Executive Summary Oil and Gas development occurs in the western half of the state and the Finger Lakes region, while mining occurs in every region of the state except in the Department of Environmental Conservation’s (DEC or Department) Region 2. Due to the differences in legal reporting requirements, the types of statistics presented for the two programs are not identical.

2016 Summary & Trends

Production, Market Value and Economic Impact New York State natural gas production in 2016 was 13.5 billion cubic feet (bcf), down 24.6% from the previous year. Trenton-Black River production declined 38.2% to 4.2 bcf, accounting for 31.4% of 2016 gas production. Gas production from the Herkimer decreased 14.9% from the previous year to 0.96 bcf in 2016, while gas production from the Medina decreased by 12.2% to 5.9 bcf. Oil production decreased 21.5% from the previous year to 222,081 barrels (bbls) in 2016. The oil and gas produced in New York State in 2016 is valued at an estimated $43.6 million. Approximately $1.3 million was generated for local government taxes. Approximately $5.5 million was generated in royalties for landowners. Oil and gas development occur in the most western parts of the state and the Finger Lakes region.

Wells In 2016, New York well operators reported 14,782 wells (all regulated well types). Most of these wells were drilled to explore for and/or produce oil or natural gas. Other well types reported in the 2016 total include underground gas storage, solution salt mining, geothermal, brine disposal, monitoring, and stratigraphic. The total number of wells completed increased 8.3% to 52 in 2016. In 2016, a total of 208 operators reported 2,572 wells with no (zero) production for the entire year. This is in addition to over 3,500 orphaned and unplugged wells in the Department's records. At the end of 2016, New York held $18.9 million in financial security to guarantee well plugging and site reclamation.

Regulatory Activity In 2016, the Department’s Division of Mineral Resources (DMN or Division) issued 55 drilling permits, and operators plugged 189 wells in accordance with DMN-issued plugging permits. In addition, 56 orphaned wells were plugged by DMN and EPA. Total drilled depth of the wells for the year was approximately 75,345 feet (or 14.3 miles). No compulsory integration hearings were conducted in 2016. Division of Mineral Resources’ Oil and Gas staff traveled 82,326 miles to perform 4,184 inspections in 2016. Staff inspect well sites:

• during permit application review; • during drilling and plugging work, with emphasis on cementing operations; • to ensure regulatory requirements are followed and that violations, if any, are

remediated; • during production and prior to ownership transfers to ensure compliance; • to score abandoned wells to assess relative threat to the environment and public

safety in support of well plugging initiatives; • to ensure that reclamation meets requirements; and • to investigate complaints.

Permits, Completions and Inspections

Drilling Permits

DMN issued 55 drilling permits; down 6.8% from 2015:

• 40 oil • 8 brine • 4 stratigraphic • 2 geothermal • 1 injection

In 2016, DMN issued permits for wells in six counties; the top 3 based on total permits were Cattaraugus (36), Wyoming (8), and Chautauqua (4).

• Oil well drilling permits were issued for Cattaraugus (35), Chautauqua (4), and Steuben (1) counties.

• Brine well drilling permits were issued for Wyoming County (8). • Stratigraphic well drilling permits were issues for Westchester County (4). • Geothermal well drilling permits were issued for Bronx County (2). • An injection well drilling permit was issued for Cattaraugus County (1) • There were no gas well drilling permits issued.

Well Spuds and Completions

• The number of wells spud (started) in 2016 was 47. • The total number of completions increased 6% from 49 in 2015 to 52 in 2016. • Zero gas wells were completed in 2016. • Oil well completions decreased 26% from 39 in 2015 to 29 in 2016. • Completions for other regulated well types in 2016 totaled 23.

Inspections

In 2016, Oil and Gas staff performed 4,184 inspections, up 5.8% from 2015. The increase of 229 inspections from the previous year was due to:

• Orphaned and abandoned well plugging activity by DEC and EPA; • Shut-In/Temporary Abandonment compliance efforts associated with inactive

wells; • Requests for transfer of well operatorship and plugging responsibility; • A decrease in the number of drilling applications received, which reduced the

amount of time spent performing application reviews, allowing staff to spend additional time inspecting existing wells; and

• An increase in the number of Division staff.

State Land Oil and Gas Leasing

In 2016, DMN administered 77 leases on 44,435 acres of state land in Allegany, Cattaraugus, Cayuga, Chautauqua, Chemung, Chenango, Erie, Ontario, Schuyler, Seneca, and Steuben counties. There were 221 wells located on and/or unitized with state land associated with 63 of these leases paying production royalties.

Revenues from oil and gas leases on state lands totaled $202,676 in 2016, a decrease of $58,215 from 2015. The decrease in leasing revenues paid to the state is attributed primarily to the decline in production and the decline oil and natural gas prices during 2016. The average price of oil decreased from $48.66/bbl in 2015 to $43.29/bbl in 2016, while the average wellhead price of natural gas decreased from $2.62/mcf in 2015 to $2.52/mcf in 2016.

Although nearly 59,000 acres of state land have been leased since 1999, only 37 (0.06%) of these acres have been disturbed by well drilling, access road and pipeline construction.

Underground Gas Storage

Natural gas and liquefied petroleum gas (LPG) are stored underground to help meet seasonal and peak demand for gas while providing a relatively stable market for produced gas. Generally, gas is injected into wells when consumer demand is low and withdrawn when demand increases during times of peak usage over days or seasons. Natural gas is stored in New York in depleted gas reservoirs and salt caverns while LPG is stored in salt caverns and a mined underground cavern.

2016

There are 27 natural gas storage facilities and 3 LPG storage facilities in New York, concentrated in the central and western regions near both gas production fields and gas transmission facilities.

Natural Gas Storage

• Natural gas injection/withdrawal and monitoring/observation wells: 954 • Total storage capacity: 245.0 bcf • Utilization: 70.7 bcf injected, 87.3 bcf withdrawn • Maximum daily deliverability: 2.76 bcf • Working gas capacity: 130.3 bcf • Storage at year-end: 187.3 bcf • Storage capacity in use at year-end: 76%

Seven different companies operate the 27 underground natural gas storage fields in New York State, with over half of the storage fields operated by National Fuel Gas Supply Corporation. Depleted natural gas reservoirs in the Onondaga, Oriskany and Medina Formations are used by 26 of the facilities, and the remaining one uses a solution-mined cavern in the Syracuse Formation. These formations range in depth from 1,500 to 5,000 feet below the earth's surface.

Liquefied Petroleum Gas Storage

• LPG injection/withdrawal wells: 13 • Total Storage Capacity: 168.7 million gallons • Utilization: 197.0 million gallons injected, 245.0 million gallons withdrawn

New York's three LPG underground storage facilities are located in Cortland, Steuben, and Schuyler counties. Finger Lakes LPG Storage, LLC is the operator of the facility in Steuben County and Enterprise Products Operating, LLC is the operator of the facilities in Cortland and Schuyler counties.

Solution Salt Mining

Approximately 8,500 square miles of New York State are underlain by bedded rock salt of potential commercial thickness. New York's salt deposits occur layered with shale, dolomite, and anhydrite in the lower part of the Silurian-aged Salina group. Salt is mined in New York via two methods: underground rock salt mining, and solution mining. New York typically ranks third in total salt mined among the salt-producing states in the United States.

Solution Mining - 2016

Solution mining operations for salt recovery, in the form of brine, currently take place at two fields in Schuyler County and three fields in Wyoming County.

• Plugged wells at current facilities: 251 • Unplugged wells at current facilities: 173 • Fresh water injected: 2.05 billion gallons • Brine withdrawn: 2.02 billion gallons

How the Salt Is Used

Brine is brought to the surface for evaporation or chemical manufacturing. Salt mined in New York State is used for chlorine and soda ash production as well as for food products and for a wide range of market segments, including agricultural, water conditioning, industrial and chemical, and packaged ice control. Customers range from home improvement, hardware, grocery and convenience store retailers, to food makers/processors, water conditioning dealers, and food service and general wholesale distribution.

The Department estimates that the annual value of salt production from solution mining in New York is approximately $275 million.

Well Plugging

At the end of their economic life, wells must be plugged in accordance with statutory and regulatory requirements. To ensure the sufficiency of funds for well plugging, DMN holds financial security in amounts statutorily determined based on an operator's number of wells and their depths. At year-end 2016, DMN held $18.94 million in financial security to guarantee well plugging and well site reclamation. This represents a decrease of $4.16 million from the amount held at year-end 2015.

Plugging Permits

In 2016, operators plugged 189 wells in accordance with requirements in DMN-issued plugging permits. Of the 189 wells plugged in 2016:

• 91 (48.15%) of the plugged wells were oil and secondary recovery wells in the oilfields of western New York;

• 74 (39.15%) were gas wells; and • 24 (12.70%) were comprised of a mix of other regulated well types.

Plugging occurred in 15 counties with 31.22% of the plugging jobs in Cattaraugus County, 20.63% in Chautauqua County, and 17.46% in Allegany County. As noted above, the plurality of plugging jobs involved old oil wells, particularly in the Richburg and Bradford fields.

Orphaned Well Plugging

Orphaned wells are unplugged wells that have been abandoned by their original owners or operators, and for which no legally responsible owner or operator can be identified. These wells exist in all oil and gas producing regions in the United States including New York State, and they represent a relatively small but significant part of the nation’s legacy of historical energy production. There are records for over 3,500 orphaned wells in the Department's oil and gas database. Most of these wells were drilled prior to the existence of a regulatory framework in New York.

In 2016, 56 orphaned wells were plugged by DMN and EPA, the majority of which were oil and secondary recovery wells in the Richburg Field in Allegany County. The 56 orphaned wells were distributed over four counties: Allegany (46 oil and secondary recovery wells plugged; 82.14% of total); Cattaraugus (6 oil and secondary recovery wells plugged; 10.71% of total); Chemung (3 gas wells plugged; 5.36% of total); and Steuben (1 gas well plugged; 1.79% of total). Of the 56 orphaned wells plugged by DMN and EPA in 2016:

• 42 were plugged by DMN. o 38 (90.48%) were oil and secondary recovery wells in Allegany and

Cattaraugus counties; and o 4 (9.52%) were gas wells in Chemung and Steuben counties.

• 14 were plugged by EPA;

o All 14 (100%) were oil and secondary recovery wells in Allegany and Cattaraugus counties.

Oil and Gas Account

Since 1981, when the New York State Legislature established the Oil and Gas Account (originally called the Oil and Gas Fund) to address orphaned oil and gas wells, the state has made efforts to plug such wells, with some limited success. The account receives $100 from every ECL Article 23 Permit to Drill issued by DMN. At year-end 2016, this account held $124,014.

EPA Well Plugging

In 2016, DMN staff continued working with the U.S. Environmental Protection Agency (USEPA) and the U.S. Coast Guard to plug oil wells with federal funding authorized under the Oil Pollution Act of 1990 (OPA 90). The OPA 90 funding is used to address leaking oil wells that pose imminent threats to navigable waterways. As a direct result of DMN staff efforts, USEPA has undertaken several plugging projects in New York State since 2005. In 2016, USEPA plugged a total of 14 Upper Devonian oil wells; one in the Town of Carrollton, Cattaraugus County; one in the Town of Willing, Allegany County; two in the Town of Bolivar, Allegany County; and 10 in the Town of Alma, Allegany County. In conjunction with the well plugging efforts, the well sites were reclaimed.

New York Works Well Plugging Initiative

The State’s fiscal budgets for the 2015-2016 and 2016-2017 fiscal years (FY) included $2 million per FY for the plugging of orphaned oil and gas wells; this funding - termed the New York Works Well Plugging Initiative (NYWWPI) - has provided a significant opportunity to address these legacy oil and gas wells, some of which represent significant threats to public safety and the environment. New York is home to over 3,500 of these orphaned wells, concentrated primarily in the southwestern part of the state where most of the historical drilling has occurred.

To prioritize the wells for inclusion in NYWWPI well-plugging projects, the Department uses a scoring rubric that assigns numeric values to various aspects of each well (e.g., location, construction, proximity to sensitive receptors) and then sums the individual values to establish a total score for each well. Higher-scoring wells represent greater potential threats, and those wells are given higher priority for plugging under the NYWWPI. Consistent with Department practice for all ECL 23 well-plugging operations, upon successful completion of the plugging of the well, the land surface around each well is restored to match adjacent areas.

Building on its successes from 2015, the Department initiated three well-plugging projects under the NYWWPI in 2016. These projects encompassed nine oil production wells in the Town of Farmersville, Cattaraugus County, 71 oil and secondary recovery

wells in the Town of Bolivar, Allegany County, and four gas wells in the Town of Hornby, Steuben County and the Town of Southport and the City of Elmira, Chemung County.

The Moose Oil Wells - Package 1 Well Plugging Project in the Town of Bolivar, Allegany County, includes 71 orphaned oil production and water injection wells which were completed between the early 1900s and the 1960s in the Richburg and Waugh & Porter formations at depths ranging from 1,299 feet to 1,779 feet. The wells are located in steep, wooded terrain on the west side of California Hollow in an area of active silviculture (logging). Due to their lack of maintenance and proximity to wetlands to the east, these wells represent significant potential threats to public safety and the environment. To date, 33 wells from the project have been successfully plugged, and the land surface at each well location has been graded and restored to match the surrounding area. The remaining 38 wells, plus any additional abandoned wells that may be found on the lease, will be plugged in 2017.

The Elmira Well Plugging Project scope of work included five gas wells distributed over a fairly wide geographic area between Steuben and Chemung counties. The wells were completed in 1940 and 1941 targeting the Oriskany formation at depths ranging from 2,740 to 2,772 feet. The project began in May at the Malacoccio 1 (API #31-015-00613-00-00), and the plugging contractor immediately encountered a large mass of cast-in-place concrete surrounding the well that required removal using jack hammers and a track-mounted excavator. Not unlike many orphaned wells encountered by the Department, the Malacoccio 1 also presented downhole complications within the wellbore that required significant additional time and effort on the part of the plugging contractor to ensure that cement plugs were emplaced at the prescribed depths. One of the wells, thought to be the Harder 1 (API #31-015-00612-00-00), was determined during the project to be an abandoned water well. The plugging contractor entered the Harder 1 and reached approximately 100 feet, still in native bedrock. Another well, the Mangin (API #31-015-00606-00-00), had been the source of numerous complaints over the years from residents, as it had been periodically set on fire by vandals, thereby requiring responses from police, fire and other emergency personnel. Owing to their advanced age, lack of maintenance, and close proximity to residences, commercial enterprises, roads, and wetlands, the other wells also represented potential threats to public safety and the environment. At each location, after the setting of the surface plug, the well casing was cut below grade to remove any surface expression. Site reclamation included grading, replacement of topsoil, seeding, and mulching to provide a vegetative cover similar to surrounding, unaffected areas. Department staff monitored the site periodically until the vegetative cover was fully re-established. Plugging and reclamation operations were completed in September.

The F.E. Petroleum/Merrill Resources Inc. Lawrence Lease Well Plugging Project in the Town of Farmersville, Cattaraugus County includes nine orphaned oil wells, which were completed between 1974 and 1981, targeting Upper Devonian formations at depths

ranging from 496 to 2,550 feet. The wells had not been maintained for decades and were in poor condition and overgrown with vegetation. Further, their proximity to residences, farm lands, and surface waters increased the potential threat to public safety and the environment. By the end of 2016, five of the wells had been successfully plugged. The remaining four wells are scheduled to be plugged in early 2017.

The successful completion of the Elmira Well Plugging Project, including the plugging of four orphaned gas wells and the restoration of the surrounding land surface, are part of the NYWWPI program’s continuing success story.

Mined Land Reclamation

2016 Summary & Trends

Mineral Production, Market Value and Economic Impact

Mining occurs in every region of New York State, except the New York City area, as shown on the map entitled “Mines in New York” (see link below). The U.S. Geological Survey estimated the annual value of New York's mineral production in 2011 at $1.34 billion. The estimated economic impact from mining in New York in 2011 (the most recent year for which this data is available) is $4.98 billion.

Production of the state's major mined commodities remains relatively constant from year to year. In 2012/2013, New York ranked seventeenth nationally in terms of the value of overall nonfuel mineral production. Nationally, New York ranked first in industrial garnet production and third in salt. Salt was the leading mineral commodity based on production value, followed by crushed stone and construction sand and gravel. New York remains the sole domestic producer of wollastonite. New York is also a significant producer of masonry cement and portland cement.

The Center for Governmental Research, Inc. (CGR) document entitled “The Economic Impact of the New York State Mining and Construction Materials Industry, October 2011” prepared for the New York State Geological Survey/New York State Museum states that the majority of mining in New York is for construction materials used to build and maintain the state's infrastructure. The mined commodities, in addition to the hot mixed asphalt, ready mix concrete and cement industries, were responsible for generating $1.2 to $1.3 billion in wages and 28,000 to 30,000 jobs in New York State. CGR estimates the mining and construction materials industry contributes about $100 million in public sector revenues (sales tax, personal income tax, motor fuel tax, corporate franchise tax and Mined Land Reclamation Law fees). The Division assessed $4.19 million in regulatory program fees in 2016, which is higher than the amount assessed in 2015.

Types of Mines and Mineral Usage

The most common mine types in 2016 were sand and gravel (1,526), bluestone (100), and limestone (83). In 2016, New York had 1,908 active mines, a decrease of 21 mines from 2015. The majority of these mines produced sand and gravel or other surficial deposits such as glacial till, clay or topsoil. Sand and gravel mines account for nearly 80% of DEC-regulated mines. Twenty-four of the new mining permits issued in 2016, or 56%, were for sand and gravel.

There were 334 hardrock mines producing material ranging from bluestone, limestone, sandstone, shale and salt, to less common products such as wollastonite. Most of New

York's hardrock mines are surface quarries, but there are several permitted underground mines.

The Mineral Information Institute reports that “every American born will consume 3.125 million pounds of minerals, metals and fuels in their lifetime.” In other words, minerals, metals and fuels are critical to the existence and prosperity of everyone in the United States. In addition to recycled materials, nearly 40,641 pounds of new minerals must be provided every year for the things that every person in the United States uses.

Permitting and Reclamation Statistics

The number of permitted mines has declined for 18 consecutive years. Mine operators continued to replace production by expanding current mines, rather than opening new ones. This trend held true for sand and gravel mines while the total number of hardrock quarries remained nearly the same. Only 43 of the Mined Land Reclamation Permits issued in 2016 were for new facilities.

A total of 48,161 acres were affected by mining in 2016 out of a total approved life-of-mine area of 127,509 acres. All affected acreage must be reclaimed at the conclusion of mining operations. Concurrent reclamation can be accomplished immediately upon completion of a portion or "phase" of a mine while mining occurs elsewhere within the life of mine area, or reclamation of the entire affected area can occur when mining has stopped, known as final reclamation. The Division of Mineral Resources continues to have success promoting concurrent reclamation with 569 acres reclaimed at 156 operating mines in 2016. Final reclamation of 479 acres occurred at 60 closed mines bringing the 2016 total to 1,048 acres. Roughly 37,013 acres of land affected by mining have been reclaimed since 1975.

In 2016, DMN held $282.4 million in financial security to guarantee mine site reclamation.

Inspections

In 2016, Mined Land staff performed 2,200 mine inspections and traveled 130,906 miles. Staff inspect mine sites:

• during permit application review; • during operation for general compliance; • to ensure that violations are remediated; • to ensure that reclamation meets requirements; and • to investigate complaints.

Permits and New Mines

The Division of Mineral Resources issued 43 permits for new mines and 378 renewals or modifications, for a total of 421 permits. Sand and gravel mines were the most common type of newly-permitted mines in 2016.

Mined Land Reclamation Permits are issued for terms of five years or less and may be renewed. A renewal permit allows continued operation of the mine within approved limits. A modification permit authorizes changes, such as addition of processing equipment or expansion of the mine's surface area or depth beyond the original approved limits.

Mines in New York

Owner Type

There are 1,908 active mines as shown on the following map. In 2016, industry operated 1,536 mines or 80% of the mines in New York State. Towns, villages and other small local government entities operated 332 mines, and 35 mines were county-owned and operated. New York State agencies operated five mines. Most of the government mines are permitted to highway departments that use the material for road maintenance.

Trends in Mine Size and Number

Mine renewal and modification permits issued in 2016 ranged in life-of-mine acreage from 1 to 1,174 acres. However, new mines tend to be smaller; about 60.5% of new mines permitted in 2016 were 10 acres or less in size. The largest new mine was the 68.7-acre R G King General Construction Inc. Panther Lake Mine in Oswego County.

The following tables provide 2012-2016 mine sizes for all active mines, and detailed information on Mined Land Reclamation Permits by county. While the number of mines has been decreasing over time, the rate of decline has been greater for mines under 10 acres in size than those greater than 10 acres. This was due to many operators expanding or combining existing mines rather than seeking permits for new sites combined with final reclamation of mines. This trend began to change, in 2009, when the required regulatory fees were increased for sites with greater than 20 acres affected by mining. However, since 2013 there is a slight increase in the total number of mines with more than 30 acres affected.

The minor projects in the first row of the below table are always less than five acres in size. They are subject to a simpler review process but must comply with very strict criteria to be considered minor: minimum setbacks from homes and surface waters; a maximum 20-foot mine depth; no mining below water table; no hardrock (consolidated material) mining; and no on-site processing equipment, such as washing or crushing machines.

Reclamation

Every mine must be reclaimed at the end of its productive life, and DMN holds significant financial security to ensure that reclamation occurs. The Department also encourages concurrent reclamation to minimize potential negative environmental impacts and to more quickly return lands affected by mining back to other productive uses. The permittee benefits from conducting concurrent reclamation in the form of reduced financial security and lower annual regulatory fees. Examples of significant reclamation projects for 2016 include:

Final Reclamation Region 7: Porter’s Concrete Service-Hidden Lakes Mine

Town of Barton, Tioga County (70989)

The site was originally mined in the early 1900’s and was abandoned well before the Mined Land Reclamation Law went into effect in 1975. Porter’s Concrete Service permitted the site in 2011. Staff approved the final reclamation of the 11.8-acre sand and gravel mine, which was reclaimed to a pond and recreation area.

Concurrent Reclamation – Region 5: Peter Paquin – Paquin Cranberry Sand Pit

Town of Bombay, Franklin County (50871)

In 2016, reclamation approval was given for five acres concurrently reclaimed at the Paquin Cranberry Sand Pit. A total of 14 acres have been approved as reclaimed to cranberry bogs within the 20-acre life of mine.

About 4.8 acres were concurrently reclaimed to open grassland and cornfield. The Department continues to encourage concurrent reclamation as a means of reducing the environmental impacts of mining as well as the costs for the permittee.

The Town of Steuben operated the 5-acre sand and gravel mine located near Jones Road since October 1986. The mine was reclaimed to meadow. Final reclamation approval was given to the site in June 2016.

Final Reclamation – Region 3: Dutchess Quarry and Supply Co Inc.-Shunpike Road Mine

In July 2016, the Department gave final reclamation approval of the 40-acre sand and gravel mine and the permittee successfully reclaimed the site to meet the open grassland reclamation objective.

Final Reclamation – Region 4: Peckham Materials - Fyke Road Quarry

Town of Catskill, Greene County (40055)

Final reclamation of the 51-acre limestone quarry was approved in May 2016. Thirty-three acres have been reclaimed to industrial use. The remaining 18 acres have been reclaimed for use as an educational site for collegiate geology students. The site will also continue to be used as a stop on field trips of geology organizations.
