On the basis of information furnished by the registrant, the above named pesticide is hereby registered/reregistered under the Federal

Insecticide, Fungicide and Rodenticide Act.

Registration is in no way to be construed as an endorsement or recommendation of this product by the Agency. In order to protect

health and the environment, the Administrator, on his motion, may at any time suspend or cancel the registration of a pesticide in

",ccordance with the Act. The"acceptance of any name in connection with the registration of a product under this Act is not to be

construed as giving the registrant a right to exclusive use of the name or to its use if it has been covered by others.

This product is conditionally registered in accordance with FIFRA sec 3(c)(7)(A) provided that you:

1. Submit and/or cite all data required for registration of your product under FIFRA sec. ~(c)(5) when the Agency requires all registrants of similar products to submit such data; and submit acceptable responses required for re-registration of your product under FIFRA section 4.

2. Make the labeling changes listed below before you release the product for shipment:

a. Revise the "EPA Registration Number to read, "EPA Reg. No. 71240-6".

b. Include the following statement to the "Precautionary Section" to read:

"Wear long sleeved shirt and long pants, socks, shoes and chemical resistant gloves. A respirator with an organic-vapor removing cartridge with a prefilter approved for pesticides (MSHAINIOSH approval number prefix TC-23C), or a canister approved for pesticides (MSHAINIOSH approved number prefix TC-

o 4G), or a NIOSH approved respirator with an organic vapor (OV) cartridge or canister with any R, P or HE prefilter.

c. Revise the "Container Disposal" statements to be in agreement with PR Notice 2007-4.

d. The 1 st claim on page 4 must be brought into compliance with PR Notice 2000-1, Treated Article" by deleting the second and third "[OPTIONAL]." The claim must read "This product contains an antimicrobial that will kill mold, mildew, and stain/odor causing bacteria remaining on the surface at the time of application .. "

e. The 5th, 6th, 8th, 9th, 10th, 12th, and 14th claims on page 4 must be brought into compliance with PR Notice 2000,.1 , Treated Article by qualifying the type of bacteria controlled by your product. You must revise these claims to read " .... stain and odor causing bacteria."

f. Revise the first paragraph under "Perma-Guard Advantage" on page 6 by deleting the 1st, 2nd, and 3rd "[OPTIONAL]s" to bring it into compliance with PRN 2000-1.

g. Revise the last statement in the second paragraph under "Perma-Guard Advantage" on page 6 by deleting the 2nd "[OPTIONAL]" to bring it into compliance with PRN 2000-1.

h. Incorporate the EPA Registration Numbers for the registered product, JOMAX Mold Killer and Deodorizer, on pages 6,8, and 12. (You need to add the Registration Numbers to the statement)

i. Delete·the 2" [OPTIONAL]s" under "Limitations" on page 7,9, and 13.

j. Delete the 4th "[OPTIONAL]" under "limited Warranty" on pages 7 and 9 to bring it into compliance with PR N 2000-1.

k. Revise the statement, "A high performance EPA registered acrylic interior paint," on pages 8 and 11 by deleting the phrase, "EPA registered."

I. Revise the third statement in the first paragraph on page 8 by deleting the 2nd "[OPTIONAL], such that statement is in agreement with PR Notice 2000-1.

m. Revise the ANTIMICROBIAL section on pages 8 and 11 by deleting all the "[OPTIONAL]s" and the phrase "of these organisms to bring it into compliance with PRN 2000-1.

n. Revise the 1st statement under the third paragraph on pages 8 and 11 by deleting the 1st "OPTIONAL" to bring it into compliance with PRN 2000-1.

o. Delete the claims, "PERM Guard passes severe testing following ASTM 05590 and 03273 even when subject to combined stains of mold and mildew spores" and "PERM GUARD also, passes Bacterial Resistance testing following ATCC Method 147" on pages 8 and 11. Data was not submitted to support either claim.

p. "Recommended Coverage" phrase on pages 9 and 13 must be brought into compliance with PR Notice 2000-5, Mandatory Labeling by deleting the term, recommended.

q. The proposed alternate brand names cited on page 1 of the label are acceptable.

r. On page 13 delete the claim" [optional] note: Perma-Guard is formulated with a ... Iead compounds."

3. Submit two (2) copies of your final printed labeling before distributing or selling the product bearing the revised labeling.

If these conditions are not complied with, the registration will be subject to cancellation in accordance with FIFRA sec. 6(e). Your release for shipment of the product constitutes acceptance of these conditions.

Clean surfaces with JOMAX® Mold Killer and Deodorizer and remove stains with Jomax Mold & Mildew Stain Remover. TWO-COAT SYSTEM- No Priming Required! PERMA-GUARD is self-priming for , most jobs and will adhere to any sound surrace. APPLICATION - Shake or stir well before using. Apply with synthetic bristle brush, roller, pad applicator, or sprayer. For airless spraying, use a .017 tip and high medium (2000-2600 PSI) pressure. Apply when air and surface temperatures are 50° - 90°F (10°-32°C) and humidity is less than 80%. May be applied over slightly damp surfaces.

DRY TIME - At normal temperatures, 70°F (21°C), PERMA-GUARD dries to recoat in 2 hours. If used above tile on shower walls, wait at least 24 hours before using shower. Full adhesion and hardness develop in 7 days.

( TINTING - May be tinted to off-white, pastel or medium colors with universal colorants. start with 75% of the tinting formula for a given color and adjust if necessary. Maximum tint - 4 oz. per gallon (31 mill). Multiple containers of tinted paint should be intermixed (boxed) to ensure color uniformity.

COVERAGE - Apply each coat at a rate of 400 sq ft (37 m2) per gallon. Coverage will vary with the porosity of the surface am~ the method of application.

CLEANUP - Clean application tools, spatters, and spills immediately with warm water and liquid detergent; rinse with water. Follow equipment manufacturer's directions to clean spray equipment. Remove dried product with a heavy-duty ammoniated household cleaner; rinse with water.

SURFACE PREPARATION - Surfaces must be clean, sound and free of dirt, dust, grease, wax, [Optional] wall covering adhesive, soap film, loose paint or other surface contamination. Remove all existing mold & mildew before painting. Clean surfaces with Perma-Wash Disinfectant & Fungicide Interior Concentrate, Perma-Wash Fungicide, Disiofectant and Deodorizer Ready-to-Use spray, or Jomax Mold Killer & Deodorizer Ready-to-Use spray. Remove stains with Jomax Mol'd & Mildew Stain Remover. If you are concerned about mold and mildew behind walls, underneath flooring, in ventilation systems or other unseen areas, contact a professional who specializes in mold and mildew remediation.
