1 INTRODUCTION

1.1 Background

The raison d’etre for Tung Chung Cable Car Project is encapsulated in the concept of enhancing tourism and in the particular context of Lantau of “getting back to nature”.

The experience enjoyed by tourists and residents alike will begin at a state-of-the-art terminal in the vibrant and energetic Tung Chung New Town. The journey will continue with gondolas gently traversing the Sea Channel, leaving behind the panorama of the airport and the hustle and bustle of urban life. A slow ascent of the majestic and imposing Nei Lek Shan will unexpectedly reveal the first glimpse of the spectacular Giant Buddha surrounded by the collected monastic buildings and village houses. Upon arrival at the Ngong Ping terminus the tranquil atmosphere and the context of the religious setting will prevail. The terminus will therefore be of a very different style to the one in Tung Chung, in order to blend into its environs.

The Tung Chung Cable Car Project includes the following:

• construction of a Bi-cable cable car system of about 5.7 km long between Tung Chung and Ngong Ping;

• construction of two termini, one at Tung Chung and the other at Ngong Ping; • construction of two angle stations and eight supporting towers; and • construction of emergency rescue trail and other ancillary works.

The Diversion of the Ngong Ping Stream has been identified in the developed design stage, subsequent to the issue of the Environmental Impact Assessment (EIA) for the Tung Chung Cable Car Project. It will provide the space necessary to accommodate the architectural, planning and engineering features of a tourist village and attraction. In fact, serious consideration has been given to the alternative of retaining the existing stream, which in other circumstances could have been an attraction within the proposed Theme Village. However, there are a range of issues which have conspired to make this infeasible and lead to the conclusion that diversion of the stream is an essential aspect of the project. The diversion will also alleviate potential flooding, water quality and environmental health issues in the vicinity of the proposed Tung Chung Cable Car Terminal and Theme Village.

The Tung Chung Cable Car Project – Diversion of the Ngong Ping Stream includes:

• diversion of approximately 390m of the existing Ngong Ping Stream around the northern site boundary of the Cable Car Terminal and Theme Village; and

• diversion of approximately 86m of a ditch, which forms a tributary to the Ngong Ping Stream, to the west of the Terminal site.

1.2 Purpose of the Manual

The purpose of this Environmental Monitoring and Audit (EM&A) Manual, hereafter referred to as the Manual, is to guide the set up of an EM&A programme to ensure compliance with the study recommendations of Tung Chung Cable Car Project EIA, Ngong Ping Stream Diversion Project Profile and Project Profile for the Provision of Temporary Helipad at Tea Garden, Ngong Ping; to assess the effectiveness of the recommended mitigation measures and; to identify any further need for additional mitigation measures or remedial action. This Manual outlines the monitoring and audit programme proposed for the projects, ‘Tung Chung Cable Car Project’, ‘Tung Chung Cable Car Project– Diversion of Ngong Ping Stream’ and ‘Provision of Temporary Helipad at Tea Garden, Ngong Ping for the Tung Chung Cable Car Project’.

This Manual contains the following:

(a) responsibilities of the Contractor, the Engineer or Engineer’s Representative (ER) and the Environmental Team (ET) with respect to the environmental monitoring and audit requirements during the course of the project;

(b) information on project organisation and programming of construction activities for the project;

(c) the hypotheses of potential impacts, the basis for and description of the broad approach underlying the environmental monitoring and audit programme;

(d) requirements with respect to the construction schedule and the necessary environmental monitoring and audit programme to track the varying environmental impacts;

(e) the specific questions and testable hypotheses that the monitoring programme is designed to answer;

(f) details of the methodologies to be adopted, including all field, laboratory and analytical procedures, and details on quality assurance and quality control programme;

(g) the rationale on which the environmental monitoring data will be evaluated and interpreted and the details of the statistical procedures that will be used to interpret the data;

(h) definition of Action and Limit levels (A/L Levels);

(i) establishment of Event and Action Plans;

(j) requirements for reviewing pollution sources and working procedures required in the event of non-compliance of the environmental criteria and complaints;

(k) requirements for presentation of environmental monitoring and audit data and appropriate reporting procedures; and

(l) requirements for review of EIA predictions and effectiveness of the environmental monitoring and audit programme.

This document serves an updated version of the EM&A Manual and will be further reviewed as necessary.

1.3 Site Location

The site location for the Tung Chung Cable Car Project encompasses the “envelope between Tung Chung and Ngong Ping” and also takes into consideration the Hong Kong International Airport at Chek Lap Kok (for the provision of an angle station) as shown in the location plan below.

The Ngong Ping Stream diversion works are located to the north and west of the proposed Cable Car Terminal and Theme Village. The location of the proposed stream diversion is shown below.

1.4 Sensitive Receivers

Sensitive receivers have been identified within the study area of the Tung Chung Cable Car Project in the EIA Report. These include scattered village houses at Ngong Ping, Po Lin Monastery, Tin Tan Buddha Statue, Lin Chi Monastery, SG Davis Youth Hostel, Tung Chung Crescent, Fu Tung Estate, Seaview Crescent and Wan Ho Kan Primary School.

As for the Ngong Ping Stream diversion works, sensitive receivers within the study area include village houses at Ngong Ping.

1.5 Environmental Monitoring and Audit Requirements

The likely environmental impacts arising from construction of cable car and stream diversion works including dust, noise, water quality, waste, ecology, visual and landscape, and cultural heritage have been identified in the EIA report and Project Profile respectively. These impacts can be minimised to acceptable levels provided that appropriate environmental mitigation measures and environmental monitoring and audit requirements are implemented. An Implementation Schedule of the environmental mitigation measures recommended in the EIA Report and Project Profile is described in Annex A. In order to ensure the acceptability, monitoring and audit requirements for dust, noise, water quality, ecology and visual and landscape have been identified and are described in detail in the subsequent sections.

Computer-based Environmental Quality Protection Management System (EQPMS) operated by MTRC in various recent projects such as Penny’s Bay Line, Tsim Sha Tsui Station Modification and Tseung Kwan O Extension will be applied for data recording and reporting. A dedicated webpage within MTRC website has already been setup for EM&A reporting.

1.6 Environmental Management Organisation

The proposed organisation for both projects includes the Environmental Team (ET), Independent Environmental Checker (IEC), Engineers’ Representative (ER) and the Contractor. The roles of ET and ER will both be played by MTRC like all other MTRC projects. This organisation structure will allow optimal lines of communications between ET, ER and the Contractor and will ensure the Contractor will perform the implementation measures effectively and in a timely fashion. The proposed project organisation is shown in Figure 1.3.

Line of Communication

The responsibilities of respective parties are:

Environmental Team (ET)

• monitor the various environmental parameters as required in the EM&A Manual;

• carry out site inspection to investigate and audit the Contractor’s site practice, equipment and work methodologies with respect to pollution control and environmental mitigation, and anticipate environmental issues for proactive action before problems arise;

• analyse the EM&A data, review the success of EM&A programme to confirm the adequacy of mitigation measures implemented and the validity of the EIA predictions and to identify any adverse environmental impacts arising and report EM&A results to the public, contractor, ER;

• audit and prepare audit reports on the environmental monitoring data and the site environmental conditions;

• recommend suitable mitigation measures to the Contractor in the case of exceedance of Action and Limit levels in accordance with the Event and Action Plans; and

• keep a log-book of every instance or circumstance or change of circumstances which may affect the EIA and every non-compliance with the recommendations of the Project Profile, EIA or the Environmental Permit (EP).

The ET leader shall be responsible for and in charge of the ET. The ET leader shall have a relevant professional qualification and sufficient experience in EM&A.

Independent Environmental Checker (IEC)

• check, review, verify and validate the overall environmental performance of the project, including the implementation of all the environmental protection and mitigation measures, submissions relating to EM&A, and any other submissions required under the EP for the project.;

• audit in an independent, objective and professional manner in all aspects of the EM&A programme; and

• on a need basis, verify and certify the environmental acceptability of the construction methodology, relevant design plans and submissions under the EP.

Engineers’ Representative

• supervise the Contractors activities and ensure that the requirements in the EM&A Manual and the contract are fully complied with;

• inform the Contractor when action is required to reduce impacts in accordance with the Event and Action Plans; and

• adhere to the procedures for carrying out complaint investigation in accordance with MTRC internal procedures.

The Contractor

• provide assistance to ET in carrying out monitoring;

• take responsibility and strictly adhere to the guidelines of the EM&A programme;

• submit proposals on mitigation measures in case of exceedances of Action and Limit levels in accordance with the Event and Action Plans;

• implement measures to reduce impact where Action and Limit levels are exceeded; and

• adhere to the procedures for carrying out complaint investigation in accordance with MTRC internal procedures.

2 AIR QUALITY

2.1 Introduction

The Contractor shall follow the Air Pollution Control (Construction Dust) Regulation to implement dust mitigation measures during construction of cable car and stream diversion works to minimise the dust impact to the nearby air sensitive receivers and to ensure the effectiveness of the implementation of dust mitigation measures recommended in the EIA Report and Project Profile.

2.2 Air Quality Parameters

Monitoring and audit of the TSP levels shall be carried out by the ET to ensure that any deteriorating air quality could be readily detected and timely actions taken to rectify the situation.

Monitoring will examine 1-hour TSP levels where exceedances have been predicted. 1-hour TSP levels shall be measured by direct reading methods to indicate the impacts of construction dust on air quality.

All relevant data including temperature, pressure, weather conditions, reading for the start and stop of the sampler, and other special phenomena and work progress of the concerned site etc. shall be recorded down in details. A sample data sheet is shown in Annex B.

2.3 Monitoring Equipment

The ET Leader is responsible for provision of the monitoring equipment. He shall ensure that sufficient number of equipment with appropriate calibration kits are available for carrying out the baseline monitoring, regular impact monitoring and ad-hoc monitoring. All the equipment shall be clearly labelled.

Calibration of dust monitoring equipment shall be conducted as specified by the manufacturer. The calibration data shall be properly documented for future reference. All the data shall be converted into standard temperature and pressure condition.

2.4 Monitoring Locations

The dust monitoring locations are summarised in Table 2.1 and shown in Figure 2. Note that ASR 13 – Tung Chung Post Office is applicable for the Tung Chung Cable Car Project only.

Originally ASR 9 – Tung Chung Crescent was proposed as the monitoring location in the EIA. However, since access cannot be obtained and there is no suitable location either at roof or podium of Tung Chung Cresent, it is proposed to move the monitoring station to ASR 13 – Tung Chung Post Office, which is in fact closer to the project site.

The status and locations of dust sensitive receivers may still change after issuing this manual. If such cases exist, the ET shall propose updated monitoring locations and seek agreement from EPD.

When alternative monitoring locations are proposed, the following criteria, as far as practicable, shall be followed:

a) at the site boundary or such locations close to the major dust emission source; b) close to the sensitive receptors; and c) take into account the prevailing meteorological conditions.

When positioning the samplers, the following points shall be noted:

a) only one at each location. b) the distance between the sampler and an obstacle, such as buildings, must be at least

twice the height that the obstacle protrudes above the sampler; c) a minimum of 2 metres of separation from walls, parapets and penthouses is required; d) a minimum of 2 metres separation from any supporting structure, measured horizontally

is required;

e) no furnace or incinerator flue or building vent is nearby; f) airflow around the sampler is unrestricted; g) the sampler is more than 20 metres from the dripline; h) any wire fence and gate, to protect the sampler, shall not cause any obstruction during

monitoring; i) permission must be obtained to gain access to the monitoring stations; and

j) if needed, a secured supply of electricity shall be obtained to operate the samplers.

2.5 Baseline Monitoring

The ET shall carry out 1-hr baseline sampling 3 times per day at all of the designated monitoring locations for at least 14 consecutive days prior to the commissioning of the construction works.

During the baseline monitoring, there shall not be any construction or dust generation activities in the vicinity of the monitoring stations.

In case the baseline monitoring cannot be carried out at the designated monitoring locations during the baseline monitoring period, the ET shall carry out the monitoring at alternative locations which can effectively represent the baseline conditions at the impact monitoring locations.

In exceptional cases, when insufficient baseline monitoring data or questionable results are obtained, the ET shall liaise with the EPD to agree on an appropriate set of data to be used as a baseline reference.

Ambient conditions may vary seasonally and shall be reviewed as required. If the ET

considers that the ambient conditions have been changed and a repeat of the baseline monitoring is required to be carried out for obtaining the updated baseline levels, the monitoring shall be at times when the contractor's activities are not generating dust, at least in the proximity of the monitoring stations. Should a change in ambient conditions be determined, the baseline levels and, in turn, the air quality criteria, shall be revised. The revised baseline levels and air quality criteria shall be agreed with EPD.

2.6 Impact Monitoring

The ET is responsible for impact monitoring during the course of the works. For 1-hr TSP monitoring, the sampling frequency of at least three times in every six-days shall be undertaken when the highest dust impact occurs.

In case of non-compliance with the air quality criteria, more frequent monitoring exercise, as specified in the Action Plan in Section 2.7, shall be conducted within 24 hours after the result is obtained. This additional monitoring shall be continued until the excessive dust emission or the deterioration in air quality is rectified.

2.7 Event and Action Plan for Air Quality

The baseline monitoring results form the basis for determining the air quality criteria for the impact monitoring. The ET shall compare the impact monitoring results with air quality criteria set up for 1-hour TSP. Table 2.2 shows the air quality criteria, namely Action and Limit (A/L) Levels to be used. Should non-compliance of the air quality criteria occurs, actions in accordance with the Action Plan in Table 2.3 shall be carried out.

3 NOISE

3.1 Introduction

The monitoring programme shall be carried out by the ET to ensure that the noise level of construction works complies with the 75dB(A) criterion with 70dB(A) for schools with a further reduction to 65dB(A) during examination periods.

Please refer to Annex E for the monitoring programme for the operation of the temporary helipad at Tea Garden, Ngong Ping.

3.2 Noise Parameters

The construction noise level shall be measured in terms of the A-weighted equivalent continuous sound pressure level (Leq). Leq(30 min) shall be used as the monitoring parameter for the time period between 0700-1900 hours on normal weekdays. A sample field data record sheet is shown in Annex B.

3.3 Monitoring Equipment

As referred to in the Technical Memorandum (TM) issued under the Noise Control Ordinance (NCO), sound level metres in compliance with the International Electrotechnical Commission Publications 651: 1979 (Type 1) and 804: 1985 (Type 1) specifications shall be used for carrying out the noise monitoring. The calibration of the sound level meters and their respective calibrators shall be carried out in accordance with the manufacturer’s requirements.

Noise measurements shall not be made in the presence of fog, rain, wind with a steady speed exceeding 5 ms-1 or wind with gusts exceeding 10 ms-1.

The ET Leader is responsible for the provision and maintenance of the monitoring equipment. He shall ensure that sufficient noise measuring equipment and associated instrumentation are available for carrying out the baseline monitoring, regular impact monitoring and ad hoc monitoring.

3.4 Monitoring Locations

The noise monitoring locations are summarised in Table 3.1 and shown in Figure 3. Note that NSR 4 – Tung Chung Post Office is applicable for the Tung Chung Cable Car Project only.

For reasons as discussed in Section 2.4, it is proposed to move the monitoring location from Tung Chung Crescent to Tung Chung Post Office, which is in fact closer to the project site.

The status and locations of noise sensitive receivers may still change after issuing this manual. If such cases exist, the ET Leader shall propose updated monitoring locations and seek agreement from EPD.

When alternative monitoring locations are proposed, the monitoring locations shall be chosen based on the following criteria:

a) at locations close to the major site activities which are likely to have noise impacts;

b) close to the noise sensitive receivers (N.B. for the purposes of this section, any domestic premises, hotel, hostel, temporary housing accommodation, hospital, medical clinic, educational institution, place of public worship, library, court of law, performing art centre shall be considered as a noise sensitive receiver); and

c) for monitoring locations located in the vicinity of the sensitive receivers, care shall be taken to cause minimal disturbance to the occupants during monitoring.

The monitoring station shall normally be at a point 1m from the exterior of the sensitive receivers building facade and be at a position 1.2m above the ground. If there is a problem with access to the normal monitoring position, an alternative position may be chosen.

3.5 Baseline Monitoring

The ET shall carry out baseline noise monitoring prior to the commencement of the construction works. The baseline monitoring shall be carried out daily for a period of at least 14 days.

There shall not be any construction activities in the vicinity of the stations during the baseline monitoring. Baseline monitoring measurements shall be evenly spread throughout the assessment period to be conducted at the some frequency and duration throughout all periods of the day.

In exceptional cases, when insufficient baseline monitoring data or questionable results are obtained, the ET shall liaise with EPD to agree on an appropriate set of data to be used as a baseline reference.

3.6 Impact Monitoring

Noise impact monitoring shall be carried out by the ET at all the designated monitoring stations once every six days. The monitoring frequency shall depend on the scale of the construction activities.

General construction work carried out during restricted hours is controlled by Construction Noise Permit (CNP) under the NCO.

In case of non-compliance with the construction noise criteria, more frequent monitoring as specified in the Action Plan in Section 3.7 shall be carried out. This additional monitoring shall be continued until the recorded noise levels are rectified or proved to be irrelevant to the construction activities.

3.7 Event and Action Plan for Noise

The A/L Levels for construction noise are defined in Table 3.2. Should non-compliance of the criteria occurs, action in accordance with the Action Plan in Table 3.3, shall be carried out.

4 ECOLOGY

4.1 Introduction

It is stipulated that EM&A for ecology is undertaken throughout the design, construction and operational phases to ensure that all mitigation measures are fully complied with. In particular, the objectives of the design audit shall be to ensure that the design process clearly implements the ecology mitigation specified in the EIA and the Project Profile and to ensure that such designs are ecologically feasible and effective. The construction and operational EM&A objectives shall be to ensure that the mitigation procedures recommended are carried out as specified and are effective.

As stated in Annex 16 of the TM issued under the EIA Ordinance (EIAO), the purpose of ecological monitoring are:

• to monitor the effectiveness of the mitigation measures;

• to detect unpredicted ecological impacts arising from the proposed development;

• to verify the accuracy of the predictions of the ecological assessment study; and

• to recommend action plans in response to unpredicted impacts, and/ or failed mitigation.

4.2 Ecological Monitoring during Construction Phase

Ecological monitoring shall be undertaken by the ET which shall include qualified ecologist who will be involved in:

• the briefing and training of MTRC staff, construction contractors/ subcontractor crews;

• attending site meetings to agree on appropriate construction practices etc. prior to work commencing on site and to highlight areas of ecological importance;

• identifying rare or protected species in the vicinity of the works, marking species/ features and areas to be avoided and advising on methods an details of protection;

• liaison with construction crews to modify layouts as needed to avoid sensitive areas;

• immediate correction of situations which violate the intent of the mitigation plan.

Before commencement of the cable car project and the stream diversion works, the qualified ecologist shall conduct detailed survey to ascertain the presence of any rare or protected flora species to be affected. Flora transplantation works will be carried out in accordance to the Transplantation Plan under the supervision of the qualified ecologist. In addition, the qualified ecologist will undertake fauna translocation prior to the commencement of the stream diversion works. Measures will be taken based on the Fauna Translocation Plan to relocate the species to be affected by the diversion works from the existing Ngong Ping Stream and surrounding riparian habitat.

It is recommended that the ecologist conducts regular field surveys and sampling of impacted flora and fauna species using the site and its surrounding during construction. Success of flora transplantation and fauna translocation should be assessed and reported in accordance to the relevant plans.

The risk of contamination of surface and ground waters by chemicals should be minimal provided that the principles given in Section 5 of the EIA Report are followed. An emergency plan will be developed to deal with accident chemical leakage and spillage during construction.

Ecology mitigation will be audited to ensure effective implementation and to quantify results. Monitoring will be undertaken as per Table 4.1 below.

4.3 Ecological Monitoring during Operational Phase

Success of the replanting should be monitored by regular visual inspection and special care should be undertaken to ensure that any damaged, diseased or dying trees or shrubs are replaced as required. Of potential concern during early years of operation could be erosion of recently re-vegetated areas. This should be monitored visually following storms and corrective measures should take place if any form of erosion occurs. The replanting works will be maintained for one year after completion.

5 VISUAL AND LANDSCAPE

5.1 General

It is recommended that EM&A for landscape and visual resources is undertaken during the detailed design stage as well as the construction and operational phases of the project. The incorporation of design guidelines and implementation and maintenance of landscape compensatory and restoration planting measures is a key aspect of this and should be checked to ensure that they are fully realised. Potential conflicts between the proposed landscape measures and any other project works and operational requirements should be resolved at the earliest possible date and without compromise to the intention of the mitigation measures. In addition, implementation of the mitigation measures recommended by the EIA and the Project Profile will be monitored throughout the construction phase site audit programme.

5.2 Landscape and Visual Baseline

Reference will be made to the habitat maps included in the EIA Report and the detailed tree survey.

5.3 Construction and Operational Phase Audit

A competent landscape architect should be employed by the Contractor for the implementation of landscape works and subsequent maintenance during the 12-month after completion.

All measures undertaken by both the Contractor and Landscape Contractor during the construction phase and first year of the operational phase shall be audited by the ET on a regular basis to ensure compliance with the intended aims of the measures and the Landscape and Compensatory Planting Plans. The broad scope of the audit is detailed below:

• The progress of the engineering works should be regularly reviewed on site to identify the earliest practical opportunities for the landscape works to be undertaken.

• Tree and shrub transplanting and planting operations.

• Topsoil protection and storage operations.

• Trees to be retained within or adjacent to work areas are carefully protected.

• All landscaping works are carried out in accordance with the specifications, with particular attention to approved use of herbicides or pesticides.

• The species and mix of new plant species to be planted are suitable.

• The newly planted trees, shrubs and grassed areas are properly maintained in respect of the following:

(a) regular watering, weeding and fertilising of all planting reinstatement;

(b) regular grass cutting for reinstated areas;

(c) firming up of plants after periods of strong winds or heavy rain;

(d) regular checks for and eradication of pests, fungal infection etc.;

6 WATER QUALITY

6.1 Introduction

It is concluded in the EIA and the Project Profile that the water quality impacts are deemed to be acceptable by implementation of the mitigation measures and adherence to the practice notes for work within the country park and Water Gathering Ground.

6.2 Water Quality Monitoring during Construction Phase

Mitigation measures as detailed in the implementation schedule (in Annex A) and the Temporary Drainage Systems Proposal will be implemented to control the surface runoff and wastewater generated from the construction works. At tower work sites within the country park, measures will be taken to prevent ingress of rainfall during storm events and offsite migration of materials. Regular inspections of the work sites and nearby streams (within the Water Gathering Ground) will be conducted by the ET which should be adequate for protection of water resources.

In the event of accidental chemical spillages, the Emergency Response Plan will be effected. The effectiveness of such measures will be audited as described in Section 7.

7 WASTE

7.1 Introduction

It is concluded in the EIA and the Project Profile that the handling, transportation and disposal of waste materials during construction will not give rise to significant impacts provided that appropriate mitigation measures are implemented.

7.2 Construction Phase Audit

Mitigation measures will be taken in accordance to the Waste Management Plan. Regular site inspection will be undertaken as part of the EM&A procedures to ensure proper control: all waste is removed from site areas as appropriate and illegal disposal of waste is not being undertaken. A comprehensive record will be maintained for all disposals leaving site and these records will be audited.

8 SITE ENVIRONMENTAL AUDIT

8.1 Site Inspections

Site inspections provide a direct means to trigger and enforce the specified environmental protection and pollution control measures. They will be undertaken routinely by the ET to inspect the construction activities in order to ensure that appropriate mitigation measures are properly implemented. With well defined pollution control and mitigation specifications and a well established site inspection, deficiency and action reporting system, the site inspection is one of the most effective tools to enforce the environmental protection requirements on site.

The ET Leader is responsible for formulation of the environmental site inspection, deficiency and action reporting system, and for carrying out the site inspection works.

Regular site inspections will be carried out at least once per week. The areas of inspection will include but not be limited to the pollution control and mitigation measures within the site; it will also review the environmental situation in the vicinity of the works area which is likely to be affected, directly or indirectly, by the construction activities. The ET will make reference to the following information in conducting the inspection:

a) recommendations on environmental protection and pollution control mitigation measures in the EIA and the Project Profile;

b) submissions as required by the Environmental Permits;

c) works progress and programme;

d) individual works methodology proposals (which shall include proposal on associated pollution control measures);

e) the relevant environmental protection and pollution control laws; and

f) previous site inspection results.

The Contractor shall update the ET with all relevant information of the construction contract for ET to carry out the site inspections. The inspection results and its associated recommendations on improvement to the environmental protection and pollution control works will be passed to the ER and the Contractor for reference and for taking immediate action. The Contractor shall follow the procedures and time-frame as stipulated.

Ad-hoc site inspections will also be carried out if significant environmental problems are identified. Inspections may also be required subsequent to receipt of an environmental complaint, or as part of the investigation work, as specified in the Event/ Action Plan for environmental monitoring and audit.

8.2 Compliance with Legal Requirements

There are legal environmental protection and pollution control requirements in Hong Kong which the construction activities shall comply with.

The ET will review the works method statements, the progress and programme of the works to check that relevant environmental laws have not been violated, and that any foreseeable potential for violating the laws can be prevented. The ET will also ensure compliance with the submissions as required by the Environmental Permits.

The Contractor shall regularly copy relevant documents to the ET so that the checking of works can be carried out. The document shall at least include the updated work progress reports, the updated works programme, the application letters for different licenses/ permits under the environmental protection laws, and all the valid licenses/ permits. The site diary shall also be available for the ET inspection upon request.

After reviewing the document, the ET will advise the ER and the Contractor of any non-compliance with legislative requirements on environmental protection and pollution control for them to take follow-up actions. If the ET's review concludes that the current status on license/ permit application and any environmental protection and pollution control preparation works may not cope with the works programme or may result in potential violation of environmental protection and pollution control requirements by the works in due course, the ET shall advise the Contractor and the ER accordingly.

Upon receipt of the advice, the Contractor shall undertake immediate action to remedy the situation. The ER shall follow up to ensure that appropriate action has been taken by the Contractor in order that the environmental protection and pollution control requirements are fulfilled.

8.3 Environmental Complaints

Complaints shall be referred to the ET Leader for carrying out complaint investigation procedures. The ET will undertake the following procedures upon receipt of complaint:

a) log complaint and date of receipt onto the complaint database and inform the ER and IEC immediately;

b) investigate the complaint to determine its validity, and to assess whether the source of the problem is due to works activities;

c) if a complaint is valid and due to works, identify mitigation measures;

d) if mitigation measures are required, discuss the details with ER, Contractor and IEC for implementation;

e) review the Contractor's response on the identified mitigation measures, and the updated situation;

f) if the complaint is transferred from EPD, submit interim report to EPD on status of the complaint investigation and follow-up action within the time frame assigned by EPD;

g) undertake additional monitoring and audit to verify the situation if necessary, and review that any valid reason for complaint does not recur;

h) report the investigation results and the subsequent actions to the source of complaint for responding to complainant (if the source of complaint is EPD, the results shall be reported within the time frame assigned by EPD); and

i) record the complaint, investigation, the subsequent actions and the results in the monthly EM&A reports.

During the complaint investigation work, the Contractor and ER shall cooperate with the ET in providing all the necessary information and assistance for completion of the investigation. If mitigation measures are identified in the investigation, the Contractor shall promptly carry out the mitigation. The ER shall ensure that the measures have been carried out by the Contractor. A copy of tentative compliant log is shown in Annex C.

9 REPORTING

9.1 General

Computer-based monitoring and audit software EQPMS will be applied for data recording. The reporting is based upon a computer-based system and appropriate data will be published on the MTR Corporate website (www.mtr.com.hk).

9.2 Baseline Monitoring Report

The ET will prepare and submit a Baseline Monitoring Report including a complete photographic record of the works area to EPD 2 weeks prior to the commencement of construction of cable car and stream diversion works.

9.3 EM&A Reports

The results and findings of all EM&A works required in this Manual shall be recorded in the monthly EM&A reports prepared by the ET. The EM&A report shall be submitted within two weeks after the end of each reporting month, with the first report due in the month after construction commences. The ET will liaise with EPD regarding the format of the report prior to the first issue. The ET will review the number and location of monitoring stations and parameters to monitor on as needed basis in order to cater for the changes in surrounding environment and nature of works in progress.

The Monthly EM&A Report shall include the following:

(a) Executive Summary;

• Reporting month’s key issues • Breaches of A/L levels; • Complaints Log; • Reporting Changes; • Future key issues.

(b) Basic Project Information, including

Works undertaken during the month and coming month;

(c) Implementation Status

Advice on the compliance with the Environmental Permit Conditions, and the implementation status of environmental protection and pollution control/ mitigation measures, as recommended in the EIA and the Project Profile, summarised in the updated implementation schedule (in Annex A);

(d) Monitoring Results

To provide monitoring results together with the following information:

• Drawing showing the project area, any environmental sensitive receivers and the

• the major activities being carried out on site during the period; • weather conditions during the period; and • any other factors which might affect the monitoring results

g) A summary of non-compliance (exceedances) of the environmental quality performance

limits (A/L Levels); h) A review of the reasons for and the implications of non-compliance including review of

pollution sources and working procedures as appropriate; i) A description of the actions taken in the event of non-compliance; j) A summary record of all complaints received, liaison and consultation undertaken,

action and follow-up procedures taken; k) A summary record of notifications of summons and successful prosecutions for

breaches of the current environmental protection/ pollution control legislations including locations and nature of the breaches, investigation, follow-up actions taken and results;

l) A review of the effectiveness and efficiency of the mitigation measures; and m) A review of success of the EM&A programme to cost effectively identify deterioration

and to initiate prompt effective mitigation action when necessary.

9.4 Data Keeping

The site document such as the monitoring field records, site inspection forms, etc. will not be included in the monthly EM&A reports for submission. The document will be well kept by the ET and be ready for inspection upon request. All relevant information will be clearly and systematically recorded in the document. The monitoring data will also be recorded in EQPMS. All the electronic documents and data will be kept for at least one year after completion of the construction contract.

9.5 Interim Notifications of Environmental Quality Limit Exceedances

With reference to Event/Action Plans in Tables 2.3 and 3.3, when the environmental quality limits are exceeded, the ET shall immediately notify the ER, IEC and EPD, as appropriate. The notification shall be followed up with advice to EPD on the results of the investigation, proposed action and success of the action taken, with any necessary follow-up proposals. A sample template for the interim notifications is shown in Annex D.

Practice Note for Professional Persons with regard to site drainage (ProPECC PN 1/94)

All waste water generated on the site shall be collected, removed from site via a suitable

and properly designed temporary drainage system and disposed of at a location and in a manner that will cause neither pollution nor nuisance.

• The Contractor should construct, maintain, remove and reinstate, as necessary,

temporary drainage works and take all other precautions necessary for the avoidance of damage by flooding and silt washed down from the works. The Contractor should also provide adequate precautions to ensure that no spoil or debris of any kind is allowed to be pushed, washed down, fall or be deposited on land or on the seabed adjacent to the site.

• The Contractor should not permit any sewage, waste water or other effluent

containing sand, cement, silt or any other suspended or dissolved material to flow from the site onto any adjoining land or allow any solid waste to be deposited anywhere within the site or onto any adjoining land and shall have all such materials removed from the site.

• The Contractor should be responsible for temporary drainage, diverting or

conducting of open streams or drains intercepted by any works and for reinstating these do their original courses on completion of the works.

Any proposed temporary diversions to stream courses or nullahs shall be submitted to the

Engineer for agreement one month prior to such diversion works being commenced. Diversions shall be constructed to allow the water flow to discharge without overflow, erosion or washout. The area through which the temporary diversion runs is to be reinstated to its original condition when the temporary diversions is no longer required.

S.5.6.3 • The Contractor shall not discharge directly or indirectly (by runoff) or cause or

S.5.6.3 To reduce water quality impacts from construction sites WQOs • Reduce the amount of water used to dampen any surfaces or stockpiles • Prevent uncontrolled runoff from site by provision of perimeter drains at the

seaward extremity of the sites in Tung Chung

• Any liquid generated on-site should be treated and disposed of in accordance with

the provisions of the Technical Memorandum (TM) on Standards for Effluents Discharged into Drainage, Sewerage, Inland and Coastal Waters. Chemical or mulching toilets for tankering away the effluent or composting should be provided where there is no provision for making connection to the sewerage system.

• Temporary drains with silt/grease traps shall be constructed at the boundary of the site prior to the commencement of any earthworks. • Facilities for washing the wheels of vehicles before leaving the site shall be

• Any construction plant which causes pollution to catchwaters or catchment due to

leakage of oil or fuel shall be removed off site immediately.

S.5.6.3 • Any soil contaminated with fuel leaked from plant shall be removed off site and

the voids arising from removal of contaminated soil shall be replaced by suitable material to the approval of the Director of Water Supplies.

• Provision of temporary toilet facilities shall be subject to the approval of the

Director of Water Supplies. All waste shall be cleared away daily and disposed of outside WGG. The toilet facilities shall not be less than 30 m from any watercourse.

• All mud and debris shall be removed from any Waterworks access roads and

associated drainage systems.

• Any chemicals to be used including fertilizers, disinfectants and deodorants within

the WGG shall be subject to the approval of the Director of Water Supplies.

Species used for planting should be undertaken in consultation with AFCD and take

reference from the species identified in the Tree Survey and be native to Hong Kong or South China region (if possible).

Reconstruct and revegetate the stream at Ngong Ping (refer to Figure 5.3), taking account

of improved water quality in future. The restitution of the stream should take into consideration the potential presence (downstream) of protected and rare amphibian species.

Riparian vegetation should also be planted and maintained. Consultation with relevant community groups and relevant government departments

would ensure that the stream restitution is effective.

Water should not be soured from any watercourses on site. However the clearing of riparian vegetation should be avoided where possible along the

Emergency Rescue Trail.

Protected and rare flora species including orchids and Camellia species will be maintained and fenced off from construction work to prevent any accidental damage. If any impacts are evident on rare or protected species the affected flora species shall be transplanted to similar environment as the original habitat (i.e. in the same habitat type in the local vicinity). All the individuals of the species should be relocated. It is recommended that seeds of the target species be collected to preserve the genetic resource and allow more source plant to transplant in case of the failure of transplantation. The seeds should be collected and preserved or germinated appropriately by qualified botanist.

S.7.8 Vegetation (that is considered to harbour sensitive habitat or of biological significance

should be clearly marked by a qualified person for protection (to prevent accidental damage during construction), this person should be present during tree clearing.

During construction a suitably trained person shall be present to relocate any terrestrial

fauna located in the construction area (including those that are rare or protected). If any additional species listed as rare or protected are confirmed present, additional field surveys specific for the listed species should be conducted before the resumption of construction.

Noise resulting from the preparation for construction shall remove most faunal presence

from the vicinity until construction has ceased, however it is recommended that a tap/ knock of trees prior to clearing should be undertaken to reduce the chance of faunal injury. If any fauna species that are injured during construction the species should be promptly treated by the nearest fauna carer or vet.

Where topsoil and vegetation is stripped during construction, wherever possible, topsoil

and vegetative matter will be stockpiled. Stockpiled material will be stabilised to prevent sediment generation and re-spread as part of landscaping and rehabilitation of disturbed areas following construction. Exposed soil shall be covered or the run-off diverted away from stream habitats if possibly. Temporary silt traps or sedimentation pools should be considered.

Cleared vegetation to be ‘chipped’ (where appropriate) and stored for use as mulch during site landscaping works and/or in surrounded vegetated areas susceptible to erosion.

Some of the locations are located in areas with vegetation. The contractor is not allowed

to fell any trees or form any open access roads in any area or remove any vegetation without approval from the Engineer.

Construction Site Access Only one pathway no wider than 1.5m shall be established to reach all of the tower

locations within the Country Park (prior approval from Country and Marine Parks Authority is required). No additional paths shall be made.

S.7.8 Flags shall be placed indicating the lateral extent of the pathway. Flags shall be placed

accordingly so those workers can easily distinguish the next set of pathway flags. A different set of coloured flags shall be used to define the work site at the tower locations. Workers shall not move any flags and shall notify the engineer if any maintenance is needed on the pathway or to the flags themselves.

Access to work sites to be restricted and signed to prohibit unauthorised entry and the

construction area should be fenced. This will minimise disturbance to vegetation, including unauthorised clearing. There shall be no work outside of the designated sites.

Restrict the passage of machinery outside the designated construction areas and a

minimum number of machinery parking areas should be used and clearly designated.

Workers shall not disturb birds and other animals. Animals shall not be fed and no food

shall be left for any animals and no pets of any type shall be allowed on any site.

Prior to works commencing on site, a complete photographic record shall be obtained of the site, its surroundings, any watercourses and any dams or pipes constructed by others.

A photographic survey shall also be made of the site upon completion of all works.

Following review of the photographic record, additional measures may be needed to make the site look natural.

Reinstate temporary work sites/disturbed areas to its original condition immediately after

completion of construction.

Workers shall not leave any litter on site. Litter shall not be burned on site but shall be

removed off site. All surplus construction materials brought onto site shall be removed from site and daily clearance of general litter shall be undertaken. Particular care shall be taken with bottles, wire, polystyrene lunch boxes, plastic wrapping, cans and non-degradable materials. Waste from portable toilets will be taken off-site.

Watercourses shall not be polluted with soaps, detergents or excretion. S.7.8 Prevention of Hill Fires MTRC’s Contractor shall propose a Fire Prevention Strategy in the Method Statement to

the approval of the Engineer for all works within the Country Park. The strategy will be developed prior to operation in conjunction with relevant Government authorities. This strategy will aim to protect sensitive plant communities within the site and it will also consider the needs of significant fauna species.

The Fire Prevention Strategy will include measures to prevent hill fires including no

smoking; cooking or use of open fires on any site; no cigarette lighters or matches shall be carried onto the site in connection with the Tung Chung Cable Car Project. Welding or hot work is also not permitted and temporary fire fighting equipment shall be provided in all work areas.

Air Pollution Damaging Flora and Fauna There shall be regular cleaning and frequent watering of the construction sites during dry

periods to avoid dust (as determined by the engineer), but attention should be paid to prevent washing waste materials off site. No vehicles shall be allowed on site without written permission from the Country and Marine Parks Authority.

Storage and Handling of Potential Pollutants No fuel or oil shall be stored within the Country Park and no pesticides or herbicides will

be used within the Country Park.

Watercourses within and adjacent to the working areas shall be treated with extreme

care. They shall not be used as repositories for waste materials. Extreme care shall be exercised during the transportation, handling and storage of potential pollutants and in the operation of mechanised equipment to avoid spillage.

MTRC’s contractor shall propose an Emergency Spillage Plan in the Method Statement

to the approval of the Engineer for all works within the Country Park.

The contractor shall provide for all necessary materials on site for emergency spill

measures and shall be trained in emergency spill response.

Details of drilling fluid additives confirming that they will not contaminate the water

gathering grounds shall be deposited.

S.8.8 Tree transplanting: Prior to construction work the detailed tree survey will have been completed. Any trees identified as affected by the works will be first considered for transplanting to nearby suitable sites. Felling will only be considered as a last resort. The feasibility of transplanting will depend on a number of factors such as size, health and species of the tree as well as the condition of the local terrain. Adequate time (a minimum of 4 months) should be allowed for preparing trees for transplanting.

Tree protection: Trees to be retained within or adjacent to works areas will be carefully

protected by strong hoarding and if necessary additional protection to individual tree trunks to avoid damage by machinery. The hoarding will also prevent contractors compacting soil around tree roots or dumping materials.

Topsoil conservation: The topsoil layer on the steep hillsides where most of the towers

are located is very thin and fragile. Any excavation must carefully save and store the topsoil to one side of the works area for reuse upon completion. Re-establishing grass and shrubs below and around the towers is a vital part of the landscape and visual mitigation works upon completion to minimise visual scars or soil erosion.

Replanting: The existing species mix colonising the proposed worksites has been

recorded and it is proposed that a complementary mix of indigenous species is specified for replanting at similar densities. It is important that the species selected for replanting is hardy and commercially available.

Footpaths: The proposed rescue trails will require cutting of a fresh track across the

hillside and installation of a stable hard surface for emergency access. It is recommended that wherever possible this is constructed using natural stone materials similar to the typical country park trails. Excavated material from tower footings should not be discarded on the hillside but instead reused to construct the rescue trails as well as upgrade existing nearby walking trails.

Structures: The following landscape design guidelines are proposed to minimise the

potential visual impact of the terminals and towers.

Tung Chung Terminal: This structure will be visually prominent in the centre of the

new town and will be of a modern hi-tech appearance in keeping with the character of the adjacent urban development and image of the international airport. Formal planting to the entrances and perimeter of the site will enhance the crisp and sweeping lines of the architecture. It is not the intention to screen the building. Instead it should be displayed in an interesting and complementary manner.

S.8.8 Ngong Ping Terminal: This structure will not be so visually prominent. It is more

appropriate that the existing buildings of the Po Lin Monastery, the Buddha Statue and surrounding temples should continue to express the landscape and visual character of the Ngong Ping settlement. The site for the terminal is relatively low-lying, situated behind a belt of mature trees and offset from the key visual axis of the Monastery and Buddha. Thus the site topography and vegetation will generally screen the new building from most views within the heart of Ngong Ping. However, it is important to consider the key view from the elevated position of the Buddha statue from where the terminal will be visible to the west. Therefore, the terminal should blend as much as possible with the character of the surrounding settlement by adopting a similar overall density, mass, form and colour scheme.

Towers: The towers are a lattice steel frame design generally similar in appearance to

the high voltage electricity towers used by CLP or HEC. There is no means of screening the towers and the best landscape mitigation is to ensure the existing ground profile and vegetation is reinstated below and around them upon completion. The proposed scheme also minimises the number of towers, greatly reducing the potential visual impact.

Angle Stations: The angle stations are more visually intrusive than the individual towers and comprise a short tunnel-like structure. Using a glazing material for the canopy would make the structure more transparent and less visually intrusive. However, there are arguments that this may result in greater bird strike. In this case, it is preferable to safeguard wildlife as far as possible and adopt a more solid material finished in a recessive colour scheme. To reduce the visual impact a special design treatment is recommended. To help blend in the Nei Lak Shan Angle Station into the natural surroundings a “chameleon” colour treatment is proposed, that is, the structure will incorporate interchangeable roof panels using tones of green and ochre to match the summer and winter changes in surrounding vegetation colour.

Night Lighting of Gondolas: At first this would appear to be a potential visual impact.

However, in the urban area of Tung Chung the background light of the airport and new town, depending on the viewpoint, would render the small scale lighting of gondolas relatively insignificant. Similarly, at Ngong Ping the short section of cable car visible is relatively remote and well screened from the village houses. In the context of the Ngong Ping plateau the regular spots of light from the distant gondolas would be generally similar to the pattern of street lighting in nearby roads. Where the lighting would be most incongruous is in the remote mid-section. Fortunately, there are very few VSRs in this location and the visual impacts are not expected to be significant.

The recommended mitigation measures to reduce air quality impacts relating to the handling of materials during construction are: • the height from which materials are dropped should be controlled to a minimum

practical height to limit fugitive dust generation from unloading; • any stockpiles of aggregate or spoil should be covered and water applied as

determined by the Environmental Team Leader; • water spray should be used during the handling of excavated material where dust is

likely to be created; and • limit number of operating plant to the minimum necessary to undertake the works. The recommended mitigation measures to reduce air quality impacts relating to vehicle movements on unpaved site roads during construction are: • every vehicle should be washed to remove any dusty materials from its body and

wheels before leaving a construction site; • the load on the vehicles should be covered entirely by clean impervious sheeting to

ensure that the dusty materials do not leak from the vehicle; and • vehicle speeds limited to 20 kph to reduce the traffic induced dust dispersion and re-

suspension within the site The recommended mitigation measures to reduce air quality impact relating to earthworks during construction are: • the amount of exposed soil should be kept in minimal by re-vegetation of completed

earthworks.

5.2.1 Recommended Noise Mitigation Measures during Construction

Good site practice and noise management can significantly reduce the impact of construction site activities on nearby SRs. The following package of measures should be followed during of construction: • only well-maintained plant should be operated on-site and plant should be serviced

regularly during the construction works; • machines and plant that may be in intermittent use should be shut down between

work periods or should be throttled down to a minimum; • plant known to emit noise strongly in one direction, should, where possible, be

orientated to direct noise away from the SRs; • mobile plant should be sited as far away from SRs as possible; and • material stockpiles and other structures should be effectively utilised, where

practicable, to screen noise from on-site construction activities. Movable barriers, which may be made off-site, can be very effective in screening noise from particular items of plant when constructing the stream diversion work. Along the proposed stream alignment from chainage 50 - 150 and at a section perpendicular to the stream at chainage 0, it is recommended that a 3m high noise barrier with a materials’ sound reduction index of at least 20 dB(A) (e.g. 20mm Marine Plywood) is erected. The proposed noise barriers shall be installed as close to the noise generating component of a PME (say 2m between PME and Barrier). According to Figure D.3 of BS 5228 Part I: 1997, the proposed noise barriers can reduce noise levels by at least 10 dB(A).

5.3.2 Control/Mitigation Measures Storage, Collection and Transport of Waste Permitted waste hauliers shall be used to collect and transport wastes to the disposal points. The following measures to minimise adverse impacts shall be instigated: • Handle and store wastes in a manner which ensures that they are held securely

without loss or leakage, thereby minimising the potential for pollution; • Use waste hauliers authorised or licensed to collect specific category of waste; • Remove wastes in a timely manner; • Maintain and clean waste storage areas regularly; • Minimise windblown litter and dust during transportation by either covering trucks

or transporting wastes in enclosed containers; • Obtain the necessary waste disposal permits from the appropriate authorities, if they

are required; • Dispose of waste at licensed waste disposal facilities; and • Maintain records of the quantities of waste generated, recycled and disposed.

Construction and Demolition (C & D) Material • The Contractor shall recycle C&D material on-site. Proper segregation of wastes on

site will increase the feasibility of certain components of the waste stream by the recycling contractors.

• The use of wooden hoardings shall not be allowed except where noise barriers are needed, and then these shall be of 20mm thick wood/ply. Elsewhere alternative materials, which can be reused or recycled, for example, metal (aluminium, alloy etc) shall be used.

• Different areas of the worksite shall be designated for such segregation and storage wherever site conditions permit.

• Trip-ticket system should be established to monitor the disposal of C&D material and solid wastes at public filling facilities and landfills, and to control fly-tipping.

Chemical Waste Containers used for the storage of chemical wastes shall: • be suitable for the substance they are holding, resistant to corrosion, maintained in a

good condition, and securely closed; • have a capacity of less than 450 litres unless the specifications have been approved

by the EPD; and • display a label in English and Chinese in accordance with instructions prescribed in

Schedule 2 of the Regulations.

The storage area for chemical wastes shall: • be clearly labelled and used solely for the storage of chemical waste; • be enclosed on at least 3 sides; • have an impermeable floor and bunding, of capacity to accommodate 110% of the

volume of the largest container or 20% by volume of the chemical waste stored in that area, whichever is the greatest;

• have adequate ventilation; • be covered to prevent rainfall entering (water collected within the bund must be

tested and disposed as chemical waste if necessary); and • be arranged so that incompatible materials are adequately separated.

Disposal of chemical waste shall: • register as chemical waste producer; • be via a licensed waste collector; and • be to a facility licensed to receive chemical waste, such as the Chemical Waste

Treatment Facility which also offers a chemical waste collection service and can supply the necessary storage containers; or

• be a reuser of the waste, under approval from the EPD.

General Refuse • General refuse shall be stored in enclosed bins or compaction units separate from

C&D and chemical wastes. Waste collector shall be employed by the contractor to remove general refuse from the site, separately from C&D and chemical wastes, on a daily or every second day basis to minimise odour, pest and litter impacts. Burning of refuse on construction sites is prohibited by law.

• A co-ordinator for the management of waste should be identified who shall prepare a Waste Management Plan.

Design Considerations The diversion and restitution of the Ngong Ping Stream aims to enhance its potential ecological value, through improvements to the banks (soft engineering) is seen as a long-term benefit to the area and the downstream stream habitats. The detailed design of stream enhancement works in this small section will utilise a number of channel designs features and will focus on a soft engineering. The proposed indicative design of the stream diversion is illustrated in Figure 1.3.

General Mitigation Measures All wastewater generated on the Study site shall be collected, removed from site via a suitable and properly designed temporary drainage system and disposed of at a location and in a manner that will cause neither pollution nor nuisance. The Contractor should construct, maintain, remove and reinstate, as necessary, temporary drainage works and take all other precautions necessary for the avoidance of damage by flooding and silt washed down from the works. He shall also provide adequate precautions to ensure that no spoil or debris of any kind is allowed to be pushed, washed down, fall or be deposited. The Contractor shall not permit any sewage, wastewater or other effluent containing sand, cement, silt or any other suspended or dissolved material to flow from the site onto any adjoining land or allow any solid waste to be deposited anywhere within the Site or onto any adjoining land and shall have all such materials removed from the site. The Contractor shall be responsible for temporary drainage, diverting or conducting of open streams or drains intercepted by any works and for reinstating these to their original courses on completion of the works.

The Contractor shall at all times ensure that all existing stream courses and drains within, and adjacent to the Site are kept safe and free from any debris and any excavated materials arising from the Works. The Contractor shall ensure that chemicals and concrete agitator washings are not deposited in watercourses. All Contractor’s Equipment shall be designed and maintained to minimise the risk of silt and other contaminants being released into the water column or deposited in other than designated locations. To reduce water quality impacts from construction sites the Contractor will endeavour to: • reduce the amount of water used to dampen any surfaces or stockpiles; • any liquid generated on-site should be treated and disposed of in accordance with

the provisions of the Technical Memorandum (TM) on Standards for Effluents Discharged into Drainage, Sewerage, Inland and Coastal Waters and shall be acceptable to (MTR/DSD/WSD/EPD);

• all domestic effluent arising from the construction work force, any work camps, or canteen facilities should also be collected, treated and disposed of according to the provisions of the TM; and

• any special works areas which may be provided for material storage or mixing, should be surrounded by bunds and have drainage collection systems to contain any spillages.

Water Gathering Ground The following are conditions for working within Water Gathering Grounds as specified by Water Supplies Department. They will apply, through the permit process, in totality to the Cable Car project including the stream diversion works. For all works within Water Gathering Ground (WGG), the Contractor will be required to comply with the following conditions: (a) All practical measures shall be taken to ensure that no pollution or siltation occurs

to the catchment.

(b) No earth, building materials, fuel, soil or toxic materials or any other materials which may cause contamination to the WGG are allowed to be stockpiled on site.

(c) No storage and discharge of flammable or toxic solvents, petroleum oil or tar and

other toxic substances shall be allowed within the WGG.

(d) Any spoil shall be reused wherever practical, in-situ and where unavoidable surplus material shall be removed from the WGGs as soon as practicable.

(e) Temporary drains with silt/grease traps shall be constructed at the boundary of the

site prior to the commencement of any earthworks. The effluent from the drain shall comply with the standards of Group A Inland Waters as stipulated in the Technical Memorandum prepared by EPD on “Standards for Effluents Discharged into Drainage and Sewerage Systems, Inland and Coastal Waters”. This will specifically apply at the Ngong Ping Terminal.

(f) Regular cleaning of the silt/grease traps shall be carried out to ensure that they

function properly at all times.

(g) All excavated or filled surfaces which have the risk of erosion shall always be protected from erosion.

(h) Facilities for washing the wheels of vehicles before leaving the site shall be

provided.

(i) Any construction plant which causes pollution to catchwaters or catchment due to leakage of oil or fuel shall be removed off site immediately.

(j) Any soil contaminated with fuel leaked from plant shall be removed off site and the

voids arising from removal of contaminated soil shall be replaced by suitable material to the approval of the Director of Water Supplies.

(k) Provision of temporary toilet facilities shall be subject to the approval of the

Director of Water Supplies. All waste shall be cleared away daily and disposed of outside WGG. The toilet facilities shall not be less than 30 m from any watercourse.

(l) All mud and debris shall be removed from any Waterworks access roads and

associated drainage systems.

(m) Any chemicals to be used including fertilizers, disinfectants and deodorants within the WGG shall be subject to the approval of the Director of Water Supplies.

(n) For drainage and sewerage diversions within or affecting WGG, the agreement of

the Director of Water Supplies is also required.

(o) Use of pesticides is not allowed within WGG, use of fertilizers within WGG subject to WSD’s approval.

Emergency Responses to Spillages Emergency plans and clean up procedures will need to provided by the Contractor recognising his specific working methods and construction programme, activities and sequences. Agreement must be sought prior to commencement of the construction work but the following principles should be considered. The emergency plans should include the procedures for: • spill prevention and precaution; • response actions; and • spill clean up and disposal. Spill prevention and precaution embraces good site practice and covers: • good housekeeping practices; • chemical storage requirements; and • chemical transfer and transport. Detailed response actions should be clearly stated in the emergency plans and training to implement the responses should be provided to all staff. Emergency response plans should cover both construction and operational phases. Emergency response plans will contain procedures, telephone numbers and actions/responses to “prevent an accident becoming an emergency”. The Emergency Response Plan and clean up procedure outlined the Tung Chung Cable Car EIA shall be adopted. Detailed emergency plans and clean up procedures shall be agreed between MTR/EPD/WSD before the commencement of the construction work. It is proposed that the following measures be implemented: • the stream diversion to be constructed and completed prior to connection of up-

stream water supply to reduce construction (in particular sedimentation) impacts; • best practice construction methods and measures outlined in the Project Profile

should be implemented; and • ecologically friendly design should be undertaken. The operational water quality of the stream course in Ngong Ping will be greatly improved with the completion of the planned Ngong Ping Sewage Treatment plant and sewerage works. •

• Revegetate areas of temporary vegetation loss.

• Reconstruct and revegetate the stream at Ngong Ping (refer to Section 5.5.3), taking account of improved water quality in future. The restitution of the stream should take into consideration the potential presence (downstream) of protected and rare amphibian species.

• A Fauna Relocation Plan (Appendix H) is proposed to avoid and mitigate

impacts caused by habitat and vegetation loss.

• Water for construction purposes should not be sourced from the Ngong Ping Stream (or any natural watercourses).

• During construction, a suitably trained person shall be present to relocate

any terrestrial fauna located in the construction area (including those that are rare or protected). If any additional species listed as rare or protected are confirmed present, additional field surveys specific for the listed species should be conducted before the resumption of construction.

• Noise resulting from the preparation for construction shall remove most

faunal presence from the vicinity until construction has ceased, however it is recommended that a tap/ knock of trees prior to clearing should be undertaken to reduce the chance of faunal injury. If any fauna species are injured during construction, the species should be promptly treated by the nearest fauna carer or vet.

• Where topsoil and vegetation is stripped during construction, wherever

possible, topsoil and vegetative matter will be stockpiled. Stockpiled material will be stabilised to prevent sediment generation and re-spread as part of landscaping and rehabilitation of disturbed areas following construction. Exposed soil shall be covered or the run-off diverted away from stream habitats if possible. Temporary silt traps or sedimentation pools should be considered.

• Cleared vegetation to be ‘chipped’ (where appropriate) and stored for use

as mulch during site landscaping works and/or in surrounded vegetated areas susceptible to erosion.

Mitigation measures should be undertaken to reduce impacts. The following section

provides a summary of the mitigation measures proposed to be implemented to minimise potential environmental impacts resulting from stream diversion works. Tree Transplanting Any trees identified as affected by the works will be first considered for transplanting to nearby suitable sites. Felling will only be considered as a last resort. The feasibility of transplanting will depend on a number of factors such as size, health and species of the tree as well as the condition of the local terrain. Adequate time (a minimum of 4 months) should be allowed for preparing trees for transplanting. Tree Protection Trees to be retained within or adjacent to works areas will be carefully protected by strong hoarding and if necessary additional protection to individual tree trunks to avoid damage by machinery. The hoarding will also prevent contractors compacting soil around tree roots or dumping materials. Topsoil Conservation The topsoil layer removed during construction of the stream course should be saved and carefully stored to one side of the works area for reuse upon completion to help backfill gabion mattresses and embankments.

Replanting The existing species mix colonising the existing stream banks have been recorded. Together with tree planting to the footpath to be formed alongside the new stream it is proposed that a complementary mix of indigenous shrub and herb species is specified for reinstating the embankments and colonising the gabion mattresses. In association with the proposed planting for the Cable Car Terminal and Theme Village in general it is intended to enrich the flora species diversity for the new stream. Species for compensatory planting works is provided in Appendix G which will be of value for birds, butterflies and bats. It is noted that native trees typically have a higher ecological value as food and shelter for animals, and will be preferred to exotic species when finalising the plant species mix.

Recommended Mitigation Measures during Construction / Operation Since the two shrines directly impacted shall be relocated or rebuilt no mitigation measures shall be required. However discussion shall be undertaken with the shrine owners and concerned parties and agreement reached on the location and method of relocation or reconstruction of the shrines. At shrine three the mitigation shall comprise monitoring of the condition of the shrine and making good any damage.

E.1 Introduction

Noise measurements shall be carried out by the ET during the operational phase of the temporary helipad to ensure that the helicopter noise level in terms of Lmax and Leq(30mins) complies with the TM-EIAO criterion of 85 dB(A) and 75 dB(A) respectively.

E.2 Monitoring Location

The noise monitoring location shall be at the nearest noise sensitive receiver, NSR1A – the S.G. Davis Hostel. See Figure E.1 below.

The status and locations of noise sensitive receivers may still change after issuing this manual. If such cases exist, the ET Leader shall propose updated monitoring locations and seek agreement from EPD.

When alternative monitoring locations are proposed, the monitoring locations shall be chosen based on the following criteria:

a) at locations close to the major site activities which are likely to have noise impacts;

b) close to the noise sensitive receivers (N.B. for the purposes of this section, any domestic premises, hotel, hostel, temporary housing accommodation, hospital, medical clinic, educational institution, place of public worship, library, court of law, performing art centre shall be considered as a noise sensitive receiver); and

c) for monitoring locations located in the vicinity of the sensitive receivers, care shall be taken to cause minimal disturbance to the occupants during monitoring.

The monitoring station shall normally be at a point 1m from the exterior of the sensitive receivers building facade and be at a position 1.2m above the ground. If there is a problem with access to the normal monitoring position, an alternative position may be chosen.

E.3 Monitoring Equipment

As referred to in the TM-NCO, sound level metres in compliance with the International Electrotechnical Commission Publications 651: 1979 (Type 1) and 804: 1985 (Type 1) specifications shall be used for carrying out the noise monitoring. The calibration of the sound level meters and their respective calibrators shall be carried out in accordance with the manufacturer’s requirements.

Noise measurements shall not be made in the presence of fog, rain, wind with a steady speed exceeding 5 ms-1 or wind with gusts exceeding 10 ms-1.

The ET Leader is responsible for the provision and maintenance of the monitoring equipment. He shall ensure that sufficient noise measuring equipment and associated instrumentation are available for carrying out the regular and ad-hoc monitoring.

E.4 Monitoring Parameters and Frequency

The helicopter noise level shall be measured in terms of Lmax and Leq(30mins) in dB(A). Both Lmax and Leq(30mins) shall be used as the monitoring parameter between 0700 to 1900 hours.

The helicopter type and operating mode shall be recorded if possible (the helipad is screened by surrounding topography and trees and cannot be viewed from the NSR1A) along with each Lmax measurement.

Noise measurement shall be carried out at the designated monitoring station on weekly basis. The monitoring frequency shall depend on the scale of the helicopter operations.

In case of non-compliance, more frequent monitoring as specified in the Action Plan in Section E.5 shall be carried out. This additional monitoring shall be continued until the recorded noise levels are rectified or proved to be irrelevant to the helicopter operations.

E.5 Event and Action Plan for Noise

The A/L Levels for helicopter noise are defined in Table E.1. Should non-compliance of the criteria occur, action in accordance with the Action Plan in Table 3.3 (of Section 3.7) shall be carried out.
