    1. Defendant(s) NEIL J. GILLESPIE, henceforth in the first person, an indigent, disabled

    nonlawyer reluctantly appearing pro se for himself and his interests as S OLE TRUSTEE of T HE

    GILLESPIE FAMILY LIVING TRUST AGREEMENT DATED FEBRUARY 10, 1997 (Trust), files this

    Motion to Quash Service of Process pursuant to Fla. Stat. chapter 48, and moves to cancel a Case

    Management Conference Hearing (CMC) December 18, 2014, and states:

    2. The face of three (3) summons for the Defendants indicates that Plaintiff has attempted to

    perfect service of process under Fla. Stat. 48.031(1)(a), 48.031(5), and 48.22.

    3. It is well settled that a Plaintiff must strictly comply with the statutory requirements for

    service of process pursuant to Fla. Stat. 48.031(1)(a), 48.031(5), and 48.22, otherwise service

    of process is improper.

    4. Service of process must strictly comply with all relevant statutory provisions. Walker v.

    Fifth Third Mortgage Company, 2012 WL 5457220, No. 5D12-3187 (Fla. 5th Dist. Ct. App.

    2012) citing Shurman v. Atlantic Mortgage & Investment Corp . (Fla. 2001) (holding that

    "statutes governing service of process are to be strictly construed and enforced") see also Re-

    Employment Services, Ltd v. National Acquisitions Co., 969 So. 2d 467 (Fla. 5th Dist. Ct. App.

    2007) (holding that "courts require strict construction of, and compliance with, the provisions of

    statutes governing service of process").

    5. Plaintiff has failed to strictly comply with Fla. Stat. 48.031(5) therefore service of

    process in this instance on Defendant Neil J. Gillespie must be quashed.

    6. Pursuant to Fla. Stat. 48.031(5), a person serving process shall place, on the copy

    served, the date and time of service and his or her identification number and initials for all

    service of process. Fla. Stat. 48.031(5) is properly satisfied when the process server places the

    date and time of service and his or her identification number and initials on the copy of the

    summons served. Nirk v. Bank of America N.A., 94 So. 3d 658 (Fla. 4th Dist. Ct. App. 2012).

    Failure to do so renders service improper. Vidal v. Suntrust Bank , 41 So. 3d 401 (Fla. 4th Dist.

    Ct. App. 2010) see also Walker v. Fifth Third Mortgage Company , 2012 WL 5457220, No.

    5D12-3187 (Fla. 5th Dist. Ct. App. 2012).

    7. The party seeking to invoke the courts jurisdiction has the burden to prove the validity

    of service of process. Torres v. Arnco Constr., Inc., 867 So. 2d 583, 587 (Fla. 5th DCA 2004).

    COUNT I

    Service of Process onto Defendant Neil J. GillespieFailed to Comply with Fla. Stat. 48.031(5)

    8. The summons attached to this motion as Exhibit 1 is in fact a true and correct copy of the

    summons served onto Defendant Neil J. Gillespie. However, the true and correct copy of the

    summons served onto Defendant Neil J. Gillespie fails to include the correct date of service on

    the face of the summons. The Summons was not served onto Defendant Neil J. Gillespie on

    January 12, 2012.

    9. Because Plaintiff failed to strictly comply with the requirements of Fla. Stat. 48.031(5),

    service of process must be quashed. Vidal , 41 So. 3d 401; see also Gamboa v. Jones , 455 So. 2d

    6] 3 (Fla. 3d Dist. Ct. App. 1984).

    WHEREFORE , Defendant Neil J. Gillespie requests this Court enter an Order

    Quashing service of process, and any further relief this Court deems appropriate.

    COUNT II

    Service of Process onto Defendants Failed to Comply withFla. Stat. 48.031(1)(a), 48.031(5), and 48.22

    10. The face of three (3) summons for the Defendants indicates that Plaintiff has attempted to

    perfect service of process under Fla. Stat. 48.031(1)(a), 48.031(5), and 48.22.

    11. Fla. Stat. 48.22 Cumulative to other laws.All provisions of this chapter are

    cumulative to other provisions of law or rules of court about service of process, and all other

    provisions about service of process are cumulative to this chapter.

    12. It is well settled that a Plaintiff must strictly comply with the statutory requirements for

    service of process pursuant to Fla. Stat. 48.031(1)(a), 48.031(5), and 48.22, otherwise service

    of process is improper.

    13. Service of process must strictly comply with all relevant statutory provisions. Walker v.

    14. Plaintiff has failed to strictly comply with Fla. Stat. 48.031(1)(a), 48.031(5), and 48.22

    therefore service of process in this instance on Defendants must be quashed.

    15. The summons attached to this motion is in fact a true and correct copy of the summons

    served on each of the Defendants. See Exhibit 1, Exhibit 2, and Exhibit 3.

    However, the true and correct copy of each of the summons served onto the Defendants fails to

    include Rule 2.540 Notices to Persons with Disabilities mandated by Supreme Court of Florida

    in Order No. SC09-1487, required by the Florida Rules of Judicial Administration, Rule 2.540

    Notices to Persons with Disabilities, and required by Marion County Fifth Judicial Circuit

    Administrative Order M-2010-08-A.

    16. Under Fla. Stat. 48.22 all provisions of this chapter are cumulative to other provisions

    of law or rules of court about service of process, and all other provisions about service of process

    are cumulative to this chapter. Supreme Court of Florida Order No. SC09-1487, APPENDIX,

    Rule 2.540 (c) Notice Requirement. Rule 2.540 Notices to Persons with Disabilities (Exhibit 4)

    PER CURIAM.

    The Florida Bars Rules of Judicial Administration Committee (Committee)

    has filed an out-of-cycle report proposing amendments to Florida Rule of Judicial

    Administration 2.540, Notices to Persons with Disabilities. We have jurisdiction.

    See art. V, 2(a), Fla. Const.

    BACKGROUND

    The Committee has proposed extensive amendments to rule 2.540 in order to

    better guide Florida courts and members of the public as to their rights and

    obligations under the Americans with Disabilities Act of 1990 (ADA). See 42

    U.S.C. 12101-12213 (2006). These amendments are also intended to promote

    uniformity in the provision of accommodations to individuals with disabilities.

    The Committees proposal was drafted with input and comments from various

    groups, including the Equal Opportunity Law Section of the Florida Bar (EOLS),

    the Office of the State Court Administrator (OSCA), and the Judicial

    Administration Committee of the Conference of Circuit Judges. Additionally, the

    Small Claims Rules Committee (SCRC) has independently suggested amendments

    to rule 2.540; the Committee indicated that it did not incorpora te the SCRCs

    suggestions into its own proposal, but it is not opposed to those changes.

    The Court published the proposed amendments in the October 1, 2009,

    edition of The Florida Bar News and received several comments. The Committee

    filed a response to the comments. After considering the proposal, the comments,

    and the Committees response, we adopt the amendments to rule 2.540 as

    proposed, with the exception of the specific revisions outlined below.

    AMENDMENTS

    Rule 2.540 provides for notice to persons with disabilities of their right to

    request accommodations. New subdivisions have been added governing the

    provision of such accommodations. Accordingly, the title of rule 2.540 is changed

    from Notices to Persons with Disabilities to Requests for Acc ommodations by

    Persons with Disabilities in order to reflect the broader content.

    The rule is organized into six new subdivisions. Subdivision (a), Duties of

    Court, recognizes the court systems obligation to provide accommodations to

    qualified persons with disabilities. This subdivision provides that a qualified

    individual with a disability will be provided, at the courts expense, with

    accommodations, reasonable modifications to court rules and practices, and the

    provision of auxiliary aids or services. Subdivision (b), Definitions, incorporates

    the definitions from the ADA into rule 2.540.

    Subdivision (c), Notice Requirement, encompasses the requirement under

    the ADA that public entities, including courts, notify persons with disabilities of

    their right to request accommodations. Subdivision (c)(1) incorporates text from

    the current rule, which requires that standard language informing individuals of

    their right to request disability accommodations be included in all notices of court

    proceedings and process compelling attendance in court. At the suggestion of the

    SCRC, we have added the requirement that the standard notice shall be printed in

    boldface, 14-point Times New Roman or Courier font. We also added the

    requirement that individuals who wish to request an accommodation must contact

    the appropriate court at least seven days before their scheduled court appearance,

    or immediately upon receiving the notification if the time before the scheduled

    appearance is less than seven days. Subdivision (c)(2) of the rule contains new

    language that requires trial and appellate courts to post the procedures for

    requesting accommodations and the grievance procedures outlined in subdivision

    (f) throughout each courts building and on its website.

    accommodation reque st. The Committees original proposal required the court to

    respond to every request for disability accommodations in writing. Based upon the

    comments directed to this subdivision, as well as the Committees response to

    those comments, we have modified t he Committees proposal. As revised,

    subdivision (e)(2) provides that if the request for accommodation is granted in its

    entirety, the court shall respond to the individual with a disability by any

    appropriate method. If the request is denied or granted only in part, or if an

    alternative accommodation is granted, the court must respond to the individual

    with a disability in writing. Lastly, subdivision (e)(3) provides that if a court

    determines that an individual is a qualified person with a disability and an

    accommodation is needed, the court may only deny the request if it determines that

    the requested accommodation would create an undue financial or administrative

    burden on the court or would fundamentally alter the nature of the service,

    program, or activity.

    Finally, subdivision (f), Grievance Procedure, directs each judicial circuit

    and appellate court to establish and publish grievance procedures that allow for the

    resolution of complaints.

    CONCLUSION

    Accordingly, we amend Florida Rule of Judicial Administration 2.540 as

    reflected in the appendix to this opinion. New language is indicated by

    underscoring; deletions are indicated by struck-through type. These amendments

    shall become effective immediately upon the release of this opinion.

    The definitions of electronic record in subdivision (a)(5) and of official record in subdivision (a)(6) areintended to clarify that when a court proceeding is electronically recorded by means of audio, analog, digital, orvideo equipment, and is also recorded via a written transcript prepared by a court reporter, the written transcriptshall be the official record of the proceeding to the exclusion of all electronic records. While the term record isused within Rule 2.535 and within Fla. R. App. P. 9.200, it has a different meaning within the unique context ofeach rule.     RULE 2.540. REQUESTS FOR ACCOMMODATIONS BY PERSONSWITH DISABILITIES
