(b) In the event of delivery being give or possession obtained by the Purchaser or hisrepresentative prior to such payment then unless other arrangements regardingsettlement have been made satisfactory to the Selling Agent prior to the sale untilpayment in full of the purchase money and of any cheque and/or negotiable instrument given on account of the same the stock shall remain the property of theVendor and the Purchaser shall hold the stock as Trustee for the Vendor but in allrespects at the risk of the Purchaser;

(c) At any time prior to such payment the Vendor or the Selling Agent in his own namemay recover possession of the stock and for that purpose enter in or upon any landsoccupied by the Purchaser as often as may be necessary or alternatively or in addition sue for the recovery of possession of the stock.

(d) Notwithstanding anything herein contained the Vendor or the Selling Agent in hisown name may be notice in writing to the Purchaser either delivered to the Purchaserpersonally or posted by ordinary prepaid mail addressed to the Purchaser at hisaddress appearing in the sale book elect that the Sale shall be deemed to becompleted and the property in the stock shall pass to the Purchaser:-(i) if the notice is served personally at the time of such service;(ii) if the notice is served by post at the time when the notice would be received by

the Purchaser in the ordinary course of post whether such notice is in factreceived by the Purchaser or not.

6. The Purchaser shall deposit twenty five per cent of the whole of the amount of any purchase monies at the conclusion of the sale of each or any lot if required by theSelling Agent and in default of such payment being made the Selling Agent shall havethe right to resubmit for sale that lot any any lots which may previously have been purchased by that Purchaser.

7. (a) All lots are available for inspection prior to commencement of the sale and thePurchaser shall be deemed to have carefully inspected the stock and to havebought the same as the specific goods inspected.

(b) The stock are sold with all faults in any whether or not such faults are discoverableby inspection. All conditions and warranties which might otherwise be implied bylaw are to the extent permissible by law hereby expressly negatived. The Purchaseracknowledges that no warranty express or implied has been made by the Agent orSelling Agent as to the condition of the stock sold herender and that the Purchaseris aware that certain rights are conferred upon some purchasers of goods by lawwhich cannot be excluded from or modified or limited in any contract for the saleor purchase of goods. The liability of the Vendor to the Purchaser by reason of anybreach howsoever arising of any such non-excludable condition or warranty whichmight be implied by law shall if permitted by law be limited at the Vendor’s optionto the replacement of the stock or the supply of equivalent stock, the repair of thestock or payment of the respective cost thereof.

(c) The Selling Agent gives no warranty as to the Vendor’s title to the stock or his rightto sell the same and is not liable in respect of any error misdescription or omissionin any particulars appearing or stated regarding the description or pedigree of anystock offered for sale.

(d) The Purchaser shall have the right to cancel the purchase of any stock subject tosuch error misdescription or omission where it is of a significant and material nature but shall not be entitled to claim any compensation or damages in respectthereof.

8. (a) Notwithstanding the provisions of Clause 5 hereof the Purchaser shall have theright to cancel the sale but shall have no claim for damages or compensation of anykind whatsoever should any animal within the period of three months from the dateof sale fail to pass any veterinary tests and/or documentation necessary to enableit to be transported interstate or overseas to a destination nominated by thePurchaser on the day of the sale. All veterinary and miscellaneous expenses of anykind whatsoever shall be borne by the Purchaser on certification of the completionof the requirements for interstate movement or export documentation but by the Vendor should such requirement not be met.

(b) Notwithstanding the provisions of the preceding sub-clause where by reason of anylaw order or regulation made by any competent authority which comes into effectafter the date of the sale the Purchaser is unable to transport any animal or animalsto the destination nominated by him at the date of the sale the Purchaser shall bebound nevertheless to accept and pay for the said animals and shall have no claimfor compensation or damages of any kind whatsoever.

(c) The right to cancel the sale pursuant to sub-clause (a) hereof is conditional on thePurchaser returning the animal or animals to the Seller at the Purchaser’s cost inthe same condition as it or they were at the date of the sale if the Purchaser shallhave taken possession of the animal or animals and removed it or them from theproperty of the Seller.

9. Any statement made by the Vendor or by his Agent whether in writing or orally to theeffect that any female has been pregnancy tested in calf (P.T.I.C.) shall mean andrequire only that a certificate in writing shall be supplied to the Purchaser, signed by aqualified veterinary surgeon certifying that he has pregnancy tested the said female ona date to be specified in the certificate and that in his opinion the female was in calf on that date. Such certificate shall not constitute any warranty by the Vendor or hisAgent who shall be under no liability to the Purchaser should the said opinion be incorrect.

10.If the stock is not paid for in full cash immediately on conclusion of the sale interestshall be payable by the Purchaser on the purchase price or any unpaid part thereof atthe current rate charged by the Selling Agent on overdue accounts from the date of purchase until the date of payment. Interest at the said rate shall also be paid by thePurchaser on all expenses and charges incurred by the Selling Agent on behalf of thePurchaser from the date such are incurred until the date of payment.

11.Should there be any deficiency in numbers of any lot sold the Selling Agent shall notbe bound to deliver more than the number actually in his or the Vendor’s possession.

12.The price as recorded in the Sale Book by the Clerk at the sale shall be binding on thePurchaser and the Vendor.

13. If the Purchaser shall neglect or fail to comply with any of the conditions any stock purchased by him may without notice to the Purchaser be resold at the risk of the Purchaser atsuch time and place as may be determined by the Selling Agent either by public auctionor private contract and any loss arising from such resale together with all expensesincurred in connection therewith shall be forthwith made good by the Purchaser. ThePurchaser shall not be entitled to any profit resulting from such resale.

14.It is not the responsibility of the Selling Agent to acquire pedigree certificates andtransfers. It is the responsibility of the Vendor who shall notify the Secretary of therespective Breed Society of the full name and address of the Purchaser together withthe payment of transfer fees within the time period specified by the relative BreedSociety or Association of which the Vendor is a member.

15.Any person attempting to induce another person to abstain from bidding by any promisethat may influence the price in the purchaser’s favour or who abstains be reason ofsuch an attempt and also any auctioneer or clerk who knowingly enters into therecords of any auction sale any other name than that of the successful bidder (unlessthe successful bidder notifies the auctioneer or clerk of such other name immediatelyafter the auction) may be guilty of an offence under the provisions of the Auction SaleAct 1958.
