Dr. Charles E. Holt, Jr., President, called the meeting to order at 9:00 a.m. Dr. Holt declared that a quorum was present in order to conduct Board business. Dr. Holt welcomed the dental assistant students from the Tennessee College of Applied Technology. RULEMAKING HEARING The first order of business was a Rulemaking Hearing. Jennifer Putnam, Assistant General Counsel, served as moderator. There were no written or verbal comments from the public regarding the proposed changes. The following amendments were presented to the Board for consideration and each section was voted on by roll call vote and each section was approved by all members:

Amendments to Chapter 0460-02 Rules Governing the Practice of Dentistry Rule 0460-02-.01 Licensure Process – By Exam and by Criteria (Reciprocity) is amended by adding new subparagraph (1)(k), so that as amended, the new subparagraph (1)(k) shall read:

(k) An applicant shall successfully complete the Tennesee Board of Dentistry Ethics and Jurisprudence examination.

Dr. Holt expressed thanks to Dr. Lawrence Hsia for his service on the Board. Dr. Dan Meadows made a motion to allow Dr. Hsia to continue serving as consultant for case review. Second was given by Dr. Prince. Motion carried. MINUTES: Ms. Mary Warner made a motion to approve the March 20-21, 2014 minutes as presented. Second was given by Dr. Nadim Jubran. Motion carried.

APPLICATION / APPLICANT INTERVIEWS / REQUESTS:

ANDRE DANDRIDGE Mr. Dandridge requested approval of his re-application for registration as a dental assistant after surrendering his registration by Agreed Order dated September 17, 2010. Dr. Jubran made a motion to approve after evaluation by the Wellness Committee. Mr. Dandridge must comply with the recommendations of the Committee. Second was given by Ms. Warner. Motion carried.

DANIEL DILLARD Dr. Dillard requested approval of his application for licensure as a dentist by criteria. Dr. Dillard disclosed disciplinary action on his Texas license and a 2003 liability claim. Dr. Jubran made a motion to approve. Second was given by Ms. Warner. Motion carried.

TRAVONYA L. GILBERT Ms. Gilbert requested approval of her application for reinstatement of her registration as a dental assistant. This was the second reinstatement request by Ms. Gilbert where she had exposed radiographs while the registration was expired. Dr. Jubran made a motion to approve with a reprimand and the payment of a civil penalty in the amount of $1,000.00. Second was given by Ms. Warner. Motion carried with Dr. Randall Prince, Ms. Mary Ellen Vaughn, Ms. Bettye Richert and Dr. Ernest DeWald voting no. It was the consensus of the Board that the supervising dentist and owner of the company be referred to the Office of Investigations.

JAMES MCCAWLEY Dr. McCawley submitted an application for limited conscious sedation based on a course he took in 2010. Dr. Prince made a motion that Dr. McCawley needed to do a review course before his application could be approved. Second was given by Ms. Airica Puckett. Motion carried.

TIMOTHY MCNEELY Dr. McNeely requested approval of his reapplication for licensure as a dentist. His license was revoked by the Board in May 2012. At the January 30, 2014 meeting, the Board voted to allow Dr. McNeely to withdraw his application, submit to a medical evaluation and gain the advocacy of the Wellness Committee before reapplying. Dr. Jubran made a motion to approve after Dr. McNeely gains lifetime advocacy of the Wellness Committee and place his license on probation for five (5) years. Second was given by Dr. Meadows. Motion carried. APPLICATION RATIFICATION: Dr. Prince made a motion to approve the attached list of new licenses, certifications, reinstatements, reactivations and retirement applications for dentists, hygienists and dental assistants from March 18, 2014, to June 17, 2014. Second was given by Ms. Warner. Motion carried.

WAIVERS

Lisa Hogan - Ms. Hogan requested a waiver of the early reactivation fee. She placed her license in retirement June 17, 2013, and requested reactivation March 14, 2014. Ms. Warner made a motion to approve her request for waiver of the early reactivation fee. Second was given by Dr. Hall. Motion carried.

Douglass Norris Waterman - Ms. Warner made a motion to approve his request for a waiver of two hours of continuing education in the subject of chemical dependency for the 2011/2012 cycle. Second was given by Dr. Katherine Hall. Motion carried.

Associations The Board was provided with the American Association of Dental Boards (AADB) Bulletin, a copy of the AADB mid-year meeting presentations, and information concerning online database from the Dental Assisting National Board Inc. (DANB).

Dr. Jubran made a motion to send Dr. Charles Holt, Dr. Stephen Maroda and Dr. Ernest DeWald to the AADB Annual Meeting October 7-8, 2014 in San Antonio, Texas. Second was given by Ms. Warner. Motion carried.

Dr. Jubran made a motion to send Jennifer Putnam to the AADB Annual Meeting in San Antonio and Dea Smith to the AADB and American Association of Dental Administrators (AADA) Annual Meeting in San Antonio, Texas. Second was given by Dr. Prince. Motion carried.

Dr. Jubran made a motion to pay the membership fee for those going to the annual (Dr. DeWald, Dr. Maroda and Dr. Holt) and the mid-year (Ms. Warner, Ms. Puckett and Dr. Meadows) meetings of the AADB. Second was given by Dr. Hall. Motion carried.

Testing Agencies The Board was provided with WREB Newsletter and the November 10, 2013, ADEX Proceedings, for their information. No action was taken by the Board.

Licensees and others o KStar Program regarding courses on medical records, pharmacology and

prescribing – reviewed with no action. o American Academy of Facial Esthetics (AAFE) – discussed in conjunction with

Attorney General’s opinion regarding botox. o Stephen Speck regarding therapy pets and animals in dental offices – Dr. Jubran

made a motion directing Ms. Putnam to draft a response that the statutes and rules governing the Tennessee Board of Dentistry do not address the issue of therapy animals in a dental office. Second was given by Ms. Warner. Motion carried.

o Evan Rubensteen & Josh Friedman regarding maintaining CE certificates – Ms. Warner made a motion directing Ms. Putnam to draft a response that while the rules and regulations of the Tennessee Board of Dentistry require a licensee to maintain records of their continuing education, it does not mandate the method for maintaining those records. The Board would not consider it a violation of the rules and regulations should a licensee decide to utilize a service to maintain their continuing education records. Second was given by Dr. Jubran. Motion carried.

o triaxDENTAL regarding mobile dental units – no action taken. Dr. Hall will contact Dr. Vaughan to see if he can bring the unit by the board office to view at their meeting in September.

o Bill Taylor regarding the use of Ketamine in autistic children – Dr. Jubran made a motion to refer this matter to the Anesthesia Committee for review. Second was given by Dr. Prince. Motion carried.

o Attorney General’s opinion concerning allowing dentists to use botox and/or dermal fillers in conjunction with a letter from AAFE and Representative Bob Ramsey. The Attorney General’s Opinion 14-51 dated April 24, 2014, is that the use of botox/dermal fillers is within the scope of practice for general dentists. Dr. Jubran made a motion to remove the Boards’ policy statement concerning botox. Second was given by Ms. Puckett. Motion carried.

o Clarity Professional Evaluation Center regarding occupational functioning assessments – Board reviewed with no action

REPORTS The Board received the following reports for review:

Ben Simpson addressed the Board concerning legislation that might impact the Board such as 1) applicants will be able to submit their initial applications on-line; 2) any annual report/survey will be available on-line including those for pharmacies and hospitals; 3) the drug printout from the Controlled Substance Monitoring Database (CSMD) can now be placed in the patient’s file; 4) the Department of Health can prevent the renewal of any dentist whose professional privilege tax is not current with the Department of Revenue; 5) limits to be placed on the purchase ephedrine or pseudoephedrine; and 6) telehealth to be covered by insurance.

University of Tennessee-Memphis, School of Dentistry Dr. Morris Robbins, updated the Board on activities of the School of Dentistry. He announced the Chair of the Pediatric Department is leaving the school and the state of Alabama is interested in their EFDA program.

Office of Investigation Jennifer Putnam provided the Board with a report detailing the number of complaints currently open in Investigations as well as a summary of currently monitored practitioners.

Office of General Counsel Ms. Putnam presented the Board with a report from the Office of General Counsel. The rules are currently under review for legality at the Attorney General’s Office. Once the Attorney General’s Office has approved them, they will be filed with the Secretary of State. The rules must stay in the Secretary of State’s Office for 90 days before becoming effective.

CSMD Dr. Mitchell Mutter updated the Board on the Chronic Pain Guidelines intended to be used to support clinicians in their treatment of patients with chronic pain with particular reference to the prescribing of opioid medications so as to avoid addiction and adverse outcomes.

Executive Director Dea Smith gave an administrative report of the activities that have transpired in the administrative office since the last meeting. As of May 31, 2014, the Board has a total of 17,081 active licensees. Ms. Smith also provided the Board with a report on the continuing education audit.

Wellness Committee Dr. Wayne McElhiney provide the Board with the Quarterly Report of Activities of the Wellness Committee for the period January 1, 2014 to March 31, 2014. Dr. McElhiney requested an opinion from the Board on whether dentists can prescribe an anti-fungal drug when prescribing an antibiotic that is prone to cause a fungal infection. There were mixed opinions with no consensus.

Financial Report The Board was provided with a report showing actual revenue and expenditures through December 31, 2013, as well as projection for the fiscal year ending June 30, 2014.

CONSENT ORDER(S)

MATTHEW R. SNYDER, DDS Dr. Snyder entered into a Consent Order stipulating to allowing a dental assistant to practice outside the scope of practice by allowing her to use a high-speed handpiece for dental prophylaxis and expose dental radiographs without the proper radiology certification. Dr. Snyder agreed to a reprimand of his license and the payment of $1,000.00 civil penalty. Dr. Prince made a motion to accept the Consent Order as presented. Second was given by Dr. Jubran. Motion carried.

JENNIFER L. STITES, RDA Ms. Stites entered into a Consent Order acknowledging a guilty plea on March 4, 2013, to a DUI. Ms. Stites agreed to a reprimand of her license. Ms. Warner made a motion to accept the Consent Order as presented. Second was given by Dr. Jubran. Motion carried.

GARY D. STUMP, DMD Dr. Stump entered into a Consent Order stipulating to a guilty plea on January 23, 2014, to one felony count of Health Care Fraud. Dr. Stump caused claims for reimbursement for nitrous oxide to be submitted to TennDent in an amount totaling over ten thousand dollars for patients who had not received such analgesia. The Court ordered Dr. Stump to serve a probationary sentence of five years, during which time, he would be placed on home detention for a period of eight months, required to complete 150 hours of community service, refrain from consuming alcohol and participate in random drug testing. As for his dental license, Dr. Stump agreed to the probation of his license for five years beginning June 19, 2014, and must appear before the Board to request an Order of Compliance at the end of the probationary period. He must also pay a $5,000 civil penalty. Ms. Warner made a motion to accept the Consent Order as presented. Second was given by Dr. Maroda. Motion carried.
