To: Larry Boyd, Chief of Police From: Terri Miles, Staff Assistant, Community Services Division Date: September 18, 2015 Subject: Arrest 15-19439 On Monday, September 14, 2015, at approximately 3:50 p.m., I was sitting at my desk and someone (not certain who) brought in a parent (specifically a father) to sit and wait for his son, who had been arrested. A little while after the parent was brought in Officer Howman came to talk to him. Officer Howman proceeded to tell the father that his son had been arrested for a “hoax bomb”, and that he was being fingerprinted and then he would be released to him. Before she could complete the rest of what she was saying the father asked her if he could see his son. She told him no, that his son was being fingerprinted and processed. Officer Howman also told him that his tablet and flash drive had been confiscated. He then asked her what a “hoax bomb” was and she tried to explain it to him. The father started speaking over her and told her that his son was just very smart and he was just trying to impress his teachers. He stated that his son had been in a robotics club at his middle school and he used to make things like this. She again tried to explain to him the incident that happened at school and why he was arrested and that he was being fingerprinted and would be released to go with him afterwards. He once again started talking over her and at this point she told him that since he was not going to allow her to speak that she was done talking. I saw that he was not going to allow her to finish talking and I felt that a supervisor was needed, so I called Sgt. Jeff Mitchell to come and help her out. Sgt. Mitchell came and Officer Howman was still trying to explain things to the parent. The father was still talking over Officer Howman, so after Sgt. Mitchell listened to her trying to explain and the father still not listening he intervened. He introduced himself and proceeded to explain to the father the same as Officer Howman had. He told him his son had been arrested for “hoax bomb” at school and he was being processed and then he would be released to him. Sgt. Mitchell repeated this information a couple of times. The father’s phone then rang and he told Sgt. Mitchell that it was his wife that she was on her way in. Right after that his wife and daughter walked by the CSD window going into the building. daughtercamein,theysatdownalongsidethefather.Sgt.Mitchellproceededtotellthemthecircumstances.Ashewastellingthem,thedaughterstartedtalkingintheirnativelanguageandthefatherexplainedthatthemotherdidnotspeakEnglishsoshewastranslatingforher.AfterSgt.Mitchelltoldthemthecircumstancesthedaughterbegantoaskwhywashearrestedandnotjusttalkedtoandletgoandshestartedmakingcommentsthatitwasracism.Sgt.Mitchellwastellingthemthatitwasnotamatterofraceandthatifithadbeenawhite,brown,orblackperson,theywouldhavebeenhandledthesameway.Hetoldthemitwasjustamatterofhimhavinga“hoaxbomb”attheschoolandthatwasnotallowed.Sgt.Mitchellthentoldallofthemthesamethinghehadtoldthefatherearlierthatthesonwasbeingprocessedandthatafterwardshewouldbereleasedtothemtogohome.Thefatherthenaskedifhecouldtalktohisson,towhichSgt.Mitchelltoldhimonceheisreleasedthathecouldtakehimwithhim.Thefatherthensaidno,thathewantedtotalktohimbeforehewasreleasedtoseewhathisstorywas.Sgt.Mitchellonceagaintoldhimthathewouldbefreetotakehimwithhimoncetheybroughthimfrombeingprocessed.Tothisthefathersaidno,leavehim,Idon’twanttotakehim.(Sometimeduringthisconversationthefather,mother,anddaughterhadallgottenoutoftheirseatsandwerestanding).Sgt.Mitchellthenrepliedtothefather,ifyoudon’ttakehimwearegoingtotakehimtoJuvenileDetention.Thedaughterthenspoketoherfather.Sgt.Mitchellsaidtothefather,soletmeseeifIhavethisrightyoudon’twanttotakehim,becauseifyoudon’twearegoingtotakehimtoJuvenileDetention.AtthatpointOfficerTaylorwalkedinwiththesonhandcuffed.Thesonwalkedovertowherethefatherwasstandingandthefatherstartedtoquestionhissonaboutwhathappened.Moretalkingwenton,butIamnotcertainwhatwassaid.ThenOfficerTaylortookthedefendant’shandcuffsoffandhewasreleasedtohisparents.TheywereallescortedoutthemaindoortotheCommunityServicesDivision.AfewminuteslaterRecordsClerkChristinaAnguianocameoverandtoldSgt.Mitchellthattheyhadcomebackinandtheboywasdemandingtogethistabletandflashdriveback.Sgt.Mitchelltoldherthattheycouldnothavethemthattheywereinbeingheldasevidence.ShewentbackintoRecordstotellthemwhatSgt.Mitchellsaidabouttheitems.MariaGonzalezthencameoverandtoldSgt.MitchellthathewasupsetsoSgt.MitchellandOfficerTaylorwentintotheareainfrontofRecordstotalktothefamily.Iwalkedovertothedoortolisten.Sgt.Mitchelltoldthemthattheycouldnotgettheitemsbackbecausetheywerebeingheldasevidenceandwhentheyaredonewiththemthentheywillreleasethembacktohim.Thedaughterstartedsayingthatthiswasalljustracist,itwasbecausetheyareMuslim.Theconversationwentbackandforth,andI’mnotcertainwhatelsewassaid.Ithenwalkedbacktomydesk.Reviewed:Lt.ByronKeyes#657
