SAN BERNARDINO — A top gang prosecutor at the center of a politicalfirestorm over a series of offensive social media posts has been placedon paid leave pending the outcome of an administrative investigation.
At a news conference Monday, District Attorney Mike Ramos said hewas “offended” by Michael Selyem’s comments on Facebook andInstagram, and ordered an internal investigation after his office receiveda complaint on June 28.

“The San Bernardino County District Attorney’s Office does not condonehate, discrimination or incitement of violence,” Ramos said during thenews conference at the District Attorney’s Office. “Our community andthe entire criminal justice system depends on having a fair, ethical, andunbiased prosecutor. We must insist on that — an unbiased prosecutor.”
At the conclusion of the internal probe, Ramos said, his office willconsider disciplinary action, including possible termination. Meanwhile,he said, Selyem’s pending cases have been reassigned to otherprosecutors.
Among Selyem’s inappropriateonline posts was an onlineargument he had with someoneover the police shooting of acivilian. In it, he wrote, “That s—bag got exactly what hedeserved. … You reap what yousow. And by the way go fyourselfyou liberal s—bag.”
Selyem also targeted outspokenU.S. Rep. Maxine Waters, formerfirst lady Michelle Obama, andMexican immigrants.
Of Waters, Selyem said: “Being a loud-mouthed (expletive) in the ghettoyou would think someone would have shot this bitch by now …” He alsoposted a doctored picture of Michelle Obama holding a sign saying,“Trump grabbed my penis.”

a prosecutor, and I think further, as the district attorney, I was reallyconcerned with comments regarding officer-involved shootings,” Ramossaid. He said such comments affect “the ability for us to ensure theintegrity of this office and making sure the public knows that we aredoing these cases and investigating these cases in an unbiasedfashion.”
Ramos’ news conference preceded one held outside his office by LosAngeles civil rights activist Najee Ali, who said his organization, ProjectIslamic Hope, would be filing a formal complaint against Selyem with thestate Bar Association demanding he be disbarred.
“He does not deserve to be serving in any shape, form or fashion in lawenforcement at all,” Ali said.

He said Selyem’s actions have stirred reaction among minorities acrossthe nation, which he has fielded on his organization’s website.
“This man has proven by his words that he does not have the integrity,the character or the morals to be in that job and working as a D.A.,” Alisaid. “We don’t trust him. Nobody can trust him anymore because histrue feelings came out by what he said publicly, not just one time, butseveral times. He used language that was disparaging, inappropriateand just wrong.”
If Selyem isn’t fired, Ali said, he and others will “take to the streets” inprotest.
“We have the power, the proven ability to organize successfully andmobilize people, and this issue has united everybody,” he said.
The Rev. Jesse Jackson alsoweighed in Monday, tweeting:“San Bernardino SeniorProsecutor Michael Selyemsounds like a thug and should befired for calling (Waters) the c-word, and speculating on socialmedia why she has not beenshot. Preposterous, racist anddangerous.”
Terrance Stone, CEO of YoungVisionaries in San Bernardino,said Selyem must be dealt with“swiftly.”
“We cannot have this type ofmentality in our D.A.’s office,”Stone said.

said attorneys in their office arenow representing about 10
defendants being prosecuted by Selyem, including the high-profile caseof Alonzo Smith.
Smith has been charged with, among other things, murder, elder abuseand dissuading a witness for punching off-duty sheriff’s Deputy LarryFalce so hard in the face last New Year’s Eve that Falce, 70, died fromthe injuries days later. The incident stemmed from a road rage incident atKendall Drive and University Parkway in San Bernardino.
Prosecutors painted Smith, who was unaware Falce was a deputy whenthe incident occurred, as a career criminal with gang ties recentlyreleased from prison, and had served time for various offenses includingrobbery and selling marijuana.
“I do believe that the case was massively overfiled,” Gardner said.
Selyem requested bail of $1.9 million for Smith.
“We instructed our lawyers handling those cases that if they chose to filemotions to recuse him on those cases, we would support that 100percent if they felt that was what was in their client’s best interest,”Gardner said. “As far as reviewing other cases, past cases with Mr.Selyem, we are going to be talking to our deputies who have handledcases with him, and obviously I would assume we’ll be receiving phonecalls to look into back cases that have been dealt with by Mr. Selyem.”
“Up until this latest issue came to fruition, Mr. Selyem was not someonewho we ever heard complaints about as being a biased or an unfairprosecutor,” Gardner said. “But, obviously these kinds of statementscertainly concern us a great deal, and I’m sure that if people believe thiskind of stuff in their heart, they shouldn’t have the power or ability toprosecute people.”
Ramos also said his office has received no prior complaints aboutSelyem. “We have had no indication of Mr. Selyem having any type ofbias regarding his cases,” he said.

The prosecutor’s posts, first reported by the Southern California NewsGroup, became national news over the weekend, garnering widecondemnation. “I expect professional prosecutors to have more maturitythan a 7th grader, and more class than a high school dropout,” said onereader.
Others defended Selyem’s right to express himself.
“Why is it OK for Maxine Walters to spew derogatory and hatefulstatements with no outcry or removal of her from office, but OK todenounce and remove Selyem?” asked reader Audrey Walker in anemail. “Don’t agree with his postings but it appears the liberal media hasonce again protected the left.”
A Twitter hashtag, #FireSelyem, popped up after the original SCNGreport on Friday, July 6, and has garnered thousands of tweets, retweetsand comments as of Monday.
Many objected to their taxpayer dollars continuing to pay Selyem’ssalary. Others worried about what impact he may have had on the justicesystem.
“San Bernardino County has large community of Blacks and Latinos,”said a tweet by Jacqualine Ebule, a San Bernardino County resident whoworks for the Riverside County Department of Mental Health. “His racistand disgusting behavior puts all of his past and current prosecutions injeopardy! You can’t be fair and impartial when you’re a bigoted racist!”
Another hashtag, #IStandWithSelyem,” had one post as of Mondayafternoon.
Civil rights activist Earl Ofari Hutchinson, president of the Los AngelesUrban Policy Roundtable, said in a statement Monday that “the publiccall for violence to a federal official is a serious crime.”
“In this volatile climate, such a threat poses a grave danger to Waters,” Hutchinson said. “The shooting of an Arizona congresswoman and therecent physical confrontations with government officials in public placesunderscore that grave threat. … The U.S. Attorney must take action

against Selyem.”
Hutchinson said he delivered a formal request for the prosecution ofSelyem to Nicola T. Hanna, U.S. Attorney for the Central District ofCalifornia, on Monday morning. Such threats constitute a felonypunishable by up to five years imprisonment and a fine, he said.
Pedro Cala, a Los Angeles accountant who was aghast at Selyem’sposts and forwarded them to public officials and the Southern CaliforniaNews Group, said in a telephone interview Monday that Selyem’ssuspension was a “positive step in the right direction, but it is just the firststep.”
“By any measure, even if he tried every case that came across hispurview with impartiality and utmost fairness, the appearance ofimpropriety makes it impossible for outside observers to say that hisbiases did not seep into his work,” Cala said.
“There is a reason that our legal system incarcerates more people thanthe rest of the industrialized world,” Cala continued, noting that thoseprosecuted by Selyem’s gang unit are largely black and Latino. “Mr.Selyem has contributed to that, rightly or wrongly. … I am not a lawyer,but I can see and sense unfairness here. Mr. Selyem has made amockery of the oath he took to uphold the law. He has dishonored hisoffice, and himself.”
Rep. Pete Aguilar, D-San Bernardino, tweeted Monday: “We cannotallow racism and bigotry to have a place in our society, especially not inour government. The comments made by Deputy District AttorneyMichael Selyem are unacceptable, and he should be fired immediately.”
Ramos said he had received “thousands of emails from across America”since the Southern California News Group broke the story. He saidSelyem’s pending and past cases now face the possibility of beingchallenged in court by defendants alleging discrimination and/or racialbias. He said his office has a conviction review unit that can fieldcomplaints from defendants with such allegations and review their cases.

A prosecutor in the San Bernardino County district attorney’s office has beenplaced on administrative leave after writing offensive social media comments.
The San Bernardino Sun first reported that the office’s lead gang prosecutor,Michael Selyem, was under investigation for rants targeting U.S. Rep. MaxineWaters (D-Los Angeles), former First Lady Michelle Obama, Mexican immigrantsand the victim of a police shooting.
In a news conference Monday, San Bernardino County Dist. Atty. Michael Ramossaid he was offended by the comments.
And in a written statement, Ramos said: “The San Bernardino County DistrictAttorney's Office does not condone hate, discrimination or incitement of violence.Our community and the entire criminal justice system depends on having fair,ethical, and unbiased prosecutors.”

The Sun reports that Selyem, who joined the office 12 years ago, wrote of Waters:“Being a loud-mouthed c#nt in the ghetto you would think someone would haveshot this bitch by now …”
The newspaper also reports that Selyem got into an online argument over the policeshooting of a civilian, writing, “That s—bag got exactly what he deserved. … Youreap what you sow. And by the way go f— yourself you liberal s—bag.”
“As the district attorney, I was really concerned with comments regarding officer-involved shootings, because we handle those cases, as you know, on a daily basis,”Ramos said at the news conference. “To make any comments … impacts the abilityfor us to ensure the integrity of this office.”
The district attorney’s office received information on June 28 regarding negativecomments posted online by Selyem, according to Ramos. The district attorney saidthere were “more than several” complaints. Staff and managers spoke and thencontacted human resources and “took immediate steps to start a personnelinvestigation.”
“This could end up being some form of disciplinary action, up to termination,”Ramos said. “We haven’t decided that yet. We’re following the rules and regulationsof California.”

of bias regarding his cases, but “that’s not to say we won’t review them, especially ifthere’s a request to do so.”
While there is not a specific social media policy in place, Ramos said, there arepolicies regarding professional conduct as a prosecutor.
“You’re a prosecutor 24/7; it’s not an 8 to 5 job,” Ramos said. “The public looks atyou as leaders in the community.”

office said. He could ultimately lose his job.
In Facebook and Instagram posts, Selyem used offensive language to describe Waters, a Los AngelesDemocrat who last month called on supporters to harass members of President Donald Trump’s Cabinetover the administration’s separation of families under the zero-tolerance immigration policy.
Selyem used a profane term for women’s anatomy to refer to the “loud mouthed” Waters and said “youwould think someone would have shot this bitch by now,” the Southern California News Group reported.
Selyem’s other since-delated posts included a doctored picture of Michelle Obama holding a sign saying“Trump grabbed my penis” and one of a man in a giant sombrero with the caption “Mexican word of theday: Hide.”
He also posted about a person shot by police that called him a crude name and said he “got exactly whathe deserved.” It wasn’t immediately clear whether the police shooting occurred in San Bernardino Countyor elsewhere.
The Southern California News Group said Selyem hung up on a reporter who reached him by phone. Anemail message and phone call from The Associated Press was not returned.
District Attorney Mike Ramos said he learned of the comments two weeks ago after other attorneys in theoffice complained. While individuals have free speech rights, these must be balanced with the need forethical and unbiased prosecutors, he said.
“There’s a line that you cross that it impacts the work of your office,” Ramos told the AP. “The public hastrust in us, and we have to be really careful.”
The district attorney’s office in the county of 2 million people east of Los Angeles is developing a policy onsocial media use. It already has a policy on what constitutes professional conduct, Ramos said.
District Attorney-elect Jason Anderson told the Register on Friday that Selyem’s comments are “not areflection of the image I would like to portray of the DA’s office.”
U.S. Rep. Peter Aguilar, a Democrat who represents San Bernardino, tweeted that Selyme should be firedimmediately.

“We cannot allow racism and bigotry to have a place in our society, especially not in our government,” hewrote.
Selyem, 50, joined the DA’s office 12 years ago and is the lead prosecutor in the Central Hardcore GangUnit.
Critics said the posts called into question Selyem’s objectivity and professionalism as a criminalprosecutor.
However, San Bernardino attorney Stephen Levine, who knows Selyem as an online friend and has facedhim in court, called Selyem “very disciplined and ethical.”
“I have seen no evidence that his personal beliefs have influenced his professional responsibilities andprefer to give him the benefit of the doubt,” Levine said.

Even conservative projections show San Bernardino County growing bymore than a half million people — and a quarter million jobs — over thenext 25 years. With that comes tremendous opportunity — andformidable challenges, not the least of which is how an already jam-packed transportation network can absorb all that additional traffic.
According to the U.S. Department of Transportation, the number ofvehicles registered in San Bernardino County will grow by 370,000during that 25-year period, all traveling on virtually the same roads andhighways we currently have.
As the agency responsible for overseeing and guiding local and regionalimprovements that help move people and goods throughout our county,the San Bernardino County Transportation Authority sees this as morethan simply an engineering challenge. It’s really about our quality of life,and the role transportation plays in a grander ecosystem that includeseconomic development and the creation of high quality jobs, where andhow we live, educational opportunities, and the health, safety and well-being of all of our communities.

county and a region — one in four children living in poverty, one of theworst air quality basins in the country, a housing affordability crisis —transportation and access are critical to any long-term solutions.
Unfortunately, those solutions are harder to come by than ever before.We’re far past the days when building new freeways are a viable option.California began pumping the brakes on new highways in the late 1960sdue to escalating costs, right-of-way issues and concern over air quality.Today, the cost of building a new four-lane highway runs upwards of $10million per mile, assuming you could find a place to put it.
Compounding that is the rapidly growing cost to maintain our existinginfrastructure. California has reported a backlog of $130 billion in road,highway and bridge repairs, and according to the American Society ofCivil Engineers, 50 percent of the state’s public roads are in poorcondition.
In San Bernardino County, we’re addressing the challenge through amultimodal approach, paid for in part through Measure I — the half-centsales tax, extended through 2040 — and aggressive efforts by SBCTA tosecure grant funding. Recently, our agency brief public policy leaders on$287 million in newly funded transportation projects throughout thecounty, including $218 million awarded to us through Senate Bill 1.
Of the $287 million, $106 million will go toward the Redlands PassengerRail Project, which not only will connect the East Valley with theMetrolink system, but will incorporate state-of-the-art air-qualitytechnology.
Among the innovations the Redlands Rail project eventually will includeare Zero Emission Multi Unit trains — the first of their kind in NorthAmerica, helping establish San Bernardino County as a national leaderin alternative transportation technology.

These won’t fix all of thetransportation challenges weface as one of the fastest-growing counties in the UnitedStates. And determining whichprojects receive the highestpriority will always becomplicated in a countyspanning 20,000 squaremiles.
Which brings us back to theneed to view transportationnot as a silo, but as part of amuch bigger picture. Land-usedecisions, as an example,have a significant impact on
our ability to get from place to place. The more complicated we make itto get from Point A to Point B, the longer we’re likely to be stuck in traffic,which increases greenhouse gas emissions, takes us away from ourfamilies and raises anxiety levels. One recent study showed the averageLos Angeles County resident wasting 100 hours a year in traffic; we’renot far off that number.
So, yes, funding is a major hurdle, but so too is aligning the interests ofall of us in the quality-of-life business.
A half-million new residents is a great opportunity for our county.

“budget-based” rate structure, which requires thecity to implement new utility billing software,according to a city news release.
Staff members have been working on the newsoftware, but further testing is still required,according to Finance Director Christa Buhagiar inthe news release.
The new rate structure gives households a “waterbudget”, or allocation, based on the number ofpeople living there and their daily usage. Outdoorlandscaped areas and weather will also helpdetermine allocations.

The city has the option to raise rates another 8percent on July 1 each year through 2022.
Water customers should expect to see the newrates on their August bills, according to the city.

A judge on Monday dismissed the federal government's claim that U.S. law trumps two California lawsintended to protect immigrants who are in the country illegally, affirming his ruling last week thatCalifornia was within its rights to pass two of its three so-called sanctuary laws.
U.S. District Judge John Mendez rejected the U.S. government's argument on two of the laws that the U.S.Constitution gives the federal government pre-eminent power over states to regulate immigration. TheTrump administration argued that California is obstructing its immigration enforcement efforts.

As he did in last week's decision, Mendez ruled Monday that the federal government could proceed with itsattempt to block part of a third California sanctuary law, which prohibits employers from allowingimmigration officials on their property without warrants.
The twin rulings by Mendez, who was nominated to the federal bench by Republican President George W.Bush, allow California to continue limiting police cooperation with immigration officials and requireinspections of detention facilities despite the Trump administration's lawsuit filed in March.
The lawsuit, announced by U.S. Atty. Gen. Jeff Sessions, is part of the Trump administration's efforts tooverturn so-called sanctuary jurisdictions that he said allow criminals to remain free. Supporters ofsanctuary laws argue they encourage immigrants to report crimes without fearing deportation.
California's law limiting the sharing of information with federal agents “does not directly conflict” withU.S. law, Mendez wrote in a seven-page decision.
California Atty. Gen. Xavier Becerra, in a statement, called the decision “a victory for our state's ability tosafeguard the privacy, safety and constitutional rights of all of our people. Though the Trumpadministration may continue to attack a state like California and its ability to make its own laws, we willcontinue to protect our constitutional authority to protect our residents and the rule of law.”
Justice Department spokesman Devin O'Malley did not immediately respond to telephone and emailrequests for comment after normal East Coast business hours.
As for California's law that requires state inspections of detention facilities where immigrants are held, thejudge wrote that he found nothing in the federal statutes saying Congress did not intend for states to haveoversight of detention facilities in their borders.
The law “does not give California a role in determining whether an immigrant should be detained orremoved from the country, nor does it place any substantive requirements or burdens on these detentionfacilities apart from providing access,” Mendez wrote.
Mendez ruled last week that California cannot enforce the warrants law, so court proceedings on thatportion of the law will continue. Both sides could elect to appeal the judge's decisions on any of the rulings.

Four people were arrested in connection with the Friday, July 6, searchin the 9200 block of Milliken Avenue, three of them at the location. Thefourth — identified as Malachi Gittens, 21, of Rancho Cucamonga —was taken into custody after he arrived during the search and briefly fledthe scene, according to a Monday news release for the San BernardinoCounty Sheriff’s Department.
The search was conducted by the Rancho Cucamonga station’s multipleenforcement team, along with detectives and deputies.
Arrested on suspicion of forgery and fraud were Jamaw Chapman, 26;Joseph Patrice, 28; and Jody Petrus, 33, all of Rancho Cucamonga.Gittens was arrested on suspicion of resisting arrest, the release said.None were in custody on Monday, jail records showed.

Frustrated by discolored drinking water pouring from their taps, four Comptonresidents filed a class-action lawsuit late Monday against their water provider,Sativa Los Angeles County Water District.
The lawsuit, filed at Los Angeles County Superior Court, accuses Sativa of failing toprovide quality drinking water, misappropriating taxpayer dollars and causing afinancial burden on its low-income customers in Compton and Willowbrook. Itcomes days before a crucial decision by county oversight officials on whether todissolve the small public water district.
“Sativa mismanaged public funds by failing to use them for the intended purpose ofmaintaining and improving the water district’s infrastructure for the delivery ofpotable water,” the lawsuit alleges.
The claims in the suit echo some raised by oversight authorities about Sativa inrecent years.

The district has been accused of financial instability, nepotism, poor maintenanceand mismanagement. It has fended off two previous dissolution attempts by L.A.County’s Local Agency Formation Commission — the state-appointed body chargedwith monitoring special districts.
The commission meets Wednesday to consider initiating its third attempt todissolve the district.
That decision will come amid mounting complaints by residents of discolored waterthat smells of chlorine or rust. Residents said the water stains white clothes andforces them to purchase bottled water with which to drink, cook and bathe,according to the lawsuit.
The plaintiffs include four mothers who said they are affected by water problemsdating as far back as five years.
“It’s a wake-up call for everybody, even for those who [oversee] the district,” saidMartha Barajas, one of the plaintiffs. “Maybe people will listen to us now.
“We’ve given Sativa plenty of time to fix the problems,” she added.
The 1,600 households served by Sativa pay a flat rate of $65 a month, adding up tonearly $1.3 million in annual revenue.
Sativa says it lacks the estimated $10 million to $15 million needed to upgrade the70-year-old pipes it blames for depositing manganese in drinking water, which canmake faucets run brown.
The lawsuit states Sativa “miserably failed again and again” to meet state cleandrinking waters standards. It points to a compliance order from the State WaterResources Control Board last month that said Sativa violated the state’s health andsafety code when it neglected to maintain the minimum water pressure, delivered“muddy water” and did not engage in proper flushing.
The order said water tested from Sativa wells, faucets and hoses contained higher-than-normal levels of manganese and was sometimes cloudier than standardsallow. The state water board noted that from March 2017 to May 2018, Sativareceived at least 97 complaints of brown water from customers.

reported allegations that the district had hired paid supporters to attend a forum toaddress the problem. Sativa’s board and its administrative manager, Maria RachelleGarza, strongly denied any involvement. Days later, Garza was placed on leave.
The defendants in the lawsuit are Sativa and its five board members: LuisLanderos, Christina Casillas, Juan Aguilar, Roxsana Zepeda and Lucia Castrellon.They could not immediately be reached for comment.
Landeros previously told The Times that the district is working to fix the problembut needs financial help from the state and county.

For decades, the Los Angeles County Sheriff’s Department has struggled to combatsecretive cliques of deputies who bonded over aggressive, often violent police workand branded themselves with matching tattoos.
A federal judge called out the problem nearly 30 years ago, accusing deputies ofrunning a "neo-Nazi, white supremacist gang" named the Vikings within theLynwood station. Others followed with names such as the Regulators, GrimReapers, Rattlesnakes and the Jump Out Boys. Inside the county’s central jail, the2000 Boys and 3000 Boys ran roughshod over the lockup’s toughest floors.
Now, despite past attempts by sheriff’s officials to discourage internal cliques, freshallegations have arisen of deputies in the department’s Compton station adornedwith matching skull tattoos.
One deputy acknowledged in a recent deposition that he and 10 to 20 of hiscolleagues at the station had the tattoos but denied there was a formal clique.

Attorneys representing the family of a black man shot by deputies during a 2016foot pursuit have used the existence of the tattoos to argue there is a clique tied tothe killing, which they allege was racially motivated.
It’s unclear whether the tattoos signal a return of a secret deputy group thatcelebrates violence or something more benign. But some law enforcement expertssaid it’s important for the Sheriff’s Department to understand what’s going on andmake sure the clique mind-set has not returned.
“In addition to investigating the police shooting, the department should also look atthe culture,” said Alex Busansky, a former prosecutor who served on a countycommission that in 2012 found that the department’s tolerance of cliquescontributed to excessive force in the jails. “A place where 20 police officers receivematching tattoos is a place where there is a mentality of us-versus-them, and thaton its face is concerning.”
Sheriff’s spokeswoman Nicole Nishida declined to comment on the allegations,citing the pending litigation, but said in a statement that the agency expectsdeputies to meet high standards of integrity and appearance. She alsoacknowledged they have the right to free expression.

tactics, we have multiple systems of review and accountability both internally andexternally. Every critical incident is exhaustively analyzed,” the statement said.
The controversy focuses on a deposition given in May by Deputy Samuel Aldama,one of the deputies involved in the 2016 shooting who at the time was assigned tothe Compton station. Under oath, Aldama described a tattoo on his calf as a skullwith a rifle and a military-style helmet with flames surrounding it. On the helmetare the letters “C P T” for Compton. He said he got the tattoo in June 2016, abouttwo months before the deadly shooting.
Aldama said he knew of other deputies at the station who had tattoos like his,according to an excerpt of the deposition transcript reviewed by The Times. But herepeatedly denied that the inked art signified membership in a club.
Instead, he said, “working hard” on the job — making arrests, answering calls —was the only requirement for getting the tattoo. He described vaguely the selectionprocess, saying that when deputies in the station determined someone in theirranks was deserving of the honor, they passed along the contact information of anartist who would make the tattoo.
In a court hearing Monday, the attorney for the dead man’s family, John Sweeney,raised the tattoos and a response Aldama gave in the deposition, saying thattogether they showed the deputy harbored racist feelings about African Americanswhen he opened fire — a serious allegation that a lawyer for the Sheriff’sDepartment denied.
We’ve “uncovered another one of those cliques,” like the Vikings, Sweeney told thejudge.
“There truly is a history of tattoos in the Sheriff’s Department, but [Sweeney] hasyet to prove that this is anything more than a station tattoo,” said Harold Becks, thecounty’s attorney. He did not respond to requests later on Monday for comment.
At the deposition, along with questions about his tattoo, Sweeney asked Aldama,“Do you have any ill feelings toward African Americans in general?” according toexcerpts of the deposition reviewed by The Times.
After asking the attorney to repeat the question, Aldama said he did have feelings.The attorney asked him to elaborate.

“They’re just human beings, sir,” Aldama replied after a long silence.
Sweeney asked again if the deputy had any ill feelings, emphasizing “ill.” Aldama,after another lengthy pause, said that he did.
About a minute later, Aldama told Sweeney he had not understood the questionsabout African Americans.
“I don't have any ill feelings,” the deputy said.
Matching tattoos have long been part of a fraternity subculture in the Sheriff’sDepartment, dating at least to 1971 with the Little Devils at the East Los Angelesstation.
Seven deputies were fired in 2013 after an investigation into the Jump Out Boys, agroup of gang enforcement officers who were accused of glorifying shootings bydeputies. Their signature tattoo was a skeleton holding a revolver. Whenever adeputy in the group was involved in a shooting, he would earn extra ink of smokecoming out of the gun.
Deputy cliques were also criticized by the Citizens’ Commission on Jail Violence, ablue-ribbon group that issued harsh findings in 2012 about systemic dysfunction inthe department, including the use of excessive force against inmates. Thecommission recommended that the agency ban visible tattoos associated with thegroups because they had sometimes been used to reward aggressive behavior. Inone episode, a deputy in the 2000 Boys broke the eye socket of a complacentinmate during a beating to “earn his ink” — a tattoo with the Roman numeral “II.”
Sheriff Jim McDonnell, who was part of the commission, did not respond torequests for comment on Monday.
At his federal trial on obstruction-of-justice charges in 2016, former UndersheriffPaul Tanaka was assailed by prosecutors for being a tattooed member of theVikings. On the stand, Tanaka denied allegations he had encouraged aggressive,improper tactics by the Viking members, saying the group did not representanything sinister.
The latest controversy emerged in a legal battle over the Aug. 25, 2016, killing ofDonta Taylor.

About 8:30 p.m., Aldama and his partner, Mizrain Orrego, were assigned to a gang-suppression detail in a marked car when they saw Taylor, 31, walking onWilmington Avenue in an area known to be controlled by the Cedar Bloc Pirusgang, according to a district attorney’s review of the shooting. Taylor was wearing ared hat with the letter C on it, which the deputies took as a sign he was affiliatedwith the gang. They told investigators he appeared to be holding something in hiswaistband, the report said.
The deputies told investigators that when they pulled alongside Taylor to ask if hewas on parole or probation, he pulled a handgun from his shorts and ran, accordingto the report. Both deputies chased Taylor on foot and called for backup on theirradios, saying they were in pursuit of a man with a gun.
In an attempt to corner him, the deputies separated and pinned him in along awash. Orrego, who was positioned around a corner from his partner, said he firedseveral times when he saw Taylor approaching with a gun in his hand. Hearing theshots and seeing Taylor run into view, Aldama then fired as many a dozen rounds.Orrego said he fired again two or three times when he saw Taylor turning back inhis direction. An autopsy showed Taylor had been shot six times.
Despite an extensive search, no weapon was recovered. Sheriff’s officials said testson Taylor’s pockets and waistband turned up gunshot residue that was consistentwith a handgun.
After reviewing the shooting, the district attorney’s office found the deputies actedreasonably and should face no criminal charges.
Efforts to contact Orrego and Aldama were unsuccessful. Nishida said she wouldalert the deputies that a Times reporter wanted to speak with them.
After the hearing Monday, Sweeney cited an arrest the two deputies made monthsbefore the killing that he said mirrored what happened to Taylor.
In January 2016, the deputies rode their patrol car up to Sheldon Lockett, who wasstanding with a friend in front of his godmother’s house, and pulled their handgunson him, according to a federal lawsuit Sweeney filed for Lockett.

Orrego severely beat and Tased Lockett while repeatedly using a racial epithet,according to the lawsuit. Then, with Lockett subdued and in custody, one of thedeputies “rammed the end of a police baton” into Lockett’s eye socket.
The county has yet to respond formally to the lawsuit.
Looking to bolster his legal claim that sheriff’s officials share culpability in Taylor’sdeath, Sweeney said the department failed to investigate the deputies afterLockett’s mother complained about the arrest.
“Had they investigated this, Donta Taylor would be alive today,” Sweeney told TheTimes.

including school districts — are feeling thefinancial pinch and asking their voters to approvenew taxes of one kind or another.
There were 111 local tax measures on the Juneprimary election ballot, the vast majority of whichpassed, according to municipal finance guruMichael Coleman of CaliforniaCityFinance.com.
Dozens more — sales taxes, parcel taxes,marijuana taxes, utility taxes and hotel taxes —are being planned for the Nov. 6 general election.
So why are so many local entities feelingstrapped?
Local officials will tell you, if you don’t quote themby name, that it’s mostly because theirmandatory payments into the state’s two bigpension funds are soaring.
The California Public Employees RetirementSystem and the California State TeachersRetirement System lost tens of billions of dollarsduring the recession a decade ago and havenever fully recovered.
CalPERS has steadily and sharply increasedfinancial demands from cities, counties andschool districts for their civil service workerswhile the Legislature and Gov. Jerry Browncranked up contributions to CalSTRS from schoolsystems to cover teacher pensions.
However, while seeking more money from theirvoters to cover their ever-increasing retirementcosts, local officials have been very reluctant tosay it’s for pensions, fearing backlash at thepolls. Rather, on the advice of high-priced“consultants,” they promise the new taxes willenhance such popular services as police and fireprotection and parks.
We can expect more such propaganda this fall,leading up to the election.

One example is in Sacramento, whose mayor,Darrell Steinberg, wants his voters to reauthorizea half-cent sales tax that will soon expire and toadd another half-cent.
In a recent speech, he called his proposal “a realgame changer” that would finance affordablehousing, shelters and services for the homeless,job training in low-income communities andsmall-business incentives.
However, simple arithmetic tells us otherwise.The additional half-cent of sales tax wouldgenerate less than $40 million a year, city budgetdocuments say, while by the city’s own estimate,its mandatory payments to CalPERS areexpected to increase from $81.6 million a year to$129 million by 2023.
To its credit, the Sacramento Bee pointed out thelooming effect of the city’s rising pension costs.The state’s other news media should follow suitas their local officials tout the benefits ofincreasing taxes. Reporters can easily calculateprojected pension cost increases from CalPERSdata and the potential revenues from sales taxdata.

Meanwhile, one city just a half-hour’s drive fromSacramento is doing it the right way, tellingvoters why it needs more money.
Lodi also will place a half-cent sales tax increaseon the November ballot and its officials are notshy about the reason.
Lodi City Manager Steve Schwabauer has beena leading figure in efforts to persuade CalPERSto moderate its demands, arguing that cities suchas his will face insolvency unless they get reliefor persuade voters to raise taxes.
Schwabauer told the city council, before it votedunanimously to ask voters for the tax hike, thatwithout it the city will see operating deficitsbeginning next year.
“The cause of this, point-blank, is CalPERS andour pension fund, and I have spent at least twoyears of my life fighting with CalPERS,”Councilwoman JoAnne Mounce said.
Such candor may not make it easier to persuadevoters, but it’s the right thing to do.
