TONER FRAUDAn example of what happens ...

someone calls the office posing as a rep-resentative from the copier company say-ing that they have increased the price ofyour copier toner, but that they are willingto order 8 toner cartridges at the cheaper"original price" and only send you 1 car-tridge as to not "over stock" your office.The price the scam artist quoted me thislast try was over $500. They alreadyhave your address and fax number andusually know the type of copier you haveand if not, they'll ask you for the informa-tion. They then say that their managerwill be faxing you something that needsyour signature on it authorizing them tobill you. A few minutes after the fraudu-lent California based company faxes youthey call again (usually a different personin on the scam) and ask you to sign thepaper and fax it back to them immediate-ly while they have you on the line statingthey are having problems with their faxmachine and want to make sure theyreceive it.

The first time the scam artist called, Itended to believe them, but not quite, theywere not very professional which led meto believe they were not a legitimate com-pany. The second time they tried thescam, the person sounded as if he werereading a script. The first time this hap-pened I called a supplier our office dealswith regarding our copier needs. Theyinformed me that I was an attempted vic-tim of "Toner Fraud" and gave me thenumber to the Federal Trade Commission

to report them. I filled out a complainton-line at www.FTC.gov in October of2005 with as much information as I had.

ness day and watch the beehive of activi-ty. The luncheons, Bar Revues,Committee assignments, CLEs, courtsupport and membership initiatives ofBAMC are models due largely to the sup-port of our great staff.

- Larry Ceppos and the JudicialSelection Committee. This year theyhave made recommendations for eightvacancies - four in Circuit Court, and fourin District Court. Most recently, twentyeight applicants were investigated andscreened by the Committee, over thecourse of three long sessions. Everyonerelies on work product - the State bar, theJudicial Selections Commission, theGovernor. While ensuring the confiden-tiality of our sessions, we share the resultsand some impressions. Our interviews arethorough and painstaking for the appli-cants, and are a tribute to all members of

the Committee. If we paid our Committeemembers their hourly rates, the costwould be well over $100,000. They workfor free, and we are all the richer for it.

- Finally, to the 200 or so reallyhard working members of the BarAssociation this year. You know whoyou are, and now, so do I. You staff ourfunctions and committees, you attendearly morning breakfasts and late eveningmeetings, and you defend our profession,our Association, and our Judiciary. To: The General Membership

We are presenting a proposed budget for the year July1, 2006 to June 30, 2007. Every effort has been made tocontinue proposing progressive budgets to meet futureneeds, while reviewing actual expenses of past years.

Three years ago the membership approved a $15.00dues increase, which was phased in at $5.00 per year forthe active membership. A large part of this increase was toupgrade our computer system to better serve the member-ship.

The Lawyer Referral Service will be the first projectthat will go on-line so that the community will be able tosearch and select their attorney and thereby tap into a mar-ket, which the LRS may not serve at the present time.

The second phase of the technology upgrade willinclude on-line balloting for judicial referenda and nomina-tions and elections. On-line surveys will also make it eas-ier to gain member feedback quickly.

The Monthly Bar Luncheons continue to be a freemember service, served in Rockville on the first Tuesday ofeach month from September through April. Our luncheonsare a wonderful networking opportunity, as well as anopportunity to hear local and state speakers on topics ofinterest to the membership.

We hope all of you look at our Web Page,www.montbar.org, on a regular basis for the most upto date announcements. The Monthly Newsletter is actu-ally on the web page a week in advance of you receiving itin the mail.

WHEREAS, Robert S. Bourbon has served as President of the Bar Associationof Montgomery County, Maryland in 1966 - 1967 with outstandingleadership, commitment and boundless energy, and

WHEREAS, his willingness to plan and lead significant projects and programsfor the legal profession assured the delivery of service to manysenior members of the Bar and,

WHEREAS, his altruism and friendship have benefited current members of theBar, as he delivered an address at the "Century of ServiceCelebration" and for his oral history at the "Celebration for Seniormembers of the Bar", and

WHEREAS, his professional courtesy to colleagues and the Judiciary is anexample for every practicing attorney.

THEREFORE LET IT BE RESOLVED, by the Board of Directors of theMontgomery County, Maryland Bar Foundation, as the highesttestimonial of his volunteerism, professionalism, and collegialitypresented this 15th day of March, 2006.

WHEREAS, Judge James S. McAuliffe, Jr. has served the legal profession andthe Judiciary with integrity, vision, and commitment, and

Code Ann., Fam.Law §9.5-101 et seq.) and foreign supportorders under UIFSA (Md. Code Ann.,Fam. Law §10-310 et seq.). Beginningimmediately, the clerk's office will auto-matically generate and send out the noticeof registration contemplated by thesestatutes upon the filing of a foreign orderfor registration. To do this efficiently,however, court personnel need some indi-cation of the nature of the filing.

It's time for spring break!In the academic calendar, spring

break usually divides the semester.Whether it arrives early or late in theterm, it is always welcomed by students.Many view the break as just that–a timeto forget about classes and studies and tovisit warm places on the beach. Othersview it as a way to catch up on homeworkor to start on that long-term project thatwill become due all too soon.

For some reason, this dichotomyseems to follow us into our careers. Thereare those who know how to take breaks,whether it involves a vacation, plans forthe weekend, or even going out to lunchwith a friend. Others keep their noses tothe grindstone in a desperate attempt tocomplete yet one more task and neverthink they have the time to take a break.

Yet, to achieve the quality of life thatwe all seem to want, we most likely needto ensure ourselves breaks. Spring breakis a wonderful place to start–the weathermakes it easier to be outside and the pos-sible activities seem to multiply with thelonger daylight hours. We all have thingswe have to do and appointments that wehave to keep, but adding a "spring break"to our schedules (whether a full week oronly a day at a time) can refresh ourbrains in a way that makes the time spentworking much more enjoyable.

On Tuesday, February 28th, the 9thCircuit published its decision inCommissioner v. Ewing, 2006 WL463788 (9th Cir.). Ewing deals with thedenial of an innocent spouse claim wherethe couple was still married, and the wifebelieved the husband would be satisfying'his share' of the self-assessed tax liabili-ty. The ruling identifies three majorissues. The first is of jurisdiction; secondis the method of claiming your refund;and the third touches on the administra-tive record.

Congressional intent in enacting theinnocent spouse provisions under §6015was to allow the IRS to grant relief wherethe requesting spouse "does not know,and had no reason to know, that fundsintended for the payment of tax wereinstead taken by the other spouse for suchother spouse's benefit." H.R. Conf. Re.No. 105-599, at 254 (1988). Congress

vacated based on Ewing's finding of theUSTC's limited "scope of review" and thetaxpayer's "eligibility for relief." Id., at 5.The Ewing Court once again pointing outthe USTC's jurisdiction concerning theunderlying balance due. Second, it rea-soned that the request was not properly orovertly made. Neither in the responsebrief to the Court, nor on the face of theForm 8857 was the request found ade-quate. In addition to the timing restric-tions in filing a claim for refund, Ewingheld that merely identifying zero liabilityon Form 8857 does not rise to the level ofa request as found in Washington v.Commissioner, 120 T.C. 137 (2003). InWashington the taxpayer specificallyclaimed the refund and related interestdirectly on the Form 8857. Id., at 4.

Making the Record. Relative to theadministrative record, U.S. Tax Courtjudges have dissented in written opinionsas to whether what is raised during theadministrative process restricts what may

be brought before the Court. While cur-rent USTC opinions are based on a denovo review, Ewing does not address thisissue, again citing to jurisdiction.Nonetheless, on March 8, 2006 the 8thCircuit makes its determination of limitedreview in Robinette v. Commissioner,2006 WL 544798 (8th Cir.) Stay tuned aswe will discuss this case and its implica-tions in the next issue.

Thus, in asserting a claim for reliefunder §6015(f), be sure to also reviewRev. Proc. 2003-61 for threshold require-ments. When counseling your clients onrelief, you will want to both address theirqualification for relief and the protectionof property. In attempting to secure equi-table relief, you may be playing a game ofchance relative to the IRS and the USTC.Therefore, you want to make sure thatyour administrative record clearly reflectsyour issues-including any claims forrefund.

COMMITTEES & SECTIONSalso authorized equitable relief under§6015(f) when in "taking into account allthe facts and circumstances, it isinequitable to hold an individual liablefor all or part of any unpaid tax or defi-ciency arising from a joint return." Id.

Because Sections 6015(b) and (c)only provide relief where a proposed orassessed deficiency has been asserted bythe IRS, relief in Ewing would fall underthe purview of §6015(f).

Jurisdiction. The Ewing Court heldthat the U.S. Tax Court ("USTC") lackedjurisdiction to decide §6015(f) deficiencycases. In its reading of the statute, Ewingconcluded that Congress limited theUSTC's jurisdiction to only deficiencymatters. Because the issue before theCourt dealt with an underpayment, theUSTC lacked the authority to review it.Thus, reversing the USTC.

Claim for Refund. On appeal, thetaxpayer also requested a claim for refundfor the taxes she already paid. This was

WORKERS COMPENSATIONLAW SECTION MEETINGDATESApril 6, 2006 May 4, 2006

At the March Workers'Compensation March Section Meeting,the section discussed subrogation. ChrisHinrichs from the Montgomery CountyAttorney's Office and PhillipArmstrong from Armstrong & Paigewere the speakers. The speakers dis-cussed the law of subrogation and strate-gies to use in negotiating subrogationcases.

Chris Hinrichs gave an excellentoverview of the subrogation law in theworkers' compensation arena. Basically,when a party gets injured on the job andcollects workers' compensation benefits

and the accident was caused by the negli-gence of a third party, the claimant or theemployer/insurer can sue the third party.If a recovery is received, theemployer/insurer has a lien to the extentof the amount of money paid in the work-ers' compensation case against the thirdparty tort award.

If a recovery is received, the award hasto be disbursed. First, monies are taken outof the award to pay the costs and expensesof the action. Second, the attorneys' feesare paid. Finally, the workers' compensa-tion lien is paid off. If there is any moneyleft, the Claimant receives the proceeds ofthe action. The employer/insurer continuesto have a lien against the monies receivedby the claimant against future workers'compensation payments.

Chris advised that not only does thestatutory lien exist under 9-902 of theWorkers' Compensation Act, but theemployer/insurer may also have a con-tractual lien. For example, MontgomeryCounty labor agreements confer a right ofsubrogation onto the county and create alien on accident leave paid in addition tothe workers' compensation payments. Acommon law lien may also exist.

Finally, Chris warned that there isone exception to the workers' compensa-tion lien found in Section 9-902 of theAct. If the injured worker makes a recov-ery under the employee's own uninsuredmotorist coverage, the uninsured motoristinsurer has the right to offset payments bythe amount paid by an employer/insurerin workers' compensation.

After Chris gave this detailed outlineof the applicable law, Phillip Armstronggave some great practical tips in pursuingclaims and negotiating settlements foryour clients. First, do not assume that theonly action to recover on a third partyaction for your client is a negligenceaction. Look for other avenues of recov-ery including products liability and med-ical malpractice actions. Second, do notforget to file the compensation claim first.If you settle the third party claim beforefiling a compensation claim, your clienthas given up his right to compensation.Third, from a strategic perspective, it isbetter to settle the third party after you getthe compensation recovery. In that way,you know the extent of the third partylien. Fourth, communicate with yourclients. They need to know exactly whatthe workers' compensation lien is. Fifth,negotiate for everything. What thatmeans is see what the employer/insurer iswilling to give up to have the employeepursue the proceeds of the third partycase. While your client is obligated tocooperate with the employer/insurer torecover the third party lien, the coopera-tion does not have to be for free. Finally,be careful when signing any third partyreleases that it does not release the work-ers' compensation carrier from futurecoverage.

At the next meeting of the section,the topic will be "News from theCommission." Commissioner LaurenSfekas will be our honored guest forlunch. The meeting will be held at 12:30p.m. on April 6, 2006, at the BroadwayDiner in Rockville, Maryland. Pleaseplan to attend. Elections for new sectionchairs will also be conducted. The divorce practitioner should be aware of these issues and many other issues when anon-citizen spouse is party to a divorce proceeding. Approximately thirty percent of our county is foreign born. PERSONAL INJURYAPPELLATE DECISIONS

In Baltimore v. Hart (Court of SpecialAppeals, No. 403, September Term 2005,Filed February 2, 2006), the Courtaffirmed the trial court's evidence rulingallowing introduction of PoliceDepartment General Order 11-90. Theorder required activation of the siren androof lights of a patrol car entering an inter-section on a red light. Although not neg-ligence per se, failure to follow the orderis a factor to be considered in determiningthe reasonableness of police conduct.

A practice pointer: In order to chal-lenge an adverse ruling on a motion inlimine, one must object again in the trialitself at the time the evidence is presentedin compliance with Rule 2-520, and offera specific objection setting forth a concisestatement of the grounds.

In Ozborne v. Walzer (Court of SpecialAppeals, No. 2457, September Term 2004,Filed March 1, 2006), the Court reversedthe trial court's dismissal of a medical mal-practice suit. Section 3-2A-04(b) of theCourts and Judicial Proceedings Articlerequires that within ninety days of the filingof the complaint, plaintiff file a certificateof a qualified expert claiming that defen-dant departed from the standard of care, andthat the departure was a proximate cause ofplaintiff's injury. The statute also requiresthe filing of the expert's report.

Plaintiff filed a timely certificate, butdid not file the report until much later.The appellate court held that the penaltyof dismissal is required only for failure tofile the certificate. The portion of thestatute requiring the filing of the report isnot in the same part providing for dis-missal. If the report is never filed or notfiled after the court imposes a deadline

for its filing, then dismissal would beappropriate. Defendant suffered no prej-udice from the delayed filing.

In Mundey v. Erie (Court of SpecialAppeals, No. 2069, September Term2004, Filed March 1, 2006), the Courtaffirmed the trial court's holding thatplaintiff was not entitled to use the unin-sured motorist benefits of his parent'sautomobile liability insurance policy.Plaintiff, then 21 years old, was livingwith his grandmother in her house whenhe was severely injured in an automobileaccident. His parents lived in a differentresidence. Their insurance policy provid-ed uninsured motorist coverage for a rel-ative physically living in their household.It also provided coverage for a full-timestudent under the age of 24, not emanci-pated or married who is temporarilyaway. Plaintiff did not meet the definition

In Nationwide v. Wilson (Court ofSpecial Appeals, No. 100, SeptemberTerm 2005, Filed March 3, 2006), theCourt considered the insurance compa-ny's limitation of liability in a businessautomobile insurance policy. Claimantwas severely injured as a result of allegednegligence of his fellow employee whofell asleep at the wheel. Nationwideinsured the employer's vehicle and alsoprovided workers compensation insur-ance. The automobile policy limited cov-erage to the statutory minimums of$20,000-40,000 if injuries are caused bythe negligence of a fellow employee. Thecourt held that the limitation is valid.

IN MEMORIAM ...JOSEPH C. ROESSER

February 7, 1923 - October 20, 2005Joseph Carroll Roesser, 82, a retired

lawyer and lieutenant colonel in theArmy, died of cancer October 20 at hisdaughter’s home in Frederick. He livedin Olney.

Mr. Roesser, a Catonsville native,graduated from Mount St. Joseph HighSchool in Baltimore and served in theArmy in the United States during WorldWar II. He graduated in 1950 fromLoyola Marymount University in LosAngeles, and in 1951 his reserve unit wascalled to active duty in the Korean War.Mr. Roesser became an assistant to thebattalion aide surgeon with the Army’s5th Cavalry Regiment, First CavalryDivision. When his division was rotatedto Hokkaido, Japan, he served as com-manding officer of the Medical ServiceCompany. In a later tour of duty, heserved in Seoul with the U.N. command.

He was transferred to Walter ReedArmy Medical Center, serving in thecomptroller’s office while attending theGeorgetown University Law Center atnight. He received a law degree in 1957and transferred from the Army MedicalService Corps to the Judge AdvocateGeneral Corps, serving in Germany as acourt observer until being assigned to thePentagon. He taught evening legal andbusiness classes at American University,the University of Maryland andSoutheastern University. He retired fromthe military in 1968.

He began practicing law inMontgomery County in 1968 and openeda practice in 1972, specializing in insur-ance, negligence and family law. Heretired a second time in 1997.

Mr. Roesser was a founding memberof the Olney Lions Club and a member ofthe committee to standardize fiscal poli-cies of U.S. military hospitals. He wasalso a member of Delta Theta Phi, theRotary Club and several legal associa-tions.

Survivors include his wife of 57years, Elizabeth Louise Parke Roesser ofOlney; seven children, Joseph Roesser Jr.of Carmel, CA, Douglas Roesser ofMonterey, CA, Robert Roesser ofThurmont, MD, Thomas Roesser ofGainesville, GA, Mary Beth Kotowski of
