This is a Private car contract between You and Us and is based on theinformation You gave us when you applied for the insurance. Your agreement topay the premium including any tax applicable is subject to terms and conditions.We will provide the insurance described in this contract during the period ofInsurance.

Motor Care Line 0844 902 2220Should You have to make a claim, MMA Motor Care Line will manage all aspectsof the claim for You from the time it is reported.

MMA Motor Care Line is a service exclusive to MMA Insurance. It is available 24hours a day, 365 days a year and operates in the mainland UK only. MMA MotorCare Line offers assistance including:

• Helpline available 24 hours a day, 365 days a year;

• Full mainland coverage by Our approved repairer network;

• Collection of the damaged car;

• Swift repairs by Our approved repairer, guaranteed for 3 years;

• Return of the repaired car, thoroughly cleaned;

• Courtesy vehicle for the duration of repairs if You use an MMA repairerexcluding glass claims;

• Emergency windscreen repair and replacement;

• Emergency accommodation/journey completion facilities up to £250;

You must produce Your certificate of motor insurance to Our nominatedwindscreen contractor to take advantage of these services. If windscreens arerepaired rather than replaced, no excess applies.

If your car breaks downIf You do not have any additional pre paid Roadside breakdown and Recoveryservice, we can arrange for:

• one of the roadside assistance contractors to attend the breakdown within1 hour and repair Your car on the spot (if it cannot be fixed there and then,they will tow it to the nearest garage or to any destination You agree withthem);

• an emergency message to be sent to up to 2 people to explain the delay;

• Breakdown assistance at competitive rates. (You must pay for the assistance).

Contact the MMA Motor Care Line for guaranteed repairs or replacement by Ourapproved supplier. Please also note that VAT registered policyholders will be askedto pay the VAT at the time of replacement.

How to Make a Claim

Should You have to make a claim, telephone the MMA Motor Care Line on 0844902 2220 and they will manage all aspects of the claim regarding damage to Yourvehicle from the time it is reported. Please provide Us with the followinginformation:

• Policy Number, Your name, driver’s name

• Vehicle make, model and registration number

• Nature of incident

• Police incident number if applicable (this is a requirement for theft claims)

• Police accident reference number (if police attended the scene)

How We Deal With Your Claim

We may choose to repair or replace Your Car or accessory or spare part or pay anamount up to the Market Value of Your Car or accessory or spare part at thetime of loss or damage.

If to Our knowledge Your Car is the subject of a hire purchase or leasingagreement, any payment for loss of or damage to Your Car which is not madegood by repair, reinstatement or replacement, may, at Our discretion, be made tothe owner whose receipt shall be a full discharge of Our liability.

Should Your Car be uneconomical to repair and You pay Your premium by theMMA instalment scheme, We will deduct any outstanding balance.

We will also pay for the reasonable costs of protection and removal to the nearestrepairers and delivery to You, at the address shown on the Schedule, following aclaim covered by this policy.

What should I do in the eventof an accident?

Do• Get as much information as You can, as soon as possible.

• Ask the other drivers involved for their names, addresses and telephonenumbers.

• Request the name of their insurers and if possible their Policy or Certificatenumber.

• Send to Us any letters or documents You receive in connection with the claimbefore You reply to them.

• Make a note of the vehicle registration numbers, along with the make, modeland colours of the other vehicle involved. Also note all relevant details such asweather conditions.

• Make a note of any injuries or damage to other property.

• Ask for the names and addresses of any witnesses before they lose interest andleave the scene.

• If the police attend the scene, obtain the address of the police station and ifpossible their reference number.

• Contact MMA Motor Care Line on 0844 902 2220 as soon as possible to reportthe matter, even if You don’t intend to make a claim.

Don’t• Discuss at the scene whose fault the accident seems to have been.

• Apologise or admit any fault or liability.

• Forget to record the details of damage caused to any property or injury toanyone involved.

What the Law Says• If You are involved in any accident involving an injury to any person or damage

to any other vehicle or property You must stop.

• Give Your name, address and insurance details to anyone who has a goodreason for asking.

• If there is an injury or You do not give Your details to anyone at the scene, Youmust report the matter to the police within 24 hours.

What should I do if my car isstolen?

• Call the Police immediately and obtain a crime reference number

• Contact MMA Motor Care Line on 0844 902 2220 to report the matter to Us

• We will need the following documents so please make sure You have these tohand:

– Vehicle Registration Document (V5 or Log book)

– Current MOT Certificate

– Purchase receipt

– Service History

– Copy of Your Driving Licence

– Certificate of Motor Insurance

We will make an offer for the Market Value of Your vehicle less any policy excessthat applies and send You our settlement cheque once We have received all therequired documents and any enquiries have been completed.

If Your vehicle is recovered at any stage, either before or after We have sent thesettlement cheque to You, please contact Us immediately with the location ofYour car. This will enable Us to move the vehicle to one of Our agents. Failure todo this may result in You becoming liable for any towing and storage charges.

Period of Insurance

The effective period of time shown onthe Schedule.

Excess

The amount You must pay followingloss of or damage to Your Car. Theactual amount is shown on theSchedule.

Endorsements

Special terms or restrictions whichaffect the policy cover. TheEndorsement numbers which applyare shown on the Schedule.

Territorial Limits

Great Britain, Northern Ireland,Channel Islands, the Isle of Man andduring sea transit between ports inthese areas.

Inexperienced Driver

A person who has not held a fullUnited Kingdom driving licence forthe last 12 months.

Market Value

The cost of replacing Your Car withone of similar make, model, conditionand mileage at the time of the loss ordamage.

Definitions

We/Us/Our/The Company

MMA Insurance plc.

The Customer/Insured/You/Your

The person or persons named in theSchedule.

Certificate of Motor Insurance

Your current valid Certificate OfMotor Insurance which has the samenumber as this policy. The Certificatealso sets out who may drive Your Carand the purpose for which Your Carmay be used.

Your Car

The car whose make, model andregistration mark are specified on theSchedule and described in theCertificate Of Motor Insurance orany replacement car details whichhave been supplied to and acceptedby Us.

Schedule

The document that describes details ofthe cover You have and informationthat You have supplied to Us.

Definitions continued

Audio-Visual, Satellite Navigationand Communication Equipment

Equipment that is permanently fittedin the car, such as:

1. Compact disc, MP3 player, radiocassette, mini disc or other audioequipment;

2. Telephone or othercommunication equipment;

3. Television, DVD or other visualentertainment equipment;

4. Visual navigation equipment

Any of the above equipment which isremovable is not consideredpermanently fitted.

Equipment that is not permanentlyfitted is not covered under thissection.

2. Financial ServicesCompensation Scheme

We are covered by the FinancialServices Compensation Scheme(FSCS). You may be entitled to receivecompensation from the scheme if Wecannot meet our obligations. Thisdepends on the type of business andthe circumstances of the claim.Insurance advising and arranging iscovered for 100% of the first £2,000and 90% of the remainder of theclaims, without any upper limit.

3. Law Applicable to Contract

It is possible to choose the lawapplicable to a contract of insurancecovering a risk situated in the UnitedKingdom. We have chosen ScottishLaw if You live in Scotland, Jersey lawif You live in Jersey and English Law ifYou live elsewhere in the UnitedKingdom.

Payment of Your premium is evidenceof acceptance of Our choice. If anyother law is to apply, it must beagreed by both parties and evidencedin writing.

We may for the purposes of FraudPrevention, share your details withother insurance companies.

insurance may be able to resolve any

concerns, and You should contact

If You still consider the matterunresolved the following options areopen to You:

1. Write to the Chief Executive atMMA Insurance plc.

2. Ask for Your case to be reviewedby the Financial OmbudsmanService (FOS) at South Quay Plaza,183 Marsh Wall, London, E149SR. There are a few instanceswhere the FOS is not able toassist and You must have allowedUs the opportunity to resolveYour complaint before the FOSbecome involved.

Policy CoverSection 1 – Loss of or Damage to Your Car

1. Accidental Damage

We will pay for loss of or damage,other than by fire, theft or attemptedtheft, to Your Car and its accessoriesand spare parts in or on Your Car orin Your private garage, occurringduring the Period Of Insurancewithin the Territorial Limits.

2. Fire and Theft

We will pay for loss of or damage toYour Car and its accessories and spareparts while in or on Your Car or inYour private garage, caused by fire,theft or attempted theft occurringduring the Period Of Insurancewithin the Territorial Limits.

3. Loss of or Damage to Your Car

We may choose to repair or replaceYour Car or accessory or spare part orpay an amount up to the MarketValue of Your Car or accessory orspare part at the time of loss ordamage.

If Your Car is less than one year oldfrom the date of first registration asnew and is in current production andYou have been the first and onlyregistered keeper and it is stolen andnot recovered within 28 days of thedate of written notification to Us ordamaged so that repair will cost morethan 60% of the manufacturers latestUnited Kingdom recommended listprice including car tax and VAT at thedate the damage occurred

We will, with Your agreement andthat of any interested parties replaceit with a new car of the same make,model and specification ifimmediately available in the UnitedKingdom. The stolen or damaged carwill then become Our property. Youhave a duty to inform us if the vehicleis recovered.

If to Our knowledge Your Car is thesubject of a hire purchase or leasingagreement, any payment for loss of ordamage to Your Car which is notmade good by repair, reinstatement orreplacement, may, at Our discretion,be made to the owner whose receiptshall be a full discharge of Our liability.

Should Your Car be uneconomical torepair, and You pay Your premium bythe MMA instalment scheme, We willdeduct any outstanding balance.

We will also pay:

4. Permanently fitted Audio-Visual,Satellite Navigation andCommunication Equipment

For permanently fitted audio-visualand communication equipment themost We will pay for any one claim is£500 less the Excess.

Policy CoverSection 1 – Exceptions that apply to loss of ordamage to your car

The Company will not be liable underthis Section for:

1. loss of use of Your Car;

2. depreciation;

3. loss caused by deception;

4. any decrease in the value of YourCar following repair;

5. any cost, or part of any cost ofrepair, which improves Your Carbeyond its condition before theloss or damage;

6. wear and tear;

7. mechanical, electrical, electronic,computer or computer softwarebreakdowns, failures, faults orbreakages;

8. damage to tyres caused bybraking, punctures, cuts or bursts;

9. the Excess shown on theSchedule;

10. the Excess shown below whenYour Car is being driven by, or is inthe custody of, a driver under theage of 25 or an InexperiencedDriver. This is in addition to anyother Excess You may have to pay;

11. any claim under this Section ofthe policy resulting from theft, or attempted theft, whilst theignition keys have been left in oron Your Car or if all the doors,windows and other openingshave not been closed and locked;

12. any amount greater than themaker’s list price in the UnitedKingdom for the supply of anyspare part or accessory or, if YourCar was manufactured outsidethe United Kingdom andimported other than through themanufacturers normal importarrangement any amount greaterthan the cost of the similar sparepart or accessory for theequivalent United Kingdomvehicle model. At The Company’sdiscretion a cash settlement onthis basis may be made if suchpart or accessory cannot beobtained.

Policy CoverSection 2 – Third Party Liability

1. Your Liability

We will insure You against all sumsYou are legally liable to pay arisingfrom:

1. Death of or bodily injury to anyperson for an unlimited amount;

2. Damage to property up to:

(a) £20,000,000 excluding costsand expenses.

(b) £5,000,000 for all costs andexpenses.

The above limits apply in respect ofany one claim or a number of claimsarising from one incident caused by orin connection with:

3. Your Car;

4. Your driving any other car whichis neither owned nor held by Youunder a hire purchase or leasingagreement, (excluding the use tosecure the release of a motorvehicle, which has been seized by,or on behalf of any governmentor public authority) provided that:

(i) You have the owner’spermission to drive the car

(ii) You are not insured underany other insurance to drivethe car

(iii) There is a current and validpolicy of insurance in forcefor the car in accordance withthe Road Traffic Acts.

(iv) The current certificate ofmotor insurance permits Youto drive and use this car.

5. A trailer attached to Your Car.

2. Liability of other personsdriving or using Your Car

On the same basis and limits that Weinsure You under this Section We willalso insure the following persons:

1. Any person allowed by theCertificate Of Motor Insuranceto drive Your Car;

2. Any person who is using, but notdriving, Your Car with Yourpermission for social, domesticand pleasure purposes;

3. Any person, at Your request, whois travelling in, or getting into orout of, Your Car;

4. The employer of the person usingany car insured by this Section forbusiness purposes permitted bythe policy provided that the car:

(a) is neither the property of, norheld by, the employer under ahire purchase agreement orleasing agreement;

5. Legal Costs

In connection with any liability whichis insured by this Section, We will pay:

1. the fees of any solicitor appointedby Us to represent anyoneinsured under this Section duringproceedings in any court ofsummary jurisdiction or at anycoroner’s inquest or fatal accidentinquiry;

2. the cost of legal services arrangedby Us to defend a charge ofmanslaughter or causing death bydangerous driving;

3. other costs and expenses incurredwith Our written consent

(b) is being used in accordancewith the terms of theCertificate Of MotorInsurance

3. Legal Personal Representatives

In the event of death of any personinsured by this Section, We will insurethe legal personal representatives ofthe deceased person against anyliability covered by this Section.

4. Emergency Treatment Fees

We will pay for Emergency TreatmentFees as required by the Road TrafficActs.

Policy CoverSection 2 – Exceptions that apply toThird Party Liability

1. The insurance provided under thisSection will not apply:

(a) to the driver unless thatperson holds a licence todrive Your car, or has held,and is not disqualified fromholding or obtaining, such alicence;

(b) to any person who is notdriving Your car, if to theknowledge of that person thedriver does not hold a licenceto drive Your car, unless thedriver has held and is notdisqualified from holding orobtaining such a licence;

(c) to any person where theliability is insured underanother policy;

(d) to death of or bodily injury toany person arising out of, orin the course of, theemployment of such personby any person We insureunder this Section, except asrequired by the Road TrafficActs.

2. We shall not be liable for loss ofor damage to:

(a) property belonging to, or inthe custody or control of, anyperson insured under thisSection;

(b) any car which is insuredunder this Section;

(c) any luggage trailer attachedto Your Car or attached toany car covered by this policy,which Your Certificate OfMotor Insurance permitsYou to drive, or any propertycarried in or on such luggagetrailer.

3. We shall not be liable for anyliability, loss or damage arisingdirectly or indirectly from acts ofterrorism as defined in the UKTerrorism Act 2000, except wherewe need to provide the minimuminsurance required by the RoadTraffic Acts.

Policy CoverSection 3 – Windscreen Cover

We will pay for repair or replacement of broken glass in the windscreen, side orrear windows of Your Car.

We shall not be liable for the Excess printed in the Schedule for the replacementof broken glass. If the windscreen is replaced by a non approved repairer, we willnot pay more than £100.

Policy CoverSection 4 – Personal Effects

We will pay You, or if You request,the owner of the property up to £50for personal effects in Your Car if lostor damaged due to an accident, fire,theft or attempted theft.

Section 4 – Exceptions that apply toPersonal EffectsWe will not pay for:

1. Money, jewellery, furs,documents, securities, tickets orstamps;

2. Goods or samples carried inconnection with any trade orbusiness;

3. Property insured under any otherpolicy;

4. Any property that is left in aconvertible car when the hood orroof opening is not fully closed.

Policy CoverSection 5 – Personal Accident

If You or Your spouse suffer accidental bodily injury as a result of an accidentinvolving Your Car, We will pay £1000 if, within 12 months of the accident, thisinjury is the cause of:

1. death;

2. the complete and irrecoverable loss of sight of one or both eyes;

3. the loss by severance, at or above the wrist or ankle, of one or more limbs.

Payment will be made direct to the injured person or the legal personalrepresentatives of that person.

Section 5 – Exceptions that apply to PersonalAccidentWe shall not pay:

1. more than one of the above benefits for any of the injuries detailed above.

2. in any Period Of Insurance, more than £1,000 in respect of any one person,or £2,000 in total;

3. any benefit in respect of death or bodily injury to any person by suicide orattempted suicide.

4. If the insured person was, at the time the injury occurred, under the influenceof drink or drugs or had more alcohol in their system than the limits set downin the Road Traffic acts.

5. Death of or injury to any person not wearing a seat belt when they have to bylaw.

Policy CoverSection 6 – Medical Expenses

If You or any occupant of Your Car is injured in an accident involving Your Car,We will pay medical expenses incurred up to £100 for each person injured.

Policy CoverSection 7 – Foreign Use

You do not need an internationalMotor Insurance card (green card)

1. Compulsory insurance coveroutside the Territorial Limits

Your policy provides the minimumcover You need by law to use YourCar in:

1. any country which is a member ofthe European Union;

2. any other country which theCommission of the EuropeanUnion approves as meeting therequirements of Article 7(2) of theEuropean Community Directiveon Insurance of Civil Liabilitiesarising from the use of motorvehicles (no. 72/166 CEE).

2. Full Policy cover outside theTerritorial Limits

Your policy automatically provides thecover shown on Your Schedule for upto 45 days in any one Period ofInsurance while You are using YourCar in the countries referred to inSection 7 1. above provided that:

1. Your Car is taxed and registeredin the United Kingdom;

2. Your Car is normally kept in theUnited Kingdom;

3. You maintain a permanent homein the United Kingdom.

If You intend to use Your Car outsidethe Territorial Limits for a period inexcess of 45 days with a maximum of90 days You must notify Your Brokerbefore You leave and pay anyadditional premium that is required.We will not provide cover for anyperiod in excess of 90 days.

Your policy provides cover while YourCar is in transit (including loading andunloading) between any countries towhich this policy applies, but any seatransit must be by a scheduled searoute.

We will also pay the foreign customsduty that You must pay as a result ofloss or damage to Your Car insuredby this policy preventing its return tothe UK.

3. Other charges

We will insure You against generalaverage contribution, salvage and sueand labour charges, arising from thetransportation of Your Car, betweenany countries to which this insuranceapplies.

Policy CoverSection 8 – No Claims Discount

In the event of no claim being madeor arising under this policy thepremium for renewal will be reducedin accordance with the scaleapplicable at the renewal date.

If You make a claim under this policythe no claims discount will be reducedin line with the scale applicable atrenewal date. If two or more claimsare made in any one Period OfInsurance the no claims discount willbe deleted in full.

Details of the no claims discount scaleare available on request.

Any No Claims Discount to which Youare otherwise entitled will not bedisallowed as a result of a claim:

1. solely for repair or replacement ofglass in the windscreen, side orrear windows of Your Car;

2. under Section 2.4 (EmergencyTreatment Fees) of this policy.

The No Claims Discount is nottransferable to any other person.

Policy CoverSection 9 – Upkeep and Repair by theMotor Trade

If Your Car is in the custody of amember of the motor trade forupkeep or repair, Your policy willcontinue in force. We will nothowever, cover any liability of thetrader.

Policy CoverSection 10 – Car Sharing

If You accept payments as part of a car sharing agreement for social or othersimilar purposes, these payments will not be regarded as payments for hire orreward provided:

1. Your Car is not designed to carry more than seven passengers;

2. the passengers are not being carried in the course of a business of carryingpassengers;

3. the total contributions received for the journey concerned do not involve anyprofit.

Policy CoverSection 11 – Replacement Keys and Locks

If the keys, lock transmitter or entry card for a keyless entry system of the car arelost or stolen, we will pay up to £200 towards the cost of replacing:

• All entry locks that can be opened by the missing item

• The lock transmitter, entry card and central locking system and

• The ignition and steering locks; as long as we are satisfied that any personwho may have your keys, transmitter or card, knows the Identity or garageaddress of the car. We will also pay the reasonable cost of protecting the cartransporting it to the nearest repairers when necessary and delivering it afterrepair to your address. A claim under this section only will not affect your noclaims discount.

What is not covered

We will not pay:

• any claim where the keys, lock transmitter or entry card are either:

(a) Left in or on the car at the time of the loss; or

(b) Taken without your permission by a member of your immediate family ora person living in your home.

Policy CoverSection 12 – Exceptions applicable to all Sections

This policy does not cover

Exception 1 – Use and driving

Any accident, injury, loss, damage orliability while Your Car, or any othercar for which insurance is provided bythis policy, is being:

(a) used to Your knowledge for anypurpose not permitted by theCertificate Of Motor Insurance;

(b) driven to Your knowledge by anyperson not described in theCertificate Of Motor Insurance;

(c) driven by You unless You hold alicence to drive such vehicle orhave held and are notdisqualified, from holding orobtaining such a licence;

(d) driven with Your consent by anyperson who to Your knowledgedoes not hold a licence to drivesuch a car, unless such person hasheld, and is not disqualified fromholding or obtaining, such alicence;

(e) driven by any person who holds aprovisional licence, unless theycomply with the condition of thatlicence in relation to anaccompanying full licence holder.

Exception 2 – Agreements

Any liability You accept by agreementor contract unless liability would haveapplied in any event.

Exception 3 – War Risks

Any consequence of war, invasion, actof foreign enemy, hostilities (whetherwar is declared or not), civil warrebellion, revolution, insurrection ormilitary or usurped power other thanis necessary to meet the requirementsof the Road Traffic Acts.

Exception 4 – Earthquake or Riot

Any accident, injury, loss or damagearising from, or in consequence of:

(a) earthquake;

(b) riot or civil commotion elsewherethan in Great Britain, the Isle ofMan or the Channel Islands.

Exception 5 – Nuclear Risks

Loss, damage, accident or liabilityresulting or arising from, or directly orindirectly caused by, or contributed toor arising from:

(a) ionising radiations orcontamination by radioactivityfrom any nuclear fuel or from anynuclear waste from burningnuclear fuel;

(b) the radioactive, toxic, explosive orother hazardous properties of anyexplosive nuclear assembly ornuclear part of such assembly.

Exception 6 – Sonic Booms

Pressure waves caused by aircraft oraerial devices travelling at sonic orsupersonic speeds.

Exception 7 – Airport Risks

Any loss, damage, injury or liabilitywhile Your Car is in, or on, any partof an aerodrome, airport or airfieldused:

(a) for the take-off or landing ofaircraft, or for the movement ofaircraft on the surface;

(b) as aircraft parking apronsincluding the associated serviceroads and ground equipmentparking areas.

(f) notify Us of any impendingprosecution, coroners inquestor fatal accident enquiry, orof the intended issue of anywrit, summons or other legalprocess by You or on Yourbehalf

2. We shall be entitled to:

(a) take and keep possession ofYour Car and to deal with thesalvage in a reasonablemanner;

(b) negotiate, defend or settle inYour name or on Your behalf,any claim made against You;

(c) prosecute in Your name, forOur benefit, any claimagainst any other person inrespect of any amount paidor payable

3. You must not:

(a) abandon any property to Us;

(b) negotiate or repudiate anyclaim without Our writtenconsent

2. Reasonable precautions

You must take all reasonableprecautions to avoid injury, loss ordamage and maintain Your Car in asafe and roadworthy condition.

Policy CoverSection 13 – Conditions applicable to all Sections

The policy and Schedule shall be readtogether. Where a particular word orexpression has been given a specificmeaning, this meaning or expressionwill apply wherever the word orexpression appears.

1. Claims procedure andrequirements

1. In the event of any accident,injury, loss or damage, You orYour legal representative must atYour own expense:

(a) give Us full details, as soon aspossible, after any eventwhich could lead to a claimunder this policy by phoningMMA Motor Care Line on0844 902 2220;

(b) send to Us any letters ordocuments You receive inconnection with the eventbefore You reply to them;

(c) take all reasonableprecautions to preventfurther injury, loss ordamage;

(d) inform the police of theft ormalicious damage;

(e) send to Us upon receipt anywrit summons or other legalprocess issued or commencedagainst You;

3. Changing Your Car

1. If You change Your Car, We willnot be liable under this policy,except as required by the RoadTraffic Acts, until We have beenadvised of the change. Once Youhave advised Us, We will notifyYou of any change in Yourpremium or terms of cover.

2. The Certificate Of MotorInsurance issued with this policyspecifies Your Car by itsregistration mark. No coverapplies to any additional orreplacement car until a covernoteto that effect has been issued byor on behalf of The Companyexcept for courtesy cars arrangedunder the MMA approvedrepairer scheme.

4. Cancellation

1. If You cancel Your policy within14 days of the latter of either:

(a) the inception or renewaldate;

(b) the date from which Youreceive the contractual termsand conditions

You are entitled to a proportionatereturn of premium less £10. Thisapplies even if You have made aclaim.

If We have paid for the total loss ofthe car, You must pay the full annualpremium and You will not be entitledto any refund.

If You cancel Your policy after 14days, You are also entitled to aproportionate return of the premiumless £10, if no claim has been made.

The service charge will be applied oncancellation of Your policy.

In either case, the Certificate ofMotor Insurance must be returned toUs in order to cancel the insurancepolicy together with writtennotification of Your intention tocancel the policy.

2. We or any intermediaryappointed by Us and acting withOur authority may at any timecancel this policy by giving You 7days notice in writing, byrecorded delivery letter, to Yourlast known address. On return ofthe Certificate of MotorInsurance, We will refund thatpart of Your premium thatapplied to the rest of the Policy.

3. If You pay the premium for thispolicy by Our instalment plan andany of Your monthly instalmentsare not paid by the due date, thebalance outstanding shall becomepayable. We will give You 7 dayswritten notice and if the balanceoutstanding remains unpaid, thepolicy will be cancelled on expiryof such notice and You mustreturn Your Certificate of MotorInsurance to Us immediately.

5. Information Supplied

We will only provide the coverdescribed in this policy if:

1. all the terms and conditions ofthis policy so far as they applyhave been met by You or any oneclaiming under this policy;

2. The declaration and informationgiven on the proposal formprovided by You, and on whichthis contract is based, arecomplete and correct as far asYou know.

6. Right of Recovery

If the law of any country in whichYour policy operates requires Us tosettle a claim which We would nototherwise have paid, We have theright to recover this amount from Youor from the person who incurred theliability.

7. Sharing of Claims

If You are insured by any other policyfor loss or damage which results in avalid claim under this policy, We shallnot be liable to pay more than Ourrateable proportion. Nothing in thiscondition will impose on Us anyliability from which We would havebeen relieved by 1.3 in Exceptions toSection 2.

8. The Motor Insurance Database

It is a condition of the policy that Yousupply such details of the vehicleswhose use is covered by the policy asare required by the relevant lawapplicable in Great Britain andNorthern Ireland, for entry on theMotor Insurance Database.

9. Fraud

If any fraudulent means includinginflation or exaggeration of any claimor submission of forged or falsifieddocuments are used to obtain benefitby You or anyone acting on Yourbehalf, all benefit under the policyshall be forfeited.

10. Additional Charges
