Sir,I am directed to invite your kind attention on the above subject and letter under

reference. Monitoring report of compliance to conditions stipulated in environment clearance

accorded for Palladium Grand-II at S.No. 17/1N2, Dhanori, Pune by MIs. Raojee

Construction is enclosed herewith. Site inspection of the project has been carried out on

27.02.2017. Following observations were made during the site inspection:

Construction of the project is yet to start, hence the conditions stipulated in the

environmental clearance granted by SEIAA, Govt. of Maharashtra are yet to be

implemented. PA submitted that conditions stipulated will be implemented during

construction/operation of the project. Photographs showing the site of the project are

enclosed as Annexure-1.

Following partial compliances were observed:

General Conditions for Pre-construction phase:-

XIII. The environmental statement for each Construction of the project not started.financial year ending 31st March inForm-Vas is mandated to besubmitted by the project proponent tothe concerned State Pollution ControlBoard as prescribed under theEnvironment (Protection) Rules, 1986,as amended subsequently, shall alsobe put on the website of the companyalong with the status of compliance ofEC conditions and shall also be sentto the respective Regional Offices ofMoEF bye-mail.

This environmental clearance is beingissued without prejudice to the actioninitiated under EP Act or any courtcase pending in the court of law & itdoes not mean that project proponenthas not violated in any environmentallaws in the past & whatever decisionunder EP Act or of the Hon'ble courtwill be binding on the projectproponent. Hence this clearance doesnot give immunity to the projectproponent in the case filed againsthim, if any or action initiated under EPAct.

5. In case of submission of falsedocument and noncompliance ofstipulated conditions,Authority/Environment department willrevoke or suspend the Environmentalclearance without any intimation andinitiate appropriate legal action underEnvironmental protection Act, 1986.

6. The Environment departmentreserves the right to add any stringentcondition or to revoke the clearance ifcondition stipulated is notimplemented to the satisfaction of thedepartment or for that matter, for otheradministration reason.

As per MoEF & CC Notification dated 29m

April 2015, Environmental Clearance shallbe valid for a period of 7 years.

2. Review w.r.t to MOEFs letter dated 30.5.2012:

The above mentioned report is prepared after site visit on 27.02.2017 for the expansion

of Palladium Grand-II S.No. 17/1N2, Dhanori, Pune.

3. Court Cases and show cause/closure notices:

PA submitted undertakings thata. No show cause notices issued by MPCB are pending against the project.

MPCB issued Consent to Establish for the project vide letter no. Format

1.0/80/ROHQ/CE/CC-9699 dated 09.08.2016.

Additional Chief Secretary, Environment Department, Government of Maharashtra vide

letter no. SEAC-III-2014/CR-376fTC-3 dated 29.11.2014 issued directions under Section

5 of Environment Protection Act' 1986 stating that building construction activity started

without obtaining environmental clearance.

PA vide letter dated 24.12.2014 submitted a reply to the above directions.

Principal Secretary Environment Department, Government of Maharashtra vide letter no.

SEAC-III-2014/Cr-376/TC-3 dated 26.05.2015 withdrawn the proposed directions stating

that construction built up area 16538.69 sq.m. is less than 20000sq.m., hence

environmental clearance was not required. It was concluded that there was no cause of

violation as prescribed in EIA Notification 2006 and accordingly proposed directions

This has reference to the above subject and Mo\1 of 20lhSEAC III Agenda lor Item No. 49.We have presented our ease during SEAr meetings, ill which the SEA( III has noted omconstruction activity as violation.

With respect to the above. we would like to clanfy as under.

We refer to the minutes of the 20lh meeting ofSEAC-IIJ held on 41hto 71h November 2014 wherein yourproposed Residential & Commercial project "Palladium Grand" VilIage Dhanori, Tehsil. Haveli, District. Punewas referred to the Environment Department to verify the issue of violation of the Environment (P) Act, 1986 r.w.EtA Notification 2006.

Accordingly, the Proposed Directions were issued vide above ref.(I). We also refer to your replysubmitted vide above ref. (2), which was scrutinized and followed by personal hearing extended to you on19.5.2015 before the Principal Secretary, Environment Department.

During the course of hearing, your representative has submitted that you have applied for EC on17.10.2014 for proposed total BUA admeasuring 46793.62 m2. Your representative also submitted that you havecarried out construction of total BUA admeasuring 16538.69 m2 at site (i.e. below 20000 m2), which is certifiedby your Architect.

We also refer to the recent Circular dtd. 21.4.2015 issued by the Environment Department, G .0.M. bytaking cognizance of the Orders dtd. 24.3.2014 & 18.12.2014 passed by Hon'ble High Court in the matter ofG lomore Construction and others V /s Union of India stating "Proposed construction projects wherein projectproponent has undertaken total construction below 20000 m2 may not be considered as a violation of EIANotification 0/2006 (amended time to time) and read with OM of Mo.E.F. dtd. 12.12.2012 & 27.6.2013 ...

In view of the documents submitted by your representative vide letter dtd. 24.12.2014, additionalinformation submitted during the course of personal hearing which is certified by your Architect vide leter dtd.25.5.2015 followed by a Circular dtd. 21.4.2015 issued by the Environment Department. G.o.M. and detailedscrutiny thereof, it has been observed that you have carried out the construction of total BUA admeasuring16538.69 m2, which is less than 20000 m2. Therefore, it is hereby concluded that there is no case of violation asprescribed in the EIA Notification, 2006 and accordingly the Proposed Directions issued vide above ref.( I) ishereby withdrawn.

In case, any discrepancies are observed in these documents, necessary action will be initiated against youunder the provisions of Environment (Protection) Act, 1986 read with EIA Notification dt. 14.09.2006, whichplease be noted. ~-
