A. Case #W2015-002: A request for Rezoning from Residential Agricultural to Residential Protected – Conditional District for a Minor Subdivision. Applicant: Mike McKinney on behalf of McKinney & Sons Builders Identification: Property is identified as Tax PIN 7996-01-17-6516 (Stacy Tolbert, Planner – Rockingham County Planning Dept)

Ms. TolbertMs. TolbertMs. TolbertMs. Tolbert read the following information from the Town of Wentworth Criteria for Board Consideration for Case #W2015-002: “The intended use of this area is residential and this property is located in the Residential Land Use Category according to the Town of Wentworth Future Land Use Map. This category describes primarily low to medium density residential uses, single family homes in neighborhoods, and uses which support or complement residences. This could also accommodate limited neighborhood services, parks, schools, and neighborhood scale commercial uses. This request conforms with the Town of Wentworth Future Land Use Plan.” “After reviewing the application, Staff concludes that sufficient information has been provided for the application to be processed for consideration by the Planning Board and Town Council. Staff notes the property lies within the Dan River – Eden Watershed Overlay district. The applicant is requesting to subdivide the property into three lots to be accessed by a private road. Based on Staff’s analysis, Staff recommends approval of Case #W2015-002, a request for a Rezoning from Residential Agricultural to Residential Protected – Conditional District with the following conditions:

1. All development shall proceed in accordance with the site plan, including applicant submitted materials, and any changes may require a Site Plan Amendment.

2. All required permits shall be applied for, obtained, and complied with by the applicant. 3. The applicant must apply for and receive an erosion control plan permit from NCDENR

BEFORE any grading or construction over 1 acre begins.

4. The applicant shall use Best Management Practices for grading and erosion control for all graded areas as shown in either the USDA-Natural Resources Conservation Service Field Office Technical Guide or the NC Erosion and Sediment Control Planning and Design Manual.”

Protected – Conditional District; however, manufactured housing is not allowed.

Ms. Ms. Ms. Ms. TolbertTolbertTolbertTolbert answered, “Three. With the Property being in a watershed, and also being served by a private road, three is the maximum number that can be served off of that private road as well as the acreage requirements for the lots being in the watershed.”

Protected zoning amendment and adopts the following statements as required by NCGS 160A-382(b) and 160A-383:

1. The Council’s action in adopting this zoning amendment is consistent with the adopted comprehensive plan because:

A. The comprehensive plan shows the area is appropriate for residential uses; B. The Wentworth Planning Board adopted this statement: “The Board has determined that the zoning amendment is consistent with the Wentworth Land Use Plan because the intended use of this area is residential and this property is located in the Residential Land Use Category according to the Town of Wentworth Future Land Use Map. This category describes primarily low to medium density residential uses, single family homes in neighborhoods, and uses which support or complement residences. This could also accommodate limited neighborhood services, parks, schools, and neighborhood scale commercial uses. This request conforms with the Town of Wentworth Future Land Use Plan.” C. The tract for rezoning is approximately 6.8 acres to be subdivided into 3 lots which is allowed in the Residential Protected zoning district; D. The proposed rezoning is consistent with all other relevant maps or plans officially adopted by the Council, including the Town of Wentworth Land Use Plan and small area plans; and,

2. The Council (in addressing spot zoning concerns) considers its action in adopting the proposed conditional use zoning amendment to be reasonable because: A. The proposed zoning district allows appropriate uses for the land, considering its effect upon the entire community as a social, economic and political unit because this zoning district would allow land uses complimentary to the land uses of those existing in that area and would not put any undue hardships on the neighbors; B. The size of the parcels is appropriate for the requested zoning district; C. The effects of the rezoning within the larger community context are positive because it would allow uses that are compatible with the adjoining properties and their allowed uses; D. On balance the following factors: (1) the size of the tract in question, (2) the compatibility of the zoning action with the comprehensive plan, (3) the benefits and detriments resulting from the zoning action for the owner of the newly permitted property, the neighbors, and the surrounding community, and (4) the relationship between the envisioned permitted use and the uses currently present in adjacent tracts weigh in favor of approving the proposed zoning amendment; and,

3. The Council considers its action in adopting this zoning amendment to be in the public interest because: A. The request would allow the same uses that are present in adjacent tracts which are zoned Residential Protected and Residential Agricultural; B. Any future use of the property would have to meet or exceed all requirements and goals of the existing Planning and Zoning Ordinances and the comprehensive plan.”

B. Amendment to the Town of Wentworth Planning and Zoning Ordinances: Chapter 3, Article VII, Section 3: Eliminate Subdivision Plat Approval rule requiring lots to be evaluated for suitability of On-Site Wastewater Availability for Minor Subdivisions only.

Mayor PaschalMayor PaschalMayor PaschalMayor Paschal invited Stacy Tolbert to address Council regarding the proposed text amendments to the Wentworth Planning and Zoning Ordinances. Ms. TolbertMs. TolbertMs. TolbertMs. Tolbert stated, “I come before you tonight to request a text amendment to the Wentworth Planning and Zoning Ordinances. The text amendment is to no longer require the evaluation of land in order to subdivide. Many of you may know it by the term of ‘getting land perked’. Often, property owners wish to gift land to family members and have no future plans for the property or have no plans to build on the property. In those cases, we wish to save the property owner money to allow them to subdivide without the evaluation process. Whenever a property owner wishes to build, an improvement permit where the soil is evaluated for a septic system is required…If they have no plans to build, then we wish to not make them go through that process anymore.” She continued, “In the instance where the lot is not evaluated, staff is proposing a certificate to be placed on the plat in which the owner has to sign stating they agree to the subdivision and that they are aware that the lot has not been evaluated for on-site wastewater. They will also protect a future buyer of the property by letting them know that the lot was not perked because they will see that statement on the recorded plat at the Register of Deeds. Staff still recommends that properties be perked if the owner has plans to build within five years because of how long a permit is valid for. So, if they come into our office and they’re thinking of subdividing a lot that they are going to build on within five years, we do recommend for them to go ahead and go through the process of having that lot evaluated, or have it perked. It is, however, just a recommendation. I t would be with the property owner’s discretion whether they decided to do it at that time. The purpose of the text amendment is simply to give another option to those property owners who have no future plans for their property while also saving them money.”

1.1.1.1. The Council’s action in adopting these text amendments is consistent with the adopted

comprehensive plan because: AAAA. The Board has determined that the zoning amendments are consistent with the

Wentworth Land Use Plan and other comprehensive plans because the Land Use Plan recommended that a detailed review of existing ordinances be completed and corresponding changes be made in the ordinance that are consistent with the Plan.

BBBB. The Land Use Plan recommends that existing policies be revised and new policies be considered. The proposed amendment follows this recommendation.

2222. The Council considers its action in adopting the proposed text amendments to be reasonable and in the public interest because:

AAAA. The State of North Carolina regulates water supply and sewage disposal systems. When state regulations change, the environmental health requirements in the subdivision regulations should be changed to reflect current regulations.

BBBB. It is reasonable and in the public interest to amend the UDO to provide current permitting requirements that makes the UDO easier for the public to use and understand.”

2. Sidewalk Proposals to NCDOT

Mr. MurphyMr. MurphyMr. MurphyMr. Murphy reviewed his notes regarding the possibility of constructing sidewalks alongside sections NC 87/65 and County Home Rd. He proposed this may be possible through grant applications and/or by establishing a capital reserve fund for transportation.

Mayor Paschal Mayor Paschal Mayor Paschal Mayor Paschal raised a concern about the cost of maintaining sidewalks for years to come.

Mr. ScottMr. ScottMr. ScottMr. Scott and CouncilCouncilCouncilCouncil discussed several ideas for recreation opportunities in Wentworth. The following is a list of what they discussed:

• Leasing or partnering with Rockingham County to use the gymnasium and ballfield at the old Wentworth Elementary school on NC 65

• Use the gym at the old Wentworth school for a community basketball program

• Use the field at the old Wentworth school for baseball/softball/football

• Partnering with Rockingham County High School to use the pool at RCHS, or create programs that would involve use of the pool

• Programs for senior citizens at the Town Hall

• A walking trail, picnic area, and playground on the Town owned property near the Town Hall

• Golf clinic for kids The Wentworth Recreation Committee will explore these ideas and report back to Council.

D. Consideration of Offer to Encourage School Band Participation in Wentworth Christmas Parade (George Murphy, Town Administrator)

Council discussed Mr. Murphy’s proposal to pay the travel cost for all four High School bands in Rockingham County to participate in the Wentworth Christmas Parade. Additional prize money for the best performance by a high school marching band was also discussed.

She stated, “Having worked with some of these planning grants before, I’m aware that the major reason for getting a planning grant is you get the plan, which is the first requirement for getting a grant to implement it. You can’t get any money to build a trail or build a bike path until you have that plan in place.”

Mrs. ButlerMrs. ButlerMrs. ButlerMrs. Butler answered, “That is part of the county-wide trail system that we have planned, so we have done that through Piedmont Regional Triad Council. That plan was in place, so therefore we can get money to do these trails that we’ve done in Wentworth and other places.”

Mayor Mayor Mayor Mayor PaschalPaschalPaschalPaschal expressed his concern with having an outside group working on a plan for the Town. However, he said he felt that if the Council and the citizens of Wentworth could have hands on involvement in the plan then it may be something to pursue.

Mr. Mr. Mr. Mr. MurphyMurphyMurphyMurphy said he felt pushed for time due to the looming application deadline of November 20, 2015 but will do as Council directs him. He reiterated that if Council wants him to proceed with the grant application, then a resolution must be adopted by Council at this time.

Council agreed that this particular grant application is something they may want to pursue in the future; however, due to the time constraint and the number of ongoing projects for the Town of Wentworth, Council decided to take no action on the proposed Resolution Endorsing the Application for the NCDOT 2016 Bicycle and Pedestrian Grant.

Ms. Butler stated, “I just wanted to thank you folks for your support on the ‘Run with the Cows’ at the Chinqua Penn Trail. We had the event on the 27th of September.” Ms. ButlerMs. ButlerMs. ButlerMs. Butler reported, “We took in $5,701.30. Our expenditures were $1,658.56, so we netted $4,042.74. All of that goes to improvements on the trail. If you’ve been on the trail lately you’ve probably noticed there was a big gully washed in the trail below Turkey Pond. We had about a two feet deep hole appear in the trail as a result of overflow from the pond. We’ve had that repaired somewhat; we’re looking toward trying to make a major and more permanent repair with concrete.” Mayor PaschalMayor PaschalMayor PaschalMayor Paschal asked, “Does it need a pipe there?” Ms. ButlerMs. ButlerMs. ButlerMs. Butler replied, “It needs a lot, and we’ve had a number of proposals. Another possibility is to put concrete on it and then channel the water beside that so that it goes further down and spreads out more downhill. We’re exploring possibilities and getting estimates. We don’t have enough money to do anything major yet.
