August 2014 A

From the moment I was asked to write a brief story about someone in the Senior Men’s Club I knew it had to be Charlie. I’d only known him for a couple of years here in the SMC, but after all, he is going to be our next President. So I collected some press, biographical notes and started looking for that one special defining note that might help to understand the true make up of this prominent attorney.

Oh there was a lot to point out. Admitted to practice law in 1957, this young Toledo citizen, by way of the University of Detroit, B.C.E. and U of D. J.D. specialized in all phases of intellectual property law. He practiced before the U.S. Patent and Trademark office and is licensed as a Professional Engineer. Charles was a former instructor for the U of D School of Engineering. Oh and get this. He is a retired United States Air Force Colonel, having served in the Judge Advocate General Department as a reserve officer.

Very impressive, but I still wanted to know what drove this delightful man. His list of Professional Associations is three quarters of a mile long, His Civic and Cultural Involvements are enviable as is his awards list which culminated with his selection as The Michigan State Bar Foundation’s 2006 Founders Award Recipient.

Even with all this material I was looking for some little tidbit that would help define Charlie. I was aware of his families terrible loss in August of 2005. That was when Charles and Patricia received word that their oldest son Charles was lost in a boating accident on Lake Huron. As parents we can only imagine the heartbreak that the Rutherford family endured. Upon the commencement of his 50Th year in the practice of law, this former professional minor league baseball umpire said, “All of us at home and at work use our personal talents and energies to make a family work, but often we see our dreams and efforts exploded by some totally unforeseen turn in the road”

All of this and I still wasn’t sure I had just what I

wanted. And then it Happened! In June I asked old friend Anthony Kenny to join us at a SMC luncheon in hopes he might become a member. After the program I introduced Tony to as many members as I could. “Hey Charlie, I want you to meet my pal Tony Kenny”. As they shook hands Tony told Charlie that he wanted to thank him again for taking him to lunch forty years ago. Charlie looked slightly puzzled so Tony continued. “When I was just out of law school I sent my resume to you at Dykema Gossett in my search for a job. You called me and said there weren’t any openings right now but you invited me to lunch. I was confused. Why lunch? But in your kindness you imparted much knowledge that has been with me through the years”. And there I had it.

You’re a good man Charles Rutherford. It looks like the tradition of fine presidents is going to continue. At least for another year.

The weather was very agreeable for this year’s cruise on the Diamond Jack, which covered the Detroit River from the Ambassador Bridge to Wyandotte, including river views of downriver industry we don’t see driving down Jefferson or Fort. We also saw several examples of unusual architecture for riverside homes as well as a quick glimpse of the BobLo boats in storage for possible renovation. The day was topped off with food and fellowship at Portofino Restaurant in Wyandotte. While it was not quite the Riviera or Monaco, it was a most enjoyable excursion, well worth repeating next year.

A WICKED WAR: POLK, CLAY, LINCOLN and the 1846 U.S. Invasion of Mexico.

The Readers Frank Markey (313-886-8324) Jack Cobau (313-885-1650)

Reading List

known figures: John J. Hardin, an early political friend and rival to Lincoln, who was killed in the war, and Nicholas Trist, whom Polk appointed – to his later regret – to negotiate the 1848 treaty which concluded the war. The descriptions of the battles of the war, all of which were American victories, are brief.

The only Michigan connection was the Demo-cratic politician Lewis Cass, who was a loyal friend of the South and its peculiar institution slavery; he was a candidate for the Presidency in both 1844 and 1848. All the Readers liked the book.

There is no meeting in August.

The September book is DIRTY WARS: THE WORLD IS A BATTLEFIELD by Jeremy Seahill. Meeting Location is to be announced.

The author refers to this country’s “warrior tradition,” which may explain in part the proliferation of firearms and the reluctance of state and federal legislators to enact meaningful restrictions on their ownership.

Our group could not agree on whether the land taken from Mexico in 1848 at the conclusion of the war could have been acquired peacefully through diplomacy. The major thesis of the book is that James K. Polk, President 1845-49, was determined (under the theory of “Manifest Destiny”) to extend the bor-ders of the U.S. – by hook or by crook – to include not only the independent republic of Texas but the part of Mexico between Texas and the Pacific Ocean; he had no moral scruples about starting an unprovoked war to accomplish this. None of our Readers challenged this, which the author documents in great detail, but there was some hesitation about how this injustice could be rectified after 166 years. One solution, returning Cali-fornia to Mexico, received no support, the justifica-tion for which was “fait accompli”, but an alternative, returning to Mexico the wooden leg of Santa Anna (the Mexican general/dictator), which the Americans captured in the battle of Cerro Gordo, met with more approval.

The book tells us how the two republics – Mexico and U.S.A. – diverged in development, both politically and economically, in the first half of the 19th century; and this engendered or reinforced a feeling that Mexi-cans were inferior and not entitled to keep the vast area in its north. It also gives splendid descriptions of Henry Clay and his politics, Abraham Lincoln’s early political life, President Polk (a protegé of Andrew Jackson) and his strong wife Sarah, and two lesser
