I. WELCOME

Vice-Chair Afendoulis called the meeting to order at 10:30 a.m.

Welcome to the city of Grand Rapids – Mayor Rosalynn Bliss

Mayor Rosalynn acknowledge her good friend Vice Chair, Lynn Afendoulis, and mentor,

previous mayor of Grand Rapids, Mayor Heartwell. Mayor Rosalynn thanked Director

Steudle, in his absence, for his leadership and essential partnership with Grand Rapids.

Mayor Rosalynn also thanked MDOT, Eric Kind, and Vickie Weerstra for their work in

the city. The fix on I-196, the BRT Silver Line and Laker Line, are just examples of some

of the great projects completed in Grand Rapids. Mayor Rosalynn said the goal is to get

the streets back to 70 percent fair and good, which passed with 66 percent among the

electors and green the expressways by adding more trees. Green the expressways is a

project which started last year 2016 and Mayor Rosalynn stated that her goals is to expand

expeditiously, so everyone can have a beautiful drive into the city very soon.

MDOT Grand Region Update – Vicki Weerstra, Associate Region Engineer and

Dennis Kent, Region Transportation Planner

Mr. Kent stated that Grand Region is now a 13 county region, which was changed with the

region prosperity initiative about a year and a half ago.

Mr. Kent and Ms. Weerstra highlighted some of Grand Region projects which consisted of

the I-196 WB over the Grand River ($21.4 million), widening to connect 3rd lane for US-

131 SB ramp, substructure extensions, and deck replacement in the eastern half; deep

overlay and substructure repairs in the western half. The M-45 city of Walker Non-

Motorized Tunnel project ($2.4 million) completed in October 2016, consisted of multiple

partners, and connects regional trails. Other projects, I-96 at Cascade Road DDI existing

Parclo Interchange, M-44 reconstruction project at Wolverine Boulevard to Myers Lake

Avenue ($5.0 million), 2017 construction of center left turn lane, local sanitary sewer

coordination, and future non-motorized path. US-131 Reconstruction project ($26.0

milling), 14 Mile Road to 17 Mile Road/White Creek Avenue, 2017 construction including

road reconstruction and bridge preservation, RITF 30 year HMA pavement, and

maintaining traffic plan (local/through lanes).

Michigan Department of Transportation Director’s Report – Laura Mester, CAO

Chief Administrative Officer, Laura Mester, briefed the Commission on the current rate of

fatalities for the State of Michigan. At a current number of 388, it is a number that is

increasing at an alarming rate, up 122 from April. She enforced the fact that MDOT is

working hard towards zero deaths.

Ms. Mester also informed the Commission that the Director has been appointed to the

Michigan Council on Future Mobility. He, along with Eric Delong, who was also on the 21st

Century Infrastructure Commission, greatly appreciated the support received from the city

of Grand Rapids. The Council will be focusing on what to do about providing mobility for

the disabled, the last mile, and issues with getting people from point A to B as a service when

discussing connecting autonomous vehicles. Currently, the Council is in the information

gathering stage, with a focus on cyber security, liability insurance using technology, and the

advancement of mobility for the disable. The Director will provide updates to the

Commission in the future.

II. COMMISSION BUSINESS

Minutes of March 23, 2017, Commission Meeting

Vice-Chair Afendoulis requested a motion regarding approval of the minutes for the last

State Transportation Commission meeting. Commissioner Heartwell made a motion to

approve and Commissioner Moser supported. Vice-Chair Afendoulis led a voice vote; all

members present voted in favor; motion to approve carried.

Office of Commission Audits (OCA) Update – Jack Cotter

Mr. Cotter spoke about MDOT’s successes in recent Office of Attorney General (OAG)

audits during the last commission meeting. As a consequence of MDOT’s successes, the

OAG has inundated MDOT with 9 preliminary analysis/performance audits, in addition to

the State-wide Single Audit and a few audits of DTMB which bleed over into MDOT

operations.

The OAG is partially funded with MDOT tax dollars, as opposed to most of the other 19

departments that are paid for with State general fund money, the OAG actually has to have

boots on the ground at MDOT. Because MDOT does such a good job, generally, the OAG

planned on 9 audits, figuring that 5 or 6 will expire as preliminary analysis and in the

financial hopes that 3 or 4 will live as audits.

Mr. Cotter had a passing conversation, a few years ago, with the OAG as to whether we can

find a way for them to get paid while not intruding on MDOT operations. The OAG noted

that they had conveyed to the legislature that MDOT is a low risk department and had asked

the legislature for a different funding mechanism. The legislators at the time remained

adamant that they want boots on the ground and MDOT. No motion required.

Exhibit A: Contract Agreements – Myron Frierson

Mr. Frierson presented information on 20 agreements. Pending any questions, Mr. Frierson

asked for approval of Exhibit A.

Exhibit A-1: Bid Letting Pre-Approvals – Myron Frierson

Mr. Frierson presented information about Letting Statistics and Exhibit A-1. Projections for

fiscal year 2017 are for 212 state jobs and a total construction cost estimate of $740 million.

At this point in the year, MDOT has let 98.8 percent of jobs anticipated. Upcoming June

lettings are currently advertising 4 state projects and 52 local projects. Exhibit A-1 lists 40

projects. Pending any questions, Mr. Frierson asked for approval of Exhibit A-1.

Exhibit A-3: Information for the Commission – Myron Frierson

Mr. Frierson provided information on a single bidder demolition project for the Gordy

Howdy Bridge Plaza. Mr. Frierson stated this project is a part of the small business program.

Exhibit B: Construction Contracts – Jason Gutting

Mr. Gutting presented information about Exhibit B, which included cost comparison

information about contracts that were recently finalized.

MDOT Projects for March and April

o 69 projects totaling approximately $134 million were finalized.

o 4 projects were more than 10 percent over the original contract amount

o 39 projects came in under original contract amount

March and April final contract costs were respectively 0.94 under and 0.33 over the

original contract amount.

State Administrative Board Agenda, May 9, 2017 – Myron Frierson

The Director’s Agenda covers memos of understanding with no dollar amounts, revenue

agreements, and small dollar amount agreements. The State Administrative Board (SAB)

Agenda covers service contracts in excess of $250,000 and construction contracts in excess

of $500,000. Some items on the SAB agenda, primarily in the area of construction contacts,

have previously been submitted to and approved by STC. These two documents are included

in the meeting packet, which is posted on the Commission website, in order to inform the

public about all types of MDOT bidding activity. No motion required.

V. PRESENTATIONS

2016 Michigan Roads and Bridges Annual Report Presentation – Roger Belknap,

TAMC Coordinator

Mr. Belknap discussed the Transportation Asset Management Council (TAMC) Roads and

Bridges 2016 Annual Report. Mr. Belknap said the conditions for all federal-aid-eligible

roads are 18 percent good, 43 percent fair, and 39 percent poor. The overall pavement

condition trends have shown a steady decline of good and fair conditions since 2007. For

bridges, 41 percent are good, 49 percent are fair, and 10 percent are poor. Comparing bridge

conditions with other Great Lakes states, Michigan has the highest percentage of structurally

deficient bridges at 11 percent, compared to Minnesota with the lowest at 6 percent.

The Rapid Central Station and Operations Center Introduction – Peter Varga, CEO

Mr. Varga gave a brief introduction of the upcoming tour scheduled for The Rapid Central

Station and Operations Center, along with a tour of The Silver Line BRT, following the

adjournment of the commission meeting.

meeting adjourned at 11:30 a.m.

7. PASSENGER TRANSPORTATION - Section 20005(b) of MAP-21

Project Authorization (1) under Master Agreement (2017-0043) between MDOT and the City of Detroit will provide state matching funds for the FY 2017 Federal Section 20005(b) of MAP-21 Pilot Program grant for Transit Oriented Development Planning for transit oriented development planning. The authorization will be in effect from May 23, 2017, through May 22, 2021. The authorization will be retroactive due to the effective date matching the federal grant award date. The authorization amount will be $375,000. The term of the master agreement is from October 1, 2016, until the last obligation between the parties has been fulfilled. The master agreement includes authorizations for program years FY 2017 through FY 2021. Source of Funds: Federal Transit Administration Funds - $300,000; FY 2017 State Restricted Comprehensive Transportation Funds - $75,000.

8. PASSENGER TRANSPORTATION - Section 20005(b) of MAP-21 Project Authorization (1) under Master Agreement (2017-0119) between MDOT and the Regional Transit Authority of Southeast Michigan, in Wayne County, will provide state matching funds for the FY 2017 Federal Section 20005(b) of MAP-21 Pilot Program grant for Transit Oriented Development Planning for transit oriented development planning. The authorization will be in effect from September 12, 2016, through September 11, 2020. The authorization may be retroactive due to the effective date matching the federal grant award date. The authorization amount will be $312,500. The term of the master agreement is from October 1, 2016, until the last obligation between the parties has been fulfilled. The master agreement includes authorizations for program years FY 2017 through FY 2021. Source of Funds: Federal Transit Administration Funds - $250,000; FY 2017 State Restricted Comprehensive Transportation Funds - $62,500.


9. *RAIL – Reduce Loan Amount Amendatory Contract (2015-0325/A1) between MDOT and Northern Dry Bulk, Inc., will reduce the loan amount by $18,118.24 to reflect actual construction costs. The project amount will be reduced by $36,236.48. The original contract provides financial assistance in the form of a loan to Northern Dry Bulk, Inc., for the construction of a new rail transloading facility in Grand Rapids, Michigan. The contract term remains unchanged, from September 14, 2015, until the last obligation between the parties has been fulfilled, until the contract is terminated, or until the appropriate funds have been disbursed. The revised project cost will be $658,763.52. MDOT will loan Northern Dry Bulk, Inc., 50 percent of the project cost, up to a maximum amount of $329,381.76. Provisions included in the contract permit the loan to be forgiven incrementally over a five-year period based on carloads shipped to/from the facility via rail. Northern Dry Bulk, Inc., commits to shipping/receiving a minimum of 250 carloads of freight to/from the facility via rail annually over and above the current level of 50 carloads expected to transfer from the Clare facility. Source of Funds: FY 2015 State Restricted Comprehensive Transportation Funds - $329,381.76; Northern Dry Bulk, Inc., Funds - $329,381.76.

10. *RAIL - Freight Economic Development Program Contract (2017-0581) between MDOT and FCA US, LLC, will provide financial assistance in the form of a loan for the construction of rail spurs at a new manufacturing facility in Sterling Heights. The contract will be in effect from the date of award until the last obligation between the parties has been fulfilled, until the contract is terminated, or until the loan has been fully repaid. The estimated project cost is $1,177,145.30. MDOT will loan FCA US, LLC, 50 percent of the project cost, up to a maximum amount of $588,572.65. Provisions included in the contract permit the loan to be forgiven incrementally over a five-year period if FCA US, LLC, ships and/or receives a minimum of 3,060 carloads of freight by rail annually. Source of Funds: FY 2017 State Restricted Comprehensive Transportation Funds - $588,572.65; FCA US, LLC, Funds - $588,572.65.

11. *RAIL – Freight Economic Development Program Contract (2017-0610) between MDOT and Wolf Steele, LLC, will provide financial assistance in the form of a loan for the construction of a rail spur at a new warehouse facility in Grand Rapids. The contract will be in effect from the date of award until the last obligation between the parties has been fulfilled, until the contract is terminated, or until the loan has been fully repaid. The estimated project cost is $176,175. MDOT will loan Wolf Steele, LLC, 50 percent of the project cost, up to a maximum amount of $88,087.50. Provisions included in the contract permit the loan to be forgiven incrementally over a five-year period if Wolf Steele, LLC, ships and/or receives a minimum of 48 carloads of freight by rail annually. Contract (2017-0615) between MDOT and the City of Fremont is a state infrastructure bank (SIB) loan to

assist the City in financing transportation infrastructure improvements through the Cedar Street extension

project. The City plans to use its State Restricted Trunkline Funds to repay the loan. MDOT will loan

$750,000 at 2.5 percent interest for 6 years to the City of Fremont. The contract will be in effect from the

date of award through December 31, 2023. Source of Funds: SIB Loan Funds - $750,000.


Contract (2017-5346) between MDOT and the Presque Isle County Road Commission will provide for

funding participation in the construction of the following improvements utilizing State Transportation

Economic Development Category D Funds, which are allocated for Local Agency projects (State

Restricted TED Funds), and Federal Highway Administration Surface Transportation Program – Rural

Funds designated for Local Agency projects (FHWA STP – Rural Funds):

Hot mix asphalt resurfacing work along County Road 451 from approximately 0.29 miles south of County

Road 638 northerly to Claus Road, including concrete curb and gutter, storm sewer upgrade, aggregate

shoulder, permanent signing, and pavement marking work.

LETTING STATISTICS

JULY 7, 2017

STATE PROJECTS OVERVIEW

The July 7, 2017, bid letting, included 29 State trunkline projects with $54.8 million in total engineer estimates. The low bids received totaled $54.5 million. The average low bid received for the State trunkline projects let is $1.9 million and the median of $499.8 thousand. Of the 29 State projects let, six included warranties with $42.3 million as the low bid total. The 29 State projects received a total of 86 bids. In comparison to July of 2016 totals, 25 State projects were let with total engineer estimates of $24.4 million and low bid dollars of$22.6 million. The State projects of July 2016 received a total of76 bids.

For fiscal year 2017 to date, 260 State trunkline projects have been let with a low bid total of$820.0 million. Compared to the same period last year, 270 State projects were let with the low bid total of $824.0 million.

PROJECTS BID SUMMARY

A total of254 bids were received for the 62 projects let on July 7, 2017, for an average of 4.10 bids received per project.

There were no projects postponed or withdrawn from the July 7, letting and currently, there are no projects for which all bids have been rejected.

Of the 92 contracting companies eligible to submit bids for the July 7, letting, 80 submitted at least one bid.

JOB PROJECTIONS

Job projections are State trunkline jobs specific in category and are classified under the work groups of road, bridge, and traffic and safety.

The list of jobs projected to be let for FY 2017 included a total of295 State jobs with total construction cost estimates of $872.2 million.

For fiscal year 2017 through July, 99.6% of State jobs anticipated for this period have been let using 99.2% ofthe projected cost estimates. For the same period ofFY 2016,91.1% of State jobs were let using 107.0% ofthe projected construction costs.

UPCOMING LETTING STATS

For the July 12, 2017, Special Bid Letting, two State trunkline projects are advertised with the engineer's estimate total of $4.2 million. There are no warranties for the two projects.

The July 21, 2017, Special Bid Letting, is advertising one State trunkline project with an estimate total of $52.5 million. This project includes warranties.

The August 4, 2017, Letting is currently advertising four State trunkline projects with total engineer estimates of $3.6 million. Of the four State trunkline projects, two include warranties with an estimate total of $1.5 million. In addition, 41 Local area projects with total estimates of $44.8 million are scheduled to be let.

The revised cross-section was developed after consulting with MDOT Region Soils Engineer. Reason #2: CM #2 includes increases to crush and shape quantity ($14,857.66) and CM #4 includes increases to HMA, LVSP quantity ($42,450.62) totaling $57,308.28. The plans originally called for the road surface to have HMA overlay but the roads had degraded significantly since design and had to be crush and shaped instead. Reasons 1-2 account for $184,428.79, or 90% of the total increase to the project costs.

CONTRACT

1. PASSENGER TRANSPORTATION – Transportation-Related Training

Project Authorization (3) under Master Agreement (2017-0026) between MDOT and the

Cadillac/Wexford Transit Authority will provide state funds for a participant to attend the Community

Transportation Association of America’s 2017/2018 Emerging Leaders Academy. The program is

100 percent state-funded. The authorization will be in effect from June 9, 2017, through

December 31, 2018. The authorization amount will be $4,500. The term of the master agreement is

from October 1, 2016, until the last obligation between the parties has been fulfilled. The

master agreement includes authorizations for program years FY 2017 through FY 2021.

Source of Funds: FY 2017 State Restricted Comprehensive Transportation Funds - $4,500.

Subject to the exercise of discretion in processing, I approve the above described contracts and authorize their

award by the responsible management staff of MDOT in accordance with the December 14, 1983, resolution of

CONTRACTS - PRE-APPROVAL

1. HIGHWAYS – Design Services

Contract (2017-0568) between MDOT and WSP Michigan, Inc., will provide for design

services to be performed for an Intelligent Transportation System (ITS) project, including

conduit and fiber optic cable installation and spur conduit and fiber connections to

existing ITS components, along I-75 between West Road and I-275 in the cities of

Woodhaven, Brownstown, Flat Rock, and Rockwood, Wayne County, and in Berlin

Charter Township, Monroe County (CS 82191 – JN 120423C). The project length is 17

miles. The work items will include providing conceptual layouts for the corridor;

performing surveys; preparing required plans, typical cross-sections, details, and

specifications; and computing and verifying all plan quantities. The contract will be in

effect from the date of award through December 31, 2020. The contract amount will not

exceed $800,000. Source of Funds: 82% Federal Highway Administration Funds and

18% State Restricted Trunkline Funds.


Contract (2017-0575): MDOT will enter into a contract with a consultant that will

provide for design services to be performed for the milling, concrete patching, signal

modification, and rehabilitation of I-275 from Ford Road to 5 Mile Road in

Canton and Plymouth Townships and in the City of Livonia, Wayne County

(CS 82292 – JN 111073). The work items will include preparing required plans, typical

cross-sections, details, and specifications; preparing maintenance of traffic plans; and

preparing permanent freeway signing plans and pavement marking plans. The contract

will be in effect from the date of award through April 12, 2019. The contract amount will

not exceed $2,445,000. Source of Funds: 82% Federal Highway Administration Funds

and 18% State Restricted Trunkline Funds.

Contract (2017-0585): MDOT will enter into a contract with a consultant that will

provide for as-needed Light Detection and Ranging (LiDAR) data collection and

extraction to be performed for connected vehicle infrastructure at various locations

throughout Southeast Michigan. The work items will include the acquisition of LiDAR

data, map extraction of features for connected vehicle purposes, and development of

connected vehicle deliverables. The contract will be in effect from the date of award

through two years. The contract amount will not exceed $2,000,000. Source of Funds:

Federal Highway Administration Funds, State Restricted Trunkline Funds, or local funds,

depending on the particular project authorized.

4. *HIGHWAYS – Intelligent Transportation System Services

Contract (2017-0586) between MDOT and Mixon/Hill of Michigan, Inc, will provide for

the hosting, operation, and maintenance of MDOT’s existing Data Use Analysis and

Processing (DUAP) System and for the enhancement of hardware and software for the

DUAP System (CS 84900 – JN 116386). The consultant will also provide a quality

assurance/quality control plan and will review and clarify project issues and data needs.

This contract will provide services for the first year of a five-year program; it may be

amended to add four optional one-year periods. The contract will be in effect from the

date of award through one year. The contract amount will be $3,739,999. Source of

Funds: 81.85% Federal Highway Administration Funds and 18.15% State Restricted

Trunkline Funds.

CONTRACTS

5. HIGHWAYS - IDS Engineering Services

Authorization (2) Revision (2) under Contract (2016-0242) between MDOT and RS

Engineering, LLC, will provide for the performance of additional design services and will

increase the authorization amount by $99,705.09. The additional services will include

Intelligent Transportation System (ITS) structure foundation investigation work and

geotechnical services for structure (S01 of 82025) on Gratiot Avenue over I-94 within the

limits of the I-94 Modernization Project. The original authorization provides for design

services to be performed for bridge replacement on Gratiot Avenue over I-94 within the

limits of the I-94 Modernization Project in the city of Detroit, Wayne County

(CS 82025 - JN 108061D). The authorization term remains unchanged, June 14, 2016,

through April 26, 2019. The revised authorization amount will be $896,981.09. The

contract term is April 27, 2016, through April 26, 2019. Source of Funds: 90% Federal

Highway Administration Funds and 10% State Restricted Trunkline Funds.

6. *RAIL - Increase Maximum Contract Amount

Amendatory Contract (1992-2352/A11) between MDOT and the Indiana Northeastern

Railroad Company (INRC) will increase the maximum contract amount by $250,000 to

allow additional property management activities to be performed under the indefinite

delivery of services (IDS) contract. The original contract provides for INRC to perform

property management services, including normal and emergency repairs and

improvements on the property, as authorized by MDOT, on the state-owned railroad line

operated by INRC in Hillsdale and Branch Counties. The contract term remains

unchanged, from January 6, 1993, until both of the following have occurred: (1) written

notice of the termination of the contract has been provided by INRC by MDOT not less

than 60 days before the date of the termination, and (2) a sale or lease is executed, as

provided in Section 10(3)(e) of the State Transportation Preservation Act, PA 295 of

1976, as amended by PA 235 of 1998. The revised maximum IDS contract amount will

be $1,450,000. Source of Funds: 100% State Restricted Comprehensive Transportation

Funds.

7. RAIL – Grade Crossing Work


National Railroad Passenger Corporation (Amtrak) will provide for the complete grade

crossing reconstruction of Michigan Avenue (MP 75.55) and Cooper Street (MP 75.45)

in the City of Jackson on the rail line purchased by MDOT from Norfolk Southern

Railway Company between Kalamazoo and Dearborn on the Chicago-Detroit/Pontiac

High Speed Rail Corridor. MDOT will compensate Amtrak for eligible costs under the

approved scope of work and spending plan. The authorization will be in effect from

June 1, 2017, through December 31, 2017. The authorization amount will be

$1,003,093.81. The term of the master agreement is December 7, 2012, through

September 30, 2032. Source of Funds: Federal Railroad Administration Funds -

$902,784.43; FY 2016 State Restricted Trunkline Funds - $100,309.38.

This authorization was originally approved by the State Administrative Board at its

October 25, 2016, meeting; however, the authorization was not awarded. Now the scope

of work has been modified and term has been changed.

8. RAIL – Grade Crossing Work


National Railroad Passenger Corporation (Amtrak) will provide for the complete grade

crossing reconstructions of Park Street (MP 143.6), Westnedge Avenue (MP143.7),

Kalamazoo Avenue (MP 143.8), and Main Street (MP 144.08) in the City of Kalamazoo.

MDOT will compensate Amtrak for eligible costs under the approved scope of work and

spending plan. The authorization will be in effect from June 1, 2017, through

November 30, 2017. The authorization amount will be $1,345,605. The term of the

master agreement is December 7, 2012, through September 30, 2032. Source of Funds:

Federal Highway Administration Funds - $1,211,044.50; State Restricted Trunkline

Funds - $134,560.50.

9. RAIL – Signal Upgrades at Grade Crossing


National Railroad Passenger Corporation (Amtrak) will provide for the removal of the

existing gate mechanisms and the installation of four new rail road cantilevers with gate

mechanisms at the grade crossings of Michigan Avenue (MP 75.55) and Cooper Street

(MP 75.45) in the City of Jackson to allow for the two-way conversion of Louis Glick

Street. MDOT will compensate Amtrak for eligible costs under the approved scope of

work and spending plan. The authorization will be in effect from June 1, 2017, through

December 31, 2017. The authorization amount will be $1,558,311. The term of the

master agreement is December 7, 2012, through September 30, 2032. Source of Funds:

Local Funds - $1,558,311.

10. *RAIL – Transfer of Dispatching Responsibility

Amendatory Contract (2012-0219/A2) between MDOT and Norfolk Southern Railway

Company (NSR) will provide for the transfer of the dispatching responsibilities for the

Michigan rail line between Kalamazoo and Dearborn to an MDOT-designated contractor,

effective May 10, 2017. The original contract defines freight and passenger train rights

and maintenance, dispatching, and operational responsibilities for the segment of line

MDOT acquired from NSR under Contract (2012-0224). Contract (2012-0224)

established the general terms for the Joint Operations Agreement. As part of the Joint

Operations Agreement, NSR retains the freight rights over the line and compensates

MDOT for these rights at a rate of $0.445 per car mile. The contract term remains

unchanged, December 7, 2012, through December 6, 2111. Source of Funds: 100% NSR

Funds.
