1. Introduction

1.1 General

Guidance on the Specification for Works (GSW) in TII Publications (Standards) is published as a collective group of documents under the Construction and Commissioning activity within the TII Publications system and are divided into parts corresponding to those in the Specification. The headings in the guidance documents directly relate to headings in the Specification; however there are not corresponding headings to every Specification heading. The SPW and GSW are maintained as part of the TII Publications website, available online at http://www.tiipublications.ie/.

The GSW has been drafted for use in conjunction with the Public Works Contracts (published by the Department of Finance). Users of the GSW must take care to interpret terminology in a manner that is consistent with the form of contract being considered and to use appropriate terminology when compiling project specific Appendices to the SPW.

Where appropriate within the GSW, the terms “Employer’s Representative”, “specialists responsible for the design” and “compiler” are used. These titles should be interpreted as follows:-

i) The term Engineer when used in relation to scheme preparation relates to the “designer/compiler” and not the Engineer under the Contract.

ii) Where the context implies reference to the supervisory function of the Engineer under the Contract this should be read as applying equally to the Employer’s Representative and vice-versa as suits the form of contract being used.

iii) For Works designed by the Employer the term “specialist responsible for the design” means the Employer’s designer, be that a member of the Employer’s own staff or a consultant engaged by the Employer to undertake the design. For Works designed by the Contractor the term “specialist responsible for the design” means the Contractor’s designer, be that a member of his own staff or a consultant engaged by the Contractor to undertake the design, and in particular any “Specialist” named in the Contract.

iv) The compiler is a generic term referring to the party responsible for preparing an element of the SPW, which may be any of the above.

1.2 Incorporation of the Specification into the Contract

The SPW has been drafted for use in conjunction with the Public Works Contracts.

The Contract is to contain a Preamble to the Specification and standard Preamble to the Specification is included in the GSW. This includes an explanation of how alternative text is incorporated depending on whether the Contract is for Work designed by the Employer or Works designed by the Contractor.

Where amendments, omissions or extensions are envisaged to the SPW or SCD within the Contract, such changes should be presented as part of the compiled documentation for approval through the Departure from Standards process.

1.3 Proprietary Work, Goods or Materials

Proprietary work, goods or materials must not be specified unless their function cannot be described in any other way using specifications which are sufficiently precise and easily understood. Where the

specification of proprietary work, goods or materials cannot be avoided, European law requires that the brand name or type be followed by the words “or equivalent”.

1.4 Use of the Specification for Works (SPW)

The SPW has been widely drawn to cover all road contracts from the provision of new to the improvement or reconstruction of existing roads and bridges. It also covers such schemes as the installation of road lighting, traffic signals or other traffic signing schemes on existing roads.

There is no need to reproduce the SPW in the Contract documents as it is incorporated by reference in the Preamble to the Specification.

Contract-specific requirements should be incorporated in the Numbered Appendices to the Specification (without the need to alter requirements, etc.) in one of two ways:

i) Specific requirements referred to in the national requirements:

These are generally indicated by the words “as described/stated in Appendix -/-.”

ii) Alternatives to national requirements:

These are generally indicated by the words “unless otherwise described in Appendix -/-”.

The information contained in the Numbered Appendices 0/1 to 0/4 and 1/1 onwards should be bound either in one volume or more as appropriate. Each volume should be clearly titled as to the content.

The compiler's attention is drawn to the requirements of the Safety, Health and Welfare at Work (Construction) Regulations and in particular the need for a health and safety plan to be prepared and provided at the same time as the tender documents. In particular the compiler should ensure consistency between information referred to in the above plan and the detailed information included in Appendices to the Specification. Appendices likely to be referred to, include but are not confined to:

3. Appendices

3.1 Numbered Appendices – General

The Numbered Appendices to the Specification are to be drawn up for the specific project by the compiler and included in the Contract documents. Where it is considered appropriate to include project-specific Works Requirements on drawings, cross-reference should be made in the Numbered Appendix to the relevant drawing numbers.

The Numbered Appendices are to be compiled using advice given in the relevant part of the GSW and in the Sample Appendices given at the end of each part of the GSW. Depending on whether the Contract is for Works designed by the Employer or Works designed by the Contractor various of the Numbered Appendices are to be completed by the Tenderer, the Contractor or the Specialist responsible for the design.

Appendices 1/24, 1/25 and 1/26 should comprise lists of accepted quality management schemes, product certification schemes and information relating to NSAI Agrément Certificates.

New Numbered Appendices can be used to extend Contract-specific alterations, but see Sample Appendix 0/3 regarding numbering of additional Numbered Appendices.

3.2 Numbered Appendices – 0/1 to 0/4

The “Zero” Series Numbered Appendices (0/1 to 0/4) should be compiled in accordance with the Samples following and as explained below.

The Contract-specific alterations to the SPW (accepted only under an Approved Departure from Standards) should be described in Appendices 0/1 and 0/2 taking account of the following:

i) Requirements relating to Clauses equally apply to Tables and Figures.

ii) Care should be taken to ensure compatibility between Clauses and any associated Tables and Figures which are altered.

iii) Text which conflicts with or duplicates the provisions of the Contract Conditions is to be avoided.

Appendix 0/1 is for incorporation of Contract-specific alterations to the SPW as follows:

i) Additional Clause – written in Appendix 0/1 with suffix “AR” added to the Clause number.

ii) Substitute Clause – rewritten in Appendix 0/1 in full with existing Clause number and with suffix “SR”.

iii) Cancelled Clause – Clause number with suffix “CR” followed by its title written in Appendix 0/1, with the word “Cancelled” alongside it.

iv) If there are no Additional, Substitute or Cancelled Clauses to be included in the Contract write NONE in Appendix 0/1.

Appendix 0/2 is for incorporation of Contract-specific minor alterations to existing Clauses, Tables and Figures. These can be described by the “delete and insert” or “add new sub-clause” procedure, provided they are neither extensive nor confusing. The Clause is not then a Substitute Clause and there is no need to add a suffix. The instructions for these minor alterations are to be written in Appendix 0/2. If there are none write “NONE”.

Appendix 0/3 is to comprise a complete list of Numbered Appendices included in the Contract. List A contains those referred to in the national Specification and List B contains any additional Numbered Appendices devised by the compiler. Where a Numbered Appendix in List A is not used, this should be marked “Not Used” alongside its number. Those to be completed by the Tenderer/Contractor/Specialist responsible for the design must be identified and blanks of “pro-formas”, copied from the GSW, are to be included as appropriate.

Appendix 0/4 is to list the drawings in the Works Requirements, including those from the Standard Construction Details (SCD) in TII Publications (Standards), with any omission or amendment of any applicable SCDs subject to Section 3 of CC-SPW-00010 - Specification for Works Series 000 - Introduction.

4. Standards and Other Reference Documents

In general the date 10 working days prior to the tender returns date or, if applicable, the extended tender returns date establishes, for each standard or other referenced document incorporated in the Contract, the respective edition which is to be used. However, where the date of publication of a Standard or other referenced document is specified the specified edition applies. The date is specified throughout SPW where at least one reference to the Standard includes a specific clause, section, table or appendix. Similarly, if a Standard is amended in one reference, the year is specified throughout SPW.

The compiler should ascertain whether any amendments or new editions of the reference documents have been issued since the last published national alteration of the relevant parts of the SPW and where appropriate include Contract-specific alterations in Appendix 0/1 or 0/2. Where a Harmonised European Standard or a European Standard has been issued in the period between the date of the invitation to tender and the date of the last published edition of the SPW parts, Contract-specific alterations should be made to ensure the European Standard is properly incorporated in the Contract. Use of European Standards issued prior to the date of the invitation to tender is mandatory and Section 4 of CC-SPW-00010 provides for their incorporation in the Contract by default.

The compiler should ensure that there are no inconsistencies between the reference documents specified in the Contract and those used in the design. Where necessary, Contract – specific alterations should be included in Appendix 0/1 or 0/2 to achieve consistency. Amendments to Harmonised European Standards are not permitted. Amendments to European Standards may be considered only in exceptional circumstances where there is clear and proper justification. In such circumstances, and in cases where the basis of design may be compromised unless amendments are made, the Employer/TII should be consulted.

The Employer should consider whether reference document amendments published after the Contract has been awarded should be incorporated in the Contract. Amendments making editorial changes will often have negligible cost implications and should usually be adopted. When the Employer considers an amendment should be incorporated in the Contract but there are significant cost or delay implications, TII should be consulted.

5. Thickness of Material and Tolerances

It is not considered necessary or desirable to specify tolerances for all dimensions. Where dictated by functional or aesthetic need, tolerances are included in the SPW. Other tolerances are incorporated by reference to Standards and other publications. If the compiler requires further tolerances to apply these should be given on the drawings. Unnecessarily fine tolerances have the effect of increasing prices and should be avoided.

6. Construction Products

6.1 General

The requirement to CE mark products means that documentation validating the properties of those mixtures and containing information on their composition will be available. This should be made available before the start of the Works, any change to the source or design mix changes are made.

6.2 Harmonised Technical Specifications

Harmonised technical specifications are prepared on the basis of the basic requirements for Construction Works and contain essential characteristics that a construction product must comply with. The construction product is then placed on the market for incorporation in construction works.

6.3 Assessment and Verification of Constancy of Performance (AVCP)

The system by which the performance of the construction product is assessed and the production is controlled is termed the AVCP. The responsibilities and tasks relevant to the systems required by the TII may be specified in the respective parts of the SPW.

6.4 Determination of product type

The determination of product type on the basis of type testing is performed at the beginning of the production of a new or modified product or method of production where this may affect the stated performance. It is repeated every 5 years or whenever a change occurs in the design, the raw material or the supplier, that would affect significantly one or more of the characteristics.

The number of samples, assessment method and compliance criteria for each characteristic is dependent on the product and as specified by the relevant hEN, SPW and/or other relevant parts of TII Publications (Standards). The results of the type testing, including the testing carried out on the constituents, shall be documented in Type Test reports and form part of the Declaration of Performance. The manufacturer shall retain all test reports for at least 10 years after the last date of production to which they relate. The information shall be made available when requested.

The Type Testing procedure shall demonstrate that all constituent materials conform to the appropriate requirements. The tests for geometrical properties of the constituents shall be carried out on the constituents actually used in Type Testing. For other constituent properties, tests carried out as part of the AVCP procedures used to demonstrate conformity with the appropriate European Standard shall be acceptable.

All testing shall be carried out strictly in accordance with the appropriate European test method on samples taken strictly in accordance with the appropriate EN sampling method to be representative of the normal constituents and mixed materials.

6.5 Factory Production Control (FPC)

The manufacturer must establish written policies and procedures to ensure that products placed on the market comply with the declared performance. The FPC system consists of procedures, inspections and tests to control constituents, equipment and the production process to attain a level of confidence in the constancy of performance of the product.

6.6 Declaration of Performance (DoP)

The model of the DoP is provided in Annex III of the Construction Product Regulation (EU) No 305/2011; the relevant hEN provides further details of information that the DoP is required to contain. The Type Test reports shall form part of the DoP.

An example DoP for Asphalt Concrete is contained in Figure NG 0/1.

6.7 CE Marking

By affixing a CE Marking the manufacturer indicates that he is responsible for conformity of the construction product with the declared performance and compliance with all applicable requirements laid down in the CPR.

The CE Mark contains similar information to the DoP, an example CE Mark for Asphalt Concrete is contained in Figure NG 0/2.

The CE marking symbol must be affixed to the product, packaging or accompanying documents such as a delivery docket / ticket.

6.8 Market Surveillance

Member States are required to undertake market surveillance of construction products to ensure:

i) They do not compromise the health and safety of users;

ii) Non-conforming products are withdrawn, prohibited or restricted;

iii) The public, the Commission and other Member States are informed of any non-conformity issues;

iv) That infrastructure and programmes are in place to guarantee that effective measures can be taken.

The market surveillance authority will establish procedures to include the steps to be taken should an issue of non-compliance with the CPR be identified; including;

i) The grounds for serving of prohibition, warning or suspension notices;

ii) Scenarios where immediate protective action against products are regarded as being serious risk;

iii) The legal penalties associated with breaches of the Regulation.

As the nominated Market Surveillance Authority, Local Authority building control departments are entitled to initiate any investigation and testing deemed necessary before, during and/or after the supply of the construction product.

7. Contract Implementation

The standard Preamble to the Specification is contained below.

Preamble to the Specification

The Specification referred to in the Contract shall be the Specification for Works (SPW) in TII Publications (Standards) published by TII as a collective group of documents under the Construction and Commissioning activity within the online TII Publications system (http://www.tiipublications.ie/), current on the date 10 working days prior to the tender returns date or, if applicable, the extended tender returns date and incorporating all amendments current on that date and as extended by the following:-

i) Appendix 0/1: Contract-specific Additional, Substitute and Cancelled Clauses, Tables and Figures;

ii) Appendix 0/2: Contract-specific minor alterations to existing Clauses, Tables and Figures;

iii) The Numbered Appendices listed in Appendix 0/3;

iv) Appendix 0/4 containing a list of the drawings referred to in the Specification.

An Additional Clause as indicated by a suffix 'AR' in Appendix 0/1 is a Contract-specific alteration.

A Substitute Clause as indicated by a suffix 'SR' in Appendix 0/1 is a Contract-specific alteration.

A Cancelled Clause indicated by a suffix 'CR' in Appendix 0/1 is a Contract-specific alteration.

Insofar as any of the Numbered Appendices may conflict or be inconsistent with any provision of the SPW the Numbered Appendices shall always prevail.

Any reference in the Contract to a part of the SPW or Appendix shall be deemed to refer to the corresponding Substitute part of the SPW or Appendix listed in Appendix 0/1 or 0/2.

Where a part of the SPW is altered, any original Table/Figure referred to in the part of the SPW shall apply unless the Table/Figure is also altered. Where a Table/Figure is altered, any reference in a part of the SPW to the original Table/Figure shall apply to the altered Table/Figure.

Where a part of the SPW relates to work goods or materials that are not required for the Works it shall be deemed not to apply.

Any Appendix referred to in the SPW that is not used shall be deemed not to apply.

References in the SPW to “NRA Road Construction Details” shall be taken to refer to Standard Construction Details (SCD) in TII Publications (Standards) published by TII as a collective group of documents under the Construction and Commissioning activity within the online TII Publications system (http://www.tiipublications.ie/), current on the date 10 working days prior to the tender returns date or, if applicable, the extended tender returns date.

Throughout the SPW and Appendices to the SPW, the following interpretations shall apply:

“Base Course” shall mean “Binder Course”

“Roadbase” shall mean “Base”

“Wearing Course” shall mean “Surface Course”

“UK Department of Transport” shall mean “UK Highways Agency”

List ‘B’ gives a list of Contract – specific Numbered Appendices devised for this Contract.

8.4.2.3 Brought Into the Contract by Reference

The Standard Construction Details (SCD) in TII Publications (Standards) contain the following drawings brought into the Contract by reference. Unless otherwise stated below the whole drawing is brought into the Contract.

[Notes to compiler regarding SCD’s:

1. The drawings in the SCDs are intended to be used directly in the Contract without reproducing them in the documents and without supplying them to the Contractor. The individual drawings to be included in the Contract are to be listed in 8.4.2.3 by stating the TII Publication Number (with amendment reference i.e. A, B etc.), date, and aspect or permitted alternative(s) where the whole drawing is not required.

2. Many drawings in the SCDs contain more than one detail covering the same subject. Where alternatives are shown it is essential that the particular requirements or permitted alternatives are identified. These are to be stated in 8.4.2.3.

3. The intention is that the drawings in the SCDs should be used without amendment but if this becomes essential, approval from TII will be necessary through a Departure from Standards. A copy of the amended SCD’s is then to be incorporated in the documents and listed in Appendix 0/4 with a unique drawing number and new date inserted in the date panel.]
