Local Plan Part 2: Land and Planning Policies Document Matter 2: Housing land supply Issue: Is the Plan positively prepared, justified, effective, consistent with national policy and with the policies of the Part 1 Plan in its provision for housing? A. The overall approach. Does the Plan make adequate provision to meet the non-strategic element of the housing land requirement as set out in Policy 3 of the Part 1 Plan? Question 2.1: Is the housing trajectory (Appendix B) realistic in terms of the assumptions underpinning the predicted delivery on the Core Strategy Strategic Sites and the contribution they would make through the Plan Period?

1.1. We consider that the housing trajectory (dated 05 October 2018) is not realistic

in terms of the assumptions underpinning the predicted delivery on the Part 1 Plan strategic sites; in particular, the SUEs on land south of Clifton (‘Clifton’) and east of Gamston/North of Tollerton (‘Gamston’).

1.2. As detailed in Table 1 below, the Council are now expecting 1,750 fewer homes to be delivered over the Plan period by these two strategic sites in comparison with the Part 1 Plan trajectory.

1.3. Furthermore, both sites are anticipated to be delivering 250 homes per annum within three years of the first homes being delivered. In contrast, the planning agent for both the Clifton and Gamston SUEs, Oxalis Planning, has previously challenged the average delivery rates used by the local planning authority, stating that an average rate of 200 dwellings per annum would be a more reasonable average assumption.

1.4. From our experience it is extremely unusual for a local planning authority to suggest that delivery rates will be higher than the level that the site’s promoters consider is deliverable; especially when there appears to be no evidence of why the local planning authority consider the promoters to be incorrect.

1.5. In addition, notwithstanding the eventual rate of delivery, the anticipated commencement of development on each strategic site is unrealistic. Given that the Clifton application was submitted in July 2014 and remains undetermined (albeit with a resolution to grant) over 4 years later, it cannot be realistic to expect the delivery of housing at Gamston in the 2020/21 monitoring year when no application has yet been submitted.

1.6. Similarly, it is very unlikely that housing will be delivered at Clifton in 2019/20,

given the extent of reserved matters and conditions to be submitted and enabling infrastructure to be delivered in advance of any housing construction, even if the S106 and decision were to be issued imminently. We also understand that the site is yet to be sold to a housebuilder which is a further complication that would delay the commencement of development beyond 2019/20.

Question 2.2: Is the slippage in respect of the delivery of the strategic sites from the delivery envisaged in the Part 1 Plan such that a larger supply from non-strategic sites is warranted? 2.1. Not only is a larger supply from non-strategic sites warranted, but it is vital to

ensuring Rushcliffe can meet its housing requirements; both within the immediate 5-year period and the plan period as a whole.

2.2. The Part 2 Plan housing trajectory details that 7,429 new homes will be delivered on strategic sites over the plan period and 3,190 new homes on non-strategic sites. In total the housing trajectory (dated 05 October 2018) details that 14,796 new homes will be provided over the plan period: a buffer of 1,646 homes, or 12.5%, above the Part 1 Plan requirement.

2.3. However, the proposed level of flexibility needs to be considered not just numerically, but in the context of the nature of sites allocated and the individual circumstances of the sites.

2.4. Given that the Part 1 Plan has failed to deliver as was anticipated, it is difficult to

comprehend the local planning authority progressing a strategy which remains over-reliant upon the delivery of strategic sites in the very early years of the plan period.

2.5. In particular, the anticipated delivery of the Clifton and Gamston SUEs

contradicts evidence by the planning agent for these two strategic sites who detail that an average rate of 200 dwellings per annum would be a more reasonable average assumption, instead of 250 dwellings per annum as detailed in the housing trajectory. This would lead to a reduction of 850 homes to the housing trajectory, resulting in a buffer of 796 homes, or less than 6%, above the Part 1 Plan requirement.

2.6. The Local Plans Expert Group (LPEG) report to the Government in March 2016 recommended that local plans provide a 20% buffer in order demonstrate a supply of developable land for the medium to long term (paragraph 11.4). Even the best-case scenario provided by the trajectory fails to deliver such a buffer, even before the likelihood of further slippage from the SUEs is allowed for.

2.7. Paragraph 182 of the National Planning Policy Framework (NPPF) (2012) details that in order to be found ‘sound’, plans should be evidence-based, deliverable and consistent with national policy. Paragraph 153 also advises that local plans should be flexible and be able to respond to changing circumstances.

2.8. It is clear, when based on historic trends and the evidence provided by the

planning agent for the Clifton and Gamston SUEs, that the delivery rates in the Part 2 Plan are not realistic or achievable. Notably, the local planning authority has not provided any evidence to justify deviating from the delivery rates being recommended as realistic by the promoters of both these sites, or indeed to

demonstrate their commencement by the dates currently relied upon. For the Gamston SUE in particular, it is understood that multiple ownership of the site, for both public and private sector bodies, is causing delays in delivering the site which, as noted above, has no planning application even submitted.

2.9. Any further reductions or delays to delivery rates for the strategic sites would leave the local planning authority with either no flexibility, or even a shortfall, in delivering the 13,150 new homes required by the Part 1 Plan within the plan period, let alone demonstrating a 5-year supply of deliverable housing land upon adoption of the Part 2 Plan or anything approaching the level of flexibility recommended by the LPEG report.

2.10. Accordingly, in respect of the housing supply proposed, the Part 2 Plan as submitted is not sound. In order for the Part 2 Plan to be sound and provide sufficient flexibility, additional non-strategic sites should be allocated for housing across all sustainable settlements.

Question 2.4: Does the Plan make adequate overall provision of housing to ensure the delivery of the minimum housing requirement as set out in the Part 1 Plan over the plan period and is sufficient allowance made to allow for future slippage in delivery? 3.1. The Part 2 Plan does not make adequate overall provision of housing to ensure

the delivery of the minimum housing requirement as set out in the Part 1 Plan.

3.2. The current unrealistic targets would result in the Part 2 Plan providing a 12.5% buffer, or 1,646 homes, over the Part 1 Plan housing requirement for 13,150 new homes. However, any further slippage in the Clifton or Gamston SUEs, as already anticipated by their planning agent, would result in a less than 10% buffer against the Part 1 Plan minimum housing requirement, with a significant risk that the overall target will not be met within the plan period. This is clearly an insufficient level of flexibility, particularly when compared with the 20% as advised by the LPEG.

3.3. Additional sites of varying sizes should therefore be allocated across all sustainable settlements in the Borough, to ensure variety and flexibility in the delivery of housing, and reduce reliance on immediate delivery from the SUEs.

Question 2.5: Does the Plan make adequate provision of housing land sufficient to secure five years’ worth of housing supply? 4.1. The Part 2 Plan does not make adequate provision of housing land sufficient to

secure five years’ worth of housing supply.

4.2. The projected 5-year housing land supply is detailed within the examination document ref. EX/RBC/2b, dated 08 October 2018. This document projects that on the adoption of the Part 2 Plan, the local planning authority will have an oversupply of 1,228 homes providing 5.9 years’ supply of housing land over the period 2019-24.

4.3. As previously stated above, the 5-year supply is based on ambitious delivery rates for the strategic sites, the majority of which have already suffered significant slippage from that anticipated in the Part 1 Plan. The delivery rates for the Clifton and Gamston SUEs are considered to be particularly ambitious, and are indeed disputed by their planning agent.

4.4. It is evident from the above that additional flexibility is required to be built in to the Borough’s calculations for a 5-year housing land supply to be demonstrated in accordance with the requirements and guidance in the NPPF (2012).

4.5. In addition, on adoption of the Part 2 Plan the 5-year housing land supply will

be tested against the 2018 NPPF. Annex 2 (Glossary) of the 2018 NPPF details that sites with outline permission or, which are allocated in the plan, should only be considered to be deliverable where there is clear evidence that housing completions will begin within 5 years. The testing of the housing supply against the 2018 NPPF definition may therefore reduce the supply below 5.9 years, further increasing the need for the allocation of non-strategic sites in the plan.

B. Does the distribution of non-strategic site allocations accord with the spatial strategy in the Part 1 Plan? Question 2.7: Is the distribution of the proposed housing allocations consistent with the distribution of housing as set out in Part 1 Plan Policy 3? If so, what is the evidence to support this? 5.1. The Council has not taken a consistent approach to the identification of non-

strategic allocations, with the current strategy seeking to dismiss certain settlements for reasons which are not supported by any evidence, and which were not raised in earlier plan-making stages despite the nature of the issues concerned.

5.2. The purpose for the settlement hierarchy, as defined within Policy 3 of the Part 1 Plan, is to deliver ‘the sustainable development of Rushcliffe’ (part 1 of Policy 3). The settlement hierarchy therefore focuses development in or adjoining the main built up area of Nottingham (within Rushcliffe) and six key settlements which are identified for growth. Policy 3 details that development in other settlement will be for local needs only.

5.3. However, as a result of delays and slippage in the delivery of five of the six SUE sites, the Part 2 Plan proposes to allocate additional sites for housing in the next tier of the hierarchy, to help meet the Part 1 Plan housing requirement for 13,150 homes over the plan period. Some of these homes are within the ‘other settlements’ which were previously identified for development to meet local needs only. The inclusion of this tier of the hierarchy for the allocation of housing sites is both justified and welcomed.

5.4. In the Additional Settlements Background Paper (February 2017) the local planning authority assesses the other villages and considered that Tollerton was suitable for low-medium levels of growth and had the second-best access to community services and facilities of the other villages, behind Gotham (paragraphs 49 and 51). The proximity of Tollerton to the main urban area and better public transport opportunities are also highlighted as positives for the village in the Sustainability Appraisal (April 2018, page 99).

5.5. Despite the local planning authority’s own evidence demonstrating the

sustainability and suitability for additional low-medium scale development in Tollerton, the Preferred Housing Sites consultation ruled out further development in the village for the sole reason that the primary school had no capacity or potential for expansion to accommodate housing growth. At this time there was no concern raised by the Council in relation to cumulative impacts from the Gamston SUE, and indeed the allocation of the SUE demonstrates the Council’s acceptance of the area’s ability to accommodate growth.

5.6. In representations submitted by Richborough Estates to the Preferred Housing Sites consultation, it was demonstrated not only that the primary school could

accommodate additional growth from the catchment area, but in fact that additional local growth would help ensure the long-term sustainability of the school and the village due to the significant reduction in pupil numbers which is forecast from within its catchment area. Put plainly, by not allocating growth in Tollerton the Council are guaranteeing unsustainable patterns of in-commuting by the private car for primary school aged children.

5.7. The local planning authority subsequently accepted in the Housing Site Selection Report (April 2018) that there is no evidence available to support the position that the local primary school cannot support new housing development. For ease of reference, the note from Education Facilities Management Partnership Ltd is appended to these representations (Appendix 1).

5.8. Having accepted the evidence provided by Richborough Estates in respect of education provision, the local planning authority introduced new concerns over the capacity of Tollerton Parish to sustain further housing growth in addition to the new homes already due to be delivered by the Gamston SUE. In the ‘Summary of consultation, main issues raised and responses’, Regulation 22 (c)(i-iv) Statement, dated May 2018, the local planning authority explain that the reason for making no allocations in Tollerton relates to the number of homes proposed within the Parish from the SUE and constraints on ‘sensitive areas of Green Belt’ north of Tollerton which prevent the merging of the village with the strategic allocation (page 37). This is a wholly new issue which was not raised in the Preferred Housing Sites consultation, when the Council was fully aware of the Gamston SUE, and is wholly unsubstantiated by any evidence.

5.9. In view of the above reason given by the local planning authority, the following points should be considered.

5.10. In the Core Strategy, it was assessed as being acceptable for Tollerton Parish to accommodate 2,500 new homes over the Plan period from the Gamston SUE. Based on the Part 2 Plan Housing Trajectory, the Gamston SUE is now anticipated to deliver 750 fewer homes over the Plan period. This figure falls to 1,150 fewer homes when based on the planning agent’s own trajectory for the Gamston SUE. Even on the Council’s best-case figure it is clear that, over the Plan period, there is significant additional capacity within Tollerton Parish for new homes against the previously-accepted trajectory from the Core Strategy.

5.11. Furthermore, low-medium growth in Tollerton village will not impact on the capacity of the Parish as Policy 25 of the Core Strategy details several measures, which were examined by the Inspector, and which are included as part of the Gamston SUE allocation, to mitigate impacts from the development in respect of community facilities, highways, employment and open space.

5.12. Concerning coalescence, as a result of the extent of development at the strategic site, the Inspector’s Report on the Core Strategy considered the matter and concludes with the following statement:

“Structural planting could be used to create a strong green edge limiting the visual impact of new development, as the land is relatively flat. The proposed site would be physically and visually separate from Tollerton and Bassingfield villages, providing such measures were taken.” (paragraph 54, Inspectors Report on the Core Strategy)

5.13. As there is no new evidence on which to form a different conclusion, it is evident

that the impacts from low-medium growth in Tollerton village are therefore separate to the impacts from the development of the strategic site.

5.14. With Tollerton being identified as one of the most sustainable locations amongst the other villages for growth, additional housing should be allocated around the village in accordance with the principles of sustainable development as outlined in the NPPF. Indeed, the Sustainability Appraisal (April 2018) indicates that low-medium growth in the village would benefit and support existing shops and facilities whereas a no-growth scenario would not. This is supported further by Richborough Estates’ own evidence in respect of education, as discussed above.

5.15. It is therefore clear, from all available evidence, that Tollerton village is a sustainable location which can accommodate for low-medium growth to help meet the identified housing needs of the Borough. It also clear, from the local planning authority’s own evidence, that this can take place alongside the Gamston SUE to the north.

5.16. It is important to note that such is the delay to the Gamston SUE that, rather than

being 3 years and 450 dwellings into the delivery of this site, it is still not started and in our view is likely to experience significant further delays. Consequently, we consider that if the Council were willing to work with Richborough Estates then a site of the scale being proposed on land north of Burnside Grove could be delivered quickly, and in all likelihood completed before the construction of any dwellings had even started at the Gamston SUE.

5.17. The distribution of the proposed housing allocations in the Part 2 Plan is therefore not consistent with the distribution of housing as set out Policy 3 of the Part 1 Plan. In our view the Council appear to have adopted an irrational and unevidenced position where a significantly lower level of growth in Tollerton Parish than has previously been anticipated is being used to justify overriding impacts that it has previously argued could be mitigated, therefore the logic on which it has based its spatial strategy for Tollerton is fundamentally unsound.

C. Are the proposed alterations to the Green Belt boundaries justified in terms of exceptional circumstances and will the boundaries be capable of enduring beyond the plan period? Question 2.14: Should the Plan make provision for ’safeguarded land’ between the urban area and the Green Belt in order to meet longer-term needs? 6.1. Yes, the Part 2 Plan should make provision for ‘safeguarded land’ between the

urban area and the Green Belt in order to meet both longer-term needs and, in the event that the strategic SUEs continue to slip and under-deliver, shorter-term housing needs in a plan-led approach.

6.2. Given the extent to which the most sustainable locations in the Borough are constrained by the Green Belt, it is inevitable that future development needs will require the release of additional sites. The comprehensive Green Belt review which has already been undertaken in support of this Local Plan provides the opportunity for additional sites to be released to meet future needs, where they have been assessed as being the most suitable for accommodating development in respect of their contribution, or lack thereof, to meeting the 5 purposes of the Green Belt.

6.3. As detailed above, the housing trajectory within the Part 2 Plan is based on

ambitious targets, particularly in relation to five of the six strategic SUE sites which have slipped significantly since the adoption of the Part 1 Plan in 2014. Evidence provided by the planning agent for two of the SUE sites, Clifton and Gamston, suggests that further slippage in respect of both sites can be expected, as well as reduced rates of delivery once commenced, which will impact on the level of flexibility the local planning authority is able to provide.

6.4. We have already set out the case that additional sites should be allocated across all sustainable settlements in the Borough to provide increased flexibility within the allocations. However, the removal of further sites from the Green Belt and their designation as safeguarded land would provide the opportunity for further flexibility in the future, should the need arise, without requiring further reviews of the Green Belt boundary, which are intended to endure.

9 Tollerton Primary School is part of the School Planning Area ‘Nottingham RuralPrimary’ (8911000). Nottinghamshire County Council forecast that net of new housing, in itsSchoolCapacityAssessmentreturntotheDepartmentforEducation,thatthepupilnumbersattheschoolsinthePlanningAreawillfallfrom6,505pupilsin2016/17to6,086pupilsin2020/21.10 It becomes apparent from the data that the case for more housing in theNottinghamshire rural villages, and inparticularatTollerton, is oneof sustainability. Withoutadditional family housing, theprimary school infrastructure becomes either vulnerable or canonlybesustainedbyincreasingnumbersofchildrentravellingin,usuallybyprivatecareachday.11 NottinghamshireCountyCouncilhasanadoptedPlanningObligationStrategy(NCCPOS)document(adoptedApril2014).Thepolicydocumentassessestheimpactofnewhousingof a typical dwelling and tenure mix to yield 21 additional primary school pupils per 100dwellings.12 Site reference TOL01 proposes 150 dwellings, which according to the NCC POS,would yield 32 additional pupils, once completed. Qualifications and experience

My name is Stephen Bernard Clyne. I hold a Licentiate of the College of Preceptors (LCP) in

Schools Management and Education Law as well as being a qualified schoolteacher, facilities

manager, project manager and school place planner. I have been a contributing member of

the British Society for Population Studies since March 2003, presenting to Society

Conference in 2008 and 2016. I have been a practising member of the Academy of Experts

since May 2006.

I worked as a teacher for 22 years before moving into education consultancy specialising in

accommodation and premises issues, on behalf of both public and private sector clients.

In 1990, I established EFM, an education and other social infrastructure consultancy, which

advises on schools; school provision; the implication of population forecasts on schools;

school design and operating schools. It is also responsible for the premises management of

state funded schools and project management of school construction works.

Social infrastructure planning has a particular relevance to the house building /

development industry where understanding and mitigating the impact on schools and social

infrastructure of new housing can be a significant obligation. I advise a number of major

house-builders, local authorities and developers by informing master plans, negotiating for

and against local authorities and appearing at inquiries.
