MINUTES OF 399th MEETING OF REGISTRATION COMMITTEE HELD
ON 08.04.2019 IN THE CHAMBER OF DR. S. K. MALHOTRA, ROOM NO.
231, KRISHI BHAWAN, NEW DELHI.
The 399th Meeting of Registration Committee (RC) was held under the
Chairmanship of Dr. S. K. Malhotra, Agriculture Commissioner on 08.04.2019 at
10:00 AM in Room No. 231 Krishi Bhawan, New Delhi. Sh. Rajesh Malik, Plant
Protection Advisor, Dte. of PPQ&S, Dr. Rohit Mishra, Assistant Industrial Advisor,
Ministry of Chemicals & Fertilizers, Department of Chemicals and Petrochemicals
and Dr. Sushil K. Khurana, Secretary, CIB&RC, attended the meeting. Following
officers from the Secretariat of CIB&RC also attended the meeting to present their
agendas and advises as and when required/or volunteered to provide the information
during the deliberations.

At the outset, Chairman welcomed the members and experts and asked Secretary,
CIB&RC to take up the agendas for deliberations including the deferred agendas of 398th RC
meeting to begin with. The decisions taken by the RC are as under:-

7.0 9(4) TIM CASES
7.1 Consideration of application of M/s GSP Crop Science Pvt. Ltd, for grant of
registration for indigenous manufacture of Pyrithiobac Sodium Technical under
section 9(4) TIM.
RC was apprised that no response was received after the communication of deficiency even
after six months. Even a reminder was issued from toxicity expert on 28.08.2018.
Therefore, adhering to its earlier decision in 381st RC meeting vide agenda item no 1.3,
accordingly the case is closed.

7.2 Consideration of application of M/s Agro Life Sciences Corporation, for grant of
registration for indigenous manufacture of Difenoconazole Technical 95% w/w min.
under section 9(4) TIM.
Committee deliberated the Agenda & approved the registration of indigenous manufacture
of Difenoconazole Technical 95% w/w min.
“The committee further decided that a condition to be incorporated on the CR “that the CR
will be treated as deemed invalid in case the NMR report from CIL is found unsatisfactory”
7.3 Consideration of application of M/s India Pesticides Ltd., for grant of registration for
indigenous manufacture of Thiamethoxam Technical 97% w/w min. under section 9(4)
TIM.
Committee deliberated the Agenda & approved the registration of indigenous manufacture
of Thiamethoxam Technical 97% w/w min.
“The committee further decided that a condition to be incorporated on the CR “that the CR
will be treated as deemed invalid in case the NMR report from CIL is found unsatisfactory”
7.4 Consideration of application of M/s India Pesticides Ltd., for grant of registration for
indigenous manufacture of Propineb Technical 80% w/w min. under section 9(4) TIM.
Committee deliberated the agenda and decided to revisit the case and to be presented before
RC by the concerned expert.
7.5 Consideration of application of M/s Sahib Pesticides, for grant of registration for
indigenous manufacture of Imazethapyr Technical 93% w/w min. under section 9(4)
TIM.
RC deliberated the agenda and decided to revisit the case of 9(3) based on which the
chemical equivalence is claimed.
7.6 Old 9(4) TIM cases for closure/rejection/otherwise. (Consideration of application of
M/s Coromandel Agrico Ltd for grant of registration for indigenous manufacture of
Clodinafop Propargyl Technical under section 9(4) TIM).
RC was apprised that no response was received after the communication of deficiency even
after six months. Thereafter the file was processed in other divisions. Therefore, adhering
to its earlier decision in 381st RC meeting vide agenda item no 1.3, accordingly the case is
closed.
7.7 Consideration of application of M/s Indofil Industries Ltd., for grant of registration
for indigenous manufacture of Thiophanate methyl Technical 94% w/w min. under
section 9(4) TIM.
Committee deliberated the agenda and decided to revisit the case and to be presented before
RC.
7.8 Consideration of application of M/s Crimsun Organics Pvt. Ltd., for grant of
registration for indigenous manufacture of Bispyribac sodium Technical 95% w/w min.
under section 9(4) TIM.
RC deliberated the agenda and decided to revisit the case of 9(3) based on which the
chemical equivalence is claimed.
7.9 Consideration of application of M/s India Pesticides Ltd., for grant of registration for
indigenous manufacture of Tebuconazole Technical 95% w/w min. under section 9(4)
TIM.
Committee deliberated the Agenda & approved the registration of indigenous manufacture
of Tebuconazole Technical 95% w/w min.

7.10 Consideration of application of M/s Sahib Pesticides Ltd., for grant of registration for
indigenous manufacture of Tebuconazole Technical 95% w/w min. under section 9(4)
TIM.
Committee deliberated the Agenda & approved the registration of indigenous manufacture
of Tebuconazole Technical 95% w/w min.
“The committee further decided that a condition to be incorporated on the CR “that the CR
will be treated as deemed invalid in case the NMR report from CIL is found unsatisfactory”
7.11 Consideration of application of M/s HPM Ltd., for grant of registration for indigenous
manufacture of Propiconazole Technical 88% w/w min. under section 9(4) TIM.
Committee deliberated the Agenda & approved the registration of indigenous manufacture
of Propiconazole Technical 88% w/w min.

7.12 Follow up action taken on various agendas (7.11, 7.12 & 7.14) of 397th RC with respect to
9(4) TIM cases.
RC deliberated the agenda and approved following cases considered in its 397th RC:
1. Consideration of application of M/s Agrisol (India) Pvt. Ltd., for grant of
registration for indigenous manufacture of Tebuconazole Technical 95% w/w min..
under section 9(4) TIM.
2. Consideration of application of M/s Omega Fine Chemicals, for grant of registration
for indigenous manufacture of Paclobutrazole Technical 95% w/w min. under
section 9(4) TIM.
3. Consideration of application of M/s Ichiban Crop Science Ltd., for grant of
registration for indigenous manufacture of Tebuconazole Technical 95% w/w min..
under section 9(4) TIM.
However, the RC desired that the MRL status of these cases should be apprised in
the next RC.
8.0 ENDORSEMENT CASES
8.1 M/s ADAMA India Pvt. Ltd., has submitted application for registration of
Propaquizafop 10% EC for label expansion.
RC deliberated the agenda in detail and approved for tomato crop on weeds i.e.,
Echinochloa colona, Ehinochloa crus-galli, Eleusine indica, Digitaria sanguinalis,
Dactyloctenium aegypitium Chick pea crop Echinochloa colona, Eleusine indica, Digitaria
sanguinalis, Dactyloctenium aegyptium, Chilli crop, Echinochloa colona, Dactyloctenium
aegypitium, Digitaria sanguinalis, Dactyloctenium aegyptium, Sesamum crop,
Echinochloa colona, Eleusine indica, Digitaria sanguinalis, Dactyloctenium aegyptium,
Cluster bean crop, Echinochloa colona, Eleusine indica, Digitaria sanguinalis,
Dactyloctenium aegyptium.
RC observed that the data has not been submitted on Red gram as per the guidelines
therefore, label expansion on the crop Red gram is declined.
8.2 M/s ADAMA India Pvt. Ltd., has submitted application for registration of
Oxyflourfen 2.5% + Isopropyl amine salt of Glyphosate 41% SC for label expansion.
RC deliberated the agenda in detail and approved for non-crop area on weeds i.e. Digitaria
sanguinalis, Cynodon dactylon, Paspalum conjugatum, Cyprus spp, Digera arvensis.

Further the RC constituted the sub-committee comprising of the Head of Department of
Agronomy, ICAR and DD (WS) CIB&RC to define the non-crop area and to submit its
report in 402nd RC meeting.
8.3 M/s Bayer Crop Science, has submitted application for registration of Ethoxysulfuron
15% WG (Sunrise 15WG) for label expansion.
RC deliberated the agenda in detail and decided to take the clarification from the applicant
regarding generation of data at IIBAT on residue and persistence field data at the time of
data generation.
8.4 Consideration of the request for transfer of 19 certificate of registration from M/s
Atlas Agritech Ltd., to M/s Prism Agrotec Enterprises.
Deferred as the issue pertaining the transfer of CRs is to be revisited with complete
chronology of the earlier RC decisions on the issue of transfer of CRs.
8.5 Consideration of the request from M/s Safex Chemicals (India) Ltd., for endorsement
of factory address on certificate of registration.
RC perused the agenda and recalled its decision taken in its 397th meeting whereby the
applicant was sought to submit the clarification as to why here applied for some products
which falls within the category of banned / phased out / restricted etc. RC also perused the
clarification in this regard stating that it has been done inadvertently and they had applied
before first January 2019 and the products were banned for manufacture or import from 1st
January 2019 and the Gazette notification dated 08.08.2018 did not come to their notice
immediately. RC decided to approve the request with a stern warning that the same is not
to be repeated in future.
8.6 Consideration of the request for transfer of 140 certificate of registration from M/s
Associated Enterprises to M/s Sayona Crop Care.
Deferred as the issue pertaining the transfer of CRs is to be revisited with complete
chronology of the earlier RC decisions on the issue of transfer of CRs.
8.7 Endorsement of change of name and address of source of import of Pyrazosulfuron
ethyl 70% WDG M/s NACL Industries Ltd [FI 9(3)].
Committee deliberated the agenda and approve for change of name and address of source
of import Pyrazosulfuron ethyl 70% WDG from M/s Nissan Chemical Industries Ltd.,,
Kowa – Hitotsubashi Building, 7-1, 3-Chome, Kanda-Nishiki-cho, Chiyoda-Ku, Tokyo –
101-0054, Japan to M/s Nissan Chemical Corporation, 5-1, Nithonbashi, Chome, Chuo-Ku,
Tokyo (1036119), Japan.
This case also relate with agenda item No. 9.7 below.
9.0 MISCELLANEOUS ITEMS
9.1 Label claim of Deltamethrin 2.8% EC in Pigeon pea against pod sucking bug
(Clavigralla gibbosa)
RC deliberated the agenda and observed that label claim is exist for the control of pod
sucking bug (Clavigralla gibbosa) on Pigeon pea. ICAR comments may be taken.
9.2 The objective of agenda is the request letters from pesticide industry to extend date
of submission of experimental data as per the recommendation in 361st RC from
December, 2017 to December, 2019.
RC deliberated the agenda and decided to extend the date of submission till December,
2019. Dr. Vandana Pandey has been nominated in place of Dr. Arnab Das Gupta (as he is
superannuated in January, 2019) in the group constituted for follow up action of Anupam
Verma Committee.

9.3 Production, sale and use of Streptomycin sulphate 9% + Tetracyclin hydrochloride 1%.
The RC noted that this agenda has been deliberated in 397th RC meeting vide agenda item
no. 9.21. The same was revisited and RC noted that a public notice dated 26.02.2014 was
issued for all the stake holders holding registration certificate of combination product
Streptomycin sulphate 9% + Tetracyclin hydrochloride 1% to get it rectified as
Streptomycin sulphate 90% + Tetracyclin hydrochloride 10%. Furthermore, MRL for this
deemed registered product is not yet fixed. It was also noted that the use of these substances
in agriculture may pose risk of development of resistance to these antibiotics in human
beings and animals. Hence, RC re-constituted the committee proposed in 397th RC meeting
with following composition and TOR:

To explore the possibility of phasing out of these antibiotic/antibacterial substances for use
in agriculture, if alternatives are available.
9.4 Request for priority to be given for registration of novel Chemistry under registration
Broflanilide 300 G/L (F. No. 8980-FI/9(3)/2018-CIR-II).
This issue has already been discussed under agenda item No. 2.3 of 398th RC meeting held
on 25th March 2019. It is policy matter to be decided by the sub-committee
9.5 Consideration of a request of M/s Crystal Crop Protection Pvt. Ltd. for extension of
validity period of their CR in respect of Tebuconazole Technical 95% w/w min.
Committee noted that the matter relating to grant of registration under TI category and the
extension of such certificate is sub-judice. Accordingly, after deliberation it was decided
that an affidavit from the applicant is to be obtained whether the applicant possesses the
certificate of registration for the product under TIM category. In case the applicant is found
having certificate under TIM category, the extension may be granted subject to final
outcome/order in the relevant Appeal/Court Case. RC agreed to extend the validity of the
certificate of registration for import of Tebuconazole Technical 95% w/w min. up to
11.12.2023, if applicant does not possess the Certificate of Registration for indigenous
manufacture.
9.6 Consideration of application for import/indigenous manufacturing permits for
Biocides used in paint by paint industry.
Committee deliberated the agenda and approved as per Annexure – 9.6.1. RC reiterated
that in line with its decision taken in 397th RC the applicants are required to submit affidavit.
9.7 Consideration of a request of M/s NACL Industries Ltd., for indicating validity of
source of their CR in respect of Pyrazosulfuron ethyl 70% WDG.
Committee deliberated the agenda and approved.
This case already been discussed at agenda item No. 8.7 above

9.8 Consideration of an application of M/s FMC India Pvt. Ltd.,, M/s Dow Agro Science
India Pvt. Ltd., and M/s Syngenta India Ltd.,
This issue has already been discussed under agenda item No. 2.3 of 398th RC meeting held
on 25th March 2019. It is policy matter to be decided by the sub-committee
9.9 Consideration of the order of the Hon’ble Appellate Authority dated 15.03.2019
passed in appeal/revision no. 14 of 2015 filed by Sh. K. V. Bijju vs CIB&RC
Noted.
9.10 Consideration of the orders of the Hon’ble appellate authority dated 01.03.2019,
20.03.2019 passed in appeal no. 8 of 2017, 02 of 2018 and Appeal No. 03 of 2018 filed
by M/s Anu Products Pvt. Ltd., M/s Krishi Rasayan Exports Ltd., and M/s Agro Life
Science Corporation respectively.
Noted.
9.11 Suggestion of the stake holders regarding report of the committee on field persistence
studies in plant and their analytical test studies in plant sample in tabular form.

9.12 Request of M/s Sumitomo Chemicals India Ltd., the applicant for further scrutiny for
registration application of Ethaboxam 40% SC
The application may be scrutinized in usual manner keeping in queue from the submission
of application on 29.01.2019 .
9.13 Consideration of an application of M/s Sumisho Agro India Pvt. Ltd., for grant of
registration for import Azoxystrobin Technical 98% w/w min. under section 9(4) TI
Committee deliberated the agenda and decided to revisit the case and to be brought before
RC.
9.14 Consideration of an application of M/s Best Agrochem Pvt. Ltd., for grant of
registration for import Imidacloprid Technical 94% w/w min. under section 9(4) TI
Committee deliberated the agenda and decided to revisit the case and to be brought before
RC.
9.15 Deferred case of 387th RC and 390th RC of Enhancement of validity of registration for
import of Imidacloprid Technical 94% (w/w) under 9(4) TI category.
Committee deliberated the agenda and decided to revisit the case and to be brought before
RC.
9.16 Consideration of an application of M/s Best Agrochem Pvt. Ltd., for grant of
registration for import Emamectin benzoate Technical 95% w/w min. under section 9(4)
TI
Committee deliberated the agenda and decided to revisit the case and to be brought before
RC.
9.17 List of 9(4) TI cases which are pending for DNA verification from Germany Authority.

Committee deliberated the agenda and decided to send a last reminder for DNA verification.
9.18 Requirement of Consent letter for Triacontanol under section 9(4) formulation “Me
Too” category -
File of 9(3) registration to be perused and details are to be presented before RC
9.19 Submitted affidavit by applicants from Technical supplier validity period of affidavit
of consent letter from the manufacture of technical grade supplier for acceptance of
online FIM application.
Committee deliberated the agenda and decided that the affidavit for the consent shall not be
more than three months old on the date of submission of applications.
RC further decided this should be applicable for other cases where submission of affidavit
is required.
9.20 Amendment in the registration certificate in the data bank for the product Copper
oxychloride 56% oil dispersible powder w/w min. purity of Copper oxy chloride Technical
98.5% w/w min. (Based on copper content 56% w/w min.)
Committee deliberated the agenda and decided that the chemical composition shall be
revised on the data bank as per the chemical composition approved by the RC to the
registrant u/s 9(3) of the Insecticide Act.
9.21 2,4-D Sodium salt 80% WP under 9(4) F cancellation of certificate of registration
which were approved in 391st RC, 394th RC and 397th RC.
The RC deliberated the agenda and decided that the applications 2,4-D Sodium salt 80%
WP Formulation u/s 9(4) shall be considered under category of technical as per the earlier
decision taken by the RC in its 298th meeting held on 27.03.2009 and all the certificate
issued for this product, which have already been approved and issued in 391st , 394th and
397th RC meetings shall be deemed as cancelled. NIC may be contacted and the list of such
cases issued earlier in FIM category may be brought before the Registration Committee.
Similarly, the list of cases of Hydrogen Cynamide issued under FIM category should also
be brought before the RC.

9.26 Consideration of application for import permits for multiuse insecticides (other than
Boric Acid) for non-insecticidal use.
Committee deliberated the agenda and approved as per Annexure – 9.26.1. The committee
also deliberated the case of M/s Wel Suit and directed to CIB&RC to expedite the process
of verification of end use.
9.27 Request for change of the address of source in the CR of Metamifop Technical 96%
min. w/w approved u/s 9(3) considered in 384th RC M/s FMC India Pvt. Ltd.
Committee approved the change in the address of the source.
9.28 Consideration of application for import permits for Boric Acid for non-insecticidal
use.
Committee deliberated the agenda and approved as per Annexure – 9.28.1.
9.29 Consideration of application for shelf life claimed for enhancement regarding.
Committee deliberated the agenda and approved as per Annexure – 9.29.1.
10.0 Online filling of application for registration under different categories.
10.1 Consideration of application u/s 9(4) FIM category received only by complete On-line
system.

The Agenda was deliberated in detail & all the complete cases were approved as proposed
in Annexure – 10.1.1 except the applications for the products applied under category TI /FI as
the RC desired that the details agenda note in these cases shall be placed before the next RC
except the products covered under the Gazette Notification SO 3951 (E) dated 08.08.2018
published on 09.08.2018. RC directed the Secretariat of CIB&RC that all the cases under
section 9(4) must be issued after confirming the fixation of MRL for the product. It was
also directed to recheck cases and should strictly follow Gazette Notification SO 3951 (E)
dated 08.08.2018 published on 09.08.2018 of Ministry of Agriculture, Cooperation and
Farmers Welfare while issuing approvals.

1.0 Confirmation of minutes of the 398th meeting of the Registration Committee –reg.
The minutes of agenda item No. 1.0 to 6.40 and agenda 9.25 which was shifted at 3.14
are confirmed except at agenda item No. 6.3 should be considered under technical
import (TI) category i.e. Prochloraz Technical 95% w/w Min., for technical import
instead of indigenous manufacture. Further it is recorded that agenda item No. 7.1 to
10.1 were deferred due to paucity of time. In agenda item no. 2.1 wherein the
representative of Shogun Organics requested for generation of data within one year of
time but inadvertently the same was recorded as three months. Therefore, three months
shall be substituted by one year and construed accordingly.
2.0 Follow-up actions and related presentations
2.1 Follow up actions on the decision taken by the Registration Committee in its
previous meetings including 398th meeting
The Secretariat apprised RC about the review meetings being taken by Secretary DAC&FW
on weekly basis, on new and pending court cases in various District Courts / High Courts
/ Supreme Court whereby the interests of the Government and / or RC is being defended.
and various appeals / revisions u/s 10 and 11 of the Insecticides Act, 1968 respectively. In
addition to mandate assigned to it u/s 5 & 9 of the Insecticides Act, 1968 and Rule 4 of the
Insecticides Rules 1971. The RC noted the follow-up actions with satisfaction.
In addition to above Secretary CIB&RC informed the RC about the response received from
M/s Crystal Crop Protection Limited on the decision taken by the RC on his application
under TI vs TIM category directed to be considered by the Hon’ble Appellate Authority
and subsequently by the Hon’ble Delhi High Court along with the files of M/s Willowood
Chemicals Private Limited under TI vs TIM category. RC noted the voluminous content
of the documents and directed the Secretariat of CIB&RC to examine the response
submitted by M/s Crystal Crop Protection Limited and further examine the files M/s
Willowood Chemicals Private Limited. The outcome may be brought to the RC.
2.2 Presentation by the stakeholders – reg.
Secretary CIB&RC requested to initiate the process for change in bye laws of registration
committee wherein it is mentioned to hold the meeting at Krishi Bhawan, this is being
desired because there is a difficulty for arranging the space for presentations and carry the
files to Krishi Bhawan. It is proposed to keep the venue at Faridabad.
The RC showed constraint regarding availability or otherwise of all the members including
Chairman. However, RC decided that the issue may be further discussed in the next RC.

are of TIM vs TI. RC noted that MUP does not qualify for registration under 9(3) TIM
category and also the guidelines indicated in form-I is not correct. RC decided that the
applicant may apply under the relevant category and guidelines

the guidelines of the MUP as per Annexure – 9.3.1.

9.13 Follow-up action of Agenda item No.8.10 of 397th RC meeting
RC perused the agenda and recalled its decision taken in its 397th meeting whereby the
applicant was sought to submit the clarification as to why here applied for some
products which falls within the category of banned / phased out / restricted etc. RC also
perused the clarification in this regard stating that it has been done inadvertently and
they had applied before first January 2019 and the products were banned for
manufacture or import from 1st January 2019 and the Gazette notification dated
08.08.2018 did not come to their notice immediately. RC decided to approve the request
with a stern warning that the same is not to be repeated in future.
9.14 Order in Appeal No.9 of 2017 under section of 10 of the Insecticide Act, 1968 filed
by M/s Tropical Agrosystem (India) Pvt. Ltd.
RC noted the order passed by the Appellate Authority for compliance.

Committee deliberated the Agenda and constituted a committee under the Chairperson
Dr. Sandhya Kulshreshtha, [Consultant, (Pharma)] Shri. A. K. Reddy [Deputy Director
(Weed Sciences)] and Dr. Vandana Pandey [Assistant Director (Plant Pathology)] as
members and Shri. K. W. Deshkar [Deputy Director (Entomology)]as Member
Secretary to provide the recommendations after scientifically examining the material
provided with the proposal and preferably put up in the forthcoming RC meeting.

RC deliberated the issue and noticed the discrepancy in the product approved in the
registration certificate and the product approved in the source country. RC decided that
the applicant may be called to make a presentation in the next RC.
10.0 Online filling of application for registration under different categories.
10.1 Consideration of application u/s 9(4) FIM category received only by complete On-
line system.
The Agenda was deliberated in detail & all the complete cases were approved as
proposed in Annexure – 10.1.1 except the applications for the products applied under
category TI (details agenda in these cases shall be placed before the next RC), product
at S. No. 343 further clarification from the source of supply of technical grade material
and the applications for the products covered under the Gazette Notification SO 3951
(E) dated 08.08.2018 published on 09.08.2018. RC directed the Secretariat of CIB&RC
that all the cases under section 9(4) must be issued after confirming the fixation of MRL
for the product. It was also directed to recheck cases and should strictly follow Gazette
Notification SO 3951 (E) dated 08.08.2018 published on 09.08.2018 of Ministry of

1. Data should be produced from two CIB&RC approved National Laboratories based on
minimum 2 repeated trials. This should be further supported with any published information
available from elsewhere including oversees data.
2. The applicant should submit published/ cited Indian data on bio effectiveness in support of the
claims indicated on the labels/leaflets.
3. Information on secondary pest outbreaks like ticks and mites should be given.
4. Bio-efficacy data on combination product v/s Individual products from two National
Laboratories approved by CIB&RC.

1. Bio-efficacy test on the propose formulations should be conducted under Indian conditions
minimum on two trials in each three National Laboratories approved by CIB&RC.
2. Information on secondary pest outbreaks like ticks and mites should be given.
R#3 : The data on persistence on different types of surfaces should be generated as per the requirement
indicated in case of pesticides required for regular registration under section 9(3).

manufacture of formulation u/s 9(3) In case the extract / concentrate is not registered under the
Act for use in the country.
Methodology:
Residual films of insecticides prepared by spraying insecticides on different types of surfaces, such as
Glass, Wood, Mud & Cement surfaces. Insects to be exposed for 30 minutes and then shifted to recovery
chambers for 24 hours after which the mortality count should be made and the satisfactory mortality of
insects would be more than 90%.
