  SMOKING RIDER TO THE LEASE DATED___________ FOR UNIT ______________  _____________________________________ SMOKING POLICY On December 7, 2005, the Chicago City Council passed a comprehensive clean air ordinance. The ordinance went into effect January 16, 2006 and was further expanded on July 1, 2008. Pursuant to the ordinance, (inser t building name and property address ) is a SMOKE FREE BUILDING.  No smoking of any kind is allowed. S moking is defined as cigarettes, pipes, cigars, hookas or any other lighted products. The tenant and landlord agree the property is designated as nonsmoking and the tenant agrees not to smoke in the property, within 15 feet of any entryway or in p ublic areas connected to the property. Tenant will prohibit guests and visitors from smoking on the  property or in the unit. Consequences for violating the no smoking policy may include forfeiture of the security deposit as damages. Fines for smoking will be $100 for the first offense, $250 for the second and $500 for the third offense. After three offenses, tenant will be subject to eviction. It is agreed by t he Lessee any fines l evied for violation of the no s moking  policy may be deducted from the security deposit provided written notice of the violation has been provided to the Lessee. All 25 of Chicago’s public city beaches prohibit smoking and smokers are fined $500. Fines for smoking at the Walt Disney resort hotels run as high as $500. Swissotel Chicago fines guests $250 for smoking in its non-smoking rooms. Marriott fines $300 per occurrence. Other hotels impose similar penalties on guests who smoke. These policies are strictly enforced and many establishments reserve the right to fine guests after they check out if signs of smoking appear in their room.
