    AGREEMENT

    This Agreement is entered into and executed on this _____ day of ________, 20___

    BY AND BETWEEN

    [NAME OF THE INSTITUTE] through its Director/Principal having itsregistered/approved office at

    __________________________________________________________________ (which expression, unless it be repugnant to the context or meaning thereof, shall bedeemed to mean and include their executors, administrators and assigns),(hereinafter referred to as The Institute), party of the FIRST PART.

    AND

    [Name of the SKP] through its Director/Principal having its registered/approvedoffice at

    __________________________________________________________________ (which expression, unless it be repugnant to the context or meaning thereof, shall bedeemed to mean and include their executors, administrators and assigns),(hereinafter referred to as the Skill Knowledge Provider or SKP in short), party ofthe SECOND PART.

    WHEREAS The First Party has registered itself with the All India Council forTechnical Education (AICTE) and obtained approval thereof to participate as anInstitute under the National Vocational Education Qualification Framework(NVEQF).

    WHEREAS The Second Party has registered itself with the All India Council forTechnical Education (AICTE) and obtained approval thereof to participate as a SkillKnowledge Provider (SKP in short) under the National Vocational EducationQualification Framework (NVEQF).

    WHEREAS the Both parties have held discussion and agreed for collaboration for jointly offering and conducting Vocational Education Programmes under theeducation scheme of the NVEQF, whereby the Institute will impart and award creditsfor the Academic content of the curriculum and the SKP will impart and awardcredits fort the Vocational or Skill oriented training content of the curriculum to theregistered students.

    AND WHEREAS both parties have agreed to record the terms and conditions oftheir Institute-SKP relationship under the NVEQF scheme of AICTE through thisagreement, which is as follows:

    1. Scope :

    a) This agreement sets forth the terms and conditions of collaborationbetween the Institute and the SKP for imparting and awarding creditsfor the Academic content and Vocational or Skill oriented trainingcontent of the prescribed curriculum, respectively, for following

    Vocational Education Programs under the NVEQF of AICTE.

    b) The scope of the agreement covers Vocational Education Programs ofall Levels under the NVEQF in the following Sectors andspecializations

    2. Responsibilities of the Institute:

    2.1 The institute shall plan the Vocational Education Programs to be offered inthe Academic Year concerned and inform the SKP about the same at leasttwo months prior to the date of commencement of the program[s].

    2.2 The Institute shall announce and inform through its prospectus andinformation on its website, the Vocational Education Programs it plans tooffer in the academic year concerned for the information of the prospectivestudents and invite applications for admission from interested candidates

    at least two months prior to the date of commencement of the program[s].2.3 The Institute shall follow the admission norms of AICTE and the State

    Govt. concerned. The admission shall be made strictly on merits. TheInstitute will then upload the names and details of the selected students onthe AICTE web portal.

    2.4 The Institute will have the right to collect fees from the students, asprescribed by the respective State Government for each sector andspecislisations, towards:

    a) Registration, b) Course / Skill conduct and c) evaluation of theAcademic / Skill portion of each Level of the programme. A portion of the

    fees as agreed upon by the Institute and the SKP shall be turned over tothe SKP

    2.5 The Institute will send to the SKP the Level-wise, Sector-wise andspecialization wise lists of students registered for Vocational EducationProgram[s] in the Sectors mentioned under 1. b) above, at least 15 daysbefore the commencement of the programme.

    2.6 The Institute will conduct appropriate classes for the Academic content ofthe curriculum of the Vocational Education Program[s] so as to completethe Academic portion within one year.

    2.7 The Institute will conduct final examinations and evaluate the students forthe Academic portion of the programmes as per the rules and regulationsof the Technical Board or University as the case may be.

    2.8 After receiving a Statement of Credits for the Vocational / Skill portion ofthe students from the SKP, the Institute will send the combined Academicand Vocational / Skill portion credits of the students to the Technical Boardor University as the case may be.

    2.9 Wherever such provisions are made by the Technical Board or theUniversity, as the case may be, the Institute will award a Level Certificateto the student who has successfully completed both the Academic and theVocational / Skill portions of the particular Level.

    2.10 The Institute shall maintain a record of the registered students andcertificates issued and upload the same on the AICTE web portal.

    2.11 The Institute shall submit details of students registered, evaluationconducted and results to the Technical Board or the University, for theaward of Diploma or Degree as the case may be, and also upload thesame on the AICTE web portal.

    3. Responsibilities and Duties of the SKP:

    3.1 3.1 The SKP shall plan the Skill Modules as per the suggested curriculumof AICTE for the Vocational Education Program[s] being offered by theInstitute in the academic year and inform the Institute about the samewithin 15 days of receiving the plan of Vocational Education Programsbeing offered by the Institute.

    3.2 The SKP shall announce and inform through its prospectus andinformation on its website, the schedule of the Skill Modules it plans to

    offer in the academic year concerned for the information of the prospectivestudents and It shall accept the students as admitted by the Institute forSkill training.

    3.3 The SKP shall register students for the Skill Modules and upload theirnames and details on the AICTE web portal.

    3.4 The SKP will be entitled to the fees in terms of clause 2.4 only.

    3.5 The SKP will conduct appropriate training sessions for the Vocational/Skillportion of the Vocational Education Programs so as to complete theVocational/Skill portion within one year.

    3.6 The SKP will conduct final examinations and evaluate the students for theVocational / Skill portion of the programs as per the rules and regulationsof the Technical Board or University as the case may be, and awardappropriate Skill Credit Certificate to the students and send the details tothe Institute, whereby Institute will upload the information on the AICTEportal.

    3.7 The SKP shall maintain a record of the registered students andcertificates issued and upload the same on the AICTE web portal.

    3.8 The SKP shall submit the details of students registered, evaluationconducted and final results in respect of the students registered throughthe Institute in the form of a Statement of Credits to the concernedInstitute..

    4. General:

    4.1 Fees to be charged to students:

    a) The Level-wise fees to be charged by the Institute will be informed tothe student by the Institute before his/her registration for the program;

    b) The Institute will collect from the student and retain with itself theAcademic Portion Fees and the SKP will be given the Vocational/SkillPortion Fees by the Institute;

    c) The Institute will collect the total fees for the program from the studentsand will transfer the Vocational/Skill Portion Fees against the number ofstudents to be sent for training at least one month before the onset oftraining.Any delay in transferring the fees will entail interest @ 10%calculated on the basis of delay of number of days. After receiving the feesSKP will issue Registration cards to the students at least 7 days before theonset of training.

    4.2 No Confidentiality:

    There shall not be any confidentiality of any information disclosed to byboth parties to each other, either in operationalizing this agreement or forthe purposes of implementing this agreement. The information sought

    under Right to Information Act or otherwise by any student, shall bepromptly made available.

    4.3 Effective Date:

    This agreement is effective from the date signed by both the parties.

    4.4 Validity:

    This agreement is valid for an initial period of 5 years and may be renewedfor further periods of 5 years each with mutual consent of both the parties.However, in case the registration of either party with the AICTE issuspended or terminated, the instant agreement shall stand determinedand terminated.

    4.5 Termination:

    This agreement may be terminated by either party without assigningreasons thereof by giving the other a written notice of its intention toterminate the agreement minimum two months in advance of the intendeddate of termination. However, the responsibilities and duties of both partiesin respect of the common students already registered for any of theVocational Education Programs shall not end with the termination of theagreement, and these will remain valid in totality until completion ofevaluation of the already registered students and reporting of their resultsby both parties.

    Dispute Resolution:

    In the event of any dispute arising between the parties, the same shall be resolvedthrough the mediation of an arbitrator to be appointed by mutual consent.

    IN WITNESS WHEREOF, the parties hereto, each acting under due and properauthority, have executed this mutually binding Memorandum of Understanding as ofthe date first written above.
