EPA Conditions 1. A Management Plan should
be finalized, with what documentation has been lodged by the applicant in accordance with the PIRSA ‘Guidelines, for the Establishment of Commercial Domestic Rabbit Farms in SA’. The plan will need to be submitted to Council for approval, prior to the commencement of the use of Shed 1 and Shed 2 as a ‘Rabbit Farm’. Appropriate items related to odour control, fly and mosquito control, waste water, litter disposal, nutrient take up and mortality disposal should be included.
EPA Notes • The applicant is reminded of
its general environmental duty, as required by Section 25 of the Environment Protection Act, to take all reasonable and practical measures to ensure that the activities on the whole site, including during construction, do not pollute the environment in a way which causes or may cause environmental harm.

The Development Assessment Panel (Council):
• refuses to delete Condition 17 at the Compulsory Conference and lets the matter proceed to a full hearing of the ERD court and then argues that the building should not be approved when having regard to Council’s
Development Plan i.e. traffic, safe access requirements, etc. as stated above.
• Council proceed to defend the appeal, arguing that if the condition is severed from the approval, that the Panel’s decision to approve the application should be overturned, and the application refused;
• Mr Veitch be authorised to engage any planning, traffic or engineering evidence as recommended by Council’s legal advisors to support Council’s position; and
• Mr Veitch be authorised to agree to a settlement of the appeal if Mr Veitch is satisfied by further evidence that the road upgrade is not necessary as a result of the use of the land for commercial hay storage.

The Development Assessment Panel provides direction that 5 car parking spaces per 100m² of retail space will be acceptable and dispensation on the short fall of 6 car parking spaces will be supported i.e. not incur the $2,500 contribution per car parking space shortfall. This will be subject to the completion of public consultation (Category 2) and development assessment of the application. An encumbrance allowing the after hours use of the car park for the public, in association with the Clare Town Hall and Function Room, will be required to be included on the future Land Title, as part of a separate Land Division process (a condition of Approval). The alignment of the proposed boundary between the proposed retail and residential land uses of the subject land should be as straight as possible i.e. not follow the complicated alignment of existing site features.
