ASEAN Advisory on Talc The FDA provided information on talc to ease the public’s fear in using cosmetic products containing the ingredient. They stated that there are two types of talc, cosmetic grade and industrial grade. Cosmetic grade talc should not contain asbestos, a prohibited substance. It is also considered a safe ingredient throughout the world. Talc used in children’s products should always contain a warning stating “Keep powder away from children’s nose and mouth.” ASEAN countries will continue to monitor closely any new safety data related to the use of talc in cosmetics 1 st GENERAL MEMBERSHIP MEETING The first General Membership Meeting for the year was held at the Joy-Nostalg Hotel and Suites Manila in Ortigas center on February 22, 2018, hosted by VMV Hypoallergenics. Induction of CCIP New Members CCIP welcomed and inducted the new members: Mahachem Inc., One Chemcentral Inc., Elegant Fumes Beauty Products Inc., Shawill Corporation, Ming Mei Cosmetics Inc., Suarez Metaplas Industries Inc., ELC Beauty Inc., and last but not the least - Heltker A.G. Corporation.

Last January 29, FDA-CCRR called a meeting to industry stakeholders to

discuss about benzalkonium chloride. It is an ingredient currently used in

cuticle tints as a sanitizer and a

surfactant for rinse-off hair care products.

Market monitoring has turned up

that cuticle tints in the market contain benzalkonium chloride and

claims to have antibacterial/ disinfectant properties. Considering

the manicure process, there is a

possibility that the skin may be broken by the manual cleaning of the nails

(with cuticle remover) and the product is applied on broken skin.

During the 7th ACC Meeting, it

was decided that antimicrobial claims in leave-on products may be allowed

as long as the product is not

intended to be used on broken skin.

Thus, after a discussion with

representatives from CDRR, CCRR and CDRR has determined that

benzalkonium chloride-containing cuticle tints with antiseptic/

antibacterial/ disinfectant claims

should be categorically classified as household remedy, not a cosmetic

product.

Note: Cuticle Tints is still allowed in cosmetic as long as the product

is (1) compliant with ACD ingredient annexes and appendices;

(2) benzalkonium chloride is used

only as a preservative and (3) no antibacterial/antiseptic/disinfectant

claim is made.

The proposed transition periods for the new regulations will be on June

2021, but will still be reviewed by the FDA.

regulatory updates regarding

Chemistry Law (RA No. 10657)

focusing on hazard pay and

other FDA advisories.

The event was also sponsored by PLDT, VMV Hypoallergenics,

Tradesphere Industrial Commodities, Inc. and Beauché International

REGULATORY UPDATES CHEMISTRY LAW RA 10657 ON HAZARD PAY Full implementation will start on April 2018.

A 2nd Consultative meeting on HAZARD PAY was done by the Integrated Chemists of the Philippines (ICP)

during the Chemistry Week Symposium at Century Park Hotel, Manila held on 19 February 2018. Draft guidelines on hazard pay were presented. Details are the following:

1) The Hazard pay is not covered by DOLE.

2) The suggested amount for hazard pay is Php 1760.00 per month – full amount if one has worked for

22 days at a high risk to hazard. The amount was based on the maximum total SSS contribution and is therefore subject to future modification or adjustments.

3) Establishments may opt to give a higher amount based on their internal job hazard risk analysis or their own assessment of conditions in the laboratory.

4) For those giving hazard pay higher than the prescribed minimum amount. The principle of non-

diminution of benefits shall apply. 5) Hazard pay should be indicated as a separate item in the compensation package. Establishments

claiming that hazard pay is already part of the compensation package must provide a detailed breakdown of the compensation specifically the amount that is separately given as hazard pay.

The BIR 2316 Form Certificate of Compensation shows a box where the amount of hazard pay received has to be indicated.

Guidelines on hazard pay are mandatory.

Formula for determining the amount of hazard pay:

The discussion was done with reference to the following:

R.A. No. 10657, Section 42 Hazard Pay, Health and Accident Insurance, and Legal Assistance. – Registered

chemists and registered chemical technicians who are exposed to chemicals as part of their regular responsibilities are entitled to hazard pay and insurance coverage commensurate to the risk involved.

Likewise, registered chemists and registered chemical technicians who face civil or criminal suits arising from chemistry work done in good faith are entitled to legal assistance to be provided by the employer/laboratory

for whom the work was performed. Section 50. Hazard Pay, Health and Accident Insurance – Chemists and Chemical Technicians exposed to Chemicals as part of their regular work and responsibilities are entitled to hazard pay and insurance

coverage commensurate to the risks involved. This should be part of the organization’s compensation and

benefit scheme for such work. The Board shall set guidelines for this purpose, in consultation with relevant stakeholders and government agencies.

Compliance to R.A. 10657: Certificate to Operate a Chemical Laboratory –

Additional requirement for issuance of Certificate to Operate a Chemical Laboratory (QC Lab) is the _ Hazard pay, health and accident insurance, legal assistance to chemists and chemical technicians.
