Purpose: Provides minimum standards for programs and practices to support the education of homeless children and students in State facilities.

Adoption:◦ Replaced “student with disabilities” with “student

with a disability” throughout the chapter.

◦ Replaced “homeless child with disabilities” or “homeless children with disabilities” to ‘homeless child with a disability” or “homeless children with a disability” throughout the chapter.

◦ Revisions made for consistency and to align with N.J.A.C. 6A:14, Special Education.

Proposal: Clarified that the school district of residence for a homeless child remains the same “until the parent of the child establishes a permanent residence or is deemed domiciled in another jurisdiction pursuant to N.J.S.A. 18A:38-1.d.”

Adoption: ◦ Revised: Changed “or is deemed domiciled in another

jurisdiction pursuant to N.J.S.A. 18A:38-1.d.” to “until the family is deemed domiciled in another jurisdiction pursuant to N.J.S.A. 18A:31-1.d.”

◦ Added: Financial responsibility will remain with the homeless child’s school district of residence until the family is deemed domiciled in another jurisdiction pursuant to N.J.S.A. 18A:38-1.d.

Proposal: ◦ Changed “origin” to “residence” to be consistent

with the change throughout the chapter; and ◦ Added acronym “IEP” to replace individualized

education program for stylistic improvement. Adoption:

◦ Removed language regarding the review and revision of the IEP that is inconsistent with N.J.A.C. 6A:14, Special Education; and

◦ Added language to specify that when a homeless student is enrolled in a school district other than the school district of residence the student is treated as a transfer student pursuant to N.J.A.C. 6A:14, Special Education.

Proposal: The previously proposed amendment used the following citations: N.J.S.A. 18A:7B-12.1 and N.J.S.A. 18A:7F-50.

Adoption: ◦ Revised citations for accuracy;◦ Replaced “N.J.S.A. 18A:7B-12.1” with “N.J.S.A.

18A:7B-12.d”;◦ Replaced “N.J.S.A. 18A:7F-50” (first use) with

“N.J.S.A. 18A:7F-49,” where necessary; and ◦ Removed “N.J.S.A. 18A:7F-50” (second use).

Proposal: Requires State agencies to submit a professional development plan to the Department.

Adoption: ◦ Replaced “submit” with “make available” for

consistency with new rules at N.J.A.C. 6A:9-15.6 (recodified as N.J.A.C. 6A:9C-3.6 as of August 4, 2014) that eliminated the requirement for professional development plans to be reviewed by county office staff.
