4.3 Quarterly Report 8 - 11Purpose: To receive the 4th year-to-date Public Works quarterly report.

Recommendation:That the Committee receive for information the Public Works quarterly report.

4.1 Roads, Cycling and Sidewalks Construction Program

The Committee received a presentation from the Director of Engineering and Operations

regarding proposed road, cycling and sidewalk projects.

That the Committee recommend that Council consider during its 2017 – 2021 Financial

Plan deliberations, the proposed 2017 - 2021 Roads, Cycling and Sidewalks Construction

Program budget, including $50,000 in 2017 for Herd Road traffic calming at the Maple

Bay playground (to be funded by reducing the pavement overlay budget by the same

amount).

4.2 Drinkwater Road Traffic Calming

The Committee received reports from the Manager of Engineering (Development and

Capital Projects) dated November 3, 2016 and Parsons Corporation dated October 2016,

regarding proposed traffic calming measures on Drinkwater Road.


That the Committee recommend that Council:

1. endorse the phase 1 recommendations contained in the Parsons Corporation report

“Traffic Calming for Drinkwater Road West of Somenos Road” dated October 2016;

2. direct staff to budget implementation of phase 1 recommendations in the 2017

Roads Program; and

3. provide a 6-month follow-up report after implementation of the phase 1

recommendations.

4.3 Installation of Speed Reader Boards

The Committee received a verbal presentation and written report, dated November 7,

2016, from the Manager of Engineering (Development and Capital Projects) regarding

installation of speed reader boards on Queen Street and Herd Road. The Committee

noted that ICBC will contribute $5,000 of the projected $25,000 cost of the speed reader

boards.


That the Committee recommend that Council endorse the installation of speed reader

boards on Queen Street in Crofton, and on Herd Road in Maple Bay, and further that

Council direct staff to provide a report to the Public Works Committee on the success of

the boards in reducing traffic speed 6 months after they are installed.

5. NEW BUSINESS

5.1 Transit Bench Installation

The Committee received a letter from the Cowichan Valley Regional District (CVRD),

dated September 13, 2016, proposing to install new transit benches on Maple Bay Road

and Joan Avenue in 2016 to encourage ridership and support the regional transit system.

The Committee also noted the CVRD's plans to install additional transit infrastructure in

North Cowichan in 2017 and 2018, subject to funding availability.


That the Committee recommend that Council approve, and authorize the Mayor and

Corporate Officer to sign, an encroachment agreement with the Cowichan Valley

Regional District to locate new transit benches on Maple Bay Road at Queen of Angels

school and Joan Avenue, and provide funding assistance from the Public Works budget

up to $5,000 to pave a pull out area for the Maple Bay Road bus stop.

5.2 Road Safety Issues

The Committee received a letter from Bruce Findlay, dated November 15, 2016,

requesting traffic safety improvements in Crofton and directed staff to reply to Mr.

Findlay to summarize the Municipality's traffic safety plans for Crofton.

Subject Boulevard Maintenance Policy

Purpose

The purpose of this report is to provide the Committee with information about the current Boulevard

Maintenance Policy and to provide recommendations regarding the replacement of the policy with a

bylaw.

Background

Complaints have been received from municipal residents when they are informed that they must

maintain boulevards adjacent to their properties. Recently, a complaint was received and in doing

research about where this requirement stemmed from and how it could be enforced, it was determined

that the requirement is based on policy not bylaw. This policy was established in May 1975 and later

reaffirmed. However, the Community Charter requires these powers be exercised by bylaw rather than

policy.

Discussion

On May 1, 1975, the Municipality of North Cowichan adopted the following policy:

“The Committee re-affirmed the current practise of encouraging owners to look after the

boulevard area in front of their property. Improvements on the road right-of-way are done at

their own risk as the property may be needed for future municipal use. Plantings detrimental to

sewers such as large trees are to be discouraged.”

This was reaffirmed on July 19, 2006 when Council passed the motion:

“that Council reaffirm its policy that the Municipality will not maintain boulevards fronting

private property, but continue to rely on private owners to maintain these areas”.

In addition, the Municipality’s Highway Access Permit states:

“Permission has been granted to construct a Highway Access from the above referenced

property in accordance with the following conditions:

…4. No planting of any trees, shrubs or plants, other than grass, in the boulevard…”

Section 4 of the Highway Use Bylaw 1988 states:

“Except as authorized by a permit issued by the Director Engineering and Operations pursuant

to section 5 of this Bylaw, no person shall excavate in, encumber, injure or damage any portion

of a highway, and in particular no person shall do the following:

…(b) plant any tree, shrub, or plant other than grass upon any boulevard;…”

Note there is no mention in Section 4 of the Highway Use Bylaw 1988 of on-going maintenance in the

boulevard. Boulevard maintenance is required solely by Municipal policy.

Under Section 8(3) of the Community Charter:

“A council may, by bylaw, regulate, prohibit and impose requirements in relation to the

following:

(a) municipal services;

(b) public places;

(c) trees;…”

Also, Sections 36 (i) and 39 (e) of the Community Charter specify that:

“a council may, by bylaw, regulate and prohibit in relation to all uses of or involving a highway

or part of highway”; and,

“a council may, by bylaw, require persons to take specified actions for the purposes of

maintaining the cleanliness or safety of a highway that is next to property that they own or

occupy, or that is affected by property that they own or occupy”.

These sections in the Community Charter indicate that a municipality must use a bylaw to regulate

public spaces and trees, and specific owner action.

The Municipality does have a bylaw that requires property owners to maintain public places or the

highway boulevard fronting their property. Section 14 of the Highway Use Bylaw 1988 requires removal

of snow, ice and rubbish from sidewalks by adjacent owners:

“The owner and occupier of real property bordering a concrete, asphalt or wooden surfaced

sidewalk shall remove all snow, ice, or rubbish on that portion of the sidewalk adjacent to the

property, within 48 hours of the accumulation or placement of such snow, ice, or rubbish on the

sidewalk”.

Implications

Implications of this bylaw amendment are:

Neighbourhoods may differ in their desired boulevard aesthetic giving rise to additional

complaints to the Municipality;

The Municipality can limit its costs liability exposure by requiring owners to maintain their

boulevards; and,

Property owners may object to having to maintain boulevards.

Recommendation

That the Committee recommend that Council direct staff to draft a bylaw to amend the Highway Use

Bylaw 1988 to require property owners to maintain their boulevards.

14 (1) The owner and occupier of real property bordering a concrete, asphalt or wooden surfaced

sidewalk shall remove all snow, ice, or rubbish on that portion of the sidewalk adjacent to their

property, within 48 hours of the accumulation or placement of such snow, ice, or rubbish on the

sidewalk.

(2) The owner and occupier of real property must:

(a) maintain, or cause to be maintained, the boulevards adjacent to their property in proper, safe

and tidy condition, and

(b) ensure that any landscaping on the boulevard fronting their property is maintained to a

similar standard of landscaping as their own property.

(3) Without restricting the standard of maintenance required by section (14) (2), an owner of real

property adjacent to a boulevard must ensure that:

(a) all vegetation other than noxious weeds receive water as necessary for the sustained growth

and health of the vegetation,

(b) noxious weeds are not permitted to grow on the boulevard,

(c) no hazardous or potentially hazardous situations are allowed to develop or remain,

(d) sight lines to intersections, driveways, sidewalks, walkways, travel lanes, and visibility to all

traffic control devices are maintained, and,

(e) any garbage, debris, or discarded materials that accumulate are removed.

(4) Exceptions to section 14 (2) and (3) include the following:

(a) boulevards adjacent to provincially-controlled highways;

(b) boulevards deemed by the Director of Engineering and Operations as

(i) being too steep for personal safety; or

(ii) having access that is too difficult for personal safety.

Purpose

The purpose of this report is to provide the Committee with general information on aspects of ongoing

Engineering and Operations activities.

Background

Council has expressed an interest in knowing about various undertakings and status within the

department regarding initiatives and project schedules. Information was given to the Committee at the

March 9, 2016 meeting where it was determined to continue the process of reporting quarterly.

Discussion

Attached is a copy of the current 2016 Engineering Capital Projects list and construction time lines.

Other information that may be of interest is as follows:

PUBLIC WORKS UTILITY STATISTICS:

Personnel:

Hired one Term Utility Worker to fill a position open due to another employee off for an

extended period.

Fleet and Machinery:

Will award tender to replace Emergency Generator for Kin Beach. This is an insurance

claim due to the original generator catching fire.

Calls for Service:

From September 1 to November 30 = 605 calls (348 for Utilities issues)

Roads:

Asphalt Overlay Maintenance Program complete for 2016.

Utilities:

Kin Beach Lift Station Upgrade and Beautification completed.

Operation of Banon Creek Dam intensified during summer to accommodate the

Chemainus Wells Summer Testing.

Required to replace Chemainus Well Pump due to motor seal failure.

Initiated Request for Quote (RFQ) for expenditures exceeding thresholds including past

suppliers.

Costs of spare pumps is being performed in order to avoid risks of special order pump

equipment failing without quick replacement.

Building Maintenance:

Old Chemainus Elementary School

o Demolition tender sent out for bidding, closes December 16, 2016.

Maple Bay Washrooms

o Renovation of the washrooms so they can be open all year, add heat, lights,

insulation, power service, windows.

Duncan RCMP

o General repairs to gym;

o Repaired various light fixtures;

o Repaired various video cameras;

o Repaired various cell doors in the holding area;

o Repaired various doors;

o Replaced window blinds;

o Replaced counter the in the food prep room for cells;

o Repaired several garage doors;

o Pest control contractor set traps;

o Install lockers;

o Secure shelves;

o Repair soffit and fascia.

Operations Building

o Replaced two shop overhead door;

o Replaced and repaired various lights;

o Installed motion sensors to various lights in the truck bays;

o Closed the Request for Proposals for Building assessments, under review;

o Securing shelves for earthquake;

o Built a new storage rack for the rolls of Geotextile fabric.

Fuller Lake Arena

o Repaired and replaced various lights;

o Relocated video cameras;

o Hydro upgrade.

Municipal Hall


o Repaired various desks and keyboards;

o Repaired HR Dept. entrance doors;

o Replaced windows in the IT Dept.;

o Replaced the blinds in the IT Dept.;

o Changed lights in Jason Birch’s office;

o Installed plaques for Planning Dept.;

o Installed a new set of blinds in the Osborne Bay Meeting room, this will act as a

screen for the new overhead projector;
