Policies and Procedures SummaryThe Nevada Statewide Independent Living Council (SILC) is an autonomous entity that encompasses the entire State providing advocacy and support for Independent Living services throughout. It consists of a group of volunteers appointed by the Governor that consists of a majority of individuals with disabilities in order to have a strong consumer voice moving forward. Individuals with disabilities of all types are supported by the Nevada SILC’s Mission and Vision.

The IL Program is funded primarily through the federal Rehabilitation Act (Independent Living Part-B) and a portion of matched State general funds. The Aging and Disability Services Division AT/IL manual provides policy and guidance for program operations. All services provided by ADSD grantees must be in compliance with Service Specifications, which are found at http://adsd.nv.gov/uploadedFiles/adsdnvgov/content/Programs/Grant/ServSpecs/GeneralServiceSpecsDSPrograms.pdf and fiscal instructions called PINs – Program Instructions Nevada, found at http://adsd.nv.gov/uploadedFiles/agingnvgov/content/Programs/Grant/nvpins.pdf. They must also agree to Assurances and Certifications, and the agency’s Confidentiality Agreement.

This Policy and Procedure manual is meant to compliment the Designated State Entity guidelines by addressing specific expectations of Council members in Nevada, according to Nevada law and the Nevada SILC’s authority.

NV SILC – What We’re AboutObjectivesA. To realign, build and promote an autonomous NVSILC.

A1: Research and review other states to understand various ways SILCs are set up and use as an aid towards determining the best establishment for NVSILC. Start: 10/1/16 End: 9/30/17

Evaluation: NVSILC staff will gather information under the direction of the NVSILC. 2

A2. Research all applicable federal, state and local laws that pertain to independent living services to gain a thorough working knowledge for successful movement towards autonomy. Start: 10/1/16 End: 9/30/17

Evaluation: NVSILC staff will gather information under the direction of the NVSILC.

Findings will be presented to the NVSILC by 3/31/17.

Year 1: resource plan

A3: Provide a series of on-going trainings to increase competencies of the NVSILC and community partners. Start: 10/1/16 End: 9/30/19

Evaluation: The NVSILC will direct staff to coordinate a minimum of two (2) trainings per year.

A survey tool will be developed by staff with the direction of the NVSILC for participants to all trainings.

Participants will be surveyed at the conclusion of all trainings.

Years 1, 2, & 3: $15, 000 each

A4: Develop a working relationship with the Governor’s office to strengthen NVSILC's composition and to ensure a majority of its voting members represent a cross section of disabilities. Start: 10/1/16 End: 9/30/19

Evaluation: The NVSILC will receive quarterly updates from staff regarding the building of a relationship with the Governor’s Office staff.

The NVSILC will receive quarterly updates from staff about outreach for members and potential NVSILC candidates.

The NVSILC membership will be compliant with its bylaws and diversity by 9/30/17.

Years 1, 2, & 3: resource plan for each

A5: Conduct an organizational assessment of the NVSILC and its compliance assurances to understand the strengths and weaknesses of NVSILC and make improvements where necessary. Start: 10/1/17 End: 9/30/18

Evaluation: The NVSILC will complete an organizational assessment by 3/31/18.

The NVSILC will develop an action plan by 6/30/18.

The NVSILC will implement strategies for improvement by 9/30/18.

Year 2: resource plan

A6: Draft a strategic business plan to strengthen and move the NVSILC towards autonomy. Start: 10/1/18 End: 9/30/19

Evaluation: The NVSILC will draft a strategic business plan by 12/31/18.

The NVSILC will implement the plan and be an autonomous and independent entity by 9/30/19.

Year 3: Obj & resource plan

B. Support a comprehensive statewide network of Center for Independent Living services

B1: NVSILC and CIL’s will collaborate to address priority needs within the state. Start: 10/1/16 End: 9/30/19

Evaluation: The NVSILC will arrange consultation with each CIL by 3/31/17.

The consultant will provide a report outlining potential priorities for the CIL network.4

B2: Ensure effective communication between the NVSILC and CIL’s. Start: 10/1/16 End: 9/30/19

Evaluation: The NVSILC will facilitate a minimum of two (2) face-to-face onsite meetings between the CILs, an NVSILC member, and staff by 6/30 of each year to ensure effective communication.

Years 1, 2, & 3: $1,500 for each

C. Develop a comprehensive statewide independent living network (SILN).

C1. The NVSILC and the CIL’s will collaborate with programs and services throughout the state to develop a comprehensive statewide independent living network. Start: 10/1/16 End: 9/30/19

Evaluation: Research and adopt an effective IL network model by 9/30/17.

The NVSILC will increase participation by 5 partners based on the identified model each year.

Year 1: $18,000

C2: Develop strategies to increase awareness of the IL Philosophy, by working with community partners, CIL’s and the statewide independent living network. Start: 10/1/16 End: 9/30/19

Evaluation: The NVSILC will have strategies developed by 3/31 of each year.

The NVSILC will have strategies implemented by 9/30 of each year.

Year 1: $140,000

D1. Research and develop an effective data collection strategy. Start: 10/1/16 End: 9/30/17

Evaluation: The NVSILC will begin the development of the data collection strategy by 12/31/16; next status to the NVSILC by 3/31/17; next status to the NVSILC by 6/30/17; with the strategy in place by 9/30/2017.

D2: Implement data collection strategies and review annually. Explore partnerships with other agencies and community partners to develop a viable data collection tool. Start: 10/1/17 End: 9/30/19

Evaluation: The NVSILC will implement the data collection strategies by 11/30/17.

The NVSILC will establish baseline report by 12/31/17.

The NVSILC will have data for decision making by 6/30/17; and reviewed quarterly at minimum throughout the life of the SPIL.

Mission StatementThe mission of the Council is to advocate the development of a network of programs, services and options designed to empower Nevadans with disabilities to live independently in the community.

Vision StatementWorking together to support empowerment and consumer-control for Nevadans with disabilities.

Purpose of the Nevada SILCThe specific purposes of the Council is:

1. to promote the philosophy of independent living, including a philosophy of consumer control, peer support, self-help, self-determination, equal access and individual and system advocacy in order to maximize the leadership, empowerment, independence, and productivity of individuals with disabilities, and the integration and full inclusion of individuals with disabilities into the mainstream of society;

2. to promote the development and expansion of independent living programs and concepts on a statewide basis;

3. to provide guidance to State agencies and local planning and administrative entities assisted pursuant to Title VII of the Act;

4. to provide guidance to State agencies and local planning and administrative entities that are providing independent living services; and

5. to improve working relationships among councils, centers for independent living, State, federal and non-federal programs.

RecruitmentProcedure:

Each potential new member will be assigned to a designated mentor

Each of the following will be available to the prospective new member in hard copy, online or in the accessible format needed:

Each potential new member will attend SILC and/or SPIL Workgroup Meetings prior to appointment.

After working closely with the mentor, the mentor will present a recommendation for membership appointment to the Nominating Committee.

Once approval from the Nominating Committee moves forward, the New Membership packet will be provided, including the new member checklist of training activities.

Final Approval of membership will be decided at the next SILC Council Meeting.

Policy:

The assigned mentor will forward the application for Council membership to the Chairperson within 10 business days of submission to the Governor’s Office.

The NV SILC Chairperson will review potential membership applications within 2 weeks of receipt from mentor.

The Council shall vote to approve membership for only those individuals who meet the required Federal Membership Composition Guidelines for the Council per Article V in the NV SILC Bylaws.

Disputes / Conflict of InterestRegarding any potential conflict of interest:

Personal financial gain and private benefit to a Council/Subcommittee member or his/her spouse, child, step-child, parent or step-parent through the member’s participation on the Council shall be considered a conflict of interest. The following apply:

No Council/Subcommittee member or immediate family member mentioned in 6.9(1) above shall seek to influence any vote regarding the awarding of a contract, a grant or other business from the Council/Subcommittee when the individual knows that he or she has a direct or indirect financial interest in the awarding of such a contract or grant or other business.

“Direct financial interest” is a situation that would result in a pecuniary benefit in the form of cash, salary or property to a person or his/her immediate family;

“Indirect financial interest” is any situation that will result in a financial advantage to another person or organization with which a person has a relationship or association.

Nothing herein shall be construed to prohibit any firm, agency or organization that any member or immediate family member is associated with from appearing before the Council/Subcommittee as part of the normal course business by the firm, agency or organization. Nor shall it be construed that employment in any firm, agency, or organization that any member or immediate family member is associated with prohibit any member from engaging in discussion of, presentation on, or vote on business that comes before the Council/Subcommittee as part of the normal course of its activities.

Any member, or family member of a Council member, who is a recipient of services from any division of the Department shall not be construed as having a conflict solely as a result of having a disability, being a recipient of services from any division of the Department or having a familial relationship with an individual with a disability or recipient of services from a division within the Department.

Any member who is also a consumer of services from any agency, organization or project that receives funds through the Division shall not be considered to have a conflict of interest if his or her participation with that agency, organization or project is only as a consumer of services and does not exercise any administrative or decision-making authority in that project or organization.

All members shall disclose conflicts of interest to the Chair of the Council/Subcommittee, including uncertain or potential conflicts, as soon as the conflict becomes apparent. Members have an ongoing duty to disclose any conflicts of interest.

A disclosure of a conflict, including refraining from voting on applicable items, shall be made at all applicable times.

If a member is uncertain whether a conflict may exist in a specific situation, the Council/Subcommittee shall determine if a conflict exists in consultation with the Chief and other Division or Department staff as appropriate.9

Disclosure of any conflicts of interest shall be recorded in the meeting minutes.

A member who discloses or has been found to have a conflict of interest must not participate in any discussion on any matter related to the subject of the conflict or unduly influence or vote in those areas where a conflict has arisen.

Any member may bring suspected violations of this policy to the Council/Subcommittee Chair.

Once an allegation of a conflict has been brought to Chair’s attention, the Chair shall notify the Chief and the member alleged to have violated the conflict of interest provisions of the allegation. Once a conflict has been reported, the Chief or his/her designee will gather pertinent information regarding the alleged conflict of interest violation and provide such information to the Council.

Once the pertinent information has been gathered by the Chief or his/her designee, the information will be forwarded to the Council for a determination of whether a conflict of interest exists at the Council’s next regularly scheduled meeting.

Once the Council determines if an allegation of a conflict of interest violation has been substantiated, the Council shall determine if the violation is intentional or unintentional.

If it is determined by a majority vote of the Council that a violation of the conflict of interest provisions was intentional, the Council shall vote on the appropriate sanction, up to and including recommendation for removal of the member found to have a conflict of interest to the Appointing Authority and Council or Subcommittee.

If it is determined by a majority vote of the Council that a violation of the conflict of interest provisions was unintentional, the Council, in consultation with the Chief, and other Division staff as appropriate, shall define the area of the conflict of interest and instruct the Council member to refrain from participation or discussion when that area is the subject of any Council actions.

Official MeetingsAll official Council and Committee Meetings will be planned, posted, and held according to Nevada Open Meeting Law requirements.

The SILC shall meet at least quarterly according to Federal guidelines (45 CFR 1329.15(a)(3)).

Executive Sessions shall follow the same applicable guidelines and Procedures herein regarding planning and posting. Names and other confidential information may be excluded as necessary. An Executive Session may be held privately when the subject matter is considered sensitive.

AccommodationsThe Nevada SILC is pleased to make reasonable accommodations for any individual who has a disability(s) and wishes to attend a meeting. If special arrangements for the meeting are necessary, please notify the Aging and Disability representative listed on the http://adsd.nv.gov/Boards/SILC/SILC/ website as soon as possible and at least ten business days in advance of the meeting. State Plan for Independent Living (SPIL) Development and ImplementationTown Hall Meetings will be arranged according to Nevada Open Meeting Law at least 6 months in advance of SPIL planning; at least three months prior to submitting the SPIL for approval to the ACL; and at other times as deemed necessary by the SILC or SPIL Workgroup to provide an accurate representation of public needs.

The Nevada SILC will continuously work to improve the process for developing the SPIL.

The Nevada SILC will monitor, review, and evaluate the current SPIL Objectives at least quarterly.

Eligibility of Centers for Independent Living (CIL) for SPIL InclusivityAccording to 45 CFR 1329.17(d)(2)(iii), not less than 51% of CIL’s will participate in the development and approval of the SPIL. All participating CIL’s must be willing to share proof of their Part C approval, upon request by the SILC.

Code of Ethics and Meeting EtiquetteAll new members will sign a Code of Ethics form that states the following:

1. I will uphold and enforce all laws, rules and regulations that apply to

recipients of federal funds and to the SILC.

2. I will make decisions that assure the equal access and independent

living of people with disabilities and will seek to develop and maintain

Independent Living Services.

3. I understand that the role of the board is policy making, planning, and

appraisal, and I will help to frame policies and plans only after the

Council has consulted those who will be affected by them.

4. I will carry out my responsibility, not to interfere with the day to day

operations of the Center and/or SILC, but, together with my fellow

Council members, to only hire qualified staff, if applicable.

5. I recognize that authority rests with the Council as a whole, and will

make no individual promises nor take any private action that may compromise the Council.

6. I refuse to surrender my independent judgment to special interest or

partisan political groups or to use the Council position for personal

gain or for the gain of friends or family.

7. In all activities and decisions of this Council, I will act in respect for

all people, and will assure that the rights and dignity of others are

upheld.

8. I will refer all complaints to the SILC Chairperson and/or DSE and will

act on the complaints from the public only after failure of an

administrative solution.
