In May 2010, the National Parliament held nine plenary sessions. Main discussions and approvals:
3 May 2010:
1. Discussion and voting in generality of the PPL 31/II on Domestic Violence Result: Approved in generality with 30 votes in favour, 0 against and 3
abstentions. 4 May 2010:
o No discussion4 10 May 2010:
o Announcement of the submission to Committee C on Economy, Finances and Anti-Corruption of the 2010 National Parliament Rectifying Budget
o Presentation of the report on Timor-Leste’s participation at the Inter-Parliamentary
Union 122nd Assembly in Thailand, which topic was “The Parliament as a central organ to Political Reconciliation and Good Governance”.
11 May 2010:
2. Discussion and voting of the Project of Resolution 43/II on Solidarity and Support to the People of Cuba
Result: Approved with 40 votes in favour, 0 against and 0 abstentions.
o Submission to Committee I on Internal Regulation, Ethics and Deputy Mandates of a request of the Dili District Court for the MP Augusto Tara Araujo (PSD) to serve as a witness.5
o Presentation of the report on the participation of the Timor-Leste National Parliament
delegation at the CPLP Assembly in Portugal. 17 May 20106:
3. Presentation of the report of Committee I on Internal Regulation, Ethics and Deputy Mandate on the authorization of MP Paulo Martins (CNRT) to serve as a witness at the Dili District Court in a case related to the 2006 crisis.
Result: Approved with 38 votes in favour, 0 against and 5 abstentions7. 4 The presentation of the report by the Committee H on Youth, Sports, Employment and Professional Training on the visits to Viqueque and Bobonaro and the presentation of the report by Committee F on Health, Education and Culture on the visits to Covalima and Oecusse district scheduled for discussion on the Agenda 300/II of 4 May 2010 were not discussed due to lack of functioning quorum. 5 Article 10, 1 of the Rules and Procedures of the National Parliament: “A Member of Parliament may not serve as a jury member, witness or expert without the authorization from the National Parliament, which may or not be granted after the Member of Parliament has been heard in that respect by the competent Committee”. 6 The discussion and voting of the Proposal of Resolution 43/II on the visit if H.E. the President of the Republic to Brazil included in the agenda 303/II was not discussed, as the visit was cancelled. 7 As it is regarding an internal voting, for statistical procedures, it is considered as “other approvals” as voted in Plenary Session. 4. Discussion and voting of the Proposal of Resolution 34/II on the Cooperation Agreement between the Democratic Republic of Timor-Leste and the Kingdom of Spain
Result: Approved with 37 votes in favour, 0 against and 0 abstentions 31 May 20109:
o Submission to Committee I on Internal Regulation, Ethics and Deputy Mandates of a request of the Dili District Court for the MP Augusto Tara Araujo (PSD) and MP Eduardo de Deus Barreto (CNRT) to serve as a witness10
Extraordinary Activities of the Parliament 14 May 2010:
o Meeting at the official residence of the Speaker of the National Parliament to discuss the CAVR legislation
Main issues raised in the plenary sessions: 1. PNTL:
o Abuse of power by PNTL in Viqueque District; o PNTL officers recruited in 2007 who have been later dismissed are now working
under the Food Security department of the Ministry of Trade, Commerce and Industry;
o MPs requested the Secretary of State for Security to provide explanations to the National Parliament regarding PNTL promotion process;
o Committee B still awaiting reply from PNTL District Commander on the case of Atauro;
2. Public consultations led by the Prime-Minister regarding the Strategic Development Plan: o CNRT expressed its support to the ongoing consultations; o FRETILIN highlighted that these consultations should not be political
campaigning; o Most MPs have not received a copy of the Strategic Development Plan;
8 Despite having discussed the issues in the period before the agenda, the plenary session was adjourned and the main issue on the agenda 305/II (Discussion and Voting in Generality of the PPL 30/II on Civil Code) was postponed. 9 The discussion and voting of the in generality of the PPL 30/II (Civil Code) was cancelled as the MPs refused to discuss it without having received the document. 10 Vide footnote nr. 5.

o FRETILIN called for a press conference to clarify statements made by the Prime-
Ministers during his visit to Ainaro District, and reported by Suara Timor Lorasae. FRETILIN suggested that the Prime-Minister should take some time off and then continue the debate on the national development program with all political parties involved rather than on his own.
3. MP Josefa Ferreira elected President of the Women Parliamentary Group; 4. Greater Sunrise and Woodside negotiations:
o MPs expressed its support to bring the pipeline to Timor-Leste; o Appeal for Government to express itself with one voice regarding the
negotiations with Woodside; o MPs regretted the comment by H.E. the President of the Republic saying that the
Secretary of State for Natural Resources did not have capacity to negotiate with Greater Sunrise;
o The door to negotiations should not be closed as this is a very important matter to the country;
5. Concern regarding the Be-bui irrigation project in Sub-District Uatolari in Viqueque District; 6. Natural disasters:
o Lack of assistance by the Ministry of Social Solidarity to the natural disasters in Bobonaro and Ainaro Districts;
o Need for urgent assistance in Zumalai, Covalima District; 7. Lack of quality of the Referendum Package projects around the country, namely in Los Palos
(Lautem District), Maliana (District Bobonaro), Lequidoe (District Aileu) and Suai (Covalima District);
8. Bad condition of roads: o Road between Viqueque and Sub-District Uatolari; o Road between Sakato and Mahata, in Oecusse District; o Road to Quelicai severely damaged due to heavy rains; o Roads in Ainaro District;
9. Information regarding the new system of visa on arrival in Indonesia (photos and fingerprints are now taken to all passengers arriving at Denpasar Airport);
10. Slow progress on the construction works of Hera Central Power Station; 11. EDTL:
o Lack of payment of extra working hours to EDTL staff; o Lack of electricity in the streets in Sub-Districts Railaco and Atauro;
12. MPs questioned the construction of a municipal building if the date for the municipal elections is still unclear;
13. Need to clarify the per diem received by the teachers to give a Portuguese course in Viqueque District;
14. Communities of Uatucarbau and Ossu in Viqueque District should receive information regarding the end of the Community Integrated Health System (SISCA) programme due to the lack of budget;
15. Incentives to Suco Chiefs, Aldeia Chiefs and Suco Cuncils; 16. Concern regarding the strike of teachers in Baucau District; 17. Request to Anti-Corruption Commission to investigate all directorates of the Ministry of
Finance, as there are allegations of maladministration; 18. Request to increase the number of midwives in the rural areas;

19. Worker of Water and Sanitation Services in Sub-District Fatuberlihu who has been
dismissed is still receiving his salary after one year; 20. In the rural areas of Sub-District Turiscai there is neither electricity nor water; 21. Government should take action regarding the garbage accumulated in Tibar area; 22. Bio Gas project in Beco is not being monitored by the Secretary of State for Energy Policy; 23. Following approval of Resolution on National Symbols, the MPs agreed to sing the national
anthem the first Monday of every month which has not yet been implemented; 24. Government should not forget the commitment of the former President Francisco Xavier do
Amaral to rename the Square D. Henrique to Square D. Boaventura; 25. MPs questioned the application of the National Security Law, recently approved by the
National Parliament, in the regulation of security companies such as APAC and Maubere Security;
26. MPs regretted the comments by the Minister of Finance supporting the integration of Timor-Leste in Australia;
27. In Suco Cova (Balibo Sub-District, Bobonaro District) Indonesian citizens are entering illegally in Timor to take magnesium rocks to Indonesia, which is causing some conflicts with the local population;
28. Direct allocation of money to District Health Services seems not to be working, as the District hospitals still lack conditions;
29. Timor-Leste Ambassador to Singapore does not have conditions to do a good job as he is working from an hotel and moving around in public transports;
30. MPs urged to make the Martial Arts Law known to the people of Timor-Leste; 31. Portuguese companies (Timor Telecom, Hotel Timor, Fundação Oriente, Ensul) wing long
term contracts with the Government and are dominating Timor-Leste; PSD highlighted that the agreement signed with Ensul was approved in the Council of Ministers;
32. Poor management and monitoring by Ministry of Education regarding the poor quality of construction of schools and training of teachers.
33. Concern regarding sanitation and water drainage in Dili; 34. Heavy rains have further isolated the population in Alas, Manufahi District; 35. Need for the Government to assign a vehicle to the director of STAE who is doing a good
job. Presently Mr. Tomas Cabral is driving a vehicle allocated by UNDP; 36. Statement made by PNTL Commander Longuinhos Monteiro on the security situation in
Ermera District. MPs have observed that the statements made by the PNTL Commander and by his deputy are not in line;
37. MPs delegations to overseas visits must be gender balanced; 38. Concern regarding Government plan to import 420 thousand tones of rice as it will affect
local produced rice; 39. Ongoing construction in the Area of Cristo Rei despite the fact that the area has been
declared protected area; 40. Government to address issue of staff at the National Hospital; one patient died after checking
in with heart problems because he did not receive medical assistance due to the lack of cardiologists.
41. Government should focus on the rights of the children (allusion to World Children Day, 1st of June).
42. Government must present first trimester budget expenditure before Parliament debates the rectifying budget.

12 This section intends to compare the official and actual attendace of the Members of the National Parliament. According to the article 11 of the Rules of Procedure of the National Parliament: “The duties of a Member of Parliament shall be as follows: a) To report punctually to and attend sessions of the Plenary and meetings of the committees he or she serves on”. In addition, article 5 of the National Parliament Rules of Procedure states that. “A Member of Parliament who is to absent himself or herself for more than three consecutive days on substantiated grounds may, through his or her political party, submit a request for an early justification of absence and temporary replacement of office”. 13 All information regarding official attendance in this section is based on the “Lista de Presença dos Deputados” prepared by the Secretariat of the National Parliament. The attendance data is based on the signature of the Member of the Parliament (MP) who signs the attendance sheet during a plenary session. Therefore, this does not mean that the MP attended the entire session. Statistics and analysis are made by DGSU/UNMIT. 14 Number of seats for the represented political parties or coalitions for the 2007-2012 mandate.

15 The chart presented is based on the average of attendance of the Plenary Sessions by the Members of the National Parliament recorded by the Demoractic Governance Support Unit-UNMIT. The average is based on actual counting of number of MPs who were at the beginning and the end of the morning and afternoon plenary sessions. The figures presented in this section are rounded up. 16 For February 2010, the actual average of attendance is based on 5 sessions monitored out of 7 plenary sessions held. 17 For May 2010, UNMIT / DGSU monitored 8 sessions out of the 9 sessions held as the 3rd of May 2010 was a UN holiday. Please note however the actual average of attendance is based on 7 sessions as the session of 24 May is included in the overall counting of meetings (9); but it was not included for the purposes of this statistical analysis as the session was adjouned right after it started. 18 Number of seats for the represented political parties or coalitions for the 2007-2012 mandate.

In May 2010, the Civil Service Commission42 had the following activities: Official meetings (ordinary and extraordinary):
1. 12 and 13 May 2010: 6th Ordinary Meeting The Commissioners discussed and / or approved: Proposal to Government of conversion of temporary to permanent employees; Review of General Careers Regime (to include CSC on the Law); Approval of 38 recruitment processes for Grade “B” (Senior Manager) of different
ministries, secretaries of state and government agencies; 9 disciplinary actions, applying different penalties (reprimand, suspension and
dismissal); in accordance with Law and CSC policy of zero tolerance to unjustified absences, CSC approved the dismissal of 5 civil servants for abandonment of employment (no show to work for 21 consecutive days).

9. 19 May 2010: CSC published the short list of candidates for Grade B (Senior Manager B) to different Ministries and Secretaries of State. Of a total of 64 candidates who took the written test, 32 were approved and 32 were not approved.
10. 24 May 2010: 7 candidates did a written test for Degree C (Professional Manager) which
includes a dictation, translation and knowledge of Portuguese. 11. CSC also supervised the recruitment of 1200 civil servants for different grades in all
ministries. Other relevant activities:
12. 10 May 2010: National Contest for new CSC logo started. Communication material to advertise the contest was distributed in the ministries, secretaries of state, government agencies, schools, public places and is available in the internet at the CSC blog. The information was also sent to the districts via the Ministry of State Administration and Territorial Management. So far, 5 proposals have already been received.
13. 24 to 28 May 2010: CSC started a campaign to update the civil servants data and the
issuing of the new ID cards in the districts. CSC Secretariat already updated data of 1.500 civil servants (temporary and permanent staff) and issued the same amount of ID cards.

43 The Petroleum Fund was formed by the enactment of the Petroleum Fund law 09/2005 of 03 August 2005. The law gives the Banking & Payments Authority (BPA) of Timor-Leste the responsibility for the operational management of the Fund. 44 The quarterly reports are produced in accordance with Article 13 of the Petroleum Fund Law which requires the Central Bank to report on the performance and activities of the Petroleum Fund of Timor-Leste and the report shall be published within 40 days of the end of each quarter. Thus, the May 2010 report is not yet available by the time of the issuance of this report. 45 Based on the Dec 2009 report, the 2009 closing balance was of 5,376,626US$, the total net revenue was of 1,538,872 US$ and the total transfer to the general state was of 352,000US$. 46 Figures are presented in thousands US$ (1,000). 47 According to the Petroleum Fund Law, other reductions will be done from this gross total, as management fee, markeatable debt securities and others taxes, royalties and market reavaluations. 48 For annual performance comparaison, in March 2009, the closing balance for the period January-March 2009 was of US$ 4.750.080.000 with an opening balance for the same period of U$ 4.196.972.000. 49 It presents the Petroleum Fund Gross receipts, according to article 6, 6.1 (a-e) of the Petroleum Fund law 09/2005 of 03 August 2005, including returns and fees.

50 For 2008 fiscal year, the original budget was 347.8 million USD. The revised budget included an appropriation of 240 million USD for the Economic Stabilization Fund (ESF) and increased appropriations for all other categories. The final budget reduced the ESF to the amount spent – 53.6 million USD – but left the combined total of the other categories unchanged, resulting in a final FY 2008 budget of 601.5 million USD.

Transparency International published an annual Corruption Perceptions Index (CPI) table that shows a country's ranking and score, the number of surveys used to determine the score, and the confidence range of the scoring.
The rank shows how one country compares to others included in the index. The CPI score indicates the perceived level of public-sector corruption in a country/territory. The following table shows the ranking for Timor-Leste from 2006 (the first year data were available) to 2009.

The States and international organizations (and other international law subjects) that celebrate a certain treaty are called “Contracting Parties” (or simply “Parties”) of this treaty.

LAW
The word law can be used with three different meanings, according to the intended scope. In the broadest sense, law is every legal rule, written or not, and covers the habits and all rules formally produced by the State. In a broad sense, law is the written legal rule, excluding legal habit. In a strict sense, it means the normative act by excellence, issued from the National Parliament.
LAW-MAKING
Science that studies the ways of designing and writing normative acts. In colloquial terms, law-making is the art of drafting laws well, in the sense that it consubstantiates a set of rules – law-making rules – the purpose of which is to contribute to a good drafting of laws.
LEGAL PROCEDURES Set of legal requirements for starting a process.
LEGISLATION Set of legal precepts regulating a certain matter.
LEGISLATIVE ACT Manifestation of the will with strength of law and meant to produce law effects. It is one of the three sovereign powers of the State, responsible for the drafting of laws.
LEGISLATIVE
COMPETENCE Legal capacity for drafting laws, decree-laws, regulations and decrees.
LEGISLATIVE POWER
Power to legislate, create and sanction laws. The goal is to draft law rules with general or individual scope that are applied to all society, in view of satisfying the needs of the pressure groups; public administration; society. The legislative power elementary functions include that of overseeing the executive power and voting on budget laws.

N NATIONAL
PARLIAMENT Assembly of representatives elected by the citizens in democratic regimes, normally holding legislative power.

ORGANIC LAW Law on the organization and operation of the Government and respective Ministries. It covers the general dispositions and sets up the main functions and actuation instruments.

ADMINISTRATION
In organic or subjective sense, Public Administration is the set of State bodies, services and agents, as well as the further public legal persons, which ensures the satisfying of various collective needs, such as security, culture, health and the wellbeing of the populations. A person employed by Public Administration is called a civil servant. It can also be defined objectively as the concrete and immediate activity that States develop for ensuring collective interests, and subjectively as the set of legal bodies and persons to which the Law attributes the exercise of the administrative function of the State. Under the operational aspect, Public Administration is the perennial and systematic, legal and

technical development of the services belonging to the State, benefiting the whole.
PROMULGATION
Internal legal act by which the President of the Republic attests the existence of a duly ratified law, Decree-Law, treaty, etc., and order its execution within the territory. It is important to highlight the difference, in practical terms, between the effects of ratification and those of promulgation. If a State ratifies a treaty but does not promulgate it (and if its constitutional law requires promulgation), the conventional text is mandatory in the international sphere but not in the internal one. In this case, the State in question may be asked by other Contracting Parts to fulfill some of its conventional obligations, but one of its internal bodies may refuse to do so because of lack of promulgation. The faulty State then incurs in a situation of international accountability.
PROJECT OF LAW Text presented by the Deputies or Parliamentary Group to the Parliament, so that the latter can pronounce on it.
PROPOSAL OF LAW Idem to Draft Law R RATIFICATION Confirmation, authentication of an act or commitment: ratify a Treaty.
REPEAL Removing validity through a different rule. The repealed rule leaves the system, interrupting its force. The rule ceases to be valid, to belong to the legal ordering, and to have special relevance in dogmatic terms.

Institution organized politically, socially and legally, occupying a defined territory, normally where the maximum law is a written Constitution, and rules by a Government whose sovereignty is acknowledged both internally and internationally. A sovereign State is characterized by the saying "One government, one people, one territory".

BUDGET
Planning instrument that expresses Government Programs monetarily, in order for a financial exercise, discriminating the objectives and goals to be achieved by the Public Administration.
