No. 06/08 NOVEMBER 2008 SURVEY OF BENZOATES AND SORBATES IN SOFT DRINKS Summary • Benzoates (E210-213) and sorbates (E200, E202-203) are used as preservatives in

various foodstuffs. A survey of their use in soft drinks has been conducted to determine

the actual usage levels of these additives in drinks and to ensure manufacturers are

complying with legislation. This follows on from a similar survey conducted in 2005.

• The samples consisted of concentrates (squashes), carbonated drinks and ready-to-

drink still drinks.

• Out of 250 soft drinks sampled, one (< 1%) contained a level of benzoic acid in excess of

the maximum permitted limit of 150 mg/l. The level found in this sample (08-216234)

was not a concern for consumer health, but there is a need to ensure compliance with

additive legislation. The manufacturer analysed another bottle of this drink from the

same batch and reported the result was less than 150 mg/l.

• Two other drinks (1%) contained levels of sorbic acid likely to have a technological

function, but which were not declared on the ingredients label. For these products the

brand owner is working with their local Environmental Health Officer and has either

altered the label (sample 08-216241) or is reviewing it (sample 08-216250).

Background Benzoates and sorbates are widely used food preservatives and are often used in

combination in soft drinks, such as carbonated drinks and squashes.

The use of benzoates and sorbates in foods is controlled by The Miscellaneous Food

Additives Regulations 1995 (Statutory Instrument (SI) 3187)1 as amended. Benzoates and

sorbates are permitted to be used in non-alcoholic flavoured drinks (excluding dairy-based

drinks). The maximum permitted level for benzoates in soft drinks is 150 mg/l (expressed

as benzoic acid). The maximum permitted level for sorbates is also expressed as the free

acid and is 300 mg/l when used singly or 250 mg/l when used in combination with

benzoates. The maximum permitted levels refer to foods ready for consumption as

prepared following manufacturers’ instructions. Therefore for concentrates (squashes) the

levels apply to the drinks when diluted according to manufacturers’ recommendations.

Soft drinks are likely to be the major contributing factor to the intake of benzoates and

sorbates for young children, due to the high levels of consumption of these products by

this age group. The information from this survey will be used to further refine intake

estimates for these preservatives, and to inform future EU discussions on maximum

permitted levels of benzoates and/or sorbates in foods.

The preservatives considered in this study are benzoic acid (E210), sodium benzoate

(E211), potassium benzoate (E212), calcium benzoate (E213), sorbic acid (E200),

potassium sorbate (E202) and calcium sorbate (E203). The acceptable daily intakes (ADI)

for sorbic and benzoic acid are 25 and 5 mg/kg body weight/day respectively. The ADI is

the amount of food additive, expressed on a body weight basis, that can be ingested daily

over a lifetime without appreciable health risk.

Methodology

Sampling

Two hundred and fifty soft drinks were purchased by Ventress Technical Ltd. (Ventress),

between January and March 2008 from ten regions in the UK. The majority of samples

were purchased in triplicate with samples bearing the same batch codes and best before

dates.

Samples from each region were analysed after collection and any high levels (above the

maximum permitted levels) or unusual results (unlabelled preservatives) were notified to

the brand owners once the confirmed results were received. The relevant Home Authority

for the brand owner was also notified of these results.

The samples consisted of concentrates (squashes), carbonated drinks and ready-to-drink

still drinks. These also included mixers, sports/health/energy drinks and flavoured water

products. Soft drinks which did not declare either benzoates or sorbates on the ingredient

list, yoghurt/dairy/flavoured milk drinks, milk shake syrups, fruit juices and alcoholic

beverages were excluded from the survey. To allow sufficient time for analysis, ambient

products with less than eight weeks to their “best before end” dates from date of purchase

or chilled products with less than 10 days to expiry from the day of purchase were not

sampled. A breakdown of the products tested is given below.

• 132 carbonated drinks

• 61 ready-to-drink still drinks

• 57 concentrates (squashes)

The ten areas sampled in the UK are given below:

• Cheltenham and district (25 samples)

• Colchester and district (25 samples)

• Glasgow and district (23 samples)

• Kettering and district (25 samples)

• London and district (28 samples)

• Manchester and district (25 samples)

• Portadown and district (24 samples)

• Taunton and district (25 samples)

• Wrexham and district (25 samples)

• York and district (25 samples)

In order to maximise the number of different drinks analysed, there was no duplication of

sampling of products.

Samples were purchased from different types of shops: 108 from large supermarkets; 81

from smaller retailers (including independent grocers); and 61 from ‘impulse purchases’

i.e. newsagents, petrol stations, cafes and/or street vendors.

Following purchase of triplicate samples, digital images were taken and labelling and

packaging details recorded. One of the three samples was despatched to Reading

Scientific Services Ltd. (RSSL) under appropriate conditions (i.e. chilled if necessary) for

analysis. The remaining two samples were retained by Ventress under dark and cool

conditions.

For twelve products selected at random, one bottle or can was subdivided into two

containers and frozen at -20°C until dispatch to RSSL and Somerset Scientific Services

(SSS) for confirmatory analysis to check the different methods used by the two

laboratories gave similar results.

Table 1 lists product details for the samples collected for this survey.

Analytical Methodology

The method of analysis was the RSSL in-house UKAS accredited method reference

TM147 (with a minor adjustment to pH). As drinks with quinine (i.e. tonic water, bitter

lemon) showed an interference of the benzoic acid peak, an alternative accredited method

was used for three samples (08-216209, 08-216210 and 08-216226).

Carbonated beverages were de-gassed by sonication prior to dilution. Ready to drink

samples were diluted 1:10 by volume with 0.01M ammonium acetate solution (pH adjusted

to 3.8). Flavoured fruit concentrates, cordials and squashes were diluted 1:20. Prior to

HPLC analysis all diluted samples were filtered through a 0.7µm glass fibre membrane.

Samples were analysed in batches of up to 46 samples. The limit of quantification (LOQ)

for the method was 2 mg/l (for carbonated and still drinks) and 4 mg/l (for concentrates,

squashes and cordials) for both preservatives.

The results for this survey are given in Table 2.

Standard Solutions Mixed calibration standards were freshly prepared on the day of analysis. These

contained 20 mg/l each of potassium sorbate and sodium benzoate in pH 3.8 buffer.

Quality Control (QC) Samples

Oasis Summer Fruits was used as a quality control (QC) sample. Once opened the QC

solution was stable for 6 weeks when stored at 4 ºC.

HPLC Analysis

The HPLC system was an Agilent 1100 with Diode Array detection. HPLC conditions are

outlined below:

Peaks for the preservatives were identified primarily by retention time with respect to the

calibration standards, and diode array spectral match was used to confirm identity.

Results for the preservatives were expressed as the free acid i.e. as benzoic acid and

sorbic acid in accordance with the Miscellaneous Food Additives Regulations 1995.

Quality Assurance

A system suitability sample (Robinson Orange and Peach Fruit Shoot) was run with each

analytical batch to ensure adequate separation of peaks. The quality assurance protocols

also included:

• Duplicate analysis of 1 in every 10 samples.

• A QC sample was run with each analytical batch.

• Any sample found to have undeclared preservatives or preservatives present at 95% or

above the maximum permitted levels (after taking into consideration the measurement

of uncertainty of RSSL’s method) was re-analysed by RSSL and a sub-sample was

sent to Somerset Scientific Services for analysis.

Confirmatory Analysis

Table 3 shows the results obtained by RSSL and Somerset Scientific Services for the 12

random samples analysed to investigate the variation in analytical results between the two

laboratories. While the specific HPLC methodologies employed by RSSL and Somerset

Scientific Services were different (giving reverse elution orders), results of the paired t-test

provide no evidence that the two laboratories give different results for either benzoic or

sorbic acid. The regression analysis shows that there is a statistically significant difference

between the results. However, the differences between laboratories are small i.e. the

results from each laboratory are within 5% of each other, which in terms of agreement

between two laboratories is reasonable.

In addition to these 12 samples, drinks that were found to contain levels of benzoates

and/or sorbates above 95% of their respectively maximum permitted levels - after

considering the measurement of uncertainty associated with RSSL’s method (benzoic acid

at or above 151 mg/l, sorbic acid at or above 297 mg/l if used alone or 248 mg/l in

combination with benzoates) - or undeclared preservative were also sent to Somerset

Scientific Services for independent confirmatory analysis. Results for both laboratories are

shown in Table 2.

Measurement Uncertainty

The measurement uncertainty for benzoic and sorbic acid at 95% confidence level was

estimated by both laboratories. The uncertainty in RSSL’s results was estimated to be

4.37% and 6.26% for sorbic acid and benzoic acid respectively. The uncertainty in SSS’s

results was estimated to be 2.05% and 2.32% for sorbic acid and benzoic acid

respectively.

Reporting

Brand names have been reported as this survey was carried out in accordance with the

guidelines for reporting survey results published in the Guidelines for Food Standards

Agency Technical Surveys2 in November 2006. The absence of a particular brand from

Table 1 means only that the brand was not sampled in the survey. No further meaning

should be read into its absence from this report.

Results, Interpretation and Action Results are given in Table 2. One sample contained benzoic acid at 169 mg/l. Although

this level is above the maximum permitted level, it was not a concern for consumer health,

but there is a need to ensure compliance with additive legislation. The information on the

product label for this drink, St Bernard diet orange flavoured drink, stated “specially packed

for Dunnes Stores” and is manufactured by M&J Gleeson. When informed of the results of

the analysis, the manufacturer requested one of the three sample bottles, which they had

tested and reported the result as below 150 mg/l.

Two other samples contained significant levels of undeclared sorbic acid (Table 4). These

levels were considered to be sufficient to have a technological function in the finished

product and so should have been included in the list of ingredients. This contravenes

regulation 14 of the Food Labelling Regulations 19963, which requires all additives added

to a food to be listed by category followed by the additives specific name or ‘E’ number, for

example “Preservative (Sorbic Acid)”.

Details of the results for the above products were notified to the manufacturer or supplier

for their comments and the relevant local enforcement Authority for investigation. The

comment received from M & J Gleeson is provided in Annex 1.

Analysis of four products indicated they contained levels of benzoates at, or slightly above

the legal limit of 150 mg/l (Table 4). However, taking into account the measurement of

uncertainty associated with the results, these samples were not considered to be in excess

of the statutory limit by both laboratories.

Nine products (4%) contained very low levels of preservatives which were not declared on

the ingredients list. As these levels were very low, the preservatives served no significant

technological function in the finished products. The presence of these additives may be

due to the use of sorbates and benzoates in ingredients used in the manufacture of the

drinks concerned, or due to cross-contamination from other products in the production line.

Cranberries contain natural levels of benzoates which vary with the species and origin of

the fruit. Under regulation 17 of the Food Labelling Regulations 1996, any additive which

is present in the food solely because it was contained in an ingredient of the food does not

need to be named in the list of ingredients if the additive serves no significant

technological function in the finished product. Therefore for these nine products the

preservatives found at very low levels do not need to be included in the ingredients list.

In conclusion, of 250 products investigated, 249 (99.6%) were shown to meet legislation

on benzoate and sorbate levels and 248 (99.2%) met labelling requirements.
