The facts however warranted dismissal of the case so far as tuning and Elkin were concerned fore the trial, so that only two ;re placed on trial Ed and George Mullins, the warrants against 'the other boys having bee" dismissed. The facts brought out at the examining trial are in brief as follows: . Ed Mullins, who according to bis own statements on the witness stand, was druok on that nigUt, and when be found them standing there at the depot, began striking the boys, which so frightened them that they ran off across the yards toward the toil or tool house.
