It may be recalled that conse~uent upon disqualification of Shri Laloo Prasad as MP (LS), Bungalow No. ~~, Tughlak Road (Type-VIII), New Delhi was cancelled in his name w.e.f. 01l~1.2013 and due to non~vacation of the bungalow, the case was alsoref~Q~~d to litigation Divsiion to initiate evicti0lJ.1 proceedings vide letter dated 19.1 'f.2013. Now, Shri Laloo Prasad in his letter dated 'NIL' addressed to DE has stated that he'is staying in Bungalow No. 25, Tughlak Road allotted by the Directorate of E~t.ates to him in his capacity as M.P. and Minister of Railways. However, dU,' to disqualification as MP, this allotment has been cancelled. .
2. In this context, he has further stated th$)t due to diabetes and cardio problem he is under treatment at AIIMS, New belhi. His son and daughter is also residing with him. His 'daughter is also u~der treatment and his granddaughter is also studying in the Sanskriti School.
3. Therefore, he has requested to allow Ilim to stay in the above Bungalow for a period of one year more. In this context. it may, however, be submitted that as per existing policy. there is no provision for retention of t~je bungalow beyond the permiSSible period.

I am enclosing a copy of a letter of 13 December, 2013 from Dr. Buta Singh, former Union Home Minister regarding his residential accommodation.
Dr. Buta Singh continues to enjoy Z+ security cover. He and his family members face very severe threats from various terrorist groups, especially from terrorists in Punjab due to action taken by him in the past on behalf of the Union
. of India. In his letter, Dr. Singh has requested that the increased market rent may be revised to the earlier amount under special leave and license fee as he is a Z+ category protectee. .
I request you to have the matter reconsidered in .the light of the facts mentioned in the enclosed letter.

I am writing to you regarding Bungalow No. 11A,Teen Murti Marg, Which was allotted tome on Security considerations on payment of special leave & license fee as I have been provided 'Z' + security cover.
Now the Directorate of Estates, Ministry of Urban Development has increased .....market rent from January 2013 onwards to Rs. 1,06,6031· PCM against Rs. 58,5001· as market rent due to non-reversion of my house--'~iiiotmEmt to special leave and license arrangement.
As you must be are aware that I am getting a ,Pension Rs. 60,000/- per month as an Ex MP, and would therefore request you to kindly reverse my accommodation rent as per special consideration and make it to t~e original amount of Rs 58,500/- (as was done under the special leave and license for Z + category protectees)
I am sure you will cons'der my request favorably and instruct for revision of my accommodation rental to the previous amount as a Z+ category protectee under special leave and license fee.

& Office Accommodation to Kendriya Bhandar, wherein the f.\l ex Court has held that "Government has no power to waive the arrears, unl ss specifically conferred." I
The above case is not covered under the guidelines, a$ ~ ision of rental liability from market rate to special rate would be contrary to' tij, judgement of the Hon'ble Supreme Court as that would amount to waiver of licence fee prescribed for such allotment for which the Government is n' t empowered. Since, the proposed case is not in conformity with the polict stated by the Ministry of Urban Development,. this Ministry does not supportth proposa!."
2. In view of the negation of the CCA proposal by the Mi)S ry of Finance, this Ministry shall be required to place counter comments in the raft CCA Note which have been attempted as .follows:
" The reasons for partial review of the decision of the Ca .' i et Committee on Accommodation (CCA) for revision of . rental liability tn respect, of accommodation occupied by Dr. Buta Singh, former Union~ Minister have already been mentioned in para-2 above. It is further ciarified in~:this regard that .. had his case been covered within the provisions of the existi, g policy, there would not have been any need to place this matter befo' e the Cabinet Committee on Accommodation (CCA)." Policy-I Section 'of this Directorate has forw~d minutes of the CCA meeting held on 26.02.2014, received from Cabinet Secretariat. CCA in this meeting ha~onsidered the Note dated 14.02.2014 of this Ministry vide Case No. 68/CCAl2014. The Committee was apprised that in accordance with the earlier decision of the Committee to charge market rent from Shri Buta Singh, certain amounts' would have already accrued and the decision to charge the' licence fee at special rate now might amount to waiver of the amount and might be in contravention of the decision of the Supreme Court in Shiv Sagar Tiwari Vs Union of India. ' '
2. The Committee, after taking into account the fact that regularisation of allotment of accommodation was proposed to be allo\v19d on security grounds as a special dispensation and also keeping in vie~ the pas~ prec~dents,
~ decided that the licence fee be regulated as proposed in para~(aph 5 of the I Note regarding partial review of the earlier decision ,of the CCA taken in its /< meeting held on 04-01-2013 (Case No.17/1/2013) for revision of rental liability ,
of Dr. Buta Singh for the period from 25-06-2010 to 24-06-2014 from market rate of licence fee to special rate of licence fee, as amended from time to time.
3. In view of above decision of the CCA, if approved, we may now implement the decision of the CCA and accordingly convey it to the beneficiary and endorse copy thereof to all concerned, as per DFA.
