Pre-Qualification / Technical Bid

Pre-Qualification / Technical bid of Bidders fulfilling the qualification criteria as mentioned below will only be considered for commercial evaluation.

A. The bidder should be a reputed designer & manufacturer of MS Chimney & Ducting . The bidder should have good credentials by way of past supplies of equipment listed in the tender to MNCs / Public Ltd Cos/ Public Sector Under taking customers .

B. The bidder should have a minimum experience of 5 years in MS Chimney/ over the roof duct as tendered.

C. The bidder should have an in-house / outsourced Design department.

D. The bidder should have supplied a minimum of five MS Chimney / Over the roof duct as tendered, within the past 5 years.

E. The bidder should have executed at least one Order with a single order value of INR 15 Lakhs or more in the past 5 years for the tendered item .

F. The average annual turnover of the bidder based on the past three financial years should be at least INR 80 lakhs.

G. The bidder should have valid Central Excise/ Service Tax/VAT/CST/PAN Registration

H. The bidder should submit a Customer list of at least 10 buyers, who are reputed processor / manufacturer/ new steel drum manufacturers.

I. Company Brochure.

J. All documents to be signed & stamped on all pages denoting acceptance of all technical specifications, output, etc. contained therein.

K. The bidder should have after sales service facility / set up within 200 Km radius of Taloja, Taluka - Panvel, District - Raigad , State - Maharashtra.

Balmer Lawrie & Co Ltd is putting up a high throughput steel drum manufacturing facility at Taloja , Taluka Panvel, Dist. Raigad. Throughput of the plant is 800 drum/ hour. Plant will have facility to produce plain as well internally coated drums. Self supported chimneys , MS ducting & GI ducting are required to connect exhaust from ovens & paint / lacquer booths to chimneys . All Exhaust from the ovens shall be connected to a Self supported chimney through MS Duct and all Exhaust from the paint / lacquer booths shall be connected to another Self supported chimney through GI Duct.

SCOPE : Design, manufacture , supply , erection & commissioning of Self supported chimney , MS ducting & GI ducting with support structure as per attached layout.( Drawing No 202 )

SECTION A

3. GENERAL REQUIREMENTS

3.1 The scope of work under this specification shall cover the design, manufacture, site acceptance test, inspection, erection and commissioning of Self supported chimney , MS ducting & GI ducting with support structure as per attached layout.

3.2 The vendor shall provide 12 months warrantee for the design, performance of the entire system and all the equipment supplied by them including all the bought out items:

3.3 The vendor shall submit the design, manufacturing drawings, manufacturer's test certificates for all the items, including electrical equipment and other bought out items included in the scope of supply.

3.4 The equipment may be inspected during various stages of manufacture at vendors/ sub-vendors works by Balmer Lawrie ( BL) representative. Report of stage wise inspection to be furnished along with supply of the equipment. BL representatives may visit sub-vendor's premises if required

3.5 The vendor shall arrange to carry out all necessary corrective actions tests as advised by BL representative and shall replace materials /rectify defects immediately if so advised by BL. Inspection shall be regarded as a check - up and shall not relieve the vendor of any of the contractual obligations and performance guarantee.

3.6 The vendor shall also furnish detailed list of a complete set of tools required for maintenance of equipment offered by the vendor.

3.7 AII electric geared motors/motors supplied by the vendor shall be as per IS 2148; IS 4691, IE 3 grade .

3.8 MS Support structure shall be made from formed sections with powder coating. Structures shall be mounted on trusses / wall.

SECTION B

4. DETAILED SCOPE AND EXCLUSIONS

4.1 Works Included

Scope of work covered in this specification shall generally be given below. However, the vendor shall be responsible to complete the work in all respects and in doing so, provide/supply all facilities not covered below specifically but never the less required for the satisfactory performance of the complete system.

i. Handling equipment & scaffolding required during installation, erection & commissioning

ii. Gas welding/cutting set , Grinding , drilling , riveting & electric arc welding machine.

SECTION C

5 JOB SPECIFICATION FOR VARIOUS EQUIPMENT/ STRUCTURES

The main object of this general specification is to outline the condition and requirement of the purchaser under which the manufacturer shall design, manufacture, shop test / inspect and supply the equipment suitable for our requirement. The specification intends to give the bidder the function and operating characteristics which the equipment shall fulfil.

5.1 MS Chimney for Flue Gas ( 15 Mtr. High )

1) In all respect , design, manufacturing, supply and erection &commissioning of the chimney should confirm to IS:6533 or better.

2) Chimney should develop sufficient draught for the exhaust of flue gas volumes as per details given below-

Paint baking oven exhaust: 8000 nm³/hr.Shell Lacquer Baking Oven Exhaust: 7000 nm³/hr.Ends Lacquer Baking Oven Exhaust: 5000 nm³/hr.

3) Loading in the chimney should be calculated as per IS:6335 and based on site data and design data provided in this tender document.

4) Design &Preparation of manufacturing drawing for chimney

5) Chimney shall be self supported & supplied in modules as per drawing

6) Base plate , top plate & field spice plates shall be suitably designed

7) Horizontal alignment shall be offered of maximum 15 mtrs. Long section at a time in the mock- up condition at the time of set –up inspection.

8) Supply of lightening arrestor with earth strip and aviation lamp with cable shall be provided

9) External surface of the chimney shall be cleaned manually with the help of wire brushes & scrappers / sand blasted to SA # 2.5 before painting before painting. Paint thickness shall be of minimum 30 micron

10) Nozzle connections shall be carried out at site & shall be sent loose

11) Inspections as per approved QAP

13) Platform as per IS:6533Platform of required size shall be provided at a suitable height on the chimneys. It shall be made from MS structural steel & fixed by nuts& bolts to the chimney. It shall be cleaned manually with the help of wire brushes & scrappers before painting. Paint thickness shall be of minimum 30 micron.

14 )Caged Ladder up to platform as per IS:6533Caged ladder made from structural steel shall be provided up to platform . It shall be made from MS structural steel & fixed by nuts& bolts to the chimney. It shall be cleaned manually with the help of wire brushes & scrappers before painting. Paint thickness shall be of minimum 30 micron.

15) Caged Ladder from platform up to top of Chimney Height as per IS 6533Caged ladder made from structural steel shall be provided from platform up to top of chimney height. It shall be made from MS structural steel & fixed by nuts& bolts to the chimney. It shall be cleaned manually with the help of wire brushes & scrappers before painting. Paint thickness shall be of minimum 30 micron.

16) Cleaning Access Door- Cleaning and access doors should be provided on the chimneys as per IS :6533

17) Cowl stays and Cowl- Both the chimneys should be provided with Cowls on the top of the chimneys to avoid/minimize entry of rain water into the chimneys

18) Aerodynamic Stabilizers- Chimney shell should be provided with aerodynamic stabilizers against air velocity drag.

5.2 MS Chimney for Paint Booth Exhaust ( 15 Mtr. High )

1) In all respect design, manufacturing, supply and erection &commissioning of the chimney should confirm to IS:6533 or better.

2) Chimney should develop sufficient draught for the exhaust of solvent laden air volumes as per details given below-

Paint Booth (Cylindrical Drums): 5600 m³/hr.Paint Booth (Conical & KDD Drums): 7350 m³/hr.Lacquer Booth (Shells): 5040 m³/hr.Lacquer Booth (Ends): 2016 m³/hr.

3) Loading in the chimney should be calculated as per IS:6335 and based on site data and design data provided in this tender document. It may be noted that either paint booth ( Cylindrical Drums ) or Paint booth ( Conical Drums ) will operate at a time. Both will not operate together.

4) Design &Preparation of manufacturing drawing for chimney

14) Caged Ladder up to top of Chimney Height as per IS 6533Caged ladder made from structural steel shall be provided up to top of chimney height. It shall be made from MS structural steel & fixed by nuts& bolts to the chimney. It shall be cleaned manually with the help of wire brushes & scrappers before painting. Paint thickness shall be of minimum 30 micron.

15) Cleaning Access Door- Cleaning and access doors should be provided on the chimneys as per IS :6533

16) Cowl stays and Cowl- Both the chimneys should be provided with Cowls on the top of the chimneys to avoid/minimize entry of rain water into the chimneys

17) Aerodynamic Stabilizers- Chimney shell should be provided with aerodynamic stabilizers against air velocity drag.

5.3 MS DUCTING

It is required to connect the exhaust from the ovens to chimney. Flow diagram, Exhaust Volume, Temperature , Velocity from the ovens are shown in the diagram No 101. Ducting shall be designed to connect the exhaust from the ovens to common MS ducting as shown in the diagram 202. It shall be designed with minimum back pressure at the exhaust from the ovens. Provision shall be made to reduce /eliminate transmission of vibration from exhaust blower to ducting.

MS ducting fabricated from minimum 3mm Hot Rolled sheet . It shall be complete with flanges & bends as per attaché diagram .

MS ducting shall be connected to blower.As all the ovens may not operates simultaneously hence adequate numbers of dampers shall be provided.

InsulationMS duct lines are to be insulated with Minimum 50mm thk. Low density resin bonded rock wool slabs . It should be covered with 24 gauge Aluminum sheet.

5.4 Automatic selective dampers for MS Ducting

Rotary ( 90 deg. Rotation ) Independent Dampers shall be provided in exhaust ducts from the oven. Dampers shall be actuated automatically by pneumatic / mechanical system. The actuation of dampers should be selectable from the control panel.

5.5 G I DUCTING

It is required to connect the exhaust from the paint / lacquer booths to the chimney .Flow diagram, Exhaust Volume, Temperature , Velocity from the paint booths are shown in the diagram No 101 . Ducting shall be designed to connect the exhaust from the paint / lacquer booths to common GI ducting as shown in the diagram. It shall be designed with minimum back pressure at the exhaust from the paint/ lacquer booths. GI square duct lines shall be made from 22 gauge GI sheet complete with frames & bends. G I flanges with proper gasket shall be used to join duct/ bends/ branch connections etc. GI flanges shall no be welded with GI ducts. GI ducting shall be connected to the blower. Provision shall be made to minimise/eliminate transmission of vibration from exhaust blower to ducting.

5.6 Automatic selective dampers for GI Ducting

Rotary ( 90 deg. Rotation ) Independent Dampers shall be provided in exhaust ducts from the paint booths. Dampers shall be actuated automatically by pneumatic / mechanical system. The actuation of dampers should be selectable from the control panel.

5.7 INDUCED DRAFT BLOWERS ( ID BLOWERS)

Suitable ID Blower with Motor shall be connected to MS Ducting.

Suitable ID Blower with Motor shall be connected to G I Ducting.

MS structure for mounting the blowers shall be provided. Delivery from the blowers shall be connected to respective chimney. Branch connection from delivery of blower up to chimney shall be provided along with the blower. All the blowers shall be dynamically balanced. It shall be provided with Variable speed drive ( VFD ) to regulate delivery .

5.8 Support Structures

MS ducting/ GI ducting lines shall be hanged /supported with the help of powder coated formed sections brackets/ supports. All the brackets / supports shall be fixed with shed structure using Nut &Bolts. No direct welding is allowed. Supports may be provided at a maximum distance of 2 mtrs.

5.9 Over the Roof Exhaust Ducts

It is required to exhaust hot air from the cooling zone of all ovens to roof top .Ducting shall be designed to connect the exhaust from the ovens to roof top . It shall be designed with minimum back pressure at the exhaust from the ovens. It shall be self supported & mounted over the delivery side of the blowers.MS ducting shall be fabricated from minimum 3mm Hot Rolled sheet . It shall be complete with flanges & bends as per requirement.

TENDER FOR EXHAUST DUCTING SYSTEM

Balmer Lawrie& Co Ltd is putting up a high throughput steel drum manufacturing facility at Taloja , Taluka Panvel, Dist. Raigad. Throughput of the plant is 800 drum/ hour. Plant will have facility to produce plain as well internally coated drums. Exhaust blower ,MS ducting & GI ducting are required to take exhaust from ovens & paint / lacquer booths to over the roof .

SCOPE : Design, Manufacture , supply , erection & commissioning of MS ducting & GI ducting with support structure and Exhaust Blower

1 .LOCATION OF SITE

Address Of the site is as given in the tender document. The intending tenderer should inspect the site at his own expense and make himself familiar with the site conditions. Non familiarity of the site conditions will not be a reason either for extra claim or for not carrying out the work in

SECTION A

3. GENERALREQUIREMENTS

3.1 The scope of work under this specification shall cover the Design, manufacture, site acceptance test, inspection, erection and commissioning of Exhaust blower , MS ducting & GI ducting with support structure .

3.2 The vendor shall provide 12 months warrantee for the design, material & workmanship and performance of the entire system and all the equipment supplied by them including all the bought out items:

3.3 The vendor shall submit the design and detail drawings for all the above mentioned items to be supplied under the scope of the tender document, manufacturer's test certificates for all the items, including electrical equipment and other bought out items included in the scope of supply.

3.4 The equipment/structure may be inspected during various stages of manufacture at vendors/ sub-vendors works by Balmer Lawrie ( BL) representative. Report of stage wise inspection to be furnished along with supply of the equipment. BL representatives may visit sub-vendor's premises if required

3.5 The vendor shall arrange to carry out all necessary corrective actions tests as advised by BL representative and shall replace materials /rectify defects immediately if so advised by BL. Inspection shall be regarded as a check - up and shall not relieve the vendor of any of the contractual obligations and performance guarantee.

3.6 The vendor shall also furnish detailed list of a complete set of tools required for maintenance of equipment offered by the vendor.

3.7 AII electric geared motors/motors supplied by the vendor shall be as per IS 2148; IS 4691, IE 3 grade .

3.8 MS Support structure shall be made from formed sections with powder coating. Structures shall be mounted on Rafter / trusses / wall/ground

SECTION B

4. DETAILED SCOPE AND EXCLUSIONS

4.1 Works Included

Scope of work covered in this specification shall generally be given below. However, the vendor shall be responsible to complete the work in all respects and in doing so, provide/supply all facilities not covered below specifically but never the less required for the satisfactory performance of the complete system.

SECTION C

5. JOB SPECIFICATION FOR VARIOUS EQUIPMENT/ STRUCTURES

The main object of this general specification is to outline the condition and requirement of the purchaser under which the manufacturer shall manufacture, shop test / inspect and supply the equipment suitable for our requirement. The specification intends to give the bidder the function and operating characteristics which the equipment shall fulfil.

5.1 MS Exhaust Duct for Entry Side of Oven

Following parameters shall be considered for designing these exhaust ducts.Max. Exhaust temperature 180 oCMax. weight of duct 408 Kg for ɸ 602 mm X 6000 mmMax. weight of duct 408 Kg for ɸ 502 mm X 6000 mm

It is required to take the exhaust from the entry side of ovens over the roof . Flow diagram, Exhaust Volume, Temperature , Velocity from the ovens are shown in the diagram No 101. Ducting shall be designed to take the exhaust from the ovens over the roof and mounted over the exhaust blower as shown in the diagram 202. It shall be designed with minimum back pressure at the exhaust from the ovens. Provision shall be made to minimise /eliminate transmission of vibration from exhaust blower to ducting.MS ducting fabricated from approx. 3mm thick Hot Rolled steel . It shall be complete with flanges & bends as required . It shall be made in segments for easy handling . Adequate structural supports shall be provided as required during erection / commissioning.

5.2 MS Exhaust Duct for Exit Side of Oven

Following parameters shall be considered for designing these exhaust ducts.Max. Exhaust temperature 100 oCMax. weight of duct 306 Kg for ɸ 602 mm X 6000 mmMax. weight of duct 306 Kg for ɸ 402 mm X 6500 mm

It is required to take the exhaust from the exit side of ovens over the roof . Flow diagram, Exhaust Volume, Temperature , Velocity from the ovens are shown in the diagram No 101. Ducting shall be designed to take the exhaust from the ovens over the roof and mounted over the exhaust blower as shown in the diagram 202. It shall be designed with minimum back pressure at the exhaust from the ovens. Provision shall be made to reduce /eliminate transmission of vibration from exhaust blower to ducting.MS ducting fabricated from approx. 3mm thick Hot Rolled steel . It shall be complete with flanges & bends as required . It shall be made in segments for easy handling . Adequate structural supports shall be provided as required during erection / commissioning.

5.3 MS Exhaust Duct for Cooling tunnel

Following parameters shall be considered for designing these exhaust ducts.Max. Exhaust temperature 80 oCMax. weight of each duct 714 Kg for ɸ 1007 mm X 6500 mm Max. weight of each duct 714 Kg for ɸ 898 mm X 5500 mm It is required to take the exhaust from the cooling tunnel over the roof. Ducting shall be designed to take the exhaust from the cooling tunnel over the roof and mounted over the exhaust blower as shown in the diagram 202. It shall be designed with minimum back pressure at the exhaust from the cooling tunnel . Provision shall be made to minimise /eliminate transmission of vibration from exhaust blower to ducting.MS ducting fabricated from approx. 3mm thick Hot Rolled steel . It shall be complete with flanges & bends as required . It shall be made in segments for easy handling . Adequate structural supports shall be provided as required during erection / commissioning.

5.4 MS Suction Duct for cooling tunnel Following parameters shall be considered for designing these exhaust ducts.Max. Exhaust temperature 40 oCMax. weight of each duct 714 Kg for ɸ 898 mm X 5000 mm Max. weight of each duct 714 Kg for ɸ 1007 mm X 4000 mm It is required to suck air from the atmosphere over the roof . Ducting shall be designed to suck the exhaust from the atmosphere over the roof and mounted over the exhaust blower as shown in the diagram 202. It shall be designed with maximum flow in the cooling tunnel . Provision shall be made to reduce /eliminate transmission of vibration from suction blower to ducting.MS ducting fabricated from approx. 3mm thick Hot Rolled steel . It shall be complete with flanges & bends as required . It shall be made in segments for easy handling . Adequate structural supports shall be provided as required during erection / commissioning.

5.5 G I DUCTING

It is required to take the exhaust from the paint / lacquer booths to the chimney .Flow diagram, Exhaust Volume, Temperature , Velocity from the paint booths are shown in the diagram No 101 . Ducting shall be designed to take the exhaust from the paint / lacquer booths over the roof. It shall be designed with minimum back pressure at the exhaust from the paint/ lacquer booths. GI square duct lines shall be made from 18 gauge GI sheet complete with frames & bends. G I flanges with proper gasket shall be used to join duct/ bends/ branch connections etc.GI ducting shall be connected to the blower. It shall be made in segments for easy handling . Adequate structural supports shall be provided as required during erection / commissioning .

5.6 Exhaust Blower

Suitable Exhaust Blower with Motor of 2000 m3 / hr. shall be provided . Suitable GI ducting/mounting on suction side shall be provided along the blower. Delivery shall be connected to G I Ducting of size 361 x 361 x 5500 .MS structure for mounting the blowers shall be provided. Impeller of blowers shall be dynamically balanced.

5.7 Support Structures

MS ducting/ GI ducting shall be supported with the help of powder coated formed sections brackets/ supports. All the brackets / supports shall be fixed with factory shed structure/ ground using Nut &Bolts/ anchor bolt etc. Adequate number of supports may be provided to reduce vibration of MS Ducting / GI Ducting.

SPECIAL TERMS & CONDITIONS

1. The tenderer means all parties/firms who respond against this tender notice and successful tenderer(s) mean party/parties, with whom the order is placed and shall be deemed to include the tenderer’s successors, representatives, heirs, executors and administrators duly approved by the firm.

2. Purpose of Contract:This contract is for design, manufacturing, supply, erection & commissioning of ““Self Supported Chimney, M S Ducting and G I Ducting with support structure, Exhaust Ducts and Exhaust Blower ”.

3. i) All the rates given in the Price Bid should be expressed both in words and in figures and where there is difference between two, and rates given in the words will be authentic.

ii) Bidder should quote in the Price Bid format. Your quotation should contain all the elements such as Basic rate, Excise Duty, and Sales Tax etc. Excise Duty, Sales tax and Freight should be shown separately.

4. The tenderer is expected to quote in accordance with the terms and conditions of the Company. Printed Standard conditions which may accompany the quotation of the tenderer will not be acceptable.

5. Delivery / Erection & Commissioning

5.1 Delivery – (i) First lot delivery 8 weeks from the date of Purchase Order.

(ii) Complete delivery in 10 weeks from the date of Purchase Order.

5.2 Erection & commissioning - Within 4 weeks from the date of receipt of equipment at the site.

6. Tender Evaluation

The tender would be finalized on the basis of Lowest Nett delivered price (NDP) for each Annexures IV & Annexure V of Price Bid. The bidder has to quote for both the Annexures IV & V. BL reserves the right to accept any one of the Annexure IV or V

7. The company reserves the right to accept any tender in whole or in part and reject any or all tenders.

8. The bidders are specifically advised to note that the Company normally would not carry out any negotiations except with such parties who is / are the lowest bidders originally. As such, it would be in the interest of the bidders to quote lowest possible rates.

9. Responses will be accepted subject to meeting the pre-qualification criteria mentioned in the tender.

10. In case of unsatisfactory performance of the successful tenderer (s) either in relation

to quality of material or adherence to delivery schedule, Company reserves its right to cancel part or whole of the order and forfeit such amounts, as the Company may deem reasonable due to the loss of goodwill, business and goods due to such unsatisfactory performance, from the security deposit (s) deposited by the successful bidder.

11. Packing & MarkingThe Equipment should be so packed to withstand the hazards normally encountered with the means of transport, including loading and unloading operation. Fragile items should be packed with special packing materials depending on the type of material. All protrusions shall be suitably protected. The successful bidder shall be held liable for all damages or breakages to the Machine(s)/Equipment(s) due to defective or insufficient packing.

All packages should be marked for easy identification

12. Despatch InstructionsUnless otherwise specifically advised in writing, the goods shall not be despatched without prior inspection testing and release notes/Materials Acceptance certificates issued by inspectors/BL.

13. Erection & CommissioningThe bidder shall depute its engineer(s) for erection / commissioning of the equipment/machine at the project site in Taloja. The engineer(s) will train our technician(s) on operation and routine maintenance of the machine.

14. Guarantee/ WarrantyThe manufacturer / supplier / bidder shall provide in writing necessary guarantee /warranty that the equipment designed,manufactured and supplied to BL shall be new and free from defects in material, workmanship and design & construction and it will perform in accordance to the specification for a period of 12 months from the date of commissioning of the machine. In the event of any deviation / non performance as per technical specification , the successful bidder will ensure repairing of the equipment / defective part(s) failing which will give free replacement with new machines or defect-ive parts or adjust the proportionate claim from the 10% retention money/Perform-ance Guarantee.

15. Operation / Maintenance ManualThe bidder shall provide along with the machine two sets (Hard and Soft copy) of oper -ation and maintenance manual (in English) including manuals for mechanical / electric-al function, assembly drawings, hardware / software program, pneumatic diagram, troubleshooting chart and preventive maintenance schedule of the machine parts, etc.

16. SafetyThe successful bidder should ensure necessary safety gears (like hand gloves / safety shoes/ helmet etc.,) are provided to their employees to perform the commissioning and erection at BL’s premises without any accident. In case of any accident/ injury to any of their employee, the bidder must bear all the required cost for the treatment/ hospitalization and absolve the Company for any such cost during the pendency of contract or in future. The successful bidder should ensure proper statutory safeguards against such eventualities

17. Statutory ComplianceThe successful bidder should take coverage under the Workmen’s Compensation Act for the workmen employed by them for the commissioning and erection of the items tendered in this tender. The successful bidder should also ensure that all compliances under PF/ESI/Contract Labor Registration etc. as applicable are complied with

In case of unsatisfactory performance of the successful bidder (s) either in relation to quality of material or adherence of specified delivery schedule, Company reserves its right to cancel part or whole of the order and forfeit such amounts, as the Company may deem reasonable due to the loss of goodwill, business and goods due to such unsatisfactory performance, from the security deposit (s) deposited by the successful bidder (s).

TERMS & CONDITIONS

1. Submission of tender will mean that the bidder have fully understood and accepted the terms and conditions of tender. Any subsequent revision on the same will not be considered and may lead to rejection of tender.

2. Earnest Money Deposit: Earnest Money Deposit {EMD} of Rs 20000.00 [Rupees Twenty Thousand only] is to be paid by Demand Draft payable at Mumbai in favour of Balmer Lawrie & Co. Ltd. Cheque and any other form of payment are not acceptable towards EMD. EMD will be refunded by cheque to unsuccessful bidders after finalization of tender. For accepted bidders, EMD of successful bidder will be adjusted towards Security Deposit against the Contract order placed on them. EMD will carry no interest. Linking with earlier transactions/adjustments with pending bills or any other amount payable by the Company is not allowed.

EMD is liable to forfeiture if :

a) In the event of withdrawal of offers during validity period of the offer.

b) Non acceptance of Contract Order.

c) Non confirmation of acceptance of Contract order within the stipulated time.

d) Any unilateral revision made by the bidder during the validity period of offer.

e) Non execution of the documents after acceptance of the contract due to any dispute of the bidder or any reason whatsoever.

f) Non submission of Security Deposit.

OFFERS RECEIVED WITHOUT EARNEST MONEY DEPOSIT WILL BE REJECTED.

3. Small Scale Units registered with National Small Industries Corporation Limited (NSIC / MSME), for item tendered are exempted from payment of Earnest Money Deposit.

5. Validity of Quotation: The quotation should be valid for the Company's acceptance for a period of 90 days (excluding the due date) from the date of opening of tender.

6. Sub-Contracting : The successful bidder shall not be allowed to sub contract either wholly or any part of the order without Company's prior written consent.

7. PAYMENT TERMS(a) Payment will be made as follows (excluding erection/installation/

commissioning charges)

30% advance against Bank Guarantee as per Balmer Lawrie format.

Running bill of maximum INR 8 lakhs in a month. Maximum 2 running bills can be submitted.

Balance payment 30 days from the date of completion of job. 25


(b) Erection/installation/commissioning charges :

80% against erection/installation of modules.

20% against commissioning

(c) 10% after successful commissioning against 12 months performance bank guarantee or 18 months from receipt of material at site whichever is earlier.

The Bidders shall provide Bank Guarantee executed by a Nationalized Bank approved by RBI as per Company’s standard format which should be valid for 20 (Twenty) months including claim period of two months .

8. RETENTION MONEY/PERFORMANCE BANK GUARANTEE10% (Ten percent) of the total order value will be retained by BL as retention money for one year from the date of commissioning or 18 months from date of Despatch, whichever is earlier. The Bidders can provide Performance Bank Guarantee executed by a Nationalized Bank approved by RBI as per Company’s standard format which should be valid for 14 (Fourteen) months in lieu of retention money of 10%. In the event of any deviation / non performance as per technical specification , the successful bidder will ensure repairing of the equipment / defective part(s), failing which will give free replacement with new machines or defective parts or adjust the proportionate claim from the 10% retention money/Performance Guarantee.

9. Consignment should be accompanied by valid documents such as Excise Gate Pass, Delivery Challan, Tax Invoice under VAT Scheme. Bills will not be accepted by us for payment without the consignee's acknowledgment in the delivery challans.

10. SECURITY DEPOSIT:Successful bidder will be required to pay Security Deposit equivalent to 10% of the Basic Value of the Order within 15 days of issue of the Purchase Order by way of Demand Draft / Pay Order in favour of ‘Balmer Lawrie & Co. Ltd., payable at Mumbai. The Company may also accept Bank Guarantee as per BLs standard format with an additional claim period of six months in lieu of the Security Deposit. Security Deposit can also be made directly to our Standard Chartered Bank (Account No. 222-0-526803-6, NEFT Code - IFSC “SCBL0036046) through electronic transfer and proof of transfer of funds deposited with us.

Cheque/Cash or any other forms of payment are not acceptable towards Security Deposit.

The Security Deposit will not bear any interest. EMD of the successful bidder will be adjusted in Security Deposit. Security Deposit is liable for forfeiture, if

- Successful bidder fails to supply tendered item as per delivery period.- Successful bidder violates the tender condition,- Security Deposit will be refunded only after successful completion of the

contract.

11. LIQUIDATED DAMAGES FOR DELAY IN DELIVERY / QUALITY PROBLEMS

Successful bidder shall have to pay to the company by way of liquidated damagesand not as penalty an amount equal to 0.5% of the value of the materials so delayedfor each week or part thereof such delay in delivery, subject to maximum of 5% of the total order value.

12. ARBITRATION

If any dispute or difference arises between the Parties inter alia in respect of the interpretation of this Agreement or of the rights or liabilities of either in respect of anything done or omitted or to be done or omitted hereunder, the Parties shall endeavour to settle such dispute amicably.

If not, such dispute or difference shall be referred for adjudication at Mumbai to a sole arbitrator to be appointed by COO[IP], Balmer Lawrie & Co Ltd.

The place of Arbitration shall be Mumbai, India. The arbitration proceedings shall be in the English language. Cost of Arbitration shall be equally shared between the Parties. It is expected that the arbitral award shall be a speaking award setting out reasons thereof. In making the award, the arbitrator(s) shall be bound by the intention of the Parties insofar as the same can be ascertained from this Agreement.

13. FORCE MAJEURE CLAUSE

If at any time during the continuance of this contract, the performance in whole or part by either party of any obligation under this contract shall be prevented or delayed by reasons of any war, hostility, acts of public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions or acts of God (hereinafter referred to as events) then provided notice of the happening any such events if given by either party to the other within 21 days from the date of occurrence thereof neither party shall be by reason of such event be entitled to terminate this contract nor shall either party have any claim for damage against the other in respect of such non performance or delay in performance and deliveries under the contract shall be resumed as soon as practicable after such event has come to an end or ceased to exist and decision of the COO (Industrial Packaging), Balmer Lawrie & Co. Ltd., as to whether the deliveries has been so resumed or not shall be final and conclusive, provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reasons of any such event for period exceeding 60 days, either party may at its option terminate the agreement.

Procedure For Bid Submission

The bidder shall submit his response through bid submission to the tender oneProcurement platform at https://balmerlawrie.eproc.in by following the procedure given in the Catalogue.

The bidder shall authenticate the bid with his Digital Certificate (Class II) for submitting the bid electronically on eProcurement platform and the bids not authenticated by digital certificate of the bidder will not be accepted on the eProcurement platform.

All the bidders who do not have Digital Certificates need to obtain Digital Certificate. They may contact Help Desk of C1 India Pvt Ltd.

Submission of Hard copies:

After submission of bid online, the bidders are requested to submit the demand drafts / Bank Guarantee towards tender fees and / EMD along with other documents as required, to the Tender Inviting Authority before the due date at our Ballard Estate Office. The bidder shall furnish the Demand Draft and other documents either in person or through courier or by post and the receipt of the same within the stipulated time shall be the responsibility of bidder. BL shall not take any responsibility for any delay or non-receipt of said documents. If any of the documents furnished by the bidder is found to be false / fabricated, the bidder is liable for black listing, forfeiture of the EMD, cancellation of work and criminal prosecution.

The bidder is requested to get a confirmed acknowledgement from the Tender Inviting Authority as proof of submission of hardcopies.

Corrigendum to tender:

The bidder has to keep track of any changes by viewing the addendum / Corrigendum's issued by the Tender Inviting Authority on time-to- time basis in the E-Procurement platform. The Company calling for tenders shall not be responsible for any claims/problems arising out of this.

Bid Submission Acknowledgement:
