been successful in locating suitable parts. New window units are on order and will be installed in these two flats within the next three to four weeks.

Q25. Councillor Mannix Flynn

Can the Chief Executive issue a report regarding illegal dumping in social housing flat complexes within the South East Area? Many residents have informed me that on regular occasions cars drive into the estates and simply dump rubbish into the large containers. This usually occurs in the evening or late at night. Reply: The issue of illegal dumping is a matter for Waste Enforcement. However, Housing Maintenance works with Enforcement in an attempt to deter the culprits. We would suggest that residents who witness the dumping support this effort by recording the details of the cars/vans that are driving in and dumping and contact the South East Area Office with the details. This information can then be reported to the Litter Management Unit who will initiate proceedings where possible.

Q26. Councillor Mannix Flynn Can the Chief Executive examine the parking arrangements in East Essex Street outside of the family court house and the immediate area? This area is very congested on regular occasions due to the parking of prison vans and Garda cars. It can be very confusing. These vehicles can park on the footpaths and can cause great inconvenience to elderly those with physical impairments. Reply: The request to examine parking arrangements on Essex Street East outside the Family Court House has been referred to the Traffic Advisory Group for examination and report. The Councillor will be informed of the recommendation in due course.

Q27. Councillor Mannix Flynn Can the Chief Executive issue a full report and update on the Assembly rooms at South William Street? This report to include the situation regarding Clongowes Boys’ Club and the basement area. This report also to contain in whose charge and ownership is the former Clongowes Boys’ Club premises in as it was never included in the formal contractual arrangements and lease to the Georgian society. Reply: The building which housed the former City Assembly Rooms is known as No. 58 South William Street and is owned by Dublin City Council. Currently part of the premises (Ground, First and Second Floors) is occupied on lease by the Irish Georgian Foundation which commenced on 4th February 2011 for a period of 30 years. The basement of the premises had previously been occupied for a long number of years by Clongowes Boys’ Club (now Trustees of Clongowes Union) who formally surrendered any interest they may have had in the premises to Dublin City Council in August 2012.

The Council is currently considering a proposal from the Irish Georgian Foundation to have the remainder of the building included in their aforementioned lease.

Q28. Councillor Mannix Flynn Can the Chief Executive report on the cash for cars signs that are erected throughout the south east area, particularly along the river front? These signs have been constantly appearing over the year and are illegal and a traffic nuisance as they are often erected very close to traffic lights with a phone number attached and they become very distracting for drivers. Reply: This office has been aware of the issues surrounding the “Cash for Cars” signs. Waste Management staff and Litter Wardens have been instructed to remove the signs. However, once removed the signs are replaced almost overnight. Staff have witnessed people removing and replacing signs and have noted the registration number of the vehicle used in the commission of the offence. When details of the vehicle are obtained they do not match the make and model of the vehicle witnessed, therefore we cannot proceed with a prosecution on the evidence provided. It has also come to our attention that the signs are now stuck on to the poles etc which are proving very difficult to remove. We are liaising with the other Dublin Local Authorities in order to gain as much information as possible but they also seem to have the same issues as Dublin City Council. We are also working with the Gardaí to identify the people involved. The signs in place advertise a mobile phone number which is not registered and therefore it is not possible to link any person to the offence in order to initiate a prosecution. We have received some important information on one person which led to the issue of a fine which remains unpaid We are in the process of attempting to issue a summons, but as the registered post containing the summons has not been accepted or collected, this office in conjunction with the Law Department proposes to seek permission from the courts to sub-serve the summons.

Can the Chief Executive issue a full report with the regards the maintenance and management of the exhibited art objects belonging to the Hugh Lane collection that are on display in the Civic Offices and other such city council offices including City Hall? How many of these works are in the permanent collection, how many are on loan, how often are they changed? Reply: There are three works on loan to City Hall. Portrait of Sir Daniel Bellingham, first Lord Mayor of Dublin; Portrait of Peter Paul McSwiney 1864 by Michelangelo Hayes and Winged Figure by Anne Madden. All three are part of the permanent collection. There are no works on loan to Civic Offices. They are not rotated.

Q30. Councillor Mannix Flynn Can the Chief Executive issue a full report regarding progress in relation to the busking bye laws that are at present before the City Council? When will the laws come before the council for ratification? Reply: The draft bye-laws were amended to take account of points raised in the submissions. The draft bye-laws which went to public consultation were amended to take account of matters raised in the submissions and other changes suggested by the City Council Law Agent. Following further discussion with the Gardaí and others it was considered that the draft bye-laws would be unenforceable without the introduction of a permit system for performers. A revised draft of Street Performance Bye-Laws, now based on a permit system, will be presented to the October meeting of the Arts, Culture, Recreation and Community Strategic Policy Committee. If endorsed by the SPC the draft bye laws will be presented to the full City Council. However, due to the extensive nature of the amendments and, in particular, the introduction of fee-based permits it will be necessary to undertake a further period of public consultation.

Q31. Councillor Mannix Flynn Can the Chief Executive issue a full report and update on traffic issues on the Milltown Road? This report also to include what arrangements, if any, have been made to stop the placing of discarded Christmas trees at the Milltown Road car park location. Also what measures have been taken, if any, to reconfigure the entrance to this car park and to remove the bottle bank recycling bins? These recycling bins are causing a great nuisance to local residents particularly during the Christmas season when they are in continuous use and create a noise nuisance as well as a traffic nuisance. This report also to contain who owns this land in its entirety. Who manages this car park? What contractual arrangements, if any, have been made between Dublin City Council and Rehab recycling at this location? Reply: The Milltown Road Car Park and adjacent open space are owned by and in charge of Dublin City Council. The Parks and Landscape Services Division manages the property and Roads Maintenance maintains the surface. The management of the parking in the car park is carried out by the Parking Enforcement Section. In order to improve the entrance to the Milltown Road Car Park, road markings have been repainted in and around the car park entrance, additional guidance arrows and lines have been provided inside the car park and a stop line/solid centre line has been provided on Strand Lane. Furthermore an extension of double yellow lines along the south facing side of No. 7 Geraldine Terrace was recommended and completed recently. The City Council have no arrangements as yet in place for Christmas tree collections in January 2015. However, the car park in Milltown has traditionally been used by the local community for the depositing of Christmas trees and all such locations are properly fenced off and signposted and are serviced on a regular basis. The bottle banks located in the public car park of Milltown have been in place for the past ten years; they have an established use and play an important recycling role with the local community. They are operated and managed on behalf of Dublin City Council by private contractors, Rehab Glassco.

The grounds are maintained on a daily basis and banks power washed on a weekly basis by Dublin City Council personnel. In addition these banks are serviced by the contractor three times every week. The four Dublin Authorities have a contractual arrangement with Rehab Glassco, which expires June 2017. Parks and Landscape Services division will examine the site in the light the above during the coming Christmas season in conjunction with Waste Management Services Division.

Q32. Councillor Mannix Flynn Can the Chief Executive issue a full report regarding the property portfolio of TBCT (Temple Bar Cultural Trust)? This report to include all commercial premises, all cultural premises and all residential premises and any interest in other properties within the Temple Bar Area. This also to include the type of leases and licenses and the revenues derived from these leases and licenses. TBCT is to be taken in to the direct administration of Dublin City Council and it is important that this committee be informed of the extent of the estate. Reply: The Temple-Bar Transitional Team is currently reviewing the property portfolio of Temple-Bar Cultural Trust in advance of the expected transfer of administration to Dublin City Council. This review involves reviewing all the cultural and commercial leases and licenses and the rental income derived from these leases and licenses. When this work is completed the Temple-Bar Transitional Team will provide a report to the South-East Area Committee in due course.

Q33. Councillor Mannix Flynn Can the Chief Executive issue a full report and update on the Dubline project? This report to include: all those who were successful in grant applications; all monies spent so far and timeframes for the work at Bernardo Square and in the office building, 3 Palace Place. Reply: The Dubline Discovery Trail is a joint project between Fáilte Ireland and Dublin City

Council. This tourism project includes three main elements, the construction of a Visitor Information Hub at Barnardo Square, Improvements to Public Realm and Improvements to Wayfinding and Interpretation.

Barnardo Square - Tender documents and drawings have been prepared by Fáilte Ireland. These documents and drawings are currently being inspected by the City Council and this process is nearing completion. It is anticipated that a contractor will be procured in November/December of this year with works commencing early in the New Year. It is hoped that these works will be completed mid 2015. The City Council have not spent any monies to date on Barnardo Square. Public Realm – Drawings and documents are currently being prepared for a Part 8

application for improvement works on High Street. It is hoped to secure planning permission and to procure a contractor in 2015. Approximately €30k has been spent on the development of preliminary plans for public realm proposals.

WayFinding – Final details are being prepared for the WayFinding scheme. It is hoped that the new Wayfinding arrangements can be placed on street early in 2015. Approximately €35k has been spent by the City Council in the planning, design and integration of the Dubline into the existing Wi-Fi scheme.

Would the Manager please arrange to have a street sign erected on Shamrock Villas, Harold’s Cross. This area has no proper sign which causes a lot of confusion. Furthermore around the corner at the entrance to Harold’s Cross Park, the address of the houses opposite is Harold’s Cross Road and this winds around to meet Kimmage Road Lower. This area is listed as Park View on Google Maps and as there is no street signage, it causes a lot of confusion. I would therefore appreciate your also arranging to have a street sign erected on this area. Reply: Two street signs will be erected at either side of Harold’s Cross Road (listed as Park View on Google Maps). Shamrock Villas has a sign erected on House No. 1.

The aspect adjacent to the trees has become particularly discoloured. Reply: Waste Management Services will arrange to have this work carried out before the middle of October 2014.

Q38. Councillor Paddy McCartan To ask the Manager to have the paths and shrubbery to the left of the Martello Tower, Sandymount near the pedestrian crossing, cleared of leaves and debris. Reply: Waste Management Services had the road and path outside Martello Tower cleaned on the 2nd October 2014. The paths and shrubbery around Martello Tower are looked after by the Parks Section.

Q39. Councillor Paddy McCartan To ask the Manager to have the area around the recycling zone on Sandymount Green cleared of broken glass and litter. Reply: Waste Management Services had the above location cleaned on the 2nd October 2014. This location is cleaned on a regular basis.

Q40. Councillor Paddy McCartan To ask the Manager to deal with the issue of graffiti at Waterloo Road (Leeson Street end). Graffiti of a particularly offensive variety is scrawled on the walls above the bus shelter. Please outline who is responsible for its removal when the wall adjoins a public thoroughfare. Reply: The owner or occupier of a property is the person legally responsible for the removal of graffiti from their own property. However, as this is offensive graffiti, the South East Area Office will arrange for its removal on this occasion.

Q41. Councillor Paddy McCartan To ask the Manager to deal with the following issue of illegal parking on the north side of the Church of St. John the Evangelist, St. John's Road, Sandymount. A vehicle (details supplied 1) has been parked for some time at this location causing considerable eyesore and obstruction. Its insurance disc has expired and it would be most helpful if some action could be taken to remove it. There are a further two vehicles on the same side with their discs expired (details supplied 2 and details supplied 3). The members of the Church's congregation and local residents would be obliged if they were removed forthwith as the Church is regularly open for public worship and they are causing extreme inconvenience. Reply: Our Abandoned Vehicles Officer will contact the registered owners of the above vehicles to establish whether these vehicles could be classed as abandoned or not.

She certainly will arrange to remove any of these vehicles if they are found to be abandoned. There are no parking restrictions in place at the location referred to and the vehicles parked at the location are not contravening any other parking regulations. There is therefore no enforcement action that can be taken on the grounds of “illegal parking”. Issues regarding expiry of tax discs and insurance have been referred for the attention of An Garda Síochána who may take action in relation to such matters.

Q42. Councillor Paddy McCartan To ask the Chief Executive to address the issue of containers at various locations on the seafront in Sandymount. Could they be relocated so as not to obstruct the views and reduce their visual impact? There are two at Gilford Road which could be placed behind the hedge. The second set at the bottle bank car park could be disguised between the trees. The third pair could be placed opposite the Aircoach bus stop and allowing the hedge to grow, the visual impact would be greatly reduced. Reply: Gilford Road Car Park and Aircoach Car Park: The two containers are placed on the grass area facing the sea. If they were placed in the car park, they would take up 3 car parking spaces and lead to complaints from users of the car parks. They would also add an obstruction in the car park due to their size and may lead to claims. It is not proposed to move them due to these factors.

Bottle Bank Car Park: Both containers are located on a green area in the corner out of the way. It would be up to Parks Dept. if they wished to plant around them. It is not proposed to move them.

Q43. Councillor Paddy McCartan Funds were set aside for traffic calming measures on Strand Rd, Sandymount. Can the Chief Executive confirm that the €11,000 will be spent this year, and has the option of radar speed display signs been ruled out? Reply: Radar speed display signs are currently being considered for implementation on a pilot basis at Strand Road. Consultation between the Intelligent Transportation Systems (ITS) Office, Senior Traffic Officers and the Area Engineer have taken place this month on this particular issue and quotes are currently being sought. Correspondence from residents and Councillors has been informative and useful in focusing efforts to deal with the issues outlined during the consultation process.

Will the Chief Executive arrange to have a higher toilet seat and the shower fixed at *details supplied, as the tenant has Parkinson’s and is not in great health. Reply: The Area Maintenance Officer reports that the following works will be carried out to

Q45. Councillor Chris Andrews Will the Chief Executive have the rat infestation in Vincent Street, Dublin 8 dealt with and also have the bottle bank at the side of these flats removed. It is extremely noisy at evening and at night-time and is way too close to residents and is not kept clean. Reply: The Team Leader of our South-side Mobile Crew has laid rat bait in this complex in

the past few weeks. He is monitoring the situation and making arrangements to have more bait laid within the next week.

The bottle banks located in the grounds of the apartments in Vincent Street have been in place for the past 10 years; they have an established use and play an important recycling role with the local community. They are operated and managed on behalf of Dublin City Council by private contractors, Rehab Glassco. The throughput at this location is high, with 582t of glass recorded from January 2014 to date. The grounds are maintained and banks power washed on a weekly basis by Dublin City Council personnel. In addition these banks are serviced by the contractor once a week and a CCTV is being installed to pursue any illegal activity. The City Council has requested that the contractor not service these containers before 8am any morning. The City Council will monitor this location over the next six weeks and if it is a case the situation does not improve, the banks will then be removed.

Q46. Councillor Chris Andrews Will the Manager supply a set of trollies for taking the goals out onto the pitch in Ringsend Park as with only one trolley which makes it particularly difficult for teams setting up pitches? Reply: There are no plans at present to provide a set of trollies at this location. However, the matter will be examined in the consideration of the 2015 Work Programme.

Q47. Councillor Chris Andrews Will the Chief Executive include the work approved by TAG (Ref. No. SR5825 Beach Road / Leahy’s Terrace) in the 2015 Works Programme, as it was not included in 2013 or 2014 Works Programmes and is long overdue? Reply: This item was approved in 2013. All works previously recommended will be considered to be included as part of the 2015 works programme, dependant on financial resources and priority of the works.

Q48. Councillor Chris Andrews Are there are any plans for a Village Development Plan for Donnybrook like that of Sandymount / Rathgar / Rathmines that are / have been considered. Reply: We are continuing the development of the Rathgar VIP which will have a life of three years and there are no plans currently to develop a Donnybrook VIP. The Dublin City Development Plan 2011 – 2017, sets the objective (SC09) “to prepare a number of schematic master plans, Village Improvement Plans (VIPs), or Village Design

Q49. Councillor Chris Andrews The Traffic lights on Sean Moore Road / Pine Road, Ringsend, facing Clanna Gael only work one direction. The pedestrian lights only work on one side and give incorrect info that it’s safe to cross when it’s not. Reply: This matter is under investigation by the Intelligent Traffic Systems section, and the Councillor will be advised of the response in due course.

Q50. Councillor Chris Andrews Can the Manager outline what flat complexes are due for painting in the South East Area and when was the last time the Whitefriar Street Flats were painted and when is the next time they will be painted? Reply: In 2014 Home Response, Lord Edward Street and the Pumphouse Apartments have

been painted and currently painting is ongoing in Pearse House flats. The Painting Programme for 2015 has not been finalised as yet. However as it is approximately ten years since Whitefriar Street flats were painted this complex has been included on our 2015 programme.

Q51. Councillor Chris Andrews Can the City Manager ensure that Clarence Place Great, Pearse Grove is swept regularly as it is being left in a mess due to Greyhound collecting the waste late and also the cars are parked in a way that means machines are not effective?

Reply: Waste Management Services Division will ensure that Clarence Place Great, Pearse Grove is swept regularly and as effectively as possible.

Q52. Councillor Chris Andrews Will the Chief Executive consider putting in more ladders along the Dodder walls to assist people who may fall in? They could be ladders that allow people to get out but don’t allow people to climb in easily. Reply: Each section of the lower Dodder river tidal estuary between bridges has been provided with access and egress points for maintenance which can double as egress locations from the estuary. Provision for extra ladders is not included in any of our four current planning permissions. Dublin City Council have no record of any member of the public falling into this stretch of the Dodder from Ringsend Bridge to Ballsbridge since recent construction works began in 2007.

The IFI and other environmental groups would be strongly against further access points to the estuary. 14 new ring buoys have been installed along this stretch of the Dodder estuary replacing the three old existing buoys. It is generally thought by various consultants and others that the introduction of extra access points to the river will encourage certain members of the public to get into the estuary thus endangering their lives due to the flashy nature of this river and that extra ladders are likely to be a more significant negative that any positive that they could provide.

Reply: Waste Management Services operate a leaves removal programme during the autumn and winter months. Priority is given to tree-lined streets with heavy pedestrian use and areas particularly prone to flooding. We will ensure that the above mentioned area is included as often as possible during the course of this programme.

Councillor Kieran Binchy To ask the manager to organise a meeting between the residents of this street *details supplied and the Area Engineer to discuss the problem with flooding in the area and to examine potential flood prevention measures. Reply: The Drainage Division is happy to meet the resident in Civic Offices to discuss any flooding issues. Irish Water may also be invited to attend, as the problems largely related to the combined network. The meeting is to be organised through the Area Office.

Councillor Kieran Binchy To ask the Manager to address the unsightly dumping at the following location *details supplied, both from a dumping and from a derelict sites perspective, as it is both an eyesore and a health hazard. Reply: A special clean up which was carried out by the South East Area Rapid Response Crew on the 3rd of September 2014. The property at details supplied has been on the Derelict Sites Register since January 2009. A charge has been registered on the land as the Derelict Sites levies have not been paid. Prospective purchasers have been in recent contact with Dublin City Council with a view to restoring the property to residential use.

Q59. Councillor Kieran Binchy To ask the Manager to address a dangerous hazard in the layout of the footpath on Eglinton Road just slightly East of Glensharoon on the same side of the road. There is a parking spot abutting a tree, but it is not at all clear and at night due to the trees blocking the streetlights it is not delineated in any way. As a result there is a serious trip hazard for pedestrians, and a local resident has tripped a number of times as they were walking at night. Can the parking spot (and dip) be clearly marked so that it is visible at night, or a bollard installed in the footpath to prevent people stepping down into it from the footpath. Reply: A bollard will be placed on the footpath towards the back of the parking bay.

Q60. Councillor Frank Kennedy To ask the Area Manager to carry out repairs to the footpaths on Nutley Avenue which are not in good condition and which need repair. Reply: Some tree damage was noted upon inspection of the footpaths on Nutley Avenue. These damaged locations will be added to our works programme for repair. However, the overall condition of the footpaths on Nutley Avenue is reasonable and does not warrant resurfacing or reconstruction.

Her interest in accommodation with Approved Housing Bodies has also been noted. Based on those positions, it is unlikely she will be reached for an offer of accommodation for some time. In order to discuss her particular circumstances in greater detail and to offer her further advice or possible options to alleviate her difficulties, I would suggest she contacts the Housing Allocations Section. The Housing Advisory Service is available in the Civic Offices, Fishamble Street., Monday to Friday each week. Alternatively, she may contact the office by telephone and Allocations staff will endeavour to offer all advices possible.

Q64. Councillor Frank Kennedy To ask the Area Manager to explain why there is a large “X” in white paint on a tree between the Merrion Shopping Centre & Merrion View Avenue and what is this “X”? Reply: The mark referred to in the question was not made by Parks and Landscape Services Division staff, and the tree is not listed for removal. Removal of the paint on the tree would damage the tree (if the paint is oil based) and if the paint is water based it will fade with time.

Q65. Councillor Frank Kennedy To ask the Area Manager to introduce an effective litter prevention strategy on the Great South Wall/South Bull Walk to the Poolbeg Lighthouse in circumstances where there is a growing problem of litter being left behind, particularly in the immediate environs of the lighthouse. Please see photo attached. Reply: The Waste Management Services Supervisor in charge of the above area reports that Dublin Port is responsible for the Great South Wall/South Bull Walk and the ESB is responsible for the South Bank Road to the ESB Station. From time to time and as the need arises, Waste Management Services together with the Parks & Landscaping Dept clean the car park on the South Bank Road. Permission must be obtained from the ESB in order to access the car park. At present, members of the

Contact will be made with both the Dublin Port and the ESB to put measures in place to prevent the creation of litter on the roads they are responsible for respectively.

Councillor Frank Kennedy To ask the Area Manager to take measures to restore grass growth alongside the promenade on Sandymount Strand in circumstances where this has been badly eroded of late, and to desist from using any toxic chemicals on the grass (as opposed to on weeds)? Please see photo attached. Reply: All Parks and Landscapes Services staff who work in the area have been instructed that grass and vegetation growing along Sandymount seafront is to be controlled by mechanical means only and it is intended to reinstate the area as quickly as possible.

Q69. Councillor Kate O’Connell To ask the Area Manager to address the following concerns, initially raised by the local residents association, with regard to the ongoing planning process at 64/66 Terenure Road West and to note my personal objection to the permission being granted: (From the association) Our understanding is that Mr Devine acquired this site from Mr. Noel O’Gara, the latter of whom claims to have obtained the site through adverse possession. However, our observations show that Mr. O’Gara only commenced work on this site during mid-2010 and consequently does not appear to fulfil the statutory minimum period for such a claim. Accordingly we cannot see how Mr. Hugh Devine can possibly secure any legal ownership to this site and/or cottage from Mr. O’Gara. The existing structure is in a conservation area with zone status objective Z2 “To protect and / or improve the amenities of residential conservation areas.” It is the view of our association that the incorporation of the centre house into the cottage is clearly at odds with Z2. The proposed development of three, two-storey detached houses (incorporating the existing cottage) is excessive in light of the site area available. The lack of symmetry between the cottage and the proposed houses can clearly be seen from the drawings and seems to us to be quite extraordinary. The design and structure of these proposed houses are not in keeping and offer no uniformity to the existing mature properties either immediately adjacent to or for those in close proximity. The way in which the existing cottage has been incorporated into this development has done nothing to improve the overall appearance. There is no indication as to the colour of the brick being proposed in the structure of these three two-storey houses, bearing in mind that the existing properties are all red brick. The proposed House Number 2, in the middle of this development, is six rooms deep on the ground floor and as such is not in keeping with any existing property on the road which are all two rooms deep or indeed compared with the proposed Houses Number 1 and/or Number 3. The rear portion of all three proposed two storey houses extend an unacceptable distance beyond the southern line of the existing properties, creating both an intrusion for number 68 and a resultant loss of light, and the same impact on number 62. The resultant restricted driveways will make it impossible for vehicles to complete a turn and so will either have to reverse into their driveways or alternatively reverse out onto a very busy road, which is already a long-standing serious traffic problem for the area and where many school going children walk to school, and is the bus route of the 15A and 17. The multiple openings and driveways proposed are excessive for the space available in the existing wall, which will almost disappear. Reply: A current application is before the City Council for decision by the 23/10/2014. The Councillor’s comments on behalf of the local residents will be referred to the Area Planner for her information and consideration.

Councillor Kate O’Connell To ask the Area Manager, in light of recent complaints by some residents, if there are any plans to restrict parking on Kenilworth Lane and, if not, to recommend that such a proposal be considered. Reply: The request for parking restrictions on Kenilworth Lane has been referred to the Traffic Advisory Group for examination and report. The Councillor will be informed of the recommendation in due course.

Q71. Councillor Kate O’Connell To ask the Area Manager to provide a history of the Council's efforts to address the complaints of the residents in the immediate vicinity of Dublin Port who have been irritated by the operation of cranes through the night. Ideally, I would like to know what plans are afoot to improve the situation. Failing that, I would like see any investigations that were undertaken which lead Dublin City Council to believe no action was necessary. It would also be very helpful to be directed to any questions (with answers) on this issue that had been submitted in the past. Reply: Matters referred to in this question are sub judice as they are inter alia, currently the subject of proceedings before the High Court. The most recent hearing on these matters was before the August and September summer court recess 2014 and a further hearing is scheduled when the Courts reconvene in early October.

Q72. Councillor Kate O’Connell To ask the Area Manager to address the issue of severely overgrown trees at 88 Greenlea Road, Terenure, on the corner of Greenlea Drive. Reply: The trees indicated in the question are on private property and their maintenance is a matter for the property owner.

Q73. Councillor Jim O’Callaghan To ask the Chief Executive whether the gates installed at Grove Road flats complex be activated electronically and the waste bins be made accessible by residents only so as to prevent dumping of mattresses and domestic waste by non-residents on a daily basis. Reply: Due to budgetary restraints it would not be possible to supply access electronics to the gate at the above housing complex at this time. The issue of illegal dumping is a matter for Waste Enforcement. However, Housing Maintenance works with Enforcement in an attempt to deter the culprits. We would suggest that residents who witness the dumping support this effort by recording the details of the cars/vans that are driving in and dumping and contact the Area Office with the details. This information can then be reported to the Litter Management Unit who will initiate proceedings where possible.

Reply: Waste Management Services operate a leaves removal programme during the autumn and winter months. Priority is given to tree-lines streets with heavy pedestrian use and areas particularly prone to flooding. We will ensure that the above-mentioned area is included as often as possible during the course of the programme.

Q75. Councillor Jim O’Callaghan To ask the Chief Executive to install more bike racks in Ranelagh and to provide public pumps for bicycles throughout the South East Area. Reply: The provision of cycle parking stands in Ranelagh will be examined by the Area Engineer and forwarded for inclusion in the Cycle Parking 2014 project if appropriate. Similarly, the proposal to supply public bicycle pumps will be considered as part of the Cycle Parking 2014 project. The Councillor will be kept informed as information becomes available.

Q76. Councillor Jim O’Callaghan To ask the Chief Executive whether there is any basis upon which rates bills for a number of sports clubs in the Dublin 6 (Rathgar) area (who are not for profit making entities) can be reduced or whether they might qualify for an exemption under the charitable exemption proviso in the Valuation Act. Reply: Schedule four of the Valuation Act 2001 sets out details of relevant property not rateable. The schedule includes land used for agriculture, horticulture, forestry and sport. Also, buildings used exclusively for public religious worship, caring for sick persons, educational institutions, any art gallery, museum, library, park or national monument which is open to the public and not maintained for the purpose of making a private profit, community halls and buildings used for charitable purposes by a charitable organisation (see sec. 16).

The Valuation Office assesses each property and use in order to establish if it is list rateable or exempt in accordance with Schedule 4. Where an occupier of a property is satisfied that exempt status should apply he/she must apply for a revision of valuation to the valuation office at Irish life Centre, Abbey Street Lower, Dublin 1. Information is also available on www.valoff.ie. The Minister for Public Expenditure and Reform, Brendan Howlin proposed recently that rates should only be levied on the part of a club that can be described as revenue generating. Currently if there is a bar on the premises clubs must pay rates on their entire property. No details have been received to-date in relation to this proposal. The Valuation Office will assess the impact of this proposal in due course.

Councillor Claire Byrne To ask the Chief Executive if she could consider planting trees in the Ringsend area on Gordon Street, South Dock Street and the streets in between, which would greatly improve the aesthetics and biodiversity of the local environment. Reply: The locations referred to in the question have been examined and found to be unsuitable for tree planting due to the narrowness of the pavements, and the proximity of the houses due to lack of front gardens.

Councillor Claire Byrne To ask the Chief Executive if she is aware of the increase in complaints about rats found inside households in the Portobello area in recent months, and the noticeable increase in visible rats along the Grand Canal, and if she could outline what measures are in place to control rat populations in the South East Area. Reply: Dublin City Council will bait manholes in proximity to properties affected by vermin as complaints arise. The problem of vermin entering houses and the dealing with this issue is a matter for Irish Water as the area has a combined sewer network and is also an issue for the Health Services Executive.

Q83. Councillor Claire Byrne To ask the Chief Executive to review the sequencing of the pedestrian and cycle lights at the junction of Bull Alley Street, Bride Street and Golden Lane. Currently the cyclists light turns green at the same time as the oncoming right turning traffic, making it difficult for cyclists to cross safely. Could the Chief Executive consider sequencing the cyclist light with the pedestrian crossing light as is the case at the junction of Patrick Street and Bull Alley Street to allow for a safer crossing? Reply: This matter is under investigation by the Intelligent Traffic Systems section, and the Councillor will be advised of the response in due course.

A planning application for improvement works to the streets to the west of Grafton Street (Chatham Street, Harry Street, Balfe Street, Chatham Lane, Swanyard, Johnson Court and part of Wicklow Street) was lodged in July 2014 and a report on this matter will be brought to the November meeting of City Council.

Subject to approval and a tender process it is hoped to have a contractor appointed to commence works early next year. Enhanced cycling infrastructure and general provisions for cyclists is referenced in the Public Realm Plan and detailed proposals in relation to cycling will be developed and implemented over the coming years in consultation with the City Council’s Roads and Traffic Division.

Councillor Claire Byrne To ask the Chief Executive review the water pipes and drainage system in Glovers Court to assess the ingoing issues of blockages and damp that the residents are experiencing. Reply: The Area Maintenance Officer reports that the drains in this location have been cleared on a number of occasions. Our Housing Maintenance Engineer will carry out investigations to identify any further issues that need to be resolved over the coming weeks.

Councillor Claire Byrne To ask the Chief Executive if she can issue a report regarding what action has been taken against waste service providers in the South East Area who are in breach of the designated waste collection day as outlined in the Household Waste Collection Bye-law’s and how many warnings and fines have been issued in this regard to date. Reply: The waste bye-laws are currently being implemented by the South East Area Litter Wardens. All areas are being closely monitored by staff and investigation of all complaints and appropriate actions taken where necessary. In terms of numbers of complaints, it should be stressed that the primary relationship is between the customers and their relevant waste operator, so we would not have comprehensive records and essentially would only deal with complaints if they relate to potential breaches of the bye-laws. A total of 15 fines have been issued to waste service providers since the introduction of the Bye-Laws for Storage, Presentation & Collection of Household & Commercial Waste. Four fines related to breach of Section 7c of the Bye-Laws, i.e. collecting waste on a non-designated day outside the Central Commercial District. Six fines were issued for collecting waste outside the designated collection time within the Central Commercial District. Five fines were issued for failure to provide a door-to door collection.

Q89. Councillor Claire Byrne To ask the Chief Executive for an update on the plans to provide recreational and green space in the Grand Canal Dock area, the proposed development of Chocolate Factory Park and whether the green spaces surrounding the dry docks could be considered for redevelopment as a recreational area rather than for commercial purposes. Reply: The proposed green spaces in the Grand Canal Dock area have been designated under the Dublin Docklands SDZ as approved by An Bord Pleanala. These areas will be developed in the context of a public realm masterplan, which will be subject to a procurement process. It is expected that this procurement process will be completed prior to Christmas with a detailed masterplan in place by the middle of 2015. The site of the proposed Chocolate Park is in the ownership of two separate entities. Dublin City Council is presently in discussions to acquire the legal interest of one half of the park from one of these entities. Upon acquisition of same it is intended to develop this site for the purposes of a park. As part of this process, Dublin City Council is currently procuring the services of a landscape consultant to design a schematic plan for this park. The other half of the park is in separate ownership, with this part of the park to be delivered as part of an SDZ planning application. The dry docks (graving docks) area is designated for residential, commercial and community purposes, through which water-based recreational facilities are to be promoted. The provision of a recreational area in place of the said uses would be non-compliant with the Dublin Docklands SDZ, as approved and would therefore not be considered acceptable. It is envisaged that the provision of the recreational spaces as designated in the SDZ will satisfy existing and future demand in the area.

Q90. Councillor Claire Byrne To ask the Chief Executive to outline what communications procedures are in place to inform residents of the Grand Canal Dock area about events and festivals taking place in the locality, and whether the Chief Executive will arrange a meeting with the Grand Canal Docks Residents’ Association to discuss the residents’ general concerns in more detail. Reply: We met with the residents on the 24th September 2014 and have agreed to meet on an ongoing basis. The Events Unit receive some requests for Events taking place on the public roads in the Docklands area, managed by Dublin City Council. Waterway Ireland and Bilfinger Management Company also look after events taking place in Grand Canal Dock and Grand Canal Square. As part of the application process for outdoor events in the City, that come through the Events Unit Dublin City Council, Event Organisers must notify business/residents in the area of the proposed event taking place. This letter generally goes out three to four weeks prior to the event taking place. The notification that goes to residents must give an overview of the event and must include the event organisers contact details should a resident have any queries in relation to the proposed event. Proposed Draft Variation of the Dublin City Development Plan 2011-2017 Location: Belmont Avenue/Mount Eden Road & Environs

_________________________________________________________________________ Proposal: It is proposed to vary the Dublin City Development Plan 2011-2017 by designating Belmont Garden/Mount Eden Road and Environs an Architectural Conservation Area (ACA). This proposed draft variation arises from the Dublin City Development Plan 2011-2017 Objective FCO32 (Chapter 7 Fostering Dublin’s Character & Culture) which states that it is an objective of Dublin City Council;

“to designate additional Architectural Conservation Areas, including residential, suburban areas of the city with the specific objective of reducing buildings in these areas which are listed on the Record of Protected Structures, as appropriate. (Any buildings selected for deletion from the RPS will be of local rather than regional significance. These ACAs will protect primarily the front facades and streetscape character and will remove the protected structure status of such buildings (see Appendix 11)”.

and Appendix 11 Proposed Architectural Conservation Areas which states;

“It is proposed to designate nine ACAs throughout the city and delete the buildings of lesser importance within them from the Record of Protected Structures. The boundary of each ACA is delineated with a detailed description of the architectural character and special interest of the area.”

Belmont Avenue/Mount Eden Road and Environs is listed number nine in the ACA’s proposed for designation in Appendix 11. Site Description: The Belmont Avenue/Mount Eden Road and Environs Architectural Conservation Area is located four kilometres south east of the city centre, adjacent to the busy shopping area of Donnybrook. It comprises Belmont Avenue, Mount Eden Road and Belmont Park. The ACA is centred on Belmont Avenue and Mount Eden Road and includes the short Belmont Park terraces. The area is bounded by terraced housing on Morehampton Road and Madigan’s public house to the east and stretches to Belmont Park on its western extremity. It includes some more recent buildings which generally follow the established pattern in terms of heights, massing and materials. It does not include the institutional lands adjacent to the boundary of Mount Eden Road. The proposed variation area is attached, and the exact boundaries of the proposed Architectural Conservation Area are delineated on the location map accompanying this summary document. Explanation: In accordance with Objective FCO32 (Chapter 7 Fostering Dublin’s Character & Culture) and Appendix 11 of the Dublin City Development Plan 2011-2017, to designate additional

Architectural Conservation Areas, including residential, suburban areas of the city with the specific objective of reducing buildings in these areas which are listed on the Record of Protected Structures, as appropriate, it is proposed to designate Belmont Avenue/Mount Eden Road and Environs as an ACA. This ACA will protect primarily the front facades and streetscape character and will remove the protected structure status of 75 buildings which are considered to be of local rather than regional significance. However the ACA will retain the protected status of a number of significant buildings as exemplifying more distinct examples of their period. These are numbers 2, 23, 58, 60, 62, 64, 70, 85, 87, 89 and 91 Belmont Avenue. The most significant of these is Belmont House, 70 Belmont Avenue, a detached three-bay, two-storey over basement house, built circa 1720. Belmont Avenue follows an historic laneway that connected to two important city access routes. Belmont Park is a cul-de-sac of smaller terraced housing and Mount Eden Road has a right angled bend with a variety of terraces, modern mews buildings and more substantial semi-detached buildings. The building pattern is diverse and has evolved with quite a dense grain and short front gardens. The architectural conservation area focuses on a core of late Victorian/Edwardian dwellings. The houses of Belmont Avenue are either arranged in terraces or semi-detached with a small number of detached and semi-detached earlier villa type houses located at its western end. Mount Eden Road has a different character with larger semi-detached houses and more generous plots enhanced with mature landscaping. An open space frames the imposing Dominican Convent on its western boundary. An attractive stone stable building enjoys a large plot set back from Mount Eden Road with brick dressings. The terraces of Belmont Park are more modest but nonetheless ornate.

The key policies and objectives of the Architectural Conservation Area may be summarised as follows: -

� It is the overall policy of Dublin City Council to protect and conserve the character and setting of Belmont Avenue/Mount Eden Road and Environs. The ACA report will identify the special character and architectural interest and seek to manage change in such a way as to preserve that special character.

� Owners and occupiers of non-protected structures located within the Belmont

Avenue/Mount Eden Road and Environs ACA should note that the carrying out of works to the exterior of a structure located in an architectural conservation area shall be exempted development only if those works would not materially affect the character of the area. For example, works of alteration to streetscape features such as roofs, walls, windows and doors, rainwater goods or the curtilage bounding a house may not be exempted development.

� It is the policy of Dublin City Council to seek the repair and retention of traditional

fabric of special interest; including those structures, which may not be protected structures. In terms of advertising structures inappropriate signs and advertising structures shall not be permitted.

� It is an objective that any new developments should have regard to the character of

the adjacent buildings, which shall include height, massing, scale and plot width.

Area Manager’s Report Southern Campshires Flood Protection Scheme Planning approval was received from An Bord Pleanála in May 2012 and Dublin City Council appointed consultants to complete the detailed design of the project and bring it through the tendering and construction phases. An information meeting for residents and Councillors was held on Monday 10th March 2014 in Gloucester Street Sports Centre. A presentation was made by Dublin City Council’s design consultants and residents were given an opportunity to ask questions. The OPW who are funding the project are now going to carry out the works themselves. Works started on Monday 13th October and will continue for 15 months. Georges Quay will be the first works location with site offices east of BJ Marine Buildings. Grand Canal Sub Group The Group last met on 8rd October 2014 and a number of councillors attended. Mervyn Hamilton of Waterways Ireland has taken over responsibility for roll out of canal warden scheme. Feasibility of using community service workers for maintenance works along the canal is being examined by WI. Waterways Ireland Operational Liaison Group (OLG) met on 19th September 2014. The group intend, in conjunction with the Royal Canal Group, to hold a Dublin Canals Volunteer Clean Up Day during the National Spring Clean Up in April 2015 similar to Dodder Action Day and are currently researching the matter. The group produced a draft “Corporate Social Responsibility” document for distribution to businesses in close proximity to the canal. The group will also investigate the possibility of developing a cultural festival at Portobello Harbour during May 2015. Irish Ship & Barge Fabrication Co. has secured a three month lease on the Naomh Eanna pending submission of a development plan and finances. The next meeting of the Grand Canal Sub Group is due to be held on12th November 2014. Ranelagh Gardens Park The Ranelagh Gardens Park user group was set up in 2014 following a meeting on site in October 2013 with residents and the Parks Department. A further meeting with residents, Parks Department and South East Area Office took place on 20th February 2014 chaired by Cllr. Mary Freehill. Design proposals were brought to this meeting by Parks Department for discussion. A second meeting, with a smaller working group took place on Monday 7th April 2014 during which there were detailed discussions of proposals made by Parks Department. A further meeting took place on 9th May to finalise the design proposals. The core proposals included the provision of a play area, improvements to the pond, enhancing environment and biodiversity. The final design was discussed at a full meeting with residents on 21st May 2014; however consensus could not be reached. At a meeting with SEA Office, Parks Services and all SE Area Councillors on 23rd September 2014 it was agreed that Part 8 approval should be sought for the redesign of the park and this is scheduled for December 2014. Minor works to the north side of the pond edge were carried out in October 2014. Funding will need to be sought in the Parks budget for 2015 to carry out any works agreed via Part 8.

Rathgar Village Improvement Plan (VIP) Arising from the motion agreed at the South East Area Committee (SEAC) in November 2013 to pilot a study for public realm enhancement in Rathgar, a brief was proposed at the SEAC in February 2014. The South East Area Office carried out on-street consultations in Rathgar Village over three days in mid May. Further meetings were held during week commencing 26th May with Rathgar Residents Association (RRA) and Rathgar Businesses Association (RBA). Local schools and churches were also consulted, and an interim report of these consultations was compiled and circulated to Councillors in June. This report formed the basis for the Public Workshop held on 26th June 2014 in Rathgar Tennis and Bowling Club. Short, medium and long-term goals were discussed and voted on at the workshop. A report of the outcome of the workshop has been circulated and posted on the Rathgar VIP dedicated web page. Works departments in Dublin City Council were briefed initially and detailed meetings with departments are taking place in September to assess the feasibility and costs of goals. Further meetings were held with RRA and RBA on 1st and 2nd October 2014. A draft Rathgar Village Improvement Plan (VIP) outlining proposed improvements has now been developed and circulated to councillors and stakeholders and is published on the DCC website. A further four week period of public consultation commenced on 14th October 2014 and ends on 11th November 2014. The finalised Rathgar Village Improvement Plan (VIP) will then be brought to the South East Area Committee. London Bridge Slí na Sláinte The proposal for the Slí came from Bath Avenue and District Residents Association (BADRA) who are funding the project. The route was developed by BADRA in conjunction with Dublin City Council, South East Area Office, and the Irish Heart Foundation (IHF). The group met and considered a number of routes over the past year before agreeing on the proposed route (map attached). On agreement of the proposed route the South East Area Office circulated the proposal to local groups including Sandymount and Merrion Residents Association (SAMRA) and Sandymount Tidy Towns. Objections to the proposal were received from both of these groups, mainly on the basis that the related signage would add to street clutter. Slí na Sláinte (Path to Health) is a Health Promotion initiative of the IHF designed to encourage people of all ages and abilities to walk for health and leisure supported through a network of over 210 uniformly sign posted walking routes nationwide. Slí na Sláinte routes are signposted at km intervals to help walkers reach distance targets. The routes also have a map-board at the start/end point of the route and directional signage. Dublin City Council will have responsibility for maintenance of related signage in the public domain after installation. When the route was assessed and approved by the IHF, DCC took every measure to ensure that the minimum number of signs and poles would be used on the route, and we endeavoured to use existing DCC poles wherever possible. The signs proposed for this Slí na Sláinte are in keeping with the other 23 routes developed in association with Dublin City Council and local communities. The signage is fully compliant with road signage standards. The South East Area Office held a meeting with all parties on Wednesday 3rd September 2014 to address the objections raised in this case. It was agreed that all parties would walk the proposed route with the intention of addressing and inspecting health and safety and signage requirement concerns along the route that were raised during the course of the meeting. The route was walked by reps from SE Area Office, BADRA, SAMRA, IHF and Sandymount Tidy Towns Committee on 20th October 2014. Led by the IHF the group walked the full route stopping at staging points where signage or new poles were required. By agreement there were a number of points where it was agreed that new poles could be dispensed with and existing public lighting poles/Aviva directional poles used instead. Along

the 3.7km route only four new poles are now required and only one of these is in the Sandymount Architectural Conservation Area. This pole outside the Spar shop at the corner of Claremont Road and Sandymount Road could be affixed in the location of a missing traffic bollard. Having assessed the route the IHF state that ‘the proposed route meets our criteria for what constitutes a suitable safe, accessible Slí na Sláinte route....’ Following mitigation of signage requirements along the route a decision was made to proceed with the proposed Slí na Sláinte. IHF will commence preparation of art work for the brochure and map board in conjunction with BADRA and arrangements will be made to procure the required signage. The Slí na Sláinte is likely to be launched in January 2015 when flood alleviation works along Beatty’s Avenue are completed. Marine Terminals Limited (MTL) MTL has sought a Judicial Review of Dublin City Council’s decision to issue an Enforcement Notice. The matters involved are sub judice as they are inter alia, currently the subject of proceedings before the High Court. Community & Social Development Report Please find below a list of events and projects organised and/or supported by the Community Development Team of the South East Area Office. The Rose Festival – 26-27 November from 10-5pm at the Carmelite Centre, Aungier Street. Finale to this year’s Friends of Green Spaces Project with a variety of roses on sale for €3 each. Community Grants Scheme – This scheme has now been advertised. Completed application forms to be submitted by 5pm, 28th November 2014. All information can be found on www.dublincity.ie Christmas Events in the Community A wide variety of entertainment / activities including local Choral Groups, Theatre Groups, Christmas Jazz, Christmas Readings and Santa on his horse drawn sleigh. Grafton Street Quarter The repaving works to Grafton Street are complete. The remaining public lighting works have commenced and will be completed as soon as possible. Discussions in relation to future cleaning and maintenance arrangements for the street have commenced with businesses and business representative groups. The Part 8 planning report for the next series of projects (those streets to the west of Grafton Street) was presented to the November meeting of City Council. Crampton Buildings The main refurbishment works are about to commence on site and will continue for approx. 12 months. A liaison arrangement is being put in place between the contractor and the ground floor commercial units. Regular updates will be provided to Councillors and to residents in relation to progress with the works. Charlemont/Tom Kelly. An afternoon of Halloween festivities was held in the community hall on the 31st October with a scary movie, children's games and fancy dress competition judged by two Community Gardaí. The Project Office continues to serve the community and to support and participate in any local activities. The first Regeneration Board meeting is scheduled for 4th of November and the next Community Safety meeting is due to take place the 20th of November.

When the Simmonscourt Road traffic turns right because of a lack of visibility it can often rear end the left turn traffic from Sandymount Avenue. This is a recurring problem as indicated by the Gardaí on the scene of a recent accident at this location.

To ask the Manager to have a traffic engineer examine the volume of traffic at the Sikh Temple on Serpentine Avenue on either a Tuesday evening or a Sunday afternoon (the times at which events take place most frequently) with a view to forming a traffic management plan for the area at these times. There is a huge volume of traffic due to the events taking place. In recent weeks an accident took place outside this venue. Further, Serpentine Avenue and Oaklands Park are subject to heavy volumes of traffic and great difficulties with parking at these times.

To ask the Manager to resolve the problem of the rat run of traffic passing through St. Kevin’s Road and Lennox Street, Dublin 8, in order to be able to turn onto south Richmond Street. This is particularly dangerous on St. Kevin’s Road which is a residential street with many families with young children playing on the road.

To ask the Chief Executive to deal with the following issue at the junction of Clanwilliam Terrace and Lower Grand Canal Street. A buddleia tree is growing out through railings onto the pavement and is an impediment to pedestrians in the area.

Q29. Councillor Paddy McCartan To ask the Chief Executive to ensure leaves do not block the gullies on Anglesea Road. Paths were recently flooded and it was necessary for residents to walk on the main road.

To ask the Chief Executive to address the issue of the lack of a continuous footpath exiting Herbert Park onto Clyde Lane, Ballsbridge. If a number of street parking bays were removed, a new path running along the side wall of Ardoyne House could link with the existing path. This is a safety issue for students and parents with buggies.

Q31. Councillor Paddy McCartan To ask the Chief Executive to address the difficulty of safe access to Sandymount Green for wheelchair users coming from Mount Tabor Nursing Home. The footpath along the outside of the Green is too narrow whilst on the shop side of the road, the pavement opposite the gate is too high. A dished footpath at this point might be the solution.

Q32. Councillor Paddy McCartan To ask the Chief Executive to deal with the following issue. At present, there is one invalid parking space outside the church in Milltown. It is beside the railings of the pastoral centre and you have to mount the path to gain access. It is not easy to reverse out of. Would it be possible to request another invalid parking space on the road to facilitate access to the church and pastoral centre? This could be achieved by converting one space outside either Wilde and Green, the pharmacy or Alexandra College.

Q65. Councillor Mary Freehill Would the Manager please indicate what progress has been made on, the apparent illegal erection of a gate at the entrance to Wharton Terrace off Harold’s Cross Road? The last information some months ago was that ownership of the lane was being established. I point out that there is an old green City Council street sign there which would indicate that it is a public lane. Also see letter from a long time resident regarding the history of this lane which used to have a terrace of cottages prior to the ESB station.

My memory as a long term resident of the area is that Wharton Terrace originally consisted of 1) a row of houses (terraced as name suggests), which has been

replaced the present Electricity substation; 2) a detached house on a plot bounded by HX Cotts 1-8 and Armstrong

St 13-25, now replaced by three dwellings on the same plot; 3) Wharton Hall; 4) a storage location which served the shop on HX Rd which traded until

recently as AMPM.

My understanding is that access to these properties was by a public thoroughfare, with limited vehicular capacity entered from HX Road beside previous AMPM store.

Recently Wharton Hall was declared derelict, presumably by the appropriate Department of DCC. I do not know the effects of such a declaration.

In the past two weeks a coded access gate has been erected close to the junction with HX Road. This gate carries a notice claiming that it bounds private property. As I mentioned above the previous access route was a public thoroughfare with, should my memory not fail me, Dublin Corporation (as it was then) public lighting.”

Also what is the legal situation regarding the building on Wharton Hall. There is a Bord Pleanála decision to have the top storey removed. That decision was quite some years ago. If the owner claims not to be able to afford to comply with this request and if the Council does not take any action, does it mean that the owner could eventually be absolved from taking any action? Currently this site is unprotected.

Also with the new diversions of buses coming down Aungier Street due to Luas works this problem will be extremely dangerous.

as soon as possible, to avoid an accident. This Lady has also reported to the council that her kitchen presses are falling off the wall and she has an issue with her boiler. (Details supplied) This lady is quite distressed over these issues and this has been reported multiple times.

Q73. Councillor Sonya Stapleton To ask the Area Manager to put bollard or railings in front of Marie’s fruit and vegetable stand on Camden Street. This was refused in previous request, however since then there has been an accident where her stall was caught by the wind and derailed out onto traffic. Thankfully this time no one was injured but it is a matter of time. I feel very strongly that we support Marie in her request, and also protect pedestrians and ongoing traffic.

Councillor Sonya Stapleton To ask the Area Manager if there are allowances made for single men/women when applying for housing if the person is step parent to a child and has been since the child was born. I have a constituent that has been refused entry onto the housing list on these grounds.

Q75. Councillor Mannix Flynn Can the Manager replace the ambulance markings at Stable Lane, Harcourt Street, outside of the senior nuns’ quarters? This marking has worn away and eroded and many incidences vans and cars park here illegally making it very difficult for the elderly nuns who must use an ambulance on occasion and very difficult for the ambulance drivers.

Can the Manager give an update as to the progress of legislation to deal with 'Chuggers' - charity collectors on our streets? This issue has become a great irritant for many pedestrians who are trying to get about their business. In many streets people are met with a wall of teams of Charity collectors from the various organizations. This is the height of anti-social behaviour and obstruction on our streets. There are also cases of outright aggression to people who just want to ignore them and get by. Irish citizens and Dubliners are more than generous to charities, the poor and many causes but this 'chugging' activity and its growth is eroding that good will. These teams are organized by a private company and not by the charity organizations themselves and are trained in a rather persistent and aggressive technique in order to extract signatures that allow payment to the various charities.

Can the Manager inquire as to whether it is possible to adorn the walls of the Dublin City Council canteen at Civic Offices with some of the artwork of the Hugh Lane gallery and other works that are in the collection of Dublin City Council? The canteen is a place of social gathering for all workers at DCC and it’s a morale boost and good social capital to acknowledge the good work that is being done at DCC and the many great staff and their commitment. This space is an ideal location for permanent and revolving exhibitions. For instance, once could initiate this through the staff choosing their favourite works and an image of that work or the original to be put on display.

Can the Manager request the relocation of the bus stop on Georges Street that is a couple of yards on the east side of Georges Street beside the Georges Street Arcade? This location is becoming a hotspot for anti-social behaviour and the like and many traders and residents in the area have complained to me on numerous

occasions. This is a very tight spot for pedestrians and bus users alike and can cause a bottle neck on Georges Street with pedestrian movement. Perhaps this bus stop can be amalgamated with the bus stop further up the street ('old Winstons' building) where there is ample footpath space and width.

Can the Manager issue a full report regarding the community gain aspect and amounts of finances available for community gain in relation to the waste to energy facility at Poolbeg? This report to include all procedures as to how this community gain finance is to be awarded / distributed? Who will administer these grants? And what is the geographical spread that is to be included for applicants to these grants. Also how much money is available to community gain?

DCC community development section has an opportunity here to create residential and community committees that can enhance these neighbourhoods and these social housing complexes and work on behalf of the whole community for its betterment.

It’s timely now that this committee received an up to date report on what is envisaged.
